The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. PL0876 850652 Page 2 RE: USR - NATURAL GAS ASSOCIATES b. The location of the proposed use minimizes the impact on the surrounding farmland, which is consistent with the Comprehensive Plan policies. c. The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood in that an existing gas processing plant is directly to the east. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a natural gas compression and natural gas liquids trucking facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to beginning the Use by Special Review activity, the applicant shall obtain the required emissions permit from the Air Pollution Control Division, Colorado Department of Health. Evidence of approval shall be delivered to the Department of Planning Services. The Use by Special Review permit is for a natural gas compression and liquids trucking facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Prior to beginning the Use by Special Review activity, the applicant shall provide a list of the maximum quantities of hazardous substances expected at the site, emergency phone numbers, and addresses of operators to the State Health Department, Division of Waste Management; the Weld County Emergency Response Coordinator; and the Fort Lupton Fire Department. Evidence of this listing, emergency phone numbers , and addresses shall be provided to the Department of Planning Services prior to the issuance of building permits. 3 . The Use by special Review area shall be limited to one access point onto Weld County Road 19 . 4 . The septic system shall be designed by a Colorado registered profession engineer. 5 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 of the Weld County Zoning Ordinance. 7 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 .6 of the Weld County Zoning Ordinance. 8 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the operations carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. Page 2 DEVELOPMENT STANDARDS - NATURAL GAS ASSOCIATES 9 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10 . The property owner and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 85-82 RE: USE BY SPECIAL REVIEW, NATURAL GAS COMPRESSION AND NATURAL GAS LIQUIDS TRUCKING FACILITY - NATURAL GAS ASSOCIATES A public hearing was conducted on November 13, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated October 7, 1985, and duly published October 31, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of Natural Gas Associates for a Use by Special Review for a natural gas compression and natural gas liquids trucking facility. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record, and said there are three conditions and ten Development Standards associated with this request. Richard Powell, representing the applicant, came forward to make his presentation and answer questions of the Board. (TAPE CHANGE #85-100) Those stating their opposition to this proposal were: William Gettlein, Thomas Spurling III, and Thomas Spurling. Mr. Powell responded to their concerns, saying that gas will not be processed at this site, the facility is for trucking. He also said that the increase in noise will not be detectable. Ms. Dunn stated that the Ft. Lupton Fire District had responded and said that they have no objections to this proposal. Thomas Spurling questioned whether an EPA Impact Study had been conducted. Mr. Powell stated that an EPA Impact Study is not required, but a State Emissions Permit is required. He said an application has been submitted to the State for this permit, and the State has indicated that this facility is in compliance with all applicable emissions regulations and a permit should be issued within the month. Following a short discussion, Commissioner Lacy moved to approve the request of Natural Gas Associates for a Use by Special Review for a natural gas compression and natural gas liquids trucking facility, based upon the recommendation of the Planning Commission and subject to the recommended conditions and Development Standards. G. Rosenoff with respect to the above-referenced use by special review. Our clients are particularly concerned in that they own a seven acre parcel of ground, presently zoned for residential purposes, located in Section 32, in the immediate vicinity of the proposed application. Our clients and their family have resided in this general area in excess of 40 years. The subject seven acres owned by our clients has been intended to be utilized for residential-type purposes for a number of years . Due to the nature of a natural gas compression, and a natural gas liquid trucking facility, our clients wish to record their strenous objection to the proposal. In our clients' opinion, this type of use is not reasonable within the subject area, will result in increased traffic and noise, and substantially diminish the value of the property owned by our clients. In any event, should the Board of County Commissioners be predisposed to grant the special use requested by the applicant, our clients have specifically requested that adequate ameliorating measures be placed on—site to limit the visual impact of such a facility, and attempt to keep any sound and other activity screened from view in a properly landscaped and bermed