Kirby, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner George Kennedy Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Director of Engineering Services, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated May 24, 1989, and duly published June 8, 1989, in The New News, a public hearing was conducted to consider creation of a Local Improvment District, to be known as Weld County Casa Grande/Enchanted Hills Local Improvement District No. 1989-2. Lee Morrison, Assistant County Attorney, made this matter of record. (Tape Change 1189-28) Drew Scheltinga, Director of Engineering Services, explained that the plans call for 6 " of base course and 3" of asphalt on Weld County Road 20, and 5" of base course and 2" of asphalt on Weld County Road 15. He also said his department has examined the drainage problems in the area and is willing to work with the property owners to make necessary corrections to the entrances. Mr. Scheltinga noted that a request has been received for the paving of Weld County Road 22 to Sierra Vista. He said this request cannot be granted as a part of this hearing, and it would require the submission of an additional petition. Mr. Morrison said any addition to the petition would require beginning the entire process again. Public testimony was offered by E.R. Hamilton, who said he has problems with water on his property; Bernard E. Teets, who said his property would receive no direct benefit from this project; Steve Hanson, who had submitted the request for the inclusion of the paving of a portion of Weld County Road 22; Elizabeth Wilson, who asked whether the heavy equipment which will use this road could be assessed; Eunice Hamilton, who asked how the assessment will be charged; and Dwayne Schlosser, who stated that Mr. Teets will indeed benefit from the proposed district. Mr. Scheltinga said, if the creation of this district is approved, construction could start within 45 days and be completed during this construction season. Pavement of the small portion of Weld County Road 22 was discussed, but it cannot be included in this district. Mr. Morrison said that a draft of a Resolution creating this District has been submitted to the Board for its approval, and he said the Assessment Hearing would be the proper time to determine whether or not Mr. Teets' property will derive benefit from this District. Commissioner Lacy moved to approve the Resolution creating Weld County Casa Grande/Enchanted Hills Local Improvement District No. 1989-2. Commissioner Johnson seconded the motion, and it carried unanimously. 891525 /J .
