WHEREAS, the Board of County Commissioners of Weld County, 03 Ul
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and K

WHEREAS, a Road Improvements and Maintenance Agreement w
between Weld County and The Robert Gerrity Company concerning 24th x1/40
Street and Fern Avenue has been presented to the Board, and t4 m

WHEREAS, the terms and conditions are as stated in the
Agreement, a copy of which is attached hereto and incorporated y r
herein by reference, and H

WHEREAS, the Board deems it advisable and in the best

interests of the citizens of Weld County to approve said N
Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County ,,, :'
Commissioners of Weld County, Colorado, that the Road Improvements N
and Maintenance Agreement between Weld County and The Robert
Gerrity Company be, and hereby is, approved. p
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.

COUNTY OF WELD, STATE OF COLORADO
ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
THIS AGREEMENT is made and entered into this 8th. day of July,
1988, by and between the COUNTY OF WELD, STATE OF COLORADO,
hereinafter called "County" and THE ROBERT GERRITY COMPANY,
hereinafter called "Gerrity".
WHEREAS, Gerrity has applied for a Use by Special Review Poto
Permit for oil and gas production facilities in the SANE' of ,-. F..
Section 15, Township 5 North, Range 65 West, 6th. P.M. , Weld '4
County, Colorado, and vi -4
WHEREAS, the Board of Weld County Commissioners granted said
application on July 6, 1988, and K O
WHEREAS, the development of oil and gas production facilities z
allowed by said permit will generate increased heavy truck

WHEREAS, damage to Weld County roads may occur due to said r
increased traffic. H r

NOW, THEREFORE, in consideration of the mutual covenants and x �+
conditions hereinafter set forth, the County and Gerrity
mutually agree as follows: h N

1. The route to haul heavy production n~i
equipment, tank trucks, and heavy truck ° o
traffic shall be via U.S. Highway 34 to % N
24th. Street, thence (i) West on 24th. o
Street to the site in the SW'NE' or (ii) 7y
East on 24th. Street to Fern Avenue, to

2 . If damage occurs to Weld County Roads in G
the area described in USR-832 as being the n
S'NE' of Section 15, Township 5 North, o to
Range 65 West, 6th. P.M. , Weld County, o
Colorado as a result of developing oil and o w
gas production facilities, Gerrity shall
repair such damage.
3. Repair shall include, but not be limited
to, blading and the placement of gravel.
4. The development of oil and gas production
facilities shall run from the time heavy
equipment is mobilized to drill each well
through such time as final production
facilities, such as tank batteries, are
completed.
