RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL
USE PERMIT FOR A 250 DOG GREYHOUND KENNEL - RICHARD K.
BLUNDELL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 18th day of October, 1989, at the hour of 10 : 00
a.m. in the Chambers of the Board for the purpose of hearing the
application of Richard K. Blundell, 1123 9th Street, #201 ,
Greeley, Colorado 80631 , for a Site Specific Development Plan and
amended Special Use Permit for a 250 dog greyhound kennel on the
following described real estate, to-wit:
Part of the SE$ SEi , Section 21 , Township 2
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was present, and
WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said amended Special Use Permit,
and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4.2 of the Weld County Zoning Ordinance as follows:
a. The proposed use is consistent with the Weld County
Comprehensive Plan' s Urban Growth Boundary Area
Goals and Policies. The proposed use is located
within the Urban Growth Boundary Area of the City
of Fort Lupton. The Fort Lupton Planning

Commission reviewed this request on September 7,
1989 , and found no conflicts with its interests.
b. The proposed use is consistent with the intent of
the Agricultural Zone District and is provided for
as a Use by Special Review.
c. The proposed use is compatible with the existing
surrounding land uses and with the future
development of the surrounding area as permitted by
the Agricultural zone district. The surrounding
land uses include two other dog kennels, dryland
pasture, and one proposed dog kennel within 1,000
feet of the Special Review area. The balance of
the surrounding property is dryland pasture,
overhead powerlines, and oil and gas production.
d. No overlay districts affect the site.
e. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a 250
dog greyhound kennel on the hereinabove described parcel of land
be, and hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Use
Permit shall be adopted and placed on the Special Use
Permit plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.
2 . No building or electrical permits shall be issued on the
property until the Special Use Permit plat is ready to
be recorded in the office of the Weld County Clerk and
Recorder.
3. Prior to recording the plat, a Soil Erosion Control Plan
and Maintenance Plan approved by Platte Valley Soil
Conservation District shall be submitted to the
Department of Planning Services.

4. Prior to recording the Special Use Permit plat, evidence
shall be submitted to the Department of Planning
Services that the Weld County Health Department has
approved the greyhounds ' water supply.
5 . The existing septic system for any dog kitchen or
employee restroom facility shall be reviewed by a
Colorado Registered Professional Engineer, a copy of
that review submitted to the Weld County Health
Department and the required I .S.D.S. Evaluation
performed.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
October, A.D. , 1989 .

AMENDED SUP-431
1 . The Site Specific Development Plan and amended Special Use
Permit is for a greyhound kennel as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein. The maximum number of greyhound dogs shall not
exceed 250 .
2. Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24, C.R.S. , as amended.
3 . The applicant shall remove, handle, and stockpile manure from
the kennel area in a manner that will prevent nuisance
conditions. The manure pile shall not be allowed to exist or
deteriorate to a condition that facilitates excessive odors,
flies, insect pests, or pollutant runoff. The manure storage
site shall have a water-tight surface which does not permit
seepage or percolation of manure pollutants into the ground.
4 . No permanent disposal of wastes shall be permitted at this
site.
5. Any new or existing floor drains or liquid waste streams
shall be disposed by an authorized Individual Sewage Disposal
System. All septic systems shall be installed and maintained
in accordance with the Weld County Individual Sewage Disposal
Regulations.
6 . Wood shavings, sawdust, and waste materials shall be handled,
stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
7. Fugitive dust shall be confined on this site.
8 . A potable water supply shall be maintained for the greyhounds
at all times.
9 . The maximum permissible noise level shall not exceed 55dB (A)
from 8 : 00 p.m. until 6 : 00 a.m. and from 6:00 a.m. until 8: 00
p.m. shall not exceed 80dB (A) as measured by 25-12-102,
C.R.S.

10 . The Soil Erosion Control Plan approved by the Platte Valley
Soil Conservation District shall be maintained at all times.
11 . The greyhound kennel facility shall comply with the Colorado
Racing Commission' s Rules and Regulations pertaining to
greyhound kennels.
12. Buildings and grounds shall be kept clean, in good repair,
and free of trash. All wastes shall be removed from the
property on a weekly basis to an approved landfill.
13. No structure shall be constructed within Panhandle Eastern
Pipe Line Company' s 50-foot right-of-way easement.
14 . Written approval shall be obtained from Panhandle Eastern
Pipe Line Company, for the construction of utility lines,
streets, sidewalks, and driveways within Panhandle Eastern
Pipe Line Company' s 50-foot right-of-way easement. Two
working days prior to the start of construction, the utility
notification center of Colorado shall be notified so that all
utilities can be located and identified.
15. All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
16 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24.5 of the
Weld County Zoning Ordinance.
17. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
18 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .
19 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall

be filed in the office of the Department of Planning
Services.
20. The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

