RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL -REVIEW PERMIT FOR FIGHT COMMUNICATION TOWERS ON TWO LOTS IN THE A (AGRICULTURAL) ZONE DISTRICT - JOHN W. BROSNAHAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, -pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of October, 1988 , at the hour of 1 : 30 p.m. in the Chambers of the Board for the purpose of hearing the application of John W. -Brosnahan, c/o James A. Gustafson, 1010 9th Avenue, Greeley, Colorado 80631 , for a Site Specific Development Plan and Special Review -Permit for eight communication towers on two lots in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SW* of Section 30 , Township A North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was _represented by James A. Gustafson, and WHEREAS, Section 24 . 3 of the Weld County Zoning Ordinance provides standards for review of said _Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Z-oning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .3 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Agricultural goals and policies of the Weld County Comprehensive Plan. The location of the proposed towers will not affect prime agricultural land and will not affect the agricultural uses in the area. 7j " !`) /. ` 881001 Page 2 RE: USR - JOHN W. BROSNAHAN b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a use by special review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include Weld County Road 49 , Weld County Road 40 , oil and gas production and dryland pasture. d. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the Weld County Comprehensive Plan . This area is expected to remain agricultural. No objections have been received from surrounding property owners . e. The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. f. No overlay districts affect the site. g. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for eight communication towers on two lots in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners . 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 881001 Page 3 RE: USR - JOHN W. Prior to the issuance of building or electrical permits, the applicant shall demonstrate compliance with all Federal Aviation Administration regulations to the Department of Planning Services. 4 . Prior to recording, the Special Review plat shall be amended to show all existing and proposed structures on the site . 5 . Within thirty (30) days from the date of approval by the Board of County Commissioners, an Intermodulation and Signal Saturation Study shall be submitted to the Weld County Information Services Agency for review and approval. A copy of this study, approved by the Weld County Communication Agency shall be submitted to the Department of Planning Services. The Special Review Permit is for eight additional communication towers on two lots in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . Any frequencies transmitting from the towers shall require an intermodulation and signal saturation study to be approved by the Weld County Communications Agency. Future studies shall be approved prior to the addition of the frequency operating from the towers. 4 . Any harmful interference caused by any frequencies transmitted from the towers shall be corrected by the applicant at the applicant' s expense. 5 . All construction on the property shall be in accordance with the requirements of the Weld County -Buil-ding Code Ordinance. 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 7 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 8 . Personnel from the Weld County Health department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 9 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld _County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Washington, D.C. 20554 ATTN: Mr James Voigt Mr George Dillon I wish to file a complaint about two radio towers that have been installed 31 miles SSE of Easton Valley View Airfield. They are located on the land located in the NE of the SW of section 30. Township 4N range 64 W of Weld County, Colorado. These towers are approximately 175'-200' tall, are, unpainted and unlighted, they are silver in color and blend into the surrounding terrain. These towers create a potential hazzard to aircrafts. I must point out that aircraft operations,(helicopters and airplanes), can be conducted in sparsely populated areas at altitudes less than the height of these towers in accordance with FAR 91.79 and FAR 137. I have had a problem seeing the towers myself, and have had several other pilots complain they could not see them! ! The towers should be painted and lighted before somthing catastrophic happens. Baumgartner : 1 have reviewed the above for a submitted request from John W. Brosnahan -for a Site Specific Development Plan and a Special Review permit for 8 -communication towers on two lots in the A (Agricultural ) zone district . The parcel of land is described as the SW 1 /4 of Section 30-4-64 . 