RE: APPROVAL OF USE BY SPECIAL REVIEW FOR SINGLE FAMILY RESIDENCE
ON A PARCEL OF LAND LESS THAN THE MINIMUM LOT SIZE REQUIRED
IN THE AGRICULTURAL ZONE DISTRICT - MARVIN A. BARSTOW
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 5th day of November, 1986, at the hour of 2 : 00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Marvin A. Barstow, 2000 South College Avenue , #308 ,
Fort Collins, Colorado 80525 , for a Use by Special Review for a
single family residence on a parcel of land less than the minimum
lot size required in the Agricultural Zone District on the
following described real estate, to-wit:
Part of the Nk NE4 and Nk Sk NEa, Section 18,
Township 8 North, Range 67 West of the 6th
P.M. , Weld County, Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed , finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4 . 2 of the Weld County Zoning Ordinance as follows:

a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan in that it does not
remove prime agricultural land from production and
will not adversely affect the local economy or
environment.
b. The proposed use is consistent with the intent of
the agricultural district in that it allows for the
promotion of agricultural activities and is
permitted as a Use by Special Review in the
district.
c. The uses permitted will be compatible with the
existing surrounding land uses and with future
development of the surrounding areas as permitted
by the Agricultural Zone District.
d. No overlay districts affect the site.
e. Use by Special Review Development Standards will
provide adequate protection of the health , safety,
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a single family residence on a parcel of
land less than the minimum lot size required in the Agricultural
Zone District on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2 . The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3 . Prior to recording the plat, the applicant/operator
shall work with the Greeley Soil Conservation District
to develop a conservation plan best suited for the
property. Evidence of an approved plan shall be
submitted to the Department of Planning Services staff.

1 . The Use by Special Review permit is for a single family
residence as submitted in the application materials on file
in the Department of Planning Services and subject to the
Development Standards stated herein .
2 . The Use by Special Review site shall be maintained in
accordance with the soil conservation plan approved by the
West Greeley Soil Conservation District.
3. All construction done on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
A . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24. 6 of the
Weld County Zoning Ordinance.
£ . Personnel from the Weld County Health Department, Weld County
"Department of Planning Services , and Greeley Soil
Conservation Service shall be granted access onto the
property at any reasonable time in order to insure the
activities carried out on the property comply with the
Development Standards stated herein and all applicable Weld
County Regulations.
7 . The Use by Special Review area shall be limited to the plans
ahown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
8. The property owner or operator shall be responsible for
complying with all of the foregoing Standards . Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners.

A public hearing was conducted on November 5, 1986, At 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 15, 1986, and
-duly published October 23, 1986, in the Johnstown Breeze, a public
-hearing was conducted to consider the request of Marvin Barstow for a
Use by Special Review for a single family residence on a parcel of land
less than the minimum lot size required in the Agricultural Zone
District. Chairman Pro-Tem Lacy explained that, there being only four
Commissioners present for this hearing, if it should result in a tie
vote, the absent Commissioner would listen to the tape of this hearing
-and review the record prior to casting the deciding vote. Lee
Morrison, Assistant County Attorney, made this matter of record.
Debbie de Besche, representing the Planning Department, read the
favorable recommendation of the Planning Commission into the record.
This -recommendation is subject to three Conditions and nine Development
Standards. Ms. de Besche stated that a soil conservation plan has been
prepared, and the Soil Conservation District Board will consider it
next week. Jerry McRae, Engineer with McRae and Short, came forward to
represent the applicant. He explained that three Use by Special Review
applications have been submitted to divide a total of 320 acres into
two parcels containing 120 acres each and one parcel containing 80
-acres and explained the configuration of the parcels. He said this is
dryland, portions of which are currently being cultivated, and it is
anticipated that they will continue to be farmed. Marvin Barstow, the
applicant, was also present. No public testimony was offered
concerning this request. -Commissioner Kirby moved to approve the
request for a -Use by Special Review, subject to the recommendations of
the Planning Commission. Seconded by Commissioner Yamaguchi, the
-motion carried unanimously.