A public hearing was conducted on October 18, 1989, at 10:00 A.M. , with

The following business was transacted:
I hereby certify that pursuant to a notice dated September 27, 1989,
and duly published October 5, 1989, in The New News, a public hearing
was conducted to consider the request of Richard K. Blundell for a Site
Specific Development Plan and and amended Special Use Permit for a 250
dog greyhound kennel. Lee Morrison, Assistant County Attorney, made
this matter of record. Keith Schuett, Planning Department
representative, entered the favorable recommendation of the Planning
Commission into the record of this hearing. Mr. Schuett explained that
Special Use Permit #431 was granted for an 80-acre parcel. A Recorded
Exemption was approved for a portion of this parcel, and this Special
Review Permit amends Special Use Permit #431 to exclude the area of the
Recorded Exemption. Mr. Blundell was present to answer questions of
the Board. No public comment was offered concerning this request.
Commissioner Lacy moved to approve the request of Richard Blundell for
a Site Specific Development Plan and an amended Special Use Permit,
subject to the Conditions and Development Standards contained in the
Planning Commission's recommendation. Seconded by Commissioner
Harbert, the motion carried unanimously.
This Certification was approved on the 23rd day of October, 1989.

recommendation, conditions, and Development Standards presented by the
Department of Planning Services staff. He stated he had no objections. The
Chairman asked the secretary to file the staff's recommendation with the
summary as a permanent record of these proceedings.

the permit to be in conformance with what is actually being done.
Therefore, he is requesting an amendment to the special use permit.

Terry Crane, Panhandle Eastern Pipeline Company, stated they are not against
this permit being granted; however, they would like to be notified prior to
any construction taking place because they do have rights-of-way through
this property.

The Chairman asked Mr. Blundell if be had reviewed the recommendation,
conditions, and Development Standards set forth by the Department of
Planning Services staff. He stated he has and he takes exception to
Condition #3 concerning the recommendation of the Soil Conservation Service.
He feels this is a misunderstanding on the Soil Conservation's part as this
is not an oval track. He will meet with them and try to work out a mutual
agreement.
AMENDMENT:
Jerry Kiefer moved Condition #3 be amended to read as follows:

APPEARANCE:
Kent Pollard, property owner and applicant, stated this is a request to
build greyhound kennels and runs for up to 150 greyhounds.
The Chairman called for discussion from the members of the audience.
Terry Crane, Panhandle Eastern Pipe Line Company stated he would like to be
notified prior to any construction being started because they have a
right-of-way through the property.
The Chairman asked Mr. Pollard if he had any objections to the
recommendation, conditions, and Development Standards presented by the
Department of Planning Services staff. Re stated he had none. The Chairman
asked the secretary to file these items with the summary as a permanent
record of these proceedings.
MOTION:
Jerry Kiefer moved Case Number USR-890 for Kent Pollard for a Site Specific
Development Plan and a Special Review permit for a Greyhound Kennel (150
dogs) in the Agricultural zone district be forwarded to the Board of County
Commissioners with the Planning Commission's recommendation for approval
based upon the recommendation, conditions, and Development Standards as
presented by the staff and the testimony heard by the Planning Commission.
Motion seconded by Rick Iverson.
The Chairman called for discussion from the members of the Planning

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
- The proposed use is consistent with the Weld County
Comprehensive Plan's Urban Growth Boundary Area Goals
and Policies. The proposed use is located within the
Urban Growth Boundary area of the City of Fort Lupton.
The Fort Lupton Planning Commission reviewed this
request on September 7, 1989, and found no conflicts
with its interests.
- The proposed use is consistent with the intent of the
Agricultural zone district and is provided for as a Use
by Special Review.
- The proposed use is compatible with the existing
surrounding land uses and with the future development of
the surrounding area as permitted by the Agricultural
zone district. The surrounding land uses includingtwo
other dog kennels, dryland_pasture,and one proposed dog
kennel within 1,000 _feet of the Special Review area.
The balance of the surrounding property is dryland
pasture, overhead powerlines, and oil and gas
production.
- No overlay districts affect the site.
- Special Review Development Standards will provide
adequate protection of the health, safety and welfare of
the neighborhood and County.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Special Use Permit
shall be adopted and placed on the Special Use Permit plat prior
to recording the plat. The plat shall be delivered to the
Department of Planning Services and be ready for recording in the
Weld County Clerk and Recorder's office within 15 days of approval
by the Board of County Commissioners.
2. No building or electrical permits shall be issued on the property
until the Special Review plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3. Prior to scheduling a public meeting before the Board of County
Commissioners, a soil erosion control plan and maintenance plan
approved by Platte Valley Soil Conservation District shall be
submitted to the Department of Planning Services.
4. Prior to recording the Special Use permit plat, evidence shall be
submitted to the Department of Planning Services that the Weld
County Health Department has approved the greyhounds' water
supply.
5. The existing septic system for any dog kitchen or employee
restroom facility shall be reviewed by a Colorado Registered
Professional Engineer, a copy of that reivew submitted to the Weld
County Health Department and the required I.S.D.S. Evaluation
performed.

