HomeMy WebLinkAbout860547.tiff RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT BETWEEN THE TOWN OF LA SALLE AND WELD COUNTY AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement between the Town of La Salle and Weld County regarding the issuance of a building permit and conduct of building inspections on a parcel of land to be annexed by the Town of La Salle, and WHEREAS , after review, the Board deems it advisable to approve said Intergovernmental Agreement, with the terms and conditions being as stated in said Agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement between the Town of La Salle and Weld County be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Agreement. Kirby erfCounty Attorney )� g�WV� Fra a g ch. �� 1),/ / 860547 6 INTERGOVERNMENTAL AGREEMENT -THIS AGREEMENT made this 9tb day of June , 19 86 , by and between the TOWN OF LASALLE, hereinafter referred to as the "Town" and the COUNTY OF WELD, a political subdivision of the State of Colorado, hereinafter referred to as the "County". WHEREAS, in accordance with CRS 29-1-203, political subdivisions may cooperate or contract with one another to provide any function, service or facility lawfully authorized to each of the corporations or contracting units, and WHEREAS, the town wishes to annex a parcel of land adjacent to the town. WHEREAS, the developer of the parcel to be annexed wishes to begin construction prior to annexation of the parcel. WHEREAS, the town is requesting that the town issue. the building permit and make the required inspections prior to annexation of the parcel. WHEREAS, the parcel of land to be annexed to the town is described as part of the SW} of Section 31 , T5N, R65W of the 6th P.M. , Weld County, Colorado, containing 20,048 square feet, more or less. (Exhibit A) WHEREAS, In order to set forth clearly the responsibilities, _obligations, powers and rights of each of the parties, the Town and the County hereby enter into this Agreement. NOW, THEREFORE, in consideration of the recitals, promises and covenants herein set forth, and other good an valuable consideration herein receipted for, the parties agree as follows: 1. The Town shall issue all applicable building permits and collect and retain any and all fees for said permits. 2. The Town shall conduct all applicable building inspections and collect and retain all fees therefor, if any. J. The Town shall assume liability, if any, for the issuance of said permits and building inspections. -WHEREFORE, the respective parties set their hands and seals hereto the day first written above. Box 758 Greeley, Colorado 80_634 Dear Commissioners: There is a distinct possibility that shortly we will be annexing a parcel of land adjacent to the Town of LaSalle. The developer has asked if it would be possible to build the building coincidentally with the annexation process. As you can understand, what will be happening is that we will be annexing this parc-el during the same time that the construction is taking place. Therefore the building permit should technically be issued by Weld County. Our request to you is to let us issue and inspect the building as it is being constructed. We naturally will show you proof that we are annexing the ground. It seems only logical that since this building will be under our control, our Inspection Department should be directly involved in its construction. Sincerely, Bruce C.
