RE: APPROVE REQUEST UNDER SECTION 13 C. OF THE WELD COUNTY
SUBDIVISION REGULATIONS - ROBERT AND ANTHONY BAKER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , Robert and Anthony Baker submitted requests that
they be allowed to obtain two building permits on two parcels of
land which had previously been divided illegally, and
WHEREAS, the parcels of land for which the requests are being
made are described as follows:

Weld County, Colorado
ROBERT BAKER
Part of the NE4, Section 9 , Township 1 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, the Board, heard all of the testimony and statements
of those present, has studied the request of the applicants and
all of the exhibits and evidence submitted in this matter and,
having been fully informed, finds that this request shall be
approved for the following reasons:
1 . The parcels shall be accessible from an existing
public road.
2 . The parcels will have access to an adequate water
supply.
3 . The parcels will have access to an adequate means
for the disposal of sewage.
4 . The issuance of the building permits will not
change the essential character of the neighborhood.
5 . The procedure defined in Section 13 C. is not being
utilized for the purpose of evading the
requirements and intent of the Weld County
Subdivision Regulations.

6 . The owners do not own a parcel of land adjacent to
the subject parcels.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Robert and Anthony
Baker be , and hereby are, granted rights for residential building
permits on the hereinabove described parcels of land.
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the applicants meeting the requirements of the Geologic
Hazard Overlay District Development Permit which is contained in
Section 27 . 1 of the Weld County Zoning Ordinance.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 30th day of
January, A.D. , 1985 .

Re: Request under Section 13 C. of the Weld County Subdivision Regulations.
Dear Commissioners:
The attached materials are In reference to a request from Robert and Anthony
Baker to obtain two (2) building permits on two (2) parcels of land. The
subject parcels have been divided illegally and are in violation of Section
1-2 (C) of the Weld County Subdivision Regulations. The parcels of land on
which the requests are being made are described as the 51 , Block 1, Scotts
Acres Subdivision and part of the NE1, Section 9, TIN, R68W of the 6th P.M. ,
Weld County, Colorado. The property is located approximately two and
one-half (21-x) miles northeast of Erie.
The Bakers have submitted a letter dated January 3, 1985, which explains
their reasons for making this request. A copy of Section 13 C. of the Weld
County Subdivision Regulations has been provided by the staff. Section 13.
C. contains the criteria that the Board must consider in this matter.
Based upon the submitted information and policies of the County the
Department of Planning Services staff recommends that the request be denied
for the following reasons:
1. Weld County Subdivision Regulations provide the proper procedures for
subdividing land within and out of platted subdivisions. The proper
procedure to legally divide lots within a subdivision would be to
resubdivide the subdivision as per Weld County Subdivision Regulations
Section 6-4 (C) .
The granting of building permits for additional lots created illegally
and outside of the process established by the adopted Weld County
Subdivision Regulations is contrary to and evades the intent and
purpose of these regulation. It is not fair to those landowners who
have followed the guidelines set forth by the Weld County Subdivision
Regulations. It is not fair to those land owners who have purchased
property with the understanding that subdivisions in Weld County are
developed from guidelines prepared for citizens input and adopted as an
Ordinance by the Board of County Commissioners. The granting of
building permits on land divided without knowledge or regard for the
established process encourages others to disregard the Weld County
Subdivision Regulations and Zoning Ordinance.
2. The subject sites are located in a Geologic Hazard Overlay District
area. Section 52.4 of the Weld County Zoning Ordinance states in part
that: "Any person applying for. . . Subdivision of land including
Recorded Exemptions, . . . within the Geologic Hazard Overlay District
area shall apply for and obtain a Geologic Hazard Overlay District
Development Permit before any of these applications are considered
finally approved by the Board of County Commissioners."
The granting of these building permits in a Geologic Hazard Overlay
District is contrary to and evades the Weld County Zoning Ordinance
process established to promote safe use of Geologic Hazard areas.

Lot size requirements addressed in the I.S.D.S Regulations
(Sec. 3.3 (B)) state:
B. The maximum size of the lot or building site that can
be used for an individual sewage disposal system can-
not exceed twenty-five (25) percent unless a waiver
has been obtained and approved by the Board of Health
for experimental or water conservation methods.

Subject: Building Permit
Commissioners:
This is to request a special building permit for construction on
land divided in an unproper manner, and currently owned by Anthony
Baker and Amy Rozinek.
On August 7, 1984, our firm was contacted by the previous owners of
subject property, William and Ruth Whittaker, wishing to list 2 parcels
of land owned by them on Rd. 7 & 12, in Scott's Acres, Weld County.
They are living in Arizona, and had decided not to return to Colorado,
and wished to sell the properties.
We then went through the customary procedures of listing properties
for sale, that is; obtaining signed listing contracts, ordering
ownership and encumbrance reports from TransAmerica Title Co. , obtaining
copies of separate tax notices on each parcel , showing the parcels on
Lot 1 , and the adjoining acreage taxed individually as 3 parcels in
the assessor's office, and obtaining copy of plat map from the owners.
We then placed the properties on the market through Multiple Listing
Service with the Longmont Board of Realtors.
On October 31 , 1984,Betty Fox from GWF Agency, Inc. in Longmont, brought
us an offer on the 5.17 Acre parcel , from Anthony Baker and Amy Rozinek,
which was accepted by the Whittakers. This contract was scheduled for
closing on December 7, 1984.
While meeting with Anthony and Amy, Mr. & Mrs. Robert Baker, Anthony's
parents, became interested in the adjacent property. They decided to
place an offer on the 3.44 Acre parcel next to the property contracted
for by Anthony and Amy. This offer was accepted and scheduled to close
on December 7, 1984. They wanted to build a home in the future close
to their son.
The Title Insurance was issued by TransAmerica Title Co. , and both
transactions closed as scheduled on December 7, 1984.

On December 10, 1984, Mr. George Fox, the broker for GWF Agency, Inc. ,
called our office to inform us that Anthony had gme to Weld County office
in Greeley to get a Building permit in order to build his "Miles Home"
on the property. He was at that time told they could not issue a permit,
as the property split had never been submitted for approval by Weld County
Planning Office. This was our first knowledge of any problem. We called
the Whittakers and of course, they had assumed when they sold the first
parcel of their Lot 1 to the Atherton's in 1978, that every thing had been
handled, as their Attorney had handled the transaction for them. They
were completely unaware that they had in essence, created a subdivision
improperly.
When we marketed the properties as building sites, we certainly felt they
were complete, as the plat map showed the division of the property. The
properties were each taxed as separate parcels and the Title Company
insured the title and closed the transaction for our firm.
At this point in time, all we can do is plead insufficient knowledge of
subdivision laws and rules in Weld County, and request that the Board
will review all of the attached documentation, and issue a special permit
to Anthony and Amy and the assurance that Mr. & Mrs. Robert Baker will
not have a problem obtaining a building permit in the future on their
property.
As stated above, our firm and the Whittakers were completely unaware
that a subdivision had been created in error. To our knowledge, we had
all the documentation necessary in order to market the properties as
building sites. A survey was ordered and obtained from Big Horn Land
Surveying, and the first time anything seemed to be amiss, was when
Anthony applied for a building permit.
We have put forth our best efforts, to rectify this mistake, and do hope
we have all the documentation necessary, to obtain a special building
permit for each of the parcels involved. If there is any further
information necessary, please advise. We wish to thank you in advance for
your time and consideration in this matter.

Dear Commissioners:
On December 7, 1984, we closed the deal and purchased a parcel
of ground in Weld County. We purchased this acreage right next
to an acreage our son was purchasing, in order to build a home
next to his home, which he is planning to build.
When our son went to get his building permit, he was told that
he couldn't build as the Lot #1 , in Scott's Acres, had been
illegally subdivided.
After talking to our Realtor and with their help in talking to
the previous owners, and the Planning Commission in Weld County,
we are requesting a special permit be issued for our acreage.
The only reason our son or ourselves purchased these acreages
was to build nice homes. If you could look at this area, we
feel you would see that there are a lot of homes on other lots,
and it would not seem to be non-conforming to the area to build
on each of our properties.
We would appreciate anything you can do to help us correct this
problem. Thank you for your time.