AMENDED SUP-431
1. The Site Specific Development Plan and amended Special Use Permit is
for a greyhound kennel as submitted in the application materials on
file in the Department of Planning Services and subject to the
Development Standards stated hereon. The maximum number of Greyhound
dogs shall not exceed 250.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The applicant shall remove, handle, and stockpile manure from the
kennel area in a manner that will prevent nuisance conditions. The
manure pile shall not be allowed to exist or deteriorate to a condition
that facilitates excessive odors, flies, or inspect pests, or pollutant
runoff. The manure storage site shall have a water-tight surface which
does not permit seepage or percolation of manure pollutants into the
ground.
4. No permanent disposal of wastes shall be permitted at this site.
5. Any new or existing floor drains or liquid waste streams shall be
disposed by an authorized Individual Sewage Disposal System. All
septic systems shall be installed and maintained in accordance with the
Weld County Individual Sewage Disposal Regulations.
6. Wood shavings, sawdust, and waste materials shall be handled, stored,
and disposed in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions.
7. Fugitive dust shall be confined on this site.
8. A potable water supply shall be maintained for the greyhounds at all
times.
9. The maximum permissible noise level shall not exceed 55dB(A) from 8:00
p.m. until 6:00 a.m. and from 6:00 a.m. until 8:00 p.m. shall not
exceed 80dB(A) as measured by 25-12-102, C.R.S.
10. The soil erosion control plan approved by the Platte Valley Soil
Conservation District shall be maintained at all times.
11. The greyhound kennel facility shall comply with the Colorado Racing
Commission's Rules and Regulations pertaining to greyhound kennels.

12. Buildings and grounds shall be kept clean, in good repair, and free of
trash. All wastes shall be removed from the property on a weekly basis
to an approved landfill.
13. No structure shall be constructed within Panhandle Eastern Pipe Line
Company's 50 foot right-of-way easement.
14. Written approval shall be obtained from Panhandle Eastern Pipe Line
Company, for the construction of utility lines, streets, sidewalks, and
driveways within Panhandle Eastern Pipe Line Company's 50 foot
right-of-way easement. Two working days prior to the start of
construction, the utility notification center of Colorado shall be
notified so that all utilities can be located and identified.
15. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
16. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
17. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
18. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
19. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
20. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

Dear Mr . Schuett :
Please find enclosed a copy of our as-built map , which shows our
pipeline, 16-10-075-31e-4" , in the hi-lighted areas, located in
the Southeast Quarter of Section 21 , Township 2 North. Range 66
West, Weld County. Colorado. It is to our understanding, that
the above referenced project will be constructed , at a minimum,
of 70 feet from our facilities. therefore. Panhandle Eastern does
not foresee any conflicts. However , before we give our
recommendations on this project, we are requesting that Mr.
Blundell contact us for further clarification of his project , and
to also acknowledge his awareness of the following stipulations.
Panhandle Eastern maintains a 50-foot wide right-of-way on all
pipelines and will not allow any building within that easement
area. Utility lines, streets, sidewalks, and driveways may be
installed at approximate right angles to the pipeline herein
authorized, provided, however , that all utilities cross under our
pipeline with a minimum clearance equal to the diameter of the
larger utility or 18" , whichever is greater . No paved or
traveled portion of any street , sidewalk. driveway. road, alley,
or curbing will be placed substantially parallel to and within
fifteen ( 15' ) feet of the pipeline, provided adequate working
space is available on the other side of the pipeline.

On September 27, 1990, your water at 14753 WCR 18, Fort Lupton, Colorado, was
sampled by Patty Deplazes of this department.
In accordance with the Standard Methods for Drinking Water Analysis, your water
was tested using a membrane filtration procedure. In this procedure, our
laboratory looks for the presence of the coliform bacteria. The presence of
coliform bacteria indicates the occurrence of fecal contamination in a water
supply. Analysis of your water yielded the following results:
ACCEPTABLE - according to the Colorado Primary Drinking Water
Regulations, your water is considered fit for human consumption.

SIZE OF PARCEL: 31.27 Acres, more or less
POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
Special Use permit #431 was approved by the Board of County Commissioners on
August 27, 1980, for a 300 dog greyhound kennel on a 66 acre, more or less,
parcel. Then on December 16, 1987, the Board of County Commissioners
approved Special Use Permit #811 for a 200 dog greyhound kennel on the
northern 34 acres, more of less, of Special Use Permit #431. Condition of
approval #3 requires SUP-431 be amended to exclude the area approved for
USR-811. This application is submitted to comply with this Condition of
approval.
The criteria for review of this Special Review permit is listed in Section
24.3 of the Weld County Zoning Ordinance. The Department of Planning
Services' staff has received specific recommendations from:
Panhandle Eastern Pipe Line Company;
Weld County Health Department; and
Platte Valley Soil Conservation District.
Referral responses have not been received from:
Town of Fort Lupton;
Weld County Engineering Department;
Colorado Racing Commission; and
Humane Society of Weld County.
No objections have been received by Department of Planning Services' staff
from surrounding property owners.