area. However, it is and remains our clients' position that they are adamently opposed to any special use which would be of this type of intense nature. Frederick; south of Weld County Road 16 and east of Weld County Road 19 APPEARANCE: Richard Powell, Natural Gas Associates, Inc. , represented the applicant. He asked that all references to Weld County Road 17 be changed to Weld County Road 19. They do not feel this request is a gas processing plant as referred to in the recommendations and the Development Standards. The gas processing plant is across the road. This site will be a compressor station and liquid petroleum gas trucking facility. They are pumping gas from tanks into the Amoco lines; raising the compression to send it through the pipeline. This gas will be delivered to the University of Northern Colorado. They have asked for a 2,000 horsepower compressor, but initially only a 700 horsepower compressor will be used. There will also be a liquid petroleum gas unloading plant and weigh station at this site. There will be two thirty thousand gallon tanks on the property and about five trucks of gas coming in per day. Eventually they plan to have five 30,000 gallon tanks and about ten truck loads coming in per day. The liquid petroleum gas is for delivery and transportation in the Amoco pipeline. They have done noise studies at the site and at midnight they are not reaching the fifty decibels that are considered acceptable. Even when the larger compressor is installed they will not reach this level. They will install hospital mufflers to control the noise. This will be an unmanned plant and he explained the safety and control features of the plant. The Chairman asked Mr. Powell if he had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. He stated he had and asked that Development Standards #1 be changed to read Weld County Road 19, condition IF 3, and Development Standards #2 be changed to reflect that no drilling will take place on the property. Other than these three minor changes he had no problems with anything outlined by the Department of planning Services staff. This soil type is considered to be prime farm land. The site chosen for this facility is conclusive to the particular construction planned. There are very few limitations for buildings on this site. However, there is a moderate shrink-swell potential which may cause problems with roads. This soil type has no previous history of flooding and the water table is at a depth greater than six feet. If sewage facilities are planned for this station, we would recommend septic tanks rather than sewage lagoons because of the seepage problem with lagoons. These liquids are currently being trucked from the Fort Lupton and Greeley areas to Amoco ' s Peoria facility east of Byers , Colorado . The new facility will save approximately 50-60 ( fifty to sixty ) miles per trip per truck . The facility will be operated as a business with no residential unit at the site . The facility will operate 24 hours per day with one to two people at the plant during normal daytime working hours . The water source for this location will be provided by Central Weld Water District . ( see letter from C . W . W . ) . The sewage system will be a septic system, sized to accommodate the equivalent of a single family residence . No additional sanitary facilities will be required at the facility . The vehicular traffic in addition to the trucks will be one or two pickups in and out of the site , two to three times per day . It is not the intent of Associated Natural Gas , Inc . , to store or stockpile any quantity of materials or waste at the site . There is no waste associated with this facility and the only materials that will be stored are valves and piping materials for maintenance and repair of the facility . The fire protection measures necessary for a facility of this type consists primarily of continual attention to safety procedures by the employees . Box 5493 Denver, CO 80217 Dear Mr. Berge: Engineering Dynamics has evaluated the acoustical impact associated with the installation of a gas compressor station proposed by Associated Natural Gas next to the existing Amoco Spindle Compressor Station. This letter summarizes the results of the analysis. The Amoco Spindle Plant is currently operating at the same capa- city as in 1978, approximately 15000 hp, and is within allowable noise crtieria as specified by the State of Colorado. Associated Natural Gas Co. has proposed a new facility to be located on the west side directly adjacent to the Spindle Plant. Initially the size of the new plant will be 700 hp (one 400 hp and one 300 hp compressor) . Future projections indicate the plant will eventually be expanded to 2000 hp. The noise level generated by a compressor station is proportional to the total horsepower of the compressors at the site. The sound level which is perceived by the human ear is a logarithmic quan- tity, not a linear quantity. If sound level was linear a doubling of acoustic energy would be perceived to be twice as loud . However, since sound level is logarithmic, a doubling of acoustic energy is an increase of only 3 dB (A) which is subjectively evaluated to be barely perceptible. In fact, a sound level must increase by 10 dB (A) before it is subjectively