RESOLUTION
RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 440 - MARJO,
INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , on January 23 ,
1980 , approved Recorded Exemption No. 440 concerning property
described as Part of the Eh, Section 2 , Township 6 North, Range 67
West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, MarJo, Inc. is now requesting that Recorded
Exemption No. 440 be amended, and
WHEREAS, the Board has studied said request to amend Recorded
Exemption No. 440 and deems it advisable to approve same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the amendment to
Recorded Exemption No. 440 for MarJo, Inc. be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from MarJo Inc. for an amended recorded exemption. The parcel of
land on which this request is being made is described as part of the E1/2,
Section 2, T6N, R67W of the 6th P.M. , Weld County, Colorado.
This request is being done in conjunction with a subdivision exemption
(SE-230) . The applicants are amending RE-440 in order to separate the
feedlot and the main set if improvements from a small 3 bedroom residence.
Approval of the amended recorded exemption will not create any additional
residential building sites.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The impact on surrounding agricultural land-uses does not appear
to be significantly different than the original request approved
on January 23, 1980.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations.

The Department of Planning Services Staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be drawn in accordance with
the requirements of Section 9-2 C. (4) of the Weld County
Subdivision Regulations. The plat shall be submitted within sixty
(60) days from the date of approval by the Board of County
Commissioners.

COMMENTS:
Total acreage for the combined subdivision exemption and amended recorded
exemption is approximately 187 acres. The parcel proposed for the
subdivision exemption consists of 16 acres and would include the following
improvements: single—family residence, garage, metal shed, outbuilding, box
car, fuel tanks, feedmill and ensilage pit. The proposed Lot "A" would be
amended to 6.96 acres and would contain a single—family residence, metal
garage and animal pens. The remaining larger parcel (Lot B) would contain a
subterranean residence and the irrigated cropland (corn) . Access for all
three proposed parcels is Weld County Road 74, a paved road.

Attached you will find the request for Subdivision Exemption and
Amended Recorded Exemtpion on RE 440. A description of the
parcels is as follows :
LOT A OF RECORDED EXEMPTION 440
This parcel consists of approximately 21 acres, having
a feed lot with a capacity of approximately 3 ,000 head.
Also located on Lot A are the main set of improvements
including the main residence of brick construction,
machine shed and shop, large grain elevator with 325
ton capacity, including roller mill mixer and scales ,
and a 7 , 000 ton ensilage pit and all livestock handling
equipment.
LOT B
This parcel consists of approximately 165 acres . It
is totally irrigated farmland, slightly rolling to
the south and southeast.
THE NEW PARCEL (WHICH WILL BECOME LOT A)
This parcel will consist of approximately 6. 96 acres.
It will be pie-shaped and will be made up of a portion
of the east end of the original Lot A and a small por-
tion from the east side of Lot B. This parcel is pres-
ently in grass and has been for many years and cannot
be farmed because of the subirrigation and water table.
There presently exists a small 3 bedroom home of 900
to 1000 square feet, and a metal barn, approximately
26 ' X 30' . Both buildings have been in existence for
several years. The utilities to this property are
natural gas and North Weld Water with a septic tank
and leach field for sewage disposal.

We have had this property rented since we have owned it and
are now desirous of selling the property to someone that
can make better use of it than we have. The property will
continue to be used as a small livestock operation, such as
3-4 horses or 15 to 20 small ewes (sheep) etc. If this
request is granted, Lot A will be approximately 6. 96 acres ,
Lot B will be approximately 163 acres and the original
Lot A will be approximately 16 . 7 acres. THE GRANTING OF
THIS REQUEST WILL NOT CREATE A NEW BUILDING SITE.
After reviewing the Weld County Comprehensive Plan and in
discussing this request with Ivan Gilbaugh, we believe this
request is consistent and compatible with the Weld County
Comprehensive Plan and the existing surrounding land uses
and future development. We also believe it would be con-
sistent with efficient and orderly development as projected
by the Comprehensive Plan of Weld County.

Great Western Railway, EXCEPT 10.5 acres more or less situated in the West Half
(W- ) of the SE' of said section, described as follows: Beginning at a point 448
feet East of the Southwest Corner (SW Cor) of the SE' of said Section 2, thence
running West to the SW Cor of said SE14 of said Section 2; Thence running North
2042 feet; Thence running in a general Southeasterly direction following the line
of a certain waste ditch to the Point of Beginning:
