NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, A. That a local improvement district for the construction and installation of street improvements was created by act of this Board on the 24th day of June, 1987. Said local improvement district has been designated as "Weld County Indianhead Local Improvement District Number 1987-1" and all proceedings heretofore taken by the Board of County Commissioners and the County staff and adopted in connection with the District are hereby ratified, approved and confirmed. B. That the Statement of Expenses and Apportionment has been submitted based upon the fact that there has been completion of the entire local improvement as previously authorized. C. The total cost of the improvements has been determined to be $8,749.18. The amount to be assessed to property within the District has been determined to be $7,055.88. The Statement of Expenses and Apportionment advises, and this Board ratifies, the finding that each of the lots described belonging within the local improvement district has been specifically benefited and each lot shall be assessed equally on a per lot basis the cost for materials and labor for the paving, in the amount of $90.46 . D. The assessment being levied for the improvements shall be due and payable within thirty (30) days after the effective date of this assessing Resolution. However, all such assessments may be paid at the election of the owner, in ten (10) equal, annual installments of principal with installments of interest on unpaid installments at an interest rate of ten percent (10%) simple interest per annum. The first of said installments of assessment shall be due and payable prior to May 1, 1988, and the remainder of the annual installments or assessments and annual payments of interest shall be due and payable successively on the same day each year thereafter until all are paid in full. E. The County Clerk and Recorder shall prepare a local assessment roll, in cooperation with the Weld County Treasurer and Accounting Department, in book form, showing, in suitable columns, each piece of land assessed, the total amount of assessment, the amount of each installment of principal and interest if, in pursuance of Part 6 of Article XX of Title 30, Colorado Revised Statutes, the same is payable in installments, and the date when each installment will become due, with suitable columns for use, in case of payment of the whole amount or of any installment or penalty, and shall deliver the same, duly certified, under the County seal, to the County Treasurer for collection. F. Failure to pay the whole assessment within the thirty (30) day period from the date of this Resolution shall be conclusive determination and held to be an election on the part of all persons interested, whether under disability or otherwise, to pay in such installments. All persons so electing to pay in installments shall be conclusively held and considered as consenting to said improvements. Such elections shall be conclusively held and considered as a waiver of any right to question the power or jurisdiction of the County to construct the improvements, the quality of the work, the regularity or sufficiency of the proceedings, the validity or correctness of the assessments, or the validity of the lien thereof. G. A copy of the Weld County cost accounting system printout it attached. At the time the district was formed it was the intent of the Board of Weld County Commissioners to assess the residents the cost of asphalt and asphalt lay down only. At the time the improvement district was approved the cost of asphalt to Weld County was $14.70 per ton. At the time the asphalt was laid in September the cost was $17.30 per ton. Because Weld County delayed in the construction the Commissioners have agreed to assess the property owners the originally estimated cost of $18.00 per ton which includes material and labor: The material used was 392.03 tons of asphalt. He stated that it is proposed that Wald County construct 850 feet of roadway from U.S. Highway 34 extending 50 feet beyond Algonquin Road, the entrance into Indianhead Subdivision, with the County providing the labor to prepare the roadbed, and the cost of the asphalt being divided among the owners of the 78 lots in the developed area of the subdivision. It was explained that the developed lots are considered to be those with roads developed to the lots. Mr. Scheltinga stated that it is estimated that the per lot cost to the property owners would be $86.54, with the county assuming $4,500 to $5,000 in the cost of preparing this roadbed. Mr. Scheltinga also explained that the amount of traffic generated by Indianhead Subdivision would require daily grading of this section of road which, over the life expectancy of the improved road, would more than compensate the County's expense. Kathleen Sundberg, a property owner within the subdivision, stated that, a majority of the homeowners have signed a petition requesting the formation of this district. Mr. Morrison stated that he has prepared a Resolution declaring the intent of the Board to create such district, and summarized the contents of the Resolution. Commissioner Kirby stated that he feels Weld County has some obligation to upgrade this section of road, due to the amount of traffic, and expressed his appreciation to the homeowners who are willing to share in the cost of upgrading. Commissioner Johnson moved to adopt the Resolution declaring the intent of the Board to create a local improvement district to be designated as Weld County Indianhead Local Improvement District No. 1987-1.