perceived to be twice as loud . This four percent increase corresponds to an increase in sound pressure level of 0.2 dB (A) . This increase is not perceivable, nor can it be measured under field conditions. When the proposed plant reaches a capacity of 2000 hp the noise level will be increased by 0.5 dB (A) , which corresponds to a 13% increase in total horsepower. An increase of this magnitude is not subjectively perceivable and cannot be measured under field conditions. The background noise levels at the Spindle Plant site are within allowable criteria as defined by the State of Colorado. The in- stallation of the proposed 2000 hp plant will increase the noise level by 0.5 dB (A) . This difference is less than what can be de- tected in field measurement conditions and is not subjectively per- ceivable under any conditions. (including laboratory tests) . Based on this information, it is concluded that the installation of the Associated Natural Gas Plant next to the existing Amoco Spindle Plant will not increase the noise level at residential locations at the site. The investigation included test borings and laboratory testing of samples obtained from these borings. The objectives of this study were to (1) evaluate the subsurface conditions at the site relative to the proposed construction, (2) make recommendations regarding the design of the substructures, (3) recommend certain precautions which should be taken because of adverse soil and/or ground water conditions, and (4) make recommendations regarding gravel surfacing for the proposed drives and parking areas to be constructed at the site. SITE EXPLORATION The field exploration, carried out on September 25, 1985, consisted of drilling , logging, and sampling six (6) test borings. The locations of the test borings are shown on the Test Boring Location Plan included in Appendix A of this report. Boring logs prepared from the field logs are shown in Appendix A. These logs show soils encountered, location of sampling, and ground water at the time of the exploration. The borings were advanced with a four-inch diameter, continuous- type, power-flight auger drill. During the drilling operations, a geotechnical engineer from Empire Laboratories, _Inc. was present and made continuous observations of the soils encountered. -1- J SITE LOCATION AND DESCRIPTION The proposed site is located on County Road 19 north of County Road 14, east of Dacona and Frederick, Colorado. More particularly, the site is described as a tract of land situate in the Southeast 1P4 of Section 33, Township 2 North, Range 67 West of the Sixth P.M. , Weld County, Colorado. The site consists of irrigated farm land partially planted in wheat. The property is relatively flat and has minor drainage to the south and southeast. The area is bordered by open fields to the south, east, and I west and by County Road 19 on the east. LABORATORY TESTS AND EVALUATION Samples obtained from the test borings were subjected to testing in the laboratory to provide a sound basis for evaluating the physical properties of the soils encountered. Moisture contents, dry unit weights, unconfined compressive strengths, water soluble sulfates, swelling potentials, and the Atterberg limits were determined. A summary of the test results is included in Appendix B. Consolidation characteristics were also determined, and curves showing this data are included in Appendix B. SOIL AND GROUND WATER CONDITIONS The soil profile at the site consists of strata of materials arranged in different combinations. In order of increasing depths, they are as follows: (1 ) Silty Topsoil : The area tested is overlain by a six (6) inch layer of silty topsoil. The topsoil has been penetrated by root • growth and organic matter and should not be used as a bearing soil or as a fill and/or backfill material. -2- -/ (2) Sandy Silty Clay: This stratum underlies the topsoil and extends to the bedrock below. The silty clay varies to a I clayey silt, contains varying amounts of sand including lenses of fine sand, and exhibits generally low to moderate bearing characteristics in its damp to moist in situ condition. When wetted, the shearing strength of the clay is reduced; and upon loading, consolidation readily occurs. (3) Claystone Bedrock: The bedrock was encountered in all borings below the upper clays at depths of seven (7) to twelve and one-half (12-1 /2) feet below the surface and extends to greater depths. The upper one (1) to four (4) feet of the I bedrock is highly weathered; however, the underlying claystone is firm and exhibits high bearing characteristics. (4) Ground Water: At the time of the investigation, free ground water was encountered at the site at depths two (2) to four and one-half (4-1 /2) feet below the surface. Water levels in this area are subject to change due to seasonal variations and irrigation demands on and/or adjacent to the site. RECOMMENDATIONS AND DISCUSSION It is our understanding the northwest corner of the site is to contain compressor units weighing sixty-five thousand (65,000) pounds. These skid-mounted units are to be placed on structural pads. Four F sixty thousand (60,000) gallon liquid petroleum gas storage tanks weighing approximately five hundred thousand (500,000) pounds are planned in the southwest