USR DESCRIPTION OF OPERATION AND USE
1. This is an amended application to an existing special use permit
(SUP) nka USR to bring the special use into conformity with the actual use of the
property since the time of the granting of the prior SUP #431. The existing
improvements, operation, and use of the property have been ongoing since at or
about the time of the application for, or granting of, the previous SUP. During
that lengthy period of time, no complaints or problems in regard to the use of
the property have occurred. Moreover, none are contemplated.
(a) Uses on surrounding properties and distance of
proposed use to residential structures: Said use of the
property is, and at all times relevant has been, in
conformity with the ongoing uses of various contiguous
parcels to the east of the property in question, all of which
have been, and continue to be, used as large greyhound kennel
operations.
To the north of the property is poor dryland
contaminated by prior waste spillage from a previously
existing and now defunct brine waste disposal site to the
north. Tom Sugihara has been granted a use by special review
of the barren 35 acres directly to the north of the property
in question in order to establish a greyhound kennel thereon.
Accordingly, continued use of this property for a dog kennel
operation would be in conformity with such use. To the west
of the property is barren dry land upon which a non-operating
oil well sits. Approximately 500 yared to the west exists a
mobile home recently placed there for residential purposes.
One-half mile or more to the south of the property in
question exists a residence. A proposed co-generation plant
is expected to go on line in that vicinity in 1991. To the
east, the residence of Herb and Karen Legg, adjacent grey-
hound kennel operators, exists.
(b) Maximum number of users, patrons, members, and
buyers: The property presently has two residences located on
it, both of which have been there since the time of the
granting of the original SUP. It is not anticipated that
persons other than inhabitants of the residences in question
would make regular use of the property.
(c) Number of employees, number of shifts, and hours of
operation: A trainer lives on the property and operates the
kennel with occasional assistance from a helper. Hours of
operation are from sunup until sunset.
(d) Type of water source: An approved well of good
quality and abundance has been on the property for a number
of years.
(e) Access route to be utilized for the proposed use:
Access will continue to be by a dirt lane exiting off Weld
County Road 18.
(f) Type, size, weight, and frequency of vehicular
traffic: There are two small light duty trucks and one or
two passenger cars infrequently used.
(g) Type of sewage facilities: Existing leech field
and septic tanks.
(h) Description of fire protection means: Fire
extinguishers placed in the residences and barn, along with
smoke alarms. Additional fire protection provided by the Ft.
Lupton Fire District.
(i) Type and maximum number of animals: 250 registered
greyhounds.
(j) Time schedule and method of removal and disposal of
debris, junk, and waste associated with proposed use: Animal
waste picked up daily and placed in an appropriate sanitation
facility. A dumpster is, and has been for a long period of
time, located on the property, which permits a sanitation
disposal company to remove waste, junk, trash, and other
debris weekly or bi-weekly, if needed.
(k) Timetable for construction: As indicated on the
mylar map produced contemporaneously herewith, virtually all
of the improvements now on the property have been in place
since the granting of the original SUP. In the event that
the kennel proceeds to operate at or near the maximum
proposed dog capacity, the mylar map sets forth the location
and size of the proposed kennel extension. At present, there
are no plans for such construction, which is dependent upon
obtaining additional financing for the construction thereof
and the purchase of the dogs to be housed there.
(1) Type of storm water retention facilities associated
this the proposed use: The improvements on the property
comprise a very small percentage of the property. There are
no concrete, cement, or paved surfaces, and no plans for any
exist. There never has been any problem with runoff or
drainage from storms, and none are anticipated. Hence, it
appears that there is a lack of impermeable substances on the
property to impede the satisfactory actual drainage of water
from the property. In essence, the natural topography of the
property is, and has been, essentially unchanged. No plans
for modification thereof exist.
(m) Proposed landscaping plans and erosion control
measures associated with the proposed use: During the
approximate seven years of use of the property in its present
form, no erosion problems have been noted. Nor are any
expected to occur. Essentially, no topographic or slope
problems have been noted. It is believed that the presence
of pasture and/or native grass as ground cover will continue
to preclude such problems. Seeding will therefore be done as
necessary to prevent erosion.

(n) Reclamation procedures to be employed upon cessa-
tion of the use by special review activity: Dog runs, pens,
and sprint field would be removed, and land restored to
former state.
(o) Timetable showing the periods of time required for
construction and start up of the proposed use: As indicated
above, all improvements are in place, except those which may
be constructed at some point in the future, given the
conditions set forth above.
(p) Consistency with the Weld County Comprehensive Plan
and the intent of the district in which the use is located:
The existing operation, as indicated above, is located on
contaminated, barren, dry land, which never has been
desirable farm land property. The kennel operation is
located in an enclave of dry land agricultural property which
has been recognized as the major area in Weld County for the
location of greyhound racing kennels. Such use places
minimal demands on the land and, given the prior contamina-
tion of the property, may well be the only realistic use
thereof. In essence, the use continues to involve the
domestic raising of animals, the operation of which is
dependent upon the ongoing use of animal meat by-products.
Accordingly, the use is, and has been, consistent with the
agricultural uses of the area in question. This is a low
density, best use of the property, consistent with adjacent
uses, the lack of projected urbanization expansion, and the
presence of nearby oil wells. Undoubtedly, had a technical
non-conforming use of this property for the last eight years
been inconsistent with the Weld County Comprehensive Plan or
with the intent of the district in which the use is located,
prior action by the County would have occurred in order to
attempt to curtail or eradicate any problems associated
therewith. Since this has never occurred, it must be assumed
that no such problems exist, or have existed with respect to
the present use of the property.
(q) Efforts to conserve productive agricultural land in
the agricultural zone district: As indicated above, this is
contaminated, poor agricultural land. To the extent that the
use consists of an agricultural activity, as has seemingly
been recognized by the County in allowing this and other
similar prior special uses in an agriculturally zoned
district, the present use of the property makes the best use
available of the agricultural land in question. Moreover,
since the improvements on the property constitute a small
fraction of the property, the overwhelming majority of the
land remains available for farming should it be determined at
some point in the future that the land would be capable of
being productive agricultural land.
(r) Provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the
County: Dogs are confined at all times and are generally
muzzled. There is no perceived or known danger or impairment
to the health, safety, and welfare of the inhabitants of the

neighborhood and the County by and through the continuation
of the use in question. Moreover, as indicated above, there
are no erosion, runoff or waste problems associated with the
continuation of the use in question. In support thereof, the
Applicant states that, upon information and belief, there
have never been any complaints about the use of the property.
(s) Compatibility with existing surrounding land uses.
Please reference the foregoing.
(t) Compatibility with future development of the
surrounding area as permitted and as projected: The land in
question is not within the projected urban expansion area of
Ft. Lupton, Colorado. It is clearly not within an area of
projected urban growth. Moreover, given an agricultural
zoning of the property and surrounding area, there is no
perceived or known incompatibility in regard thereto.
(u) Flood plane, geologic hazard, and Weld County
Airport overlay district area concerns: This land is not in
a flood plane, geologic hazard, or in the Weld County Airport
overlay district area.
(v) Water supply availability and dependability: A
deep well has existed on the property for a number of years
and has continued to produce an abundance of excellent
quality, portable water. There is no reason to believe that
continuation of the use in question will in no way impact
upon the continued availability of this water, either in
terms of quantity or quality.
(w) Noise factors: A waiver of a noise report is
requested in view of the long term use of the property in
question and the absence of any known complaints by anyone in
regard to noise or any perceived problem with the use of
property. Moreover, because these are extremely valuable
animals, the dogs are generally kept in secured cages indoors
at night, protected by a guard dog. Accordingly, there is no
reason to believe that any noise problems will ever exist in
regard to the continued use of the property as a dog kennel.
In any case, it is the applicant's intention to plant
evergreens along the southern and eastern boundaries of the
property to reduce noise, in any event, and to insure greater
privacy.

Environmental Protection Services has reviewed this proposal and recommends
for approval, subject to the following conditions:
1. The applicant shall remove, handle, and stockpile manure from
the kennel area in a manner that will prevent nuisance
conditions. The manure piles shall not be allowed to exist or
deteriorate to a condition that facilitates excessive odors,
flies, or insect pests, or pollutant runoff. The manure storage
site shall have a water-tight surface which does not permit seepage
or percolation of manure pollutants into the ground.
2. No permanent disposal of wastes other than dog manure shall be
permitted at this site.
3. The existing septic system for any dog kitchen or employee
restroom facility is required to be reviewed by a
Colorado Registered Professional Engineer, and a copy of that
review submitted to this Division before the required I.S.D.S.
Evaluation can be performed.
4. An ISDS Evaluation on all existing septic systems will be
necessary prior to issuing the required septic permits on the
existing systems.
5. Wood shavings, saw dust, and waste materials shall be handled,
stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
6. Fugitive dust must be confined on this site.
7. It should be determined that the well water to be provided for
the animals is potable.
8. The maximum permissible noise level shall not exceed 55dB(A) from
8:00 p.m. until 6:00 a.m. and from 6:00 a.m. until 8:00 a.m.
shall not exceed 80dB(A) as measured by 25-12-102 CRS.
9. Any new or existing floor drains or liquid waste streams shall be
disposed by an authorized Individual Sewage Disposal System
according to Weld County Regulations.
Colorado Health Department Regulations specifically exempt greyhound
kennels from compliance monitoring by this Department.
You may wish to contact the Colorado Racing Commission to determine if
there are any concerns they have with the proposed application.

Dear Mr. Schuett:
We have reviewed the above referenced application to create a Greyhound
Kennel operation, which includes two existing single-family dwellings and two
proposed dwellings on a 31.327 acre tract. No information on projected water
requirements was submitted. The proposed source of water for the operation is
to be an individual well .
There appears to an existing domestic well , Permit Number 86280, issued
to a Jim Motes, located on the lot. This well is permitted as the only well
on a parcel of 80 acres and is permitted for domestic and stock watering
uses. A domestic well can serve a maximum of three single-family dwellings.
The proposed operation requires a commercial water supply. The existing
well appears to be in the Laramie-Fox Hills aquifer which is considered to be
non-tributary in this area. The applicant may apply for a new well permit for
the existing well . The permit application should detail the proposed uses and
accurately describe the parcel that the well is to be permitted for. We
cannot make a final determination concerning well permit availability until we
review an application.
We can recommend approval contingent upon the applicant applying for and
obtaining a new well permit for the existing well .

Dear Mr. Schuett:
Most of the area has a moderate limitation for local roads
due to low soli strength . When doing shallow excavations
care should be used as some of these soils have a potential
for cutbank caving .
Regarding erosion control , we believe the center of the
sprint field should be seeded to adapted grasses . Any soil
disturbance should be revegetated to adapted grasses . Roads
and heavy use areas outside the dog runs should be gravelled
to help reduce potential erosion .
Regarding reclamation , in case of cessation the area should
be seeded to adapted grasses for that site and maintained
until a stand of grass is estab , rshed , not necessarily
restored to former state .
Nr . Blundell indicated plans to plant evergreens along the
southern and eastern boundaries for noise reduction . It
would be desirable to plant trees (windbreak) along the
western and nortnern boundaries for erosion protection ,
especially w i to the large area that will be bare from dog
runs and sprint fields . Grazing should not be permitted by
domestic animals .

interest rates or variable payments, this contract is conditioned upon Purchaser reviewing and consenting to such

