RE: APPROVAL OF USE BY SPECIAL REVIEW FOR SINGLE FAMILY DWELLING

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 7th day of August, 1985 , at the hour of 2 :00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Joseph A. and Elaine D. Hoff, 15546 Colorado
Highway 392 , Greeley, Colorado 80631 , for a Use by Special Review
for a single family dwelling on the following described real
estate, to-wit:
Part of the 5' SE', Section 9 , Township 6
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24.4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive
Plan and is consistent with the intent of the
Agricultural Zone District. The proposal does not
appear to have any adverse impacts on the
agricultural interests of the County or the
environment.

b. The use is both compatible with existing
agricultural activity and with future agricultural
use as identified in the Comprehensive Plan.
c. The Greeley Planning Commission recommended no
objection to the proposal.
d. No overlay districts affect the site.
e. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a single family dwelling on the
hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . The prescribed Use by Special Review activity shall not
occur nor shall any building or electrical permits be
issued on the subject property until the Use by Special
Review plat has been delivered to the Department of
Planning Services office and the plat has been recorded
in the office of the Weld County Clerk and Recorder.
3 . The Use by Special Review plat shall be corrected to
show a twenty foot right-of-way reserved on the west
side of Weld County Road 31 .

1 . The permitted use shall be a single family dwelling as
described in the application materials file with the
Department of Planning Services and subject to the Operation
Standards listed hereon.
2. The applicant shall comply with the design standards for the
Use by Special Review, Section 24 .5 et seq. , of the Weld
County Zoning Ordinance.
3 . The applicant shall comply with the Operation Standards for
Uses by Special Review, Section 24 .6 et seq. , of the Weld
County Zoning Ordinance.
4 . Representatives or members of the Weld County Health
Department and Weld County Department of Planning Services
shall be granted access onto the site at any reasonable time
in order to insure the operations carried out on the site
comply with the Operation Standards stated herein and all
applicable Weld County Regulations.
5 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the Standards as stated above
and all applicable Weld County Regulations. Any material
deviations from the plans and/or Standards as shown or stated
above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board
of County Commissioners before such changes from the plans
and/or Standards are permitted. Any other changes shall be
filed in the office of the Department of Planning Services.
6 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated
Standards. Noncompliance with any of the above stated
Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated July 15, 1985, and
duly published July 25, 1985, in the Johnstown Breeze, a public hearing
was conducted to consider the application of Joseph and Elaine Hoff for
a single family dwelling. Bruce Barker, Assistant County Attorney,
made this matter into the record. Gloria Dunn, Planning Department
representative, read the favorable recommendation of the Planning
Commission into the record. Ms. Dunn stated that there are three
conditions and six Operation Standards associated with this request.
Pat McNear, of Scott Realty, came forward to represent the applicants.
Commissioner Kirby moved to approve the request for a Use by Special
Review for a Single family dwelling for Joesph and Elaine Hoff, subject
to the conditions and six Operation Standards as recommended by the
Planning Commission. Commissioner Yamaguchi seconded the motion and it
carried unanimously.

approval based upon the recommendations and conditions as outlined and
amended by the Department of Planning Services staff and the testimony heard
by the members of the Planning Commission. Motion seconded by Louis

Joseph Hoff, applicant, reported it is their intent to purchase this sixty
acre site and build a single family residence on the property. The Zoning
Ordinance states that there must be eighty acres of irrigated land for a
building site. Therefore, they are asking for a Use by Special Review
Permit to building a home on this site. The property will remain in
agricultural farmland as it is now.

APPEARANCE:
Thomas E. Hellerich, Attorney, Dinner, Hellerich, and Lazar, represented the
applicants. He stated they have received the staff comments, conditions,
and operation standards and have no objections to anything outlined. They
have submitted written materials of what they would like to do with this
property. The property is only three miles from the city of Greeley. 'They
have a petition with four hundred and forty-four signatures from residents
in Greeley and the surrounding area stating that there is a need for this
type of facility in the area.

Joyetta Meyer explained the type of operation they are planning for this
area. Presently veterinarians are the only place a person may leave their
dog of cat if it needs to be boarded and their services are limited. The
cages are small and there is seldom an exercise area. She explained the
physical layout of the kennel area which would make it virtually impossible
for any pet to escape unless it was still with the owner being brought to
or taken from the kennel. There will be concrete walls between the runs so

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff
that the applicant has shown compliance with Section 24.3. 1 et
seq. of the Weld County Zoning Ordinance as follows:
- The proposal is consistent with the Comprehensive Plan
and is consistent with the intent of the Agricultural
Zone District. The proposal does not appear to have any
adverse impacts on the agricultural interests of the
County or the environment;
- The use is both compatible with existing agricultural
activity and with future agricultural use as identified
in the Comprehensive Plan;
- The Greeley Planning Commission recommended no objection
to the proposal;
- No overlay districts affect the site;
- Use by Special Review Operations and Design Standards
provide adequate protection of the health, safety and
welfare of the neighborhood and County.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The attached Standards for Use by Special Review be adopted and
placed on the Use by Special Review plat prior to recording.

2. The prescribed Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on the subject
property until the Use by Special Review plat has been delivered
to the Department of Planning Services office and the plat has
been recorded in the office of the Weld County Clerk and Recorder.
3. The Use by Special Review plat shall be corrected to show a twenty
foot (20') right-of-way reserved on the west side of Weld County
Road 31.
OPERATION STANDARDS

1. The permitted use shall be a single family dwelling as described in the
application materials file with the Department of Planning Services and
subject to the Operation Standards listed hereon.
2. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
3. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
4. Representatives or members of the Weld County Health Department and
Weld County Department of Planning Services shall be granted access
onto the site at any reasonable time in order to insure the operations
carried out on the site comply with the Operation Standards stated
hereon and all applicable Weld County Regulations.
5. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the Standards as stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
6. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

Dear Ms. Dunn,
I have contracted to purchase 60 acres, more or less, located in the
South 1/2 of the South 1/2 of the Southeast 1/4 of Section 9, Township
6 North, Range 66 West of the 6th P.M. in Weld County. The boundaries
of this parcel are Weld County Road 70 to the south, Weld County Road
31 easterly, the quarter-section line northerly and a natural drainage
ditch running in a southeasterly direction for the west boundary.
This parcel is currently in irrigated crop land. We wish to continue to
operate this land as an irrigated farm and build a dwelling on the site
for our residence. If the drainage ditch creating the westerly boundary
were located on the half-section line, this parcel would be a true 80
acre parcel and comply with the comprehensive plan to obtain a building
permit.
The existing surrounding properties are agriculture farmland and five
existing estate dwelling sites are to the immediate south. The distance
from where we intend to build to the nearest residential structure is
approximately 1,200 feet. We intend to create one additional access on
to Weld County Road 31 and will construct an adequate septic system for
sewage. We wish to begin construction of a residence upon approval of
this application, if not possibly sooner, and should be completed within
four months.
This proposal is consistant with the Weld County Comprehensive Plan as
it will take minimal land out of crop production for the building site
and will actually put waste land back into production as we will move
a considerable amount of earth to allow for efficient irrigation to
accomodate this parcel and provide a more favorable lay of the land.
I believe this parcel is located in the City of Greeley overlay district
as it is within two miles of the extended Greeley City Limits.
