RE: APPROVE REQUEST FOR ZONING VARIANCE FOR CITY OF GREELEY AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, as a surrounding property owner, the Board has been
presented with a request from the City of Greeley for a variance
from the Zoning Code of the City concerning the installation of a
sign, and
WHEREAS, after review, the Board deems it advisable to
approve said request,
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of the
City of Greeley for a variance for the installation of a sign be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said request for variance.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
November, A.D. , 1988 .

Attachment A
1 . The Sign Code states that for the traffic zones within the
Improvement District # 1 (Chapter 18 . 29 . 110) the maximum size
of a sign should not exceed 20 square feet . Both signs on
Attachment B are existing two-sided signs with each face
covering 28 square feet , for a total of 56 square feet .
2. The City 's Sign Code also prohibits freestanding signs
(Chapter 18. 29 . 080) . Both signs shown on Attachment B are
freestanding pedestal signs.
3 . The Sign Code prohibits internally illuminated signs (Chapter
18. 29 . 070) . The existing signs in question are internally
illuminated.

The argument substantiating the request is the fact the
signs were existing prior to the adoption of the Improvement
District #1 Sign Code, adopted in 1984 . The requested
variance would not adversely affect the surrounding area , the
future development of the area, or the health, safety, and
welfare of the inhabitants of the area. The need for this
request is not self-imposed in that the sign was constructed
legally . To remove the signs and install a new one would
cost more than to use the existing signs . For these reasons
the Zoning Board is requested to grant the three specific
variances to the Greeley Municipal Code as outline above.

IN CONSIDERING REQUESTS FOR VARIANCES, THE ZONING BOARD OF APPEALS:
1. shall consider the effect which the variance would have on the surrounding
area, its effect on future development in the area, its conformity to
the comprehensive plan, and in general the effect which the variance
would have on the health, safety and welfare of the inhabitants of the
area;
2. shall not grant the variance if the need for it is self-imposed in the
sense that development or construction was begun without full compliance
with all applicable la"+s, ordinances, rules and regulations;
3. shall grant a variance onl,, if the need for it arises from some exceptional
condition of the lot or buildir.r involved, such as a unique lot shape;
4. shall not grant a variance unless to fail to do so would seriously
and substantially impair the usability of the lot in question, to an
extent not contemplated by this code.
The Zoning Board of Appeals will consider the items below before granting a
variance located in the General Improvement District #1:
If the variance is located within Greeley General Improvement District
#1, applicant must submit two (2) copies of the application, in order
that a recommendation can be obtained from the Greeley Downtown Development
Corporation.