7 can not find in the documentation as to the height of the towers to be used, and the necessary pad size needed for each tower . The soils in the area are extremely sandy and are very prone to wind erosion . Without proper site preparation wind erosion could sever-ely jeopardize the tower itself . Miller, District Conservationist, Greeley Field Office concerning Weld County Case Number USR-854. I agree _completely with Mr. Miller's concern about the potential for wind erosion i-n the sandy soil. In is especially a problem when sites are prepared for gas and oil wells by stripping the land over an area in excess of an acre. But, in the case of a typical tower installation, a hole approximately 4 ft by 4 ft by 4 ft deep is dug for the tower base and three holes 6 ft by 8 ft by 6 ft deep are dug for the guy wires. This disturbs a minimum of the soil and in the case of the two existing towers that were installed three years ago there has been no sign of soil erosion. The vegetation has completely returned and there is no greater potential for erosion at the areas that have been disturbed than any other areas. Therefore, the areas of disturbed soil are so small that no problem is anticipated, but if any soil erosion is noted appropriate steps will be taken to overcome any problem. Two of-these towers have been installed and two are subject to the pending special use review. During the course of the appli- cation, I had occasion to speak with the FAA on a number of occassions concerning my plans. They have been very cooperative and helpful. Typically, towers less than 200 ft require no special approval, light- ing, or painting. But, since my farm is approximately 3.5 miles from the Easton (Valley Vu) landing strip, I was required by FCC and FAA regula- tions to fill out FAA form 7460 for any structure that exceeded the 1 ft of height for 100 ft distance. The FAA indicated that my activities would require no special marking our lighting because of the proximity to Easton. But the FAA also indicated, since the property was located on high ground and in an area of relatively heavy air traffic, that one of the four towers of the application should be equipped with a single marker light as a precaution. This is not the 1240 watt flashing beacon light that is used on large towers, but rather a single 114 watt bulb in a red housing, simi- lar to the one on top of the mix mill facility located at Miller Feedlot, 1 .5 mi north of the site. The FAA indicated that towers 160 ft and shorter would need no light- ing and that the requested lighting would be adequate for towers up to 260 ft in height. I have attempted to keep as many of the proposed towers as possible 160 ft and shorter. Only six are higher than 160 ft because of technical requirements and I have FAA approval for four and a verbal com- mittment for the remaining two. I propose to provide the recommended lighting on all six of the 199 ft towers to maximize the safety of the in- stallation. Initial operations utilized a generator and the existing two towers have remained at 160 ft until I was able to bring regular power into the site. The existing towers will be completed and the lighting installed over the next month or so. A final electrical inspection will be requested at that time. Since grade school I have had a fascination with electronics and com- munications. I obtained my amateur radio license while in high school and have always dreamed of having enough land to some day build a -home and install antennas to allow me to com-municate with my friends and fellow amateur radio enthusiasts around the world. My interest in electronics led to a career in science and errgineering, culminating in the -establishment of Tycho Technology over ten years ago. This company specializes in providing equipment for universities and the government for the study of-the atmosphere. Tycho is located in Boulder and employees over 75 people. The success of Tycho has allowed me to pursue my -dream of owning a farm and enjoying my hobby. I locked for the right place for five years before I decided to buy Vern Johnson's place. The location was ideal for my dream. The farm is locat- ed on high ground which is perfect for my antennas. The location is rela- tively isolate-d with few nearby neighbors while still being close to Greeley. There are a number of other antennas in the area and land use is agricultural with little chance that it will change significantly in the near future. I was under the impression-that I had six parcels of land that made up the property since I received six separate tax notices and I ha-d purchased the farm in three separate transactions. This would have allowed me two antennas per parcel for a total of up to twelve antennas. The county con- siders that I only have two parcels and has requested that I go through the special use review process for my antennas. 88100'1 I feel that it is important to not -only work closely with the county but also to work closely with my neighbors to -explain who I am and what I plan to accomplish so that everyone will understand why this project is so important to me. I plan on building a home this fall on the site where the mobile -home w as. I will be moving to -the farm as soon as it is completed and hope to begin to restore the property to good condition. Because I don't have an agricultural background other than the summers I spent on my grandfather's farm in the Ozarks in my youth, I hope to learn from the area residents the best way to improve the property. I am considering either -restoring it to native grasslands or opening it up for grazing. I especially want to maintain an environment conducive to the wildlife in the area. There are a number of deer that spend a lot of time grazing as well as two Great Horned Owls that live there and I would like to provide a natural habitat for them and the other inhabitants. I am also considering what to do with the hog barns. I will probably experiment with one and convert it to a green mouse. If this works out well, I would then convert the others. In exchange for any advice and help on how best to care for the land I would be very happy-to explain my plans and my hobby. In addition, I am _quite involved with computer systems and I would be happy to provide any -help or advice on their application in agri-business. Only the structures at A have any -relationship to the matters before the