J�_.a... ....... r 56/04 I RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR OIL AND GAS PRODUCTION FACILITIES IN THE I-1 (INDUSTRIAL) ZONE DISTRICT - BASIN EXPLORATION, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of October, 1988 , at the hour of 1 :30 p.m. in the Chambers of the Board for the purpose of hearing the application of Basin Exploration, Inc. , 155 East Boardwalk Drive, Fort Collins, Colorado 80525 , for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities in the I-i (Industrial) Zone District on the following described real estate , to-wit: Part of the Ni NEi of Section 21 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Janna Lee , and WHEREAS , Section 24 .3 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .3 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan' s Urban Growth Boundary Goals and Policies. The Town of Garden City and the City of Evans have stated they have no objections to this request. The City of Greeley Planning Commission, in its referral dated September 13 , PL0110 880998 Pi _O//D / -` Page 2 RE: USR - BASIN EXPLORATION, INC. 1988, recommended no objections to this proposal with certain conditions. The concerns and conditions of the City of Greeley are addressed in the attached additional comments. b. The proposal is consistent with the intent of the I-1 (Industrial) zone district and is provided for as a use by special review. c. The proposed use is compatible with the existing surrounding land uses which are U.S. Highway 34 and U.S . Highway 34 Frontage Road, one residence, cropland, the South Platte River and river bottom land. The use will be compatible with the future development of the surrounding area as permitted by the R-1 (Low Density Residential) , A (Agricultural) , and the I-1 (Industrial) zone districts . Special Review permit development standards will ensure compatibility with the surrounding land uses . No objections have been received from surrounding property owners. d. The proposed special review permit site is located in the flood plain. Special Review Permit development standards address the overlay district requirements. No other overlay districts affect the site . e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities in the I-1 (Industrial) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s office within 15 days of approval by the Board of County Commissioners . 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the 880998 Page 3 RE: USR - BASIN EXPLORATION, INC. property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording, the Special Review plat shall be amended to show the proposed location of the tank battery, production facilities , and access road for the proposed well. The Special Review permit is for oil and gas production facilities in the I-1 (Industrial) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . Waste oil , drilling fluids, oil field waste, fracture fluids, flow back fluids , production wastes , treatments , anti-freeze liquids and other associated liquid and solid wastes , shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent disposal of wastes shall be permitted at this site. 5 . A spillage retention berm shall be required around the tank batteries. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. 6 . Tiedowns shall be provided for all tanks located within the flood plain. Bulkheads shall be placed in front of wellheads located in the flood plain facing upstream, to protect them from flood debris damage. 7 . All oil and gas wells shall be cased in accordance with applicable rules and orders of the Colorado Oil and Gas Conservation Commission in order to protect groundwater from pollution. 8 . Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into an approved commercial brine water disposal site. 9 . Oil and gas wells and production facilities shall be set back a minimum of three hundred feet (300 ' ) from the reserved right-of-way of U.S . Highway 34 . 10 . All Construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 880998 Page 2 RE: DEVELOPMENT STANDARDS - BASIN EXPLORATION, INC. 11 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 12 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 13 . Personnel from the Weld County Health Department, Western Hills Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 14 . The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 15 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. The Special Review permit is for oil and gas production facilities in the I-1 (Industrial) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. Waste oil, drilling fluids, oil field waste, fracture fluids, flow back fluids, production wastes, treatments, anti-freeze liquids and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. A spillage retention berm shall be required around the tank batteries. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. 6. Tiedowns shall be provided for all tanks located within the flood plain. Bulkheads shall be placed in front of wellheads located in the flood plain facing upstream, to protect them from flood debris damage. 7. All oil and gas wells shall be cased in accordance with applicable rules and orders of the Colorado Oil and Gas Conservation Commission in order to protect groundwater from pollution. 8. Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into an approved commercial brine water disposal site. 9. Oil and gas wells and production facilities shall be set back a minimum of three hundred feet (300') from the reserved right-of-way of U.S. Highway 34. 10. All Construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 12. Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into an approved commercial brine water disposal site. 9. Oil n.nd gas wells and production facilities shall be set back a minimum of three hundred feet (300') from the reserved right-of-way of U.S. Highway 34. 10. All Construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11. Nonetheless, the time periods for the various phases are as follows: 1. Weld County Permitting 60 days 2. Site Preparation and Drilling 10 days 3. Installing Tank Battery (concurrent with other completion activities) 3 days In addition to the above question and answer description of the proposed operation, the use by special review procedure requires certain written information and supporting documents. These requirements are addressed below. The Weld County Comprehensive Plan does not address oil and gas exploration in great detail. However, the Plan does note that the most desirable time for the removal of minerals is prior to 4 S80998 ►,1 development (p. 71) . The proposal location is neither developed nor platted. Furthermore, the surface owner expects that farming will be the long-term continued use for the property. The actual location of the drill site is determined for the most part by the Colorado Oil and Gas Commission local well siting and spacing requirements. The tank battery location, including the separator and meter house, are also subject to state and local siting requirements. The Operator does have some latitude in the placement of surface equipment and has attempted to minimize the use of and interference with productive agricultural land. The placement of landscaping around the tank battery would itself utilize productive land. During the drilling, completion, and production phases of the well, provisions are made for the protection of the health, safety and welfare of the inhabitants of the neighborhood and county. The drilling rig is equipped with a blowout preventer. Approximately 350 feet of surface cementing for the production casing is used. A "port collar" is installed to facilitate additional cementing, if necessary. All production casing, tubing, valves and fittings are A.P.I. approved. Gas condensate is stored under pressure to restrict vapor escape. All service companies, including Halliburton Services for frac stimulation and cementing, are proven professionals. All state and local requirements shall be met. Once on production, the well will be compatible with existing, surrounding land uses. Access to the well will not interfere with any existing agricultural or residential uses. The producing well is basically a passive use, with no perceptible noise, and eventually as much a part of the streetscope as any other permanent structure. The production equipment is painted an attractive earth tone to blend with the rural setting. The producing well will be compatible with the future development of the surrounding area as permitted by the existing zone. Neither the existing agricultural use nor any future industrial use need be prevented or materially undermined by the proposed use. The subject property is not located in a geologic hazard or Weld County Airport overlay district.