corner of the property. An office, control building and shop and gravel drives and parking areas are proposed for the northeast and east portions of the plant site. Site Grading and Utilities Specifications pertaining to site grading are included below and in Appendix C of this report. It is recommended that the upper six (6) -7- inches of topsoil below foundation, filled and gravelled areas be stripped and stockpiled for reuse in planted areas or wasted from the site. The upper six (6) inches of the subgrade below building, filled and gravelled areas should be scarified and recompacted two percent (2$) wet of optimum moisture to at least ninety-five percent (95%) of Standard Proctor Density ASTM D 698-78. (See Appendix C.) Where this subgrade compaction cannot be met due to unstable or saturated subgrade soils, the subgrade should be stabilized with granular pit run or geotextiles. Finished subgrade below building and driveway and parking areas should be a minimum of three (3) feet above existing i ground water, and this should be taken into consideration in the design of the grading plan for the site. Fill should consist of the on-site soils I or imported material approved by the geotechnical engineer. Fill should be placed in uniform six (6) to eight (8) inch lifts and mechanically compacted to a minimum of ninety-five percent (95%) of Standard Proctor Density ASTM D 698-78. In computing earthwork quantities, an estimated shrinkage factor of eighteen percent (18%) to twenty-three percent (23%) may be used for the on-site clays compacted to the above-recommended density. Utility trenches dug four (4) feet or more into the upper subsoils should be excavated on slopes no steeper than 1 :1 . The bedrock may be excavated on vertical slopes. Excavation of the firm bedrock may require the use of heavy-duty construction equipment. Where utilities are excavated below ground water, dewatering will be needed during placement of pipe and backfilling for proper construction. All piping should be adequately bedded for proper load distribution. Backfill placed in utility trenches in open and planted areas should be compacted in uniform lifts at optimum moisture to at least ninety percent (90%) of Standard Proctor Density. ASTM D 698-78 the full depth of the trench. The upper four (4) feet of backfill placed in utility trenches under building and gravelled areas should be compacted at or near optimum moisture to at least ninety-five percent (95%) of Standard Proctor Density ASTM D 698-78, and the lower portion of these trenches should be compacted to at least ninety percent (90%) of 4 Standard Proctor Density ASTM D 698-78. Drying of the subsoils may be needed for proper compaction. Stripping, grubbing, subgrade preparation, and fill and backfill placement should be accomplished under continuous observation of the geotechnical engineer. Field density tests should be taken daily in the compacted subgrade, fill, and backfill under the direction of the geotechnical engineer. Foundations Compressor Units It is our understanding that compressor units will be placed on structural slabs, and the compressors will have gross loadings of approximately sixty-five thousand (65,000) pounds. We further understand that settlements greater than one-half (1 /2) inch are not desired. Based on the above data and in view of the soil conditions encountered, it is our opinion that the compressor units be supported by a drilled pier foundation system. Using this type of foundation system, the compressor is supported by piers drilled into the bedrock stratum and a structural pad spanning the piers. The piers are supported by the bedrock stratum partially through end bearing and partially through skin friction. It is recommended that all piers be straight-shaft and that they be drilled a minimum of five (5) feet into the firm bedrock stratum. Piers founded at the above level may be designed for a maximum allowable end bearing pressure of twelve thousand five hundred (12 ,500) pounds per square foot. It is estimated that a skin friction of one thousand two hundred fifty (1250) pounds per square foot will be developed for that portion of the pier embedded into the firm bedrock stratum. To counteract swelling pressures which will develop if the bedrock becomes wetted , all piers should be• designed for a minimum dead load of five thousand (5000) pounds per square foot. Where this minimum dead load requirement cannot be satisfied, it is recommended ! that skin friction from additional embedment into the firm bedrock be used to resist uplift. All piers should be reinforced their full length to r resist tensile stresses created by swelling pressures acting on the pier. The predicted settlement under the above maximum loading should be negligible. Due to moist conditions and the low swell potential of the subsoils, a void is not required between the bottom of the structural pad and the subsoil below. Drilled piers should be designed to resist all induced lateral forces. The ultimate passive resistance of the upper clay materials above existing groundwater may be computed using the equation Pp = 200Z + 2000 pounds per square foot. Below existing groundwater, the ultimate passive resistance of the clay material may be computed using the equation Pp = 145Z + 2000 pounds per square foot. In all cases, Z is the depth below the top of the stratum. Since all bedrock is below ground water, temporary casing of the drill holes will be required. It is suggested that all piers have minimum eighteen (18) inch diameters. It is strongly recommended that the geotechnical engineer be present during the drilling operations to (1 ) identify the firm bedrock stratum, (2) assure that proper penetration is obtained into the sound bedrock stratum, (3) ascertain that all drill holes are thoroughly cleaned and dewatered prior to placement of any foundation concrete, (4) check all drill holes to assure that they are plumb and of the proper diameter, and (5) ensure proper placement of concrete and reinforcement. Liquid Petroleum Gas Storage Tanks In view of the loads transmitted by the proposed gas storage tanks, it is recommended that the tank cradles be supported by conventional-type spread footings and/or a pad foundation. The footings and/or pads should be founded on the original , undisturbed soil or on a structural fill extended to the undisturbed soil .a. minimum of thirty (30) inches .below finished grade for frost protection. The structural fill should be constructed in accordance with the recommendations discussed in the "Site Grading and Utilities" section of this report. The structural integrity of the fill as well as the identification and undisturbed nature of the soil should be verified by the geotechnical engineer prior to placement of any foundation concrete. Footings and/or pads founded at -6- J the above levels may be designed for a maximum allowable bearing capacity of one thousand five hundred (1500) pounds per square foot (dead load plus maximum live load). The predicted settlement under the above maximum loading, as determined by laboratory consolidation tests, should be less than one (1 ) inch, generally considered to be within acceptatle tolerances. If the above settlement cannot be tolerated, it is suggested that the LPG storage tanks be supported by a drilled pier foundation system in accordance with the recommendations discussed above in the "Compressor Units" section of this report. Office, Control Room and Shop In view of the loads transmitted by the proposed office, control room and shop and the soil conditions encountered at the site, it is recommended that the structure be supported by conventional-type spread footings. All footings should be founded on the original , undisturbed soil or on a structural fill extended to the undisturbed soil a minimum of thirty (30) inches below finished grade for frost II protection. The structural fill should be constructed in accordance with the recommendations discussed in the "Site Grading and Utilities" section of this report. The structural integrity of the fill as well as the identification and undisturbed nature of the soil should be verified by the geotechnical engineer prior to placement of any foundation concrete. Footings founded at the above levels may be designed for a maximum allowable bearing capacity of one thousand (1000) pounds per square foot (dead load plus maximum live load) . The predicted settlement under the above maximum loading, as determined by laboratory consolidation tests, should be less than three-fourths (3/4) inch, generally considered.. to be within acceptable tolerances. II -7- Slabs on Grade Subgrade below conventional slabs on grade should be prepared in accordance with the recommendations discussed in the "Site Grading and Utilities" section of this report. Finished subgrade below slabs on grade should be placed a minimum of three (3) feet above existing ground water. Slabs on grade supporting heavy floor loads should be underlain by at least six (6) inches of crushed gravel base course, compacted at optimum moisture to at least ninety-five percent (95%) of Standard Proctor Density ASTM D 698-78. (See Appendix C.) Office and other areas transmitting light floor loads should be underlain by a minimum of four (4) inches of clean gravel or crushed rock devoid of fines. The gravel base course and/or gravel should help to distribute floor loads and should act as a capillary break. Slabs on grade should be designed for the imposed loading , and it is suggested that they be designed I structurally independent of bearing members. To minimize and control shrinkage cracks which may develop in slabs on grade, we suggest that control joints be placed every fifteen (15) to twenty (20) feet and that the total area contained within these joints be no greater than four hundred (400) square feet. Gravel Surfacing It is our understanding that the parking and drive areas will be gravel surfaced. Five (5) to twenty (20) semi-trailer trucks per day having gross loads of approximately eighty thousand (80,000) pounds will utilize the site. Based on the soil conditions encountered and this usage, it is recommended that a minimum of fourteen (H) inches of granular material be utilized in drive and parking areas. This should consist of six (6) inches of select subbase or granular pit-run material overlain by eight (8) inches of crushed aggregate base course. Subgrade below proposed parking and driveway areas should be prepared in accordance with the recommendations discussed in the "Site Grading and