home has been moved off and the Board of County Commissioners have
temporarily approved their -mobile home being on the property pending
approval of this Use by Special Review permit.
Debbie deBesche reported this is a legal lot according to state statutes,
but not according to the Weld County Zoning Ordinance.
Lee Morrison explained that by going through the Use by Special Review
process the applicant is making the property legal for a residence. No
process is -needed to split 1-and into thirty live acres, or more, parcels.
This -process is needed to put a residence on a site with fewer than 80 acres
irrigated or 160 sores dryland as -defined in the Wahl -County Zoning
Ordinance.
The Chairman called for discussion from the members -of the audience. There
was none.
MOTION:
Lynn -Brown moved Case Number USR 756:86:36 for H. Sue and Roger t. Sealy for
a Use ty Special -Review Termit for a -single family -residence (mobile tome)
on a -parcel of land which is less that the minimum required in the
agricultural zone district be forwarded to the Board of County Commissioners
with the Planning Commission's recommendation for approval based upon the
recommendations, conditions, and development standards as outlined by the
Department of _Planning Services staff and the testimony of the applicant.
_Motion seconded by Ann Garrison.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.

APPEARANC-B:
Jerry McRae, P.E. , McRae and Short Consulting Engineers, Inc. , represented
the applicants. This is a 320 acre dryland parcel. The applicant wishes to
split the property into two 120 acre parcels and one 80 acre parcel. They
are applying for Use by Special Review permits so residences may be built an
the properties. There is currently a house and a well on the 80 acre
parcel, and it has not been decided if the old house will be torn down or
remodeled. There will; however, only be one residence per parcel. One 120
acre parcel has been farmed in dryland wheat by a neighboring farmer for
-about twelve years. The 80 acre parcel is in the center and about half is
farmed in dryland wheat and half is native grasses. The third parcel is all
native grasses.
Debbie deBesche reviewed the recommendation from Ron Miller, Greeley Soil
Conservation District, recommending the entire parcel be seeded tc -native
grasses.
The Chairman asked Jerry McRae if he had reviewed the recommendations,
conditions, and development standards as outlined by the Department of
Planning Services staff. He stated they have and disagree with the soil
conservation's recommendation. Since this land has and is being farmed he
felt this recommendation should be conditional upon the land no longer being
farmed.
Marvin -Barstow, applicant, stated the owner -intends to build his house on
this property (the 120 tilled acres) , and sell the other two parcels. He
also intends to continue to lease his land to the farmer who has been
farming it for the last twelve years. Of the 320 acre parcel, only 160
acres 3s tillable land.
Lee Morrison explained he Aid not feel the dust blowing ordinance would be
applicable in this instance because the land -was broken out of native
grasses prior to the resolution being made.
Debbie deBesche suggested Condition #3 be amended to read as follows:
"3. Prior to recording the plat, the applicant/operator shall
work with the Greeley Soil Conservation District to develop a
conservation plan best suited for the property. Evidence Df
an approved plan shall be submitted to the Department of
Planning Servi-ces staff."

concerns over the size of the parcels that we are dealing with. -Ivan
Gosnell - Yes; LeAnn Reid - Yes; Paulette -Weaver - No, she is concerned
about finding a proliferation of this kind of subdivision in the County and
until we, -as a County -Government and as a county citizen, discuss the
concept of the 160 acres that we currently have in the Comprehensive Plan
she would be very reluctant to approve divisions of this size under 160
acres. Ann Garrison - Yes, _because this _would be putting the land into its
second best use, and she would agree to that with two constraints. The
first constraint, that the quality of the land be protected by the County,
and the second constraint, that the -quality of life with the current and
future neighbors be protected. Jack Holman - No, he has always been of the
opinion that -once we do start something like this in an area like this then
there is no way to stop it. As you recall, some of the testimony from the
adjacent landowner was that he would like to do the same thing. Once we do
open land up for this type of residential area we run into a problem
maintaining it down to that size. Motion _carried with four voting for the
motion and two voting against the motion.