county planners. They are used to house my equipm-ent until I receive permission to complete the installa- tion. At location A there are two 40 ft shipboard containers and a 20 ft by 20 ft portable building. The containers are being used for storage and the build- ing contains my radio equipment. These structures are located in a local depression and are hidden from view. The radio equipm-ent will be relo cated to my home when it has been completed and the two containers will be moved behind the barn once the communications towers have been in- stalled. There currently are six permanent structures on the property and these were in existence prior to my purchase of the property. At location B there are four tog barns each approximately 225 ft long and 12 ft wide. I am currently cleaning up the mess that these were left in and I am considering my options on what to do with them. They are too good to just tear down and it would be too expensive anyway. I am consid- ering converting one to a green house as an experiment as soon as the eco- nomics are obvious and the others would possibly follow aver the course of a few years. In addition there is also a 90 ft long 40 ft wide steel building constructed by Preston building. I have been repairing it and cleaning it out. At location C there is a well house that remains from before the mobile home burned. I am planning on this location on which to build my home. It has already been atiome site and the utilities are already installed. They contained government surplus optical (photonraphy and video camera) equipment as well as a radio remote sensing system for atmospheric research. (g) The type, size, weight and frequency of vehicular traffic associated with the proposed use will be only the traffic that will be required for the normal use of the applicant's property. However, during the construction phase, concrete trucks will be required to travel in and out of the subject property. (h) There should be no necessity for any sewage facilities for this proposed use. (i) There are no additional fire protection measures being considered for the proposed use. These communication towers are constructed of galvanized steel and, therefore, require no additional fire protection. (j) There will be no animals associated with the proposed use. -2- 881001 (k) There should be no waste stockpile associated with the proposed use. (1) There is no proposed type of storm water retention facilities associated with the proposed use. (m) There is no debris, junk or other waste • associated with the proposed use and, therefore, the only plan of removing any debris, junk or other waste will be by applicant taking it to the Weld County landfill. (n) There is no proposed change in the landscaping or any erosion control measures -associated with the proposed use. However, applicant does intend to maintain the agricultural nature of the subject property, which consists of one-third volunteer rye, one-third sage/brush and one-third weeds. Applicant is considering the possibility of opening up the subject property to grazing or to restoring the land to native grassland. (o) There should be no required reclamation procedures to employ with this use because the proposed use will in no way damage or change the subject property. However, if and when applicant ever ceases using the communication towers they will be removed and taken with him to wherever he relocates. (p) The timetable for construction of these communication towers is not any set time period because this is an avocational use. Construction, however, should be completed as time and money permits and finished during the next two years. 3. Materials and support documents submitted as a part of this application: (a) The proposed use of adding eight additional communication towers to the existing permitted four communication towers on the subject property is consistent with the Weld County Comprehensive Plan because the only travel associated with the proposed use will be that associated with the applicant's normal use of his property. The nearest neighboring residential structure is more than one-half mile from the proposed communication towers and neighbors in the immediate area should not be affected by the communication structures because there already exists an A.T. & T. tower to the north, an M.C.I. communication tower to the north and an a Weld County communication tower to the southwest of the subject property. (b) There have been no preliminary discussions with city or town officials because the nearest town to the subject property is the town of Kersey and it is located approximately eight to nine miles to the north. The subject property is outside the long range growth area of the town of Kersey and the proposed use does not appear to be incompatible with the future growth or the land uses. 8810'i-1 -3- (c) Since the proposed use actually does not in any way change the present land use of the subject property and is only adding eight additional communication towers of similar highth and structure, it is the applicant's belief that this proposed use will not in any way affect the health, safety or welfare of the inhabitants of the neighborhood or Weld County. The nearest neighboring residential structure is more than one-half mile from the proposed communication towers. See Exhibit "E" attached hereto for further details on safety aspects of the towers. (d) The proposed communication towers will be compatible with the existing surrounding land uses because the present land uses are as follows: (i) To the north of the subject property there is an agricultural use. Approximately one and one-half miles north there exists an