8. Cost of any appraisal for loan purposes to be obtained after this date shall be paid by Purchaser
9. An abstract of title to the Property,certified to date,or a current commitment for title insurance policy in an
amount equal to the purchase price, at Seller's option and expense, shall be furnished to Purchaser on or before
July 26 ,1989 .If Seller elects to furnish said title insurance commitment,Seller
will deliver the title insurance policy to Purchaser after closing and pay the premium thereon.
10. The date of closing shall be the date for delivery of deed as provided in paragraph 11. The hour and place of
closing shall be as designated by Seller .
11. Title shall be merchantable in Seller,except as stated in this paragraph and in paragraphs 12 and 13.Subject
to payment or tender as above provided and compliance by Purchaser with the other terms and provisions hereof,
Seller shall execute and deliver a good and sufficient special warranty deed to Purchaser on
AUG• 8 , 19_8_9_,or,by mutual agreement,at an earlier date,conveying the Property free and
clear of all taxes,except the general taxes for the year of closing,and except ,
free and clear of all liens for special improvements installed as of the date of Purchaser's signature hereon,whether
assessed or not;free and clear of all liens and encumbrances except No exceptions
except the following restrictive covenants which do not contain a right of reverter: Those of record
and except the following specific recorded and/or apparent easements: Those of record, including
utility easement across westernmost 15' of the subject property for the use
and benefit of continguous parcel.

12. Except as stated in paragraphs 11 and 13,if title is not merchantable and written notice of defect(s)is given by
Purchaser or Purchaser's agent to Seller or Seller's agent on or before date of closing, Seller shall use reasonable
effort to correct said defect(s) prior to date of closing. If Seller is unable to correct said defect(s)on or before date of
closing, at Seller's option and upon written notice to Purchaser or Purchaser's agent on or before date of closing,the
date of closing shall be extended thirty days for the purpose of correcting said defect(s).Except as stated in paragraph
13,if title is not rendered merchantable as provided in this paragraph 12,at Purchaser's option,this contract shall be
void and of no effect and each party hereto shall be released from all obligations hereunder and all payments and
things of value received hereunder shall be returned to Purchaser.
13. Any encumbrance required to be paid may be paid at the time of settlement from the proceeds of this
transaction or from any other source. Provided, however, at the option of either party, if the total indebtedness
secured by liens on the Property exceeds the purchase price,this contract shall be void and of no effect and each party
hereto shall be released from all obligations hereunder and all payments and things of value received hereunder shall
be returned to Purchaser.

14. General taxes for the year of closing,based on the most recent levy and the most recent assessment,prepaid
rents,water rents,sewer rents,FHA mortgage insurance premiums and interest on encumbrances,if any,and
shall be apportioned to date of delivery of deed. Purchaser shall be responsible for any sales and use tax that may
accrue because of this transaction.
15. Possession of the Property shall be delivered to Purchaser on date of closing
subject to the following leases or tenancies: existing unlawful detainer of Sean and
Mary Coughlan
If Seller fails to deliver possession on the date herein specified,Seller shall be subject to eviction and shall be liable for
a daily rental of$ N/A until possession is delivered.
16. In the event the Property shall be damaged by fire or other casualty prior to time of closing,in an amount of
not more than ten percent of the total purchase price, Seller shall be obligated to repair the same before the date
herein provided for delivery of deed. In the event such damage is not or cannot be repaired within said time or if the
damages exceed such sum,this contract may be terminated at the option of Purchaser and all payments and things of
value received hereunder shall be returned to Purchaser. Should Purchaser elect to carry out this contract despite
such damage,Purchaser shall be entitled to all the credit for the insurance proceeds resulting from such damage,not
exceeding, however, the total purchase price. Should any fixtures or services fail between the date of this contract
and the date of possession or the date of delivery of deed,whichever shall be earlier,then Seller shall be liable for the
repair or replacement of such fixtures or services with a unit of similar size,age and quality,or an equivalent credit.
17. Time is of the essence hereof.If any note or check received as earnest money hereunder or any other payment
due hereunder is not paid, honored or tendered when due, or if any other obligation hereunder is not performed as
herein provided,thei e shall be the following remedies:
(a) IF PURCHASER IS IN DEFAULT, then all payments and things of value received hereunder shall be
forfeited by Purchaser and retained on behalf of Seller and both parties shall thereafter be released from all
obligations hereunder. It is agreed that such payments and things of value are LIQUIDATED DAMAGES and
(except as provided in subparagraph (c)) are the SELLER'S SOLE AND ONLY REMEDY for the Purchaser's
failure to perform the obligations of this contract. Seller expressly waives the remedies of specific performance
and additional damages.
(b) IF SELLER IS IN DEFAULT,(1)Purchaser may elect to treat this contract as terminated,in which case
all payments and things of value received hereunder shall be returned to Purchaser and Purchaser may recover
such damages as may be proper,or(2)Purchaser may elect to treat this contract as being in full force and effect
and Purchaser shall have the right to an action for specific performance or damages,or both.
(c) Anything to the contrary herein notwithstanding, in the event of any litigation arising out of this
conti act,the court may award to the prevailing party all reasonable costs and expense,including attorneys'fees.
18. Purchaser and Seller agree that,in the event of any controversy regarding the earnest money held by broker,
unless mutual written instruction is received by broker,broker shall not be required to take any action but may await
any proceeding,or at broker's option and discretion,may interplead any moneys or things of value into court and may
recover court costs and reasonable attorney's fees.
19. Additional provisions:
1. The rear (North) 35 acres of the parcel previously owned by Coughlans is