I have reviewed all three requests which involve breaking the E 1/2 of
Section 18, T_N, R67W into three parcels for development purposes , all o-f
which are smaller than the 140 acre requ i rern-ent .
The E 1/2 of Section 18, T8N, 7:47W is almost entirRly made up of soils
which are Class VI , non- irrigated . The T.r-c.posal by Mr . Barstow is to
divide the 320 ac . into 3 parcels with two 120 a-c . p-arcels on the rror-ttu and
south ends and one 8_0 ac . parcel in the middle . The north 120 ac . parce I
will be made up of approximately ':'0 ac . of grassland and 30 ac . -not-
irrigated -cropland . The middle 50 ac . parcel -will be made up of 75 ac . of
non- irrigated cropland and 5 ac . in farmsteads, tiu i Id Trigs , etc . The south
120 ac . parcel will be made up of all non- irrigated cropland. All parcels
should be considered for development land with other land use as secondary.
The main criteri-a for setting minimum lot size was to set the example
needed to maintain the land in a promluctive agricsiltural prospe-ctive. The
lands presently in non-irrigated crop I aTi-d are not cropland suited due to
shallow soils , steep slopes and erosion factors that exceed erasion limits
under normal farming practices .
The maiTi _concern is that the n-ew landowners will -not be primarily
agricultural oriented and will not have the ava i tab i l i ty or tectin i c a l
knowledge to farm the land it a conserving manner. Ttierefore , I recommend
that these lands presently it not- irrigated cropland tie res-eeded to grass
( permanent ve_getat i ve cover ) to reduce er-c's i on potential and return All
sites to th-e best suited Ianduse , grassland , and that the reseeding zhculd
be made a condition of USF< approval .

STATEMENT OF USE
We are requesting a "Use -by Special Review" to allow one residential home
and appurtenant outbuildings on a 120 acre parcel located in the agricultural zone.
The home and appurtenant outbuildings will be located in the " building envelope"
designated on the plat and contains just under one acre. The ground is currently
in dryland wheat, and the intent is to leave the balance of the ground (approximately
119 acres) in this use. The primary agricultural usage of the property is being
maintained intact.
This request is to allow a 120 acre unit in an Agricultural Zone with Dry-
land classification, whereas the normal size is 160 acres. This smaller unit will
allow either a farmer to start with a smaller acreage and less investment OR a
residential unit in an agricultural atmosphere for those who desire an agricultural
life style without a full need to make a living from the farming operation.
The existing uses in the general area are rural residential and agricultural .
There is an existing home one mile south of the subject property, and another home
approximately 1-1/2 miles northwest of th-e site.
Properties in the vicinity vary from about 5 acres to 640 acres , with most
of the units being about 160 acres.
Only a single family residence with -agricultural related structures such as
garages , barns , corrals , etc. as allowed in the -Agricultural Zone are being requested.
No special uses are being requested and all proposed uses for agricultural use, farm
animals , waste disposal , fire protection, storm water retention facilities, traffic
landscaping, erosion control and reclamation will be as governed by the Agricultural
Zone.
Electrical power and telephone lines are existing in County Road 15 adjacent
to the property. Sewage disposal will be -handled by an onsite septic system. Do-
mestic water will he provided by a domestic well . A well permit will be obtained
from the State Engineer upon approval of this application. There is an existing water
well in the East Half of Section 18.
Access to this property is directly off of Weld County Road 15. The driveway
access point is shown on the map and was designated to provide good visibility from
both directions and for efficient access to the building envelope.
STATEMENT -OF COMPLIANCE
The integrity of the policy of the Weld County Comprehensive Plan will not
be jeopardized as this proposed use will mot appreciably affect the present use or
make-up of this dryland area, i .e. a single family residential _unit will be allowed
on a 120 acre tract which will remove a minimal amount of land from -production. A
ne'w residential unit will increase the tax base withaut adverse effect on any
utilities or services .
The proposal is consist-ant with the intent of the agricultural district -as
-the primary use of the land will remain in its present a-grisultural use. The soils
in the area are rated as a capability Class VI . dryland with severe limitations to
cultivation and crops.
The location of the residential unit was selected for the normal reasons
of home siting i .e. , distance from traffic, view, space, etc. The productive agri-
cultural dryland has been conserved to the extent possible with the creation of
only a small residential site and access road.
Normal provisions for access , building separation, construction to Codes
etc. will provide the standard protecti-ons for the health and safety of the inhabi-
tants of the site, neighborhood and county.
The proposed use is compatible with the existing surrounding uses of dry-
land farming as it is the same. Only uses permitted on the adjoining properties
will be permitted on this property. The site is many miles from any urban areas and
appears to be compatible to any future development of the area.
The area does not lie within any flood plain, geological hazard or airport
overlay districts , and therefore complies with the Zoning Ordinance.
Domestic water will be supplied from a domestic well . A well permit will
be obtained from the State Engineer on approval -of this application and prior to
the sale of the parcel . Other wells are in operation serving the residential units
in the vicinity.