Utilities" section of this report. Finished subgrade below gravelled areas should he placed a minimum of three (3) feet above -8- existing ground water. The surface of the subgrade should be hard, uniform, smooth, and true to grade. To prevent the growth of weeds, it is suggested that all subgrade under parking areas be treated with a soil sterilant. The base course overlying the subgrade should consist of a hard, durable, crushed rock or stone and filler and should have a minimum "R" value of 80. The composite base course material should be free from vegetable matter and lumps or balls of clay and should meet the Colorado I Department of Highways Specification Class 6 Aggregate Base Course which follows: Sieve Size % Passing 3/4" 100 #4 30-65 #8 25-55 #200 3-12 Liquid Limit - 30 Maximum Plasticity Index - 6 Maximum The base course should be placed on the subgrade at or near optimum moisture and compacted to at least ninety-five percent (95$) of Standard Proctor Density ASTM D 698-78. (See Appendix C.) It is important that the base course be shaped to grade so that proper drainage of the parking area is obtained. It should be noted that periodic grading and maintenance will be required since the driveways and parking areas are not to be paved. GENERAL RECOMMENDATIONS (1 ) Laboratory test results indicate that water soluble sulfates in the soil are negligible, and a Type I cement may be used in concrete exposed to subsoils. Slabs on grade subjected to de-icing chemicals should be composed of a more durable concrete with low water-cement ratios and higher air contents. -9- • (2) Finished grade should be sloped away from the structures on all sides to give positive drainage. Five percent (5%) for the first ten (10) feet away from the structures is the suggested slope. (3) Backfill placed around the interior and exterior perimeters of the structures should be mechanically compacted in uniform lifts. Puddling should not be permitted as a method of compaction. Interior backfill and exterior backfill below paved areas should be compacted to a minimum of ninety-five percent (95%) of Standard Proctor Density ASTM D 698-78. (See Appendix C.) Exterior backfill below planted areas should be compacted to a minimum of ninety percent (90%) of Standard Proctor Density ASTM D 698-78. (4) Gutters and downspouts should be designed to carry roof runoff water well beyond the backfill area of the office, control room and shop areas. (5) Underground sprinkling systems should be designed such that piping is placed a minimum of five (5) feet outside the backfill of the structures. Heads should be designed so that irrigation water is not sprayed onto the foundation walls. These recommendations should be taken into account in the landscape planning. (6) Footing , pad and/or pier sizes should be proportioned to equalize the unit loads applied to the soil and thus minimize differential settlements. (7) It is recommended that compaction requirements specified herein be verified in the field with density tests performed under the direction of the geotechnical engineer. -10- (8) It is recommended that a registered professional structural engineer design the substructures and that he take into account the findings and recommendations of this report. GENERAL COMMENTS This report has been prepared to aid in the evaluation of the property and to assist the architect and/or engineer in the design of this project. In the event that any changes in the design of the structures or their locations are planned, the conclusions and recommendations contained in this report will not be considered valid unless said changes are reviewed and conclusions of this report modified or approved in writing by Empire Laboratories, Inc. , the geotechnical engineer of record. Every effort was made to provide comprehensive site coverage through careful locations of the test borings, while keeping the site investigation economically viable. Variations in soil and ground water conditions between test borings may be encountered during construction. In order to permit correlation between the reported subsurface conditions and the actual conditions encountered during construction and to aid in carrying out the plans and specifications as originally contemplated, it is recommended that Empire Laboratories, Inc. be retained to perform continuous construction review during the excavation and foundation phases of the work. Suggested Specifications for Placement of Compacted Earth Fill and/or Backfills. GENERAL A geotechnical engineer shall be on-site to provide continuous observation during filling and grading operations and shall be the owner's representative to inspect placement of all compacted fill and/or backfill on the project. The geotechnical engineer shall approve all earth materials prior to their use, the methods of placing, and the degree of compaction obtained. MATERIALS Soils used for all compacted fill and backfill shall be approved by the geotechnical engineer prior to their use. The upper two (2) feet of compacted earth backfill placed adjacent to exterior foundation walls shall be an impervious, nonexpansive material. No material, including rock, having a maximum dimension greater than six (6) inches shall be placed in any fill. Any fill containing rock should be