HomeMy WebLinkAbout850788.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR OIL AND GAS PRODUCTION FACILITY IN THE C-1 (NEIGHBORHOOD COMMERCIAL) AND R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICTS - RA RESOURCES, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 10th day of July, 1985 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of RA Resources, Inc. , 1101 29th Street Road, Greeley, Colorado 80631 , for a Use by Special Review for an oil and gas production facility in the C-1 (Neighborhood Commercial) and R-i (Low Density Residential) Zone Districts on the following described real estate, to-wit: E' NWT, Section 4 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4 . 2 of the Weld County Zoning Ordinance as follows: a. All mineral resources are fixed in location. The mineral extraction industry is, therefore, restricted in its operation to those areas where the resources lay. The subject site is zoned C-1 /1 f 850788 �rLl1�i2 Page 2 RE: USR - RA RESOURCES, INC. (Neighborhood Commercial) and R-1 (Low Density Residential) , but the subject site is not platted for commercial or residential development. The Comprehensive Plan policies encourage mineral extraction prior to development. Commercial and residential development on the subject site could reduce the feasibility of ever developing the minerals in question. Therefore, the proposal is consistent with the policies of the Weld County Comprehensive Plan. b. The proposal is allowed as a Use by Special Review in Commercial and Residential Zone Districts. c. The Greeley Planning Commission has recommended no objection to this proposal. Their concerns, however, are addressed in the Operation Standards. d. The attached Operation Standards will make the proposal compatible with existing and future development of the surrounding area as permitted by the existing zoning and with future development as projected by the Comprehensive Plan of the City of Greeley. e. The use would be compatible with the existing surrounding land-uses . Agricultural production uses exist on the subject site. f. The proposed development is not located within the Floodprone (FP-2) District of the site. g. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an oil and gas production facility in the C-1 (Neighborhood Commercial) and R-1 (Low Density Residential) Zone Districts on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: Page 3 RE: USR - RA RESOURCES, INC. 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the plat has been delivered to the Department of Planning Services Office and compliance with Operation Standard #2 has been met. The prescribed Use by Special Review activity shall not occur, and building or electrical permits shall not be issued, until the Use by Special Review plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The applicant and/or operator shall be required to obtain all applicable building or electrical permits for USR-679 :85 : 22 . 4 . The operator shall submit a copy of a policy of insurance in the amount of five hundred thousand dollars ($500 ,000 .00) insuring the applicant and the County against all claims or causes of action made against either or both the applicant and the County for damages to persons or property arising out of the drilling, maintenance, production, or other work done with respect to such proposed oil and gas wells. Such policies shall be written by a company authorized to do business in the State of Colorado. Evidence of the insurance policy shall be filed with the Department of Planning Services. In case the insurance policy required shall lapse or become void for any reason whatsoever, the Use by Special Review Permit shall cease to exist until a new insurance policy is provided and filed with the Department of Planning Services. All well activity shall be shut-down and all operations and production thereof shall be suspended and discontinued, consistent with safety considerations, until the operator provides evidence of insurance in the prescribed amount. 5 . The applicant shall submit a revised mylar plat to the Department of Planning Services Office correcting the tank battery detail as proposed by the applicant in a letter dated May 22 , 1985 . The uses permitted shall be oil and gas production facilities as described in the application materials on file with the Department of Planning Services and subject to the Operation Standards listed hereon. 2 . Petroleum products and compressed flammable gases are hazardous substances per C.R.S. 29-22-107 (2) (a) . Prior to drilling, the applicant shall provide a list of the maximum quantities of hazardous substances expected at the sites and emergency phone numbers to the State Health Department, Division of Waste Management; the Weld County Emergency Response Coordinator; and the Western Hills Fire Protection District. Evidence of this listing and emergency phone numbers shall be provided to the Department of Planning Services prior to the issuance of building permits. 3 . The drilling and production of any well shall comply with the Colorado Oil and Gas Conservation Commission regulations pertaining to oil and gas drilling rules. The applicant shall also comply with the City of Greeley' s oil and gas drilling requirements. 4 . The applicant shall comply with all Western Hills Fire Protection District requirements. 5 . Prior to start-up of the activity, the operator shall provide the Western Hills Fire Protection District a list of four names, phone numbers , and addresses of responsible parties it can contact in case of an emergency. 6 . Prior to start-up of the activity, a metal sign shall be placed at the entrance to the well site indicating the name and telephone number of the person (s) to contact in the event of an emergency. 7 . Prior to, and at the conclusion of any flaring, the Weld County Communications Center shall be notified. 8 . An electric pump shall be used in conjunction with any producing oil well on the site. Page 2 OPERATION STANDARDS - RA RESOURCES, INC. 9 . All oil and gas production facilities shall be designed to meet the following standards: a. The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank. b. A six foot chain-link fence with a three-strand barbed wire top shall enclose the tank battery cluster and the well head. 10 . Brine water produced at the site during oil and gas production shall be disposed of by formation injection or disposal into a commercial brine disposal site. 11 . Drilling muds can be used as an agricultural enhancement. The drilling muds must be applied and disked into sandy soils with the landowner' s consent. 12 . Upon cessation of the proposed use, the oil and gas production facilities shall be removed and the land shall be reclaimed to its prior use. 13 . In the event that a final plat subdivision application is submitted within the subject Use by Special Review area to the Weld County Planning Department or the City of Greeley Planning Department, the Operation Standards of USR-679 : 85 :22 shall be reconsidered through the Use by Special Review application process. The intent of this standard is to review the appropriateness of landscaping around the tank battery area and not the proposed use. 14 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 15 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 .6 et seq. , of the Weld County Zoning Ordinance. 16. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 18 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. They have met with the city of Greeley and will be drilling and casing according to their recommendations. They have reviewed the recommendations, conditions, and Operation Standards as outlined by the Department of Planning Services staff and are in agreement with them. Tape 207 — Side 1 The well sites will be about eight hundred feet from the nearest residence. The Chairman called for discussion from the audience. Robert Francis, surrounding property owner, asked if they had already leased the mineral rights for these wells. He is not opposing this proposal, but he concerned about groundwater. Jim Taylor, surrounding property owner, stated he is concerned with the noise and traffic that would be going along with the drilling activity. Keith Abbott reported there will be a lot of traffic until the well has been drilled and fracted, but after that there should not be a lot of additional traffic. Also, they have leased the mineral rights and there will be no pool resources. Petroleum products and compressed flammable gases are hazardous substances per C.R.S. 29-22-107 (2) (a) . Prior to drilling, the applicant shall provide a list of the maximum quantities of hazardous substances expected at the sites and emergency phone numbers to the State Health Department, Division of Waste Management; the Weld County Emergency Response Coordinator; and the Western Hills Fire Protection District. Evidence of this listing and emergency phone numbers shall be provided to the Department of Planning Services prior to the issuance of building permits. 3. All oil and gas production facilities shall be designed to meet the following standards: - The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank; and - A six foot (6') chain-link fence with a three (3) strand barbed wire top shall enclose the tank batter cluster and the well head. Upon cessation of the proposed use, the oil and gas production facilities shall be removed and the land shall be reclaimed to its prior use. 13. In the event that a final plat subdivision application is submitted within the subject Use by Special Review area to the Weld County Planning Department or the City of Greeley Planning Department, the Operation Standards of USR-679:85:22 shall be reconsidered through the Use by Special Review application process. The intent of this standard is to review the appropriateness of landscaping around the tank battery area and not the proposed use. 14. ADDENDUM Attached to and made a part of that certain application for Use By Special Review dated May 10 , 1985 submitted by R A Resources , Inc . The purpose of this application is to obtain approval for a drill site . The site will be located in the SW4 of the NW4, Section 4 , Township 5 North , Range 65 West (refer to map) . This proposal is consistent with the Weld County Comprehensive Plan in that a very small amount of acreage ( i .e . 1 acre per well ) will actually be taken out of agriculture production. Even though this District has been zoned R-1 and C-1 it is basically agriculture and industry land. The well site will be at least 500 feet from the nearest dwelling unit . All agriculture land will be preserved as much as possible and the surface owner of the actual drill sites will be reimbursed for all losses incurred resulting from oil and gas production. All requirements pertaining to oil and gas drilling 'and production will be complied with. Safety will be our prime concern. Equipment and structures at the well site will consist of one ( 1 ) 400 barrel oil holding tank , one ( 1 ) 100 barrel water holding tank , one ( 1 ) horizontal separator , one ( 1 ) meter house , and the well-head valve . The highest structure will not exceed 20 feet . All distance requirements will be complied with . Structures and equipment will be painted with company colors (white with red trim ) , and a fence will be erected around the battery site . A berm will be built around the two tanks and will be of sufficient height and strength to contain liquids in the tanks in the event of a leak , assuming both tanks are full . Upon the abandonment of the well the hole will be plugged in accordance with the Colorado Oil and Gas Conservation Commission regulations , and the abandoned well site will be restored to a condition substantially similar to the original contours and condition or better . Vehicular traffic into the site will be minimal and will consist of daily inspections made by employees in pick-up trucks and approximately once a week a tanker truck will go into the site on the access road to load oil from the oil holding tank . Any water produced from the well in conjunction with the oil and gas produced will be separated and held in the water holding tank. Tank batterys will be located 100 feet from the well head and the well site is more than 300 feet from the nearest structure . Our wells will be in compliance with both the Western Hills Fire Department and the Eaton Fire District . "No Smoking" signs will be posted. In conclusion, we will comply with all relevant ordinances , both local and state . We will work in conjunction with the landowner in order to minimize damage to agriculture lands . The natural gas from these wells will be sold to Greeley Gas Company for local use .