presently under contract to a third party and shall be severed from this
parcel by Recorded Exemption and may be developed by its purchaser as a dog
kennel. Purchaser shall reasonably cooperate with the sale of such parcel to
this purchaser or any other, shall cooperate with application for Recorded
Exemption and not object or otherwise resist such Purchasers obtaining use
by special right to operate a dog kennel.
2. Purchasers acknowledge this property is presently used as a dog kennel and
such use may not be in compliance with existing zoning requirements. Purchase
hereby assume responsibility for existing violations, if any, and indemnify
Seller from liability for any such violations. Further, Purchasers shall
promptly apply for and diligently pursue any permits or licenses which may be
required and to take all actions required to bring such property into complian
All of this shall be at Purchaser's expense. Seller may waive and surrender
existing use by special review.
3. Seller has no title to either mobile home on the property but does hold a
Title Certificate to the 1981 Titan which shows Marvin Howlett as the owner an
Federal Land Bank as a lien holder. Seller will assign any and all rights it
holds to either mobile home to Purchaser and deliver existing Title Certificat
Seller will assist Purchaser in obtaining title to the 1981 Titan mobile home
and in that regard will obtain an Assignment from Federal Land Bank of its
lien against the Titan at no cost to Purchaser.
20. If this proposal is accepted by Seller in writing and Purchaser receives notice of such acceptance on or before
July 14 , 19_8_9_, this instrument shall become a contract between Seller and Purchaser and shall
inure to the benefit of the heirs,successors and assigns of such parties,except as stated in paragraph 7.

need to be approved.

This is a deep, well drained soil on smooth plains at elevations of
4680 to 4900 feet. It formed in eolian sands.
Included in this unit are some soils with subsoils shallower than 20
inches. Also included were some soils with loam and sandy clay loam
subsoils.
Typically the surface layer is grayish brown sand about 22 inches thick.
The subsoil is brown sandy loam about 12 inches thick. The substratum,
to a depth of 60 inches is loamy sand or sand. .
Permeability is moderately rapid. Available water capacity is moderate.
Effective rooting depth is 60 inches or more. Surface runoff is very
(. -
slow and erosion hazard is low.
This soil is suited to limited cropping; intensive cropping is hazardous
because of erosion. The cropping system should be limited to close
grown crops such as alfalfa, wheat and barley. The soils also are
adapted to irrigated pasture. A suitable cropping system would be
alfalfa 3 to 4 years followed by corn and small grain for 2 years and
alfalfa seeded with a nurse crop.

Close grown crops may be irrigated from closely spaced contour ditches
or sprinklers. Contour furrows or sprinklers should be used for new
crops. Applications of nitrogen and phosphorous fertilizer will help
maintain good production.

The potential vegetation on this soil is dominated by sand 'bluestem,
sand reedgrass , switchgrass, sideoats grama, needle-and-thread, little

bluestem and blue- grama. Potential production ranges from 2500 pounds
per acre in favorable years to 1800 pounds per acre in unfavorable years.
When range condition deteriorates, sand bluestem, switchgrass, sand reed-

Sand sage increases, undesirable weeds and annual plants invade and
"blowout" conditions can occur as range conditions becomes poorer.
Management of vegetation on this soil should be based on taking half and
leaving half of the total annual production. Seeding is advisable if
range is in poor condition. Sand bluestem, sand reedgrass, Indiangrass ,
switchgrass , sideoats grama, little bluestem and blue grama are suitable
for seeding. Due to the wind erosion susceptiblility of this soil,
seeding should be done with an interseeder or in a firm clean sorghum
C ' stubble -- prepared the growing season prior to seeding -- with a grass
drill. Early spring seeding has proven most successful. Brush manage-
ment can also help improve deteriorated range.
Windbreaks and environmental plantings are fairly well suited to this
soil. Blowing sand and low available water capacity are the principle

and high terraces at elevations of 4600 to 5200 feet. It formed in
eolian or alluvial deposits.
Included in this unit are some leveled areas. Also included are some
soils with loamy substratums and some soils that are noncalcareous
to depths of 60 inches.
Typically the surface layer is a grayish brown loamy sand about 6 inches
thick. The subsoil is a brown to light yellowish brown fine sandy loam
about 22 inches thick. The substratum, to a depth of 60 inches, is a
sandy loam or loamy sand.

Permeability is moderately rapid. Available water capacity is moderate.
Effective rooting depth is 60 inches or more. Surface runoff is slow
and erosion hazard is low.
Where irrigated this soil is suited to the commonly grown crops in
the area. However, perennial grasses and alfalfa or close grown crops
should be grown at least 50 percent of the time. Close grown crops and
pasture ,can be irrigated with contour ditches and corrugations. Furrows,
contour furrows and cross slope furrows will work on row crops. Sprin-
kler irrigation is also recommended.
Minimum tillage and crop residue utilization will help control erosion.
Fertility maintenance is important. Crops grown on these soils respond
_ to fertilizer applications of phosphorus and nitrogen.

residually from soft sandstone.
Included in this unit are some soils with sandstone at depths greater
than 40 inches.
Typically the surface layer is a pale brown fine sandy loam about 9
inches thick. The underlying material is light yellowish brown to
pale yellow fine sandy loam or sandy loam about 21 inches thick. Depth
to soft sandstone ranges from 20 to 40 inches.
( Permeability is moderately rapid. Available water capacity is moderate.
Effective rooting depth is 20 to 40 inches . Surface runoff is slow to
medium and erosion hazard is low.