A.T. & T. communication tower and approximately four and one-half miles to the north there exists an M.C.I. communication tower. (ii) To the south of the subject property there is an agricultural use. Approximately four to five miles in a southwesterly direction there exists an approximate 240 foot high communication tower of Weld County. (iii) To the west of the subject property there is an agricultural use. (iv) To the east of the subject property there is an agricultural use. (e) The proposed use will be compatible with future development of the -surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of Weld County because there already exists two communication towers upon the subject property and two more communication towers have already been permitted and will be constructed in the near future. The additional eight communication towers will al-so be ideally suited for the area because there already exists several communication towers to the north and south of the subject property. The applicant has no plans to change any of the existing rural residential and agricultural uses that presently exist upon the subject property. (f) The use by special review area is not located in a flood plain, geological hazard or theWeld County Airport overlay district area. The subject property did have a coal mine that was once located upon the property, but the coal mine had been backfilled and the proposed communication tower sites are well removed from the area of the mine. Although I submitted addition- al information a few months ago, its primary purpose was to establish my professional credentials as technically competent to undertake a task of this nature, and to provide some indication of the potential for indirect benefits from an avocational interest. BACKGROUND During the summer between second and third grades, while my family was living in Springfield, Mo, the teenager next door taught me to build crystal radios. My best effort, using a cardboard-tube wound with wire for a tuner, could only receive two broadcast stations. But for an -eight year old boy, it was very -exciting. The following summer was spent on my grandfather's (on my mother's side) farm, where I discovered his old -three-band console radio. During the evenings I could hear people chatting with each other about their interest in radio, about their-families, the weather, and a myriad of other topics. This was my first introduction to amateur radio. My grandmother (on my father's side) was the telephone operator at the public library. I would sometimes visit her on Saturday mornings, and during the course of these visits, I discovered the books on radio and on science in general and astronomy in particular. By-the time I was four- teen, I had learned enough about radio-to pass the amateur radio examina- tion, a test on theory, operating procedures, and regulations. This ulti- mately led to majoring an astrophysics at the University of Colorado, and a career in research and engineering. Since the age of fourteen I have dreamed of having enough land to build antennas for operation on all -of the amateur radio frequency bands. With this in mind, I began to collect the necessary equipment more than ten years ago. And I also began to search for the land needed for my antennas. The land needed to be rural to eliminate orat least reduce the electrical noises generated both by industry and even by home appliances that might interfere with reception. I wanted relatively high ground for best recep- B81001. tion, and it was important to find a site where my use would not interfere with the neighboring land uses. About four years ago I located approximately 8-0 acres in Weld county that seemed ideal. Although the land was relatively isolated and there were no other homes within a 1/2 mile of my planned antennas, the prop- erty was only 11 miles from Greeley and was affordably priced. The sur- rounding uses consisted -of grazing land, a feed lot, a turkey farm, and a few communications towers. I subsequently purchased two additional parcels, and now I own the quarter section. Since then an additional mi- crowave tower has been installed by MCI, and Weld county has installed a large communications tower in the area. WHAT IS PLANNED My plans involve building a home on the site where there previously was a mobile home and becoming a member of the rural Weld county com- munity. I like the rural life because of the summers spent on my grandfather's farm and I am improving the property by cleaning up the area. There is currently no agricultural use -of the land and I am consider- ing opening it up for grazing or restoring the land to native grasslands. The most recently acquired piece of land is an abandoned hog farm. I have begun cleaning up the buildings and have donated the equipment to a num- ber of neighbors in order to assist them in their agricultaral endeavors. I am interested in the conservation of natural resources and plan to main- tain an environment appropriate for the deer, pheasant, and other wildlife now residing on the property. WHY TWELVE TOWERS My interest in radio spans the complete spectrum as authorized by the Federal Communications Commission. To fully enjoy my hobby I want to be able to build -optimized antennas for each frequency. There are current- ly nine shortwave bands authorized for amateur use as well as numerous vary -high frequency and microwave bands. I purchased a quarter section in order to have enough land to install my antennas with no interaction be- tween them. As I acquired the properties at different times I believed that I had a total of six parcels since I received six tax notices. Under the regulations in effect at the