carefully mixed to avoid nesting and creation of voids. In no case shall frozen material be used as a fill and/or backfill material. PREPARATION OF SUBGRADE All topsoil, vegetation (including trees and brush) , timber, debris, rubbish, and other unsuitable material shall be removed to a depth satisfactory to the geotechnical engineer and disposed of by suitable means before beginning preparation of the subgrade. The subgrade surface of the area to be filled shall be scarified a minimum depth of six (6) inches, moistened as necessary, and compacted in a manner specified below for the subsequent layers of fill. Fill shall not be placed on frozen or muddy ground. C-2 PLACING FILL No sod, brush, frozen or thawing material, or other unsuitable material shall be placed in the fill, and no fill shall be placed during unfavorable weather conditions. All clods shall be broken into small pieces, and distribution of material in the fill shall be such as to preclude the formation of lenses of material differing from the surrounding material. The materials shall be delivered to and spread on the fill surface in a manner which will result in a uniformly compacted fill. Each layer shall be thoroughly blade mixed during spreading to ensure uniformity of material and moisture in each layer. Prior to compacting, each layer shall have a maximum thickness of eight (8) inches, and its upper surface shall be approximately horizontal. Each successive 6" to 8" lift of fill being placed on slopes or hillsides should be benched into the existing slopes, providing good bond between the fill and existing ground. MOISTURE CONTROL While being compacted, the fill material in each layer shall as nearly as practical contain the amount of moisture required for optimum compaction or as specified, and the moisture shall be uniform throughout the fill. The contractor may be required to add necessary moisture to the fill material and to uniformly mix the water with the fill material if, in the opinion of the geotechnical engineer, it is not possible to obtain uniform moisture content by adding water on the fill surface. If, in the opinion of the geotechnical engineer, the material proposed for use in the compacted fill is too wet to permit adequate compaction, it shall be dried in an acceptable manner prior to placement and compaction. COMPACTION When an acceptable, uniform moisture content is obtained, each layer shall be compacted by a method acceptable to the geotechnical engineer and as specified in the foregoing report as determined by applicable standards. Compaction shall be performed by rolling with approved tamping rollers, C-3 • pneumatic-tired rollers, three-wheel power rollers, vibratory compactors, or other approved equipment well-suited to the soil being compacted. If a sheepfoot roller is used, it shall be provided with cleaner bars attached in a manner which will prevent the accumulation of material between the tamper feet. The rollers should be designed so that effective weight can be increased. MOISTURE-DENSITY DETERMINATION Samples of representative fill materials to be placed shall be furnished by the contractor to the geotechnical engineer for determination of maximum density and optimum moisture or percent of Relative Density for these materials. Tests for this determination will be made using methods conforming to requirements of ASTM D 698, ASTM D 1557, or ASTM D 2049. Copies of the results of these tests will be furnished to the owner, the project engineer, and the contractor. These test results shall be the basis of control for all compaction effort. DENSITY TESTS The density and moisture content of each layer of compacted fill will be determined by the geotechnical engineer in accordance with ASTM D 1556, ASTM D 2167, or ASTM D 2922. Any material found not to comply with the minimum specified density shall be recompacted until the required density is obtained. Sufficient density tests shall be made and submitted to support the geotechnical engineer's recommendations. The results of density tests will also be furnished to the owner, the project engineer, and the contractor by the geotechnical engineer. Default: 3.1 In the event Purchaser should default and fail to perform any condition imposed upon and/or required of Purchaser herein, then this Option and Purchase Agreement shall be null and void, and of no further force and effect; both parties shall be released from all obligations imposed hereunder; and the Option Payment tendered by Purchaser to Sellers hereunder shall be retained by Sellers as liquidated damages and Sellers shall have no further recourse against Purchaser for failure to perform. 3.2 In the event Sellers should default and fail to perform any condition imposed upon or required of Sellers herein, then Purchaser, at its option, may either deem this Option and Purchase Agreement terminated and of no further force and effect, in which case Sellers shall be required to return to Purchaser the Option Payment tendered to and received by Sellers hereunder, or in the alternative, Purchaser may treat this Option and Purchase Agreement as being in full force and effect and seek the legal remedy of requiring the specific performance of Sellers hereunder, or in the alternative, payment of damages by Sellers. 4.
