April 18, 1985 • James and Norma Chittenden 25469 WCR 50 Kersey, CO 80644 Dear Mr. and Mrs. Chittendent This is to reiterate my notice to you and to leave no doubt that I am opposed to you expanding the original intended use of the easement across my land, in any manner. It is my inten- tion to maintain the easement for the original intended use of this easement by every legal means. Thus, it is my intention to place suit to accomplish the above. It is a shame that both of us must go to the expense it will require to pursue this to the end result. What will that cost be? You might ask your attorney how much he .will require if you only pay him for a win and nothing if he loses. If you don't do something such as this, you may find the total cost will be much more than the' original estimate, if not several times that amount.. This is not to question the honesty of your attorney, but estimated costs are very hard to arrive at. The expense could get out of hand if not solidified. I would be very careful in expending money with the intention of expanding the use of the easement across my land. Win, lose or draw, it could be very expensive for both of us considering the possibility of appeals, etc. Hobert . Boren 25449 WCR 50 Kersey, CO 80644 C.C.
