RE: GRANT MOBILE HOME PERMIT NO. 1199 - MAX & JOSIE MARTINEZ
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 6th day of August , 1986, considered the request
of Max and Josie Martinez for a mobile home to be used as a
principal dwelling, and
WHEREAS, said mobile home is to be occupied in an
A-Agricultural Zone District on a parcel of land being more
particularly described as follows:
Lot 9 and the N1 of Lot 10 , Block 5 , east side
addition of Eaton, Weld County, Colorado
WHEREAS , the Board of County Commissioners , having heard the
testimony, finds that said request should be granted subject to
the following conditions : 1) The applicant shall apply for a
building permit for the mobile home within thirty days from the
date of approval by the Board of County Commissioners; 2) A septic
permit shall be obtained prior to the issuance of a building
permit; 3) The existing structures located on the property shall
not be used on any basis as a dwelling or as overnight or
temporary housing for any person; and 4) The mobile home shall not
be occupied until such time that the applicant has complied with
the above mentioned conditions.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of Max
and Josie Martinez for permission to place a mobile home to be
used as a principal dwelling on the above described parcel of
land, which was found to be in compliance with Section 43 of the
Weld County Zoning Ordinance, be, and hereby is , granted subject
to the hereinabove listed conditions.

This request is for a mobile home to be used as a principal dwelling.
Legal Description of Parcel: Lot 9 and the Ni of Lot 10, Black 5, east side
addition of Eaton.
Location: East of Eaton.
The Department of Planning Services staff has reviewed this request and
recommends that the request he for the following reasons:
WILL WILL NOT
X Be compatible with the Weld County
Comprehensive -Plan.
X Be compatible with the surrounding area.
X Be in harmony with -the character of the
neighborhood.
X Adversely affect the immediate area.
X Be adequately served by water and sewage
disposal facilities.
X_ Adversely affect the general health, safety
and-welt-are -0f the inhabitants of the area and
the County.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant applying for a building permit for the mobile home
within thirty (30) Aays from the date of approval by the Board of
County Commissioners.
2. A septic permit shall be _obtained prior to the issuance of a
building permit.
3. The existing structures located on the property ahall nut be used
on any basis as a dwelling or as overnight or temporary housing
for any person.
4. The mobile home shall not be occupied until such time that the
applicant has complied with Conditions 1, 2, and 3 above.

COMMENTS:
The present structure located nn the property is an -old house in tad _need of
repair. It does appear that the mobiles home could be located on the
property with attention being placed on the proper setbacks, offsets, and
appropriate separation desistances between structures.
The setbacks are 20' from the road right-of-way, offsets _are a minimum of 3'
or 1' for each 3' of -building height, whichever is greater, and the
separation distance of 6' between the eaves of the R-3 Classified Structure
(mobile home) and the M. Classified Structures (storage shed) .

To Whom It May Concern:
Max and Josephine Martinez have applied for housing rehabilitation assistance
through the Weld County Housing Authority. We have determined their present
dwelling delapidated and beyond repair with available program funds. However,
we are actively resolving the Martinez' situation through our replacement
housing program.
The WCHA plans to move a mobile -home on the Martinez' lot to be used as a
principal dwelling. -Also, the WCHA will be installing a new septic -system
and leachfield. Water will be provided by the East Eaton Water and
Sanitation District. The existing dwelling will remain standing but will
not be used as a residence.
If you have any questions regarding this application for a mobile home zoning
