HomeMy WebLinkAbout850797.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW TO PROCESS AND SELL FORESTRY PRODUCTS IN AN AGRICULUTRAL ZONE DISTRICT - DARREL OR TAMARA LOCKMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of December, 1985 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Darrel or Tamara Lockman, 35581 Weld County Road 31 , Eaton, Colorado 80615 , for a Use by Special Review to process and sell forestry products in an Agricultural Zone District on the following described real estate, to-wit: Part of the NEa, Section 4 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: a . The proposal is consistent with the policies of the Comprehensive Plan in that it does not infringe on the continued agricultural use in the vicinity or County. The proposal is consistent with the intent of the Agricultural Zone District in that a reasonable effort has been made to minimize the impacts on agricultural land and is provided for as a Use by Special Review. c. The subject site is within three miles of the Town of Eaton. Gary Carsten, Eaton ' s Town Administrator has indicated no objections to this proposal and feels the request is compatible with the town ' s interests. d. No overlay districts affect the site. e. The Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review to process and sell forestry products in an Agricultural Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Use by Special Review permit is for the processing and selling of forestry products in an Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. The Use by Special Review area shall comply with all State and Federal regulations pertaining to the handling, storage or disposal of hazardous or toxic substances. 3. All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 5. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 6 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 7 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. Morrison Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated November 27, 1985, and duly published December 5, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of Darrel or Tamara Lockman for a Use by Special Review to process and sell forestry products in an Agricultural Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Debbie de Besche, Planning Department representative, read the favorable recommendation of the Planning Commission into the record and stated that eight Development Standards are recommended for this proposal. Darrel Lockman, one of the applicants, came forward to answer questions of the Board. He stated that he has no problem with the proposed Development Standards. No public comment was offered concerning this request. Commissioner Kirby moved to approve the Use by Special Review requested by Darrel or Tamara Lockman, subject to the conditions and Development Standards as recommended by the Planning Commission. Commissioner Yamaguchi seconded the motion which carried unanimously. This Certification was approved on the 23rd day of December, 1985. Motion carried unanimously. jCASE NUMBER: USR-709:85:54 APPLICANT: Darrel and Tamara Lockman REQUEST: A Use by Special Review permit to process and sell forestry products in an Agricultural Zone district LEGAL DESCRIPTION: Part of the NE}, Section 4, T6N, R66W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3 miles west of Eaton; south of Weld County Road 74 and west of Weld County Road 31 APPEARANCE: Darrel Lockman, property owner and applicant, reported they are processing fire wood, posts, wood chips, etc. They do not do anything with live trees. They own forty acres, but the Use by Special Review area will only use about five acres of their property. He gets his wood from the U.S. Forest Service. Some of the wood is cut on site and come is brought onto to the property and then cut. He will deliver the wood to customers or they can come to the property and load and haul it out themselves. At the present time, they are not using any chemicals or wood preservatives on the fence posts. The Chairman asked Mr. Lockman if he had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning services staff. He stated he had and has no objections to them. The Department of Planning Services staff amended the Development Standards to add a new 02 to read as follows: 2. The Use by Special Review area shall comply with all state and federal regulations pertaining to the handling, storage or disposal of hazardous or toxic substances. Further Development Standards following this standard will be numbered consecutively. The Chairman called for discussion from the members of the audience. Gene Gurley, applicant, reported they have an existing permit for a Use by Special Review which allows for fifty dogs on another property. Their business has grown considerably, therefore, they want to expand on this property. They would raise dog on this property. The only dogs on the property would be under one year old, injured dogs, and old dogs that do not race any more. There would be no training at this site. He explained the physical lay-out planned for the kennel operation. Hired help will live in a mobile home on this property.
