RE: APPROVE ACTION OF BOARD CONCERNING DUST BLOWING COMPLAINT -
GP III
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, at its meeting of April 4 , 1988 , the Board
considered a dust blowing complaint concerning property owned
and/or operated by GP III, said property being located in the NW
corner of the intersection of 35th Avenue and Highway 34 Bypass in
Greeley, Colorado, and
WHEREAS, the Board, after considering the evidence and
testimony presented concerning this complaint, determined that
said property is within the jurisdiction of the City of Greeley,
and, pursuant to its Fugitive Dust Ordinance, the City has
exercised its authority over said property; therefore, the County
shall take no action