HomeMy WebLinkAbout871761 ORDINANCE 89-K AR2 08537 IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS , AND THE ADDITION OF CERTAIN SECTIONS TO ORDINANCE NO. 89 , WELD COUNTY ZONING ORDINANCE, AS CURRENTLY AMENDED, REVISING AND ADDING CERTAIN PROCEDURES, TERMS, AND REQUIREMENTS BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO: WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners has the power and authority under the Weld County Home Rule Charter and State Statute, including Article 28 of Title 30 , CRS, to adopt zoning regulations for the unincorporated areas of the County of Weld, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has previously adopted Ordinance No. 89 , Weld County Zoning Ordinance, establishing a comprehensive revision of the zoning regulations and zoning maps for the unincorporated areas w H of the County of Weld, and has adopted amendments in Ordinances to a 89-A through 89-J, and WHEREAS, said Ordinance No. 89 , as amended, is in need of revision and clarification with regard to procedures , terms , and requirements therein. z o NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld County, Colorado, that certain existing a sections of said Ordinance No. 89 , as amended, are repealed and re-enacted, with amendments , and that various sections are added or revised to read as follows : H N zCO o O0 Add a new definition for ANIMAL BOARDING to read: t t+] zy The maintaining of LIVESTOCK, other than those owned x N by the property owner and where any of the following m - are provided: shelter, care, confinement, feed, and `O x � water. O 0 Amend the definition for CHILD CARE CENTER to read: z thu A facility other than a SCHOOL or special SCHOOL which is maintained for the care of five or more children o iEy O S71761 C] off O ORD089K no Page 2 RE: ORDINANCE 89-K under the age of sixteen years who are not related to the owner, operator, or manager thereof where said children reside at the facility for fewer than twenty-four hours in any given day, whether such facility is operated with or without compensation for such care, and with or without stated education purposes . Add a new definition for COMMERCIAL JUNK YARD to read: An open or enclosed area where any waste, JUNK, or used or second hand materials are bought, sold, exchanged, stored, baled, packed, disassembled or handled, including, but not limited to, scrap iron and other metals , paper, rags , rubber tires and bottles. A COMMERCIAL JUNK YARD also includes the storage or keeping of DERELICT VEHICLES . Add a new definition for DERELICT VEHICLE to read: y0 DERELICT VEHICLE: A vehicle that is inoperable 1/4O h' (unable to move under its own power) ; partially or totally dismantled; wrecked or damaged; or lacking proper equipment to the extent that it would be unsafe or illegal to use on PUBLIC road rights-of-way or K n otherwise not equipped with lamps and other equipment o as required in Sections 42-4-202 to 42-4-228 , Colorado z r Revised Statutes . A NONCOMMERCIAL JUNK YARD may also include the storage or keeping of DERELICT VEHICLES . The NONCOMMERCIAL JUNK YARD shall be totally enclosed within a BUILDING or STRUCTURE or visually SCREENED from all adjacent properties and public rights-of-way. Amend the definition for SETBACK to read: SETBACK: The horizontal distance between any BUILDING and the established PUBLIC or private STREET right-of-way line. If the abutting PUBLIC STREET is designated to he upgraded to a higher classification as defined by the Weld County Transportation Plan necessitating additional right-of-way, then the qtr SETBACK shall be measured from the future right-of-way line. The future right-of-way line (measured from the H centerline of the road) is determined by dividing the needed right-of-way as defined below in half. The following is a list of the right-of-way needed for road designations as defined in the Weld County o n Transportation Plan. • o ',b N z � a. Amend Section 24 . 4 . 3 to read: Where reasonable methods or techniques are available to mitigate any negative impacts which could be generated by the proposed USE upon the surrounding area, the Board of County Commissioners may condition the decision to approve the Special Review Permit upon implementation of such methods or techniques and may require sufficient performance guarantees to be posted with the COUNTY to guarantee such implementation.
