RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR A SINGLE FAMILY DWELLING UNIT ON A PARCEL OF LAND
LESS THAN THE MINIMUM LOT SIZE IN THE A (AGRICULTURAL) ZONE
DISTRICT - LYLE D. AND BARBARA A. KLEE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 26th day of October, 1988 , at the hour of 1 :30 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Lyle D. and Barbara A. Klee, 604 Ash Avenue, Ault,
Colorado 80610 , for a Site Specific Development Plan and Special
Review Permit for a single family dwelling unit on a parcel of
land less than the minimum lot size in the A (Agricultural) Zone
District on the following described real estate, to-wit:
Part of the Ni , Section 11 , Township 7 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Lyle Klee, one of said applicants was present, and
WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County
Comprehensive Plan. Low density residential
development is permitted on non-prime agricultural

land as recognized by the Soil Conservation
Service . The soils capability subclass designation
for the proposed building site is VIe. This
indicates limitations that make the site unsuitable
for prime agricultural production.
b. The proposed use is consistent with the intent of
the Agricultural Zone District and is provided for
as a Use by Special Review.
c. The uses which will be permitted will be compatible
with the existing surrounding land uses and with
the future development of the surrounding area, as
permitted by the A (Agricultural) Zone District.
The uses of the surrounding properties include
pasture, farm fields, and rural residences . No
objections have been received from surrounding
property owners.
d . The applicant has demonstrated a diligent effort
has been made to conserve productive agricultural
land in the locational decision for the proposed
use.
e. The proposed use is not located in an overlay
district.
f. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a
single family dwelling unit on a parcel of land less than the
minimum lot size in the A (Agricultural) Zone District on the
hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions :
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the Weld County Clerk and
Recorder' s office within 15 days of approval by the
Board of County Commissioners.

2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
October, A.D. , 1988 .

DEVELOPMENT STANDARDS

1 . The Site Specific Development Plan and Special Review Permit
is for a single family dwelling unit on a parcel of land less
than the minimum lot size in the A (Agricultural) Zone
District as submitted in the application materials on file in
the Department of Planning Services and subject to the
Development Standards stated herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . A Flood Hazard Development shall be required for any new
construction or the substantial improvement of existing
structures in the Floodway or Floodprone Districts located on
the property.
4 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
6. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
7 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations .
8 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.

9 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners .

The following business was transacted:
I -hereby certify that pursuant to a notice dated October 3, 1988, and
duly published October 12, 1988, in the Platteville Herald, a public
hearing was conducted to consider the request of Lyle D. and Barbara A.
Klee for a Site Specific Development Plan and Special Review Permit for
-a single family dwelling unit on a parcel of land less than the minimum
lot size in the A (Agricultural) Zone District. Lee Morrison,
Assistant County Attorney, made this matter of record. Rod Allison,
Planning Department representative, entered the favorable
recommendation of the Planning Commission into the record. Lyle Klee,
one of the applicants, explained this request. He stated that they
have no problems with the two Conditions and nine Development Standards
contained in the Planning Commission recommendation. Pat McDermott,
representing the City of Northglenn, commented on the proposed uses for
this parcel. Commissioner Kirby moved to approve the request of Lyle
D. and Barbara A. Klee for a Site Specific Development Plan and Special
Review Permit, subject to the recommended Conditions and Development
Standards. Commissioner Johnson seconded the motion and it carried
unanimously.
This Certification was approved on the 31st day of October, 1988.

a home on this site.
The Chairman asked the applicant if he had reviewed the recommendation,
conditions, and Development Standards as presented by the Department of
Planning Services' -staff. He had, and does not object to them.
The Chairman called for discussion from the -member s of the audience. There
was none.
The Chairman asked that the staff's recommendation-, conditions, and
Development Standards be filed with the summary as a permanent record of
these proceedings.
MOTION:
Ernie Ross moved that Case Number USR-850 for kyle D. and Barbara A. flee
for a Site Specific Development _Plan and a Special Review permit for a
single family residence on -a parcel of land less than the minimum lot size
be forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval based upon the recommendations and
conditions, as presented by the Department cf Planning Services' staff, the
Development Standards as presented by the -staff and the testimony heard by
the Planning Commission. Motion seconded by Lynn Brown.
The Chairman called for dis-cussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to Doll the members of the Planning

2. It is th-e opinion of the Weld -County Planning Commix-sion that the
applicant has shown compliance -with Section 24.3 of the Weld
County Zoning Ordinance as follows:
- The -proposal is consistent with the Weld County Comprehensive
Plan. Low density residential development is permitted on
non—prime agricultural land as recognized by the Sail
Conservation -Service. The -soils capability subolass
designation for the proposed building site is VIe. This
indicates limitations that make the site unsuitable for prime
agricultural production.
- The proposed use Is consistent with the intent of the
Agricultural zone district and is provided for as a Use by
Special Review.
- The uses which will be permitted will be _compatible -with the
existing -surrounding land uses and with the future
development of the surrounding area, as permitt-ed by the A
(Agricultural) zone _district. The _uses of the surrounding
properties include pasture, farm fields, and rural
residences. No abjection have leen received from
surrounding property owners.

