RE: APPROVE AGREEMENT FOR GRADING AND SNOW REMOVAL BETWEEN WELD
COUNTY AND TOWN OF WINDSOR AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Town of Windsor wishes to have Weld County
perform grading and snow removal services on those portions of
Weld County Road 76 within the town boundaries , and
WHEREAS, the Board has been presented with an Agreement for
such grading and snow removal , the terms and conditions being
stated in said Agreement, and
WHEREAS , after review, the Board deems it advisable to
approve said Agreement, a copy of which is attached hereto and
incorporated herein by reference .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement for
grading and snow removal between the Town of Windsor and Weld
County be, and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Agreement.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 8th day of
July, A.D. , 1987 .

AGREEMENT FOR GRADING AND SNOW REMOVAL
ON THOSE PORTIONS OF WELD COUNTY ROAD 76 LOCATED
WITHIN THE BOUNDARIES OF THE TOWN OF WINDSOR, COLORADO
THIS AGREEMENT, made and entered into this 8th day of
July , 1987 , by and between THE TOWN OF WINDSOR,
hereinafter referred to as "Town , " and THE COUNTY OF WELD, STATE
OF COLORADO, by and through the Board of County Commissioners of
the County of Weld , Colorado, hereinafter referred to as "County. "
WHEREAS, Town wishes to have County perform grading and snow
removal services on those portions of Weld County Road 76 within
the boundaries of the Town of Windsor, and
WHEREAS , County is agreeable to rendering such services
pursuant to the terms and conditions hereinafter set forth , and
WHEREAS , Agreements between County and other governmental
entities are authorized and provided for by the provisions of
Section 29-1-203 , C.R. S . , and so provided for by Section 2-3 of
the Weld County Home Rule Charter.
NOW, THEREFORE, County agrees to provide grading and snow
removal services on those portions of Weld County Road 76 located
within the Town of Windsor according to the following terms and
conditions:
1 . County shall furnish and supply all labor , supervision ,
and equipment for said services .
2 . County shall grade and remove snow on those portions of
Weld County Road 76 located within the boundaries of the Town of
Windsor , including Weld County Road 76 from its intersection with
Weld County Road 15 east approximately 1130 feet and west from the
same intersection approximately 2385 feet, contemporaneously with
County' s similar activity on the balance of said road . Town
understands that those portions of Weld County Road 76 lying
outside the boundaries of the Town of Windsor shall be given
priority.
3 . Town agrees to pay County for the services rendered,
under this Agreement at the cost incurred by County. Town
understands that this cost will vary in accordance with the salary
of the personnel completing such services and the equipment used ,
but the average cost will be approximately $35 . 00 per hour as of
the date of this Agreement . County reserves the right to raise
said average cost at any time without prior approval of Town .
County shall bill Town on a periodic basis for those services
which have been performed in said period.

4 . Town shall indemnify County, its officers , and its
employees against any and all liability for injury or damage
caused by any negligent act or omission of any of County' s
employees or agents in the performance of this Agreement, and it
shall hold County harmless from any and all loss occasioned as a
result of the performance of the services pursuant to this
Agreement.
5 . This Agreement shall run from year-to-year from the date
of the signing of this Agreement unless terminated by either
County or Town , providing the party seeking to terminate this
Agreement gives the other party ten (10) days written notice prior
to the date of said termination.
IN WITNESS WHEREOF, the parties hereto agree to the terms and
conditions stated forth herein as of this 8th day of
July , 1987.

Dear Drew,
Enclosed are two copies of the proposed road maintenance
agreement for the section of County 76 that was annexed by the
Town of Windsor. It is my understanding that the town' s attorney
has written this in cooperation with the county' s attorney.
Please send the agreement through the county' s process for
approval and signature by Mr. Lacy and return one of the copies to
me for filing.