This soil is suited to most of the irrigated crops cc:-=Dnly grown in
the area, although some restrictions will occur because the soil is
only moderately deep. A suitable cropping system is corn, corn for
silage , barley, alfalfa 3 to 4 years and wheat. These soils are also
well suited to irrigated pasture.
Row crops can be irrigated by furrows or sprinklers . Flooding from
contour ditches and sprinkling are suitable methods of irrigation for
close grown crops and pasture. Small heads of water and short runs

will help reduce erosion. Production will be maintained with frequent
irrigations and application of barnyard manure and commercial ferti-

These nearly level soils are on -smooth plains in depl°essiOns and along
the bottoms of natural drainageways throughout the survey area. The
Aquolls, which have dark colored surface layers , make up about 55
percent of the mapping unit. The Aquepts , which have lighter colored
surface layers , make up about 25 percent. About 20 percent is made
up of soils which are well drained and soils which hive sandstone or
shale within 48 inches of the surface .
These are deep , poorly drained soils . They formed in recent alluvium.
Typically they have mottled , mildly to m lderately alkaline , loamy or
clayey surface layers and underlying materials which extend to a depth
of 60 inches or more. They may or may not have a gleyed layer in the
underlying material.
Most of these soils are subject to excessive runoff. A watertable is
at or near the surface in the spring and during the peak of the irri-
gation season. -
These soils are used for rangeland and wildlife habitat . Some small
areas are used for irrigated pasture.
The potential native vegetation on these soils is dominated by switch
grass , prairie cordgrass , saltgrass , alkali sacaton, big bluestem,
Indiangrass , western wheatgrass , slender wheatgrass , sedge and rush.
Cattails and bullrush occur on swampy spots associated with this site.
Much of this site has an increased amount of salts due to farming and
irrigation of adjacent areas. Potential production ranges from 4000

4600 to 5200 feet. It formed in mixed outwash deposits.
Included in this unit are some soils with dark surface layers. Some
leveled areas were also included in mapping.
Typically the surface layer is grayish brown fine sandy loam about 10
inches thick. The subsoil is yellowish brown to very pale brown fine
sandy clay loam about 14 inches thick. The substratum, to a depth of
60 inches , is calcareous fine sandy loam.
Permeability is moderate. Available water capacity is moderate.
( Effective rooting depth is 60 inches or more. Surface runoff is medium
and erosion hazard is low.
Where irrigated this soil is suited to all crops adapted to this area,
including corn, sugar beets, beans , alfalfa, small grains , potatoes
and onions. An example of a suitable cropping system is alfalfa 3
to 4 years followed by corn, corn for silage , sugar beets , small grain,
beans and back to alfalfa. Some conservation practices such as land
leveling, ditch lining and pipelines may ae needed for proper water
application.
All methods of irrigation are suitable with furrow irrigation the most
common type used. Barnyard manure and commercial fertilizers are
needed for top yields along with maintaining good organic matter content.

The potential native vegetation on this site is dominated by sand blue-

sideoats grams and western wheatgrass are also prominent. Potential ,
production ranges from 2200 pounds per acre in favorable years to 1800
pounds per acre in unfavorable years. When range condition deteriorates,
( sand bluestem, sand reedgrass and switchgrass decrease and blue grama,
sand dropseed and sand sage increase. Annual weeds and grasses invade
the site as range condition becomes poorer.
Management of vegetation on this soil should be based on taking half and
leaving half of the total annual production. Seeding is advisable if

for beautification will do well.

This is a moderately deep, well drained soil on upland hillls and ridges
at elevations of 4850 to 5200 feet. It formed in materials weathered
residually from shale.
Included in this unit are some soils with shale deeper than 40 inches
and some soils with light clay subsoils.
Typically the surface layer is grayish brown clay loam about 9 inches
thick. The subsoil is grayish brown clay loam about 12 inches thick.
Depth to shale ranges from 20 to 40 inches.
Permeability is slow. Available water capacity is moderate. Effective
rooting depth is 20 to 40 inches . Surface runoff is medium to rapid
and erosion hazard is moderate.
This soil is suited to limited cropping; intensive cropping is hazar-
dous because of erosion. The cropping system should be limited to
close grown crops such as alfalfa, wheat and barley. The soils also
are adapted to irrigated pasture. A suitable cropping system would be
alfalfa 3 to 4 years followed by corn and small grain for 2 years and
alfalfa seeded with a nurse crop.
Close grown crops may be irrigated from closely spaced contour ditches.
Contour furrows should be used for row crops . Applications of barnyard
manure and commercial fertlizers will help maintain good production.
Minimum tillage and crop residue utilization is important.

help reduce runoff from this site. Seeding is advisable if range is in
poor condition. Western wheatgrass, blue grama, sideoats grama, buffalo-
grass , pubescent wheatgrass and crested wheatgrass are suitable for seeding.
The grass selected should meet the seasonal requirements of livestock. .
For successful seeding, a clean, firm, sorghum stubble -- prepared the
growing season prior to seeding -- or a firm, prepared seedbed and a

Wind break and environmental plantings are generally not suited to this
soil. On-site investigation is needed to determine if plantings are