- The applicant has demonstrated a diligent effort has been
made to conserve productive agricultural land in the
locational decision for the proposed use.
- The proposed use is not located in an overlay district.
- Special Review Development Standards will provide adequate
protection of the health, safety and welfare of the neighborhood
and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed this
re-quest.
The Planning Commission's recommendation Tor approval is conditional _upon
the following:
1. The -attached development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
9f Planning -Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days -of approval by the
Board of County Commissioners.

1. The Special Review permit is for a Site Specific Development Plan and a
Special Review permit for a Single Family Dwelling Unit on a parcel of
land less than the minimum lot size in the A (Agricultural) zone
district as submitted in the application materials on file in the
Department of Planning Services and subject to the Development
Standards stated hereon.
2. Approval of this plan may create a vested property right -pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. A Flood Hazard Development shall be required for any new construction
or the substantial improvement of existing structures in the Yloodway
or Floodprone Districts located on the property.
4. All Construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
5. The property owner or operator shall he responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
6. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
7. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the

The following consists of answers to the questions as outlined on
page 1 under "Application Requirements of the Use by Special Review
Procedural Guide" as outlined in Section 24.7 of the Weld County
Zoning Ordinance.
1. A completed application form is provided and attached.
2. The following details are explained in the order presented:
They are:
A. Proposed Use: To build a new home on the pasture
acreage and k-eep pleasure riding horses, and getting
their two children out of the city with some real working
chores .
B. The specific need for approval for the special use
permit is to facilitate the issuance of a building permit,
as the parcel currently is not a legal building site.
C. The surrounding parcels are primarily agricultural,
pasture grazing, cow/calf operations and horse breeding
enterprises.
D. There are only four residences that are relatively
close to the subject parcel, two are located to the North
of the Property, and two are located 1/4 mile to the West
of the Property.
E. Only the Purchaser's family will occupy the
residence; this consists of two adults and two young chil-
dren.
F. No commercial enterprise will be generated on the
property, other than the new owner's keeping the grass ir-
rigated and fences repaired. Therefore, there will be no
employees working.
G. Domestic water will be supplied by North Weld Water
District; documentation attached.
H. Access to the parcel already exists off WCR 84 in the
NE corner of the Property.
I. Vehicular traffic shall be limited to the usual
amount associated with a residence housing two adults and
two children.
J. A septic system shall be installed for the residence
pursuant to the dictates of the Weld County Environmental
Health Department.
K. The residence shall be equipped with smoke detectors
or whatever measures are dictated by the Weld County
Building Department to meet county code.
L. The Purchaser's intent to use the land for irri-
gation of grass which he has ditch rights for. The
maximum number of farm animals would not exceed the usual
four large animal units per acre, but raising livestock is
not the prime intent.

M. The only waste and storage facilities shall be those
commonly accepted and expected on a tract of this size.
N. Storm water shall follow the same paths as now exist
(natural ditch drainage) and home site is located on very
high ground and is not in a flood plain.
0. Purchaser ' s will be on a trash route provided by BFI
Trash Service which comes to the property once a week.
P. Landscaping plans, tree planting, grass seeded around
the home, flowers, and bushes. There will be no erosion
control necessary as the home is located on very flat
ground and will be surrounded by pasture for horses.
Q. Time table for construction and start-up of new home
will take place approximately two years from now.
Purchaser's will have land paid for and apply for a con-
struction loan giving the new lender a first lien on the
property.
R. Fire protection is provided by the Ault, Pierce, and
Nunn fire district.
The Proposal for Supporting Documents, page three of the
Use by Special Review:
A. The proposal is consistent with the Weld County Com-
prehensive Plan and is within the guidelines of the plan,
and is being presented as such for the proposed use to be-
come a reality.
B. The proposal is consistent with the intent of the dis-
trict because the county has zoned the district for agri-
culture use and livestock production. The land, fa-
cilities and number of livestock are well within the
county requirements.
C. Taking inferior hard grass, hard to irrigate, that has
little productive capacity and enhancing it with a new
home will generate more tax assessment than the property
has in its present condition. A minimal amount of land
will be taken out of production--only enough to construct