time, I had the right to construct two towers per parcel. I subsequently based all of my antenna designs around the plan of twelve towers and subsequently acquired the towers in anticipation of 881001E 4/ "[ installing them as time permitted over the following years. I have consolidated the towers into groups to lessen the visual impact as well as to enhance the technical performance. There are two groups of four towers and two groups of two towers. For example, the four Rohn 25 towers are grouped together and separated from the other towers for op- timum performance. The four towers are used together as one antenna, in the same manner that many AM broadcast stations use multiple towers to provide directivity to provide improved performance in a particular direc- tion. In a like manner the other towers are grouped together and located in such a way as to meet technical requirements. WHY THIS LOCATION The site was selected because it is rural, has no dwellings within 1/2 mile of the proposed towers, is near Greeley, and was affordably priced. It is also located on high ground and is surrounded by grazing land. The site was most recently a hog farm and a cattle feed lot is located 1 1/2 miles to the north and a turkey farm is located 1 1/2 miles to the east. These operations would tend to limit any residential growth in the sur- rounding areas. In addition there are already a number of communications towers in the vicinity establishing precedent. WHAT IS THE EFFECT ON THE SURROUNDING AREAS There will be no effect on the surrounding areas. There are no nearby -homes. There is no disruption of the view of the mountains since the properties to the east can not see the mountains due to the ridge. The property to the east is a rance encompassing 1 1/2 sections and the main home is located more than 1 1/2 mile from the proposed towers. There is no pollution or noise associated with the installation. SAFETY Although the towers are for non-commercial use, I have selected tow- -ers of the -type that are most often used in commercial installations be- cause of their strength and reliability. Eleven of the twelve towers are manufactured by Rohn Manufacturing of Illinois and are typical of the type of towers used for business and public safety communications. My profes- sional experience includes tower system design and installation for the federal government in environmental conditions from Alaska to Puerto 881001 Rico. I have constructed towers for a number of broadcast stations, in- cluding two in Boulder county, where the winds are extremely severe. I have also built towers for a number of local government agencies, includ- ing ones used used by Boulder county as well as Larimer county. Rohn provides recommended designs for the tower base and for the guy anchors for three wind loading ratings. I have chosen the design for the highest wind load rating and have then added an additional safety factor in addition to the industry standard safety factors included by Rohn. I have never had a tower fail. COMMUNICATIONS EXPERIENCE In addition to possessing an Amateur Radio Extra Class license, and -having been licensed for over 29 years, I also have held a First Class 'Radiotelephone license with Radar endorsement (now called a General Radiotelephone license) for over 20 years. I have testified as an expert witness for the federal government on technical issues involving antenna design and construction. IMPACT ON THE COMMUNITY While I believe that there is no negative impact to either the communi- ty or to nearby property owners, I believe that there is a strong potential for positive impact to the community at large. As part of their charter by the Federal Communications Commission, amateur radio operators are charged with the task of advancing the state of the communications art as well as providing a national resource in times of emergencies. Amateur radio operators are responsible for many of the technical ad- vances made in communications. My interests in the hobby have tended to- wards the technical side rather than the communications side. This in- cludes antenna design as well as propagation studies. I recently provided a packet of information to the planning committee on my professional ex perience, including copies of patents, technical papers, and my testimony before the Congressional Committee on Science and Technology concerning technology transfer. All of this has been an outgrowth of my interest in radio communications and amateur radio over the years. Tycho Technology is a company that I founded ten years ago and now employees approxi- mately seventy people. I have additional business interests that would be moved to Weld county and that may result in additional jobs in the future. I have been actively involved with emergency communications in time "E „ 881001 of need, and as an amateur radio operator I have provided my services for such disasters as the Big Thompson flood and the Comforter mountain for- est fire. I have been actively involved in technical education, including organiz- ing and teaching an amateur radio class that graduated 28 students. This helps to kindle an interest in electronics and may result in career choices. I have founded and/or been elected president of a number of avocational organizations, including the Denver Amateur Computer Society. SUMMARY What I propose to do is the culmination of a lifelong dream to pursue my personal hobby. My professional experience provides the basis for this project to be undertaken in a safe and expeditious manner. Significant effort has been made to locate the site in an area where no negative impact will be felt by the surrounding property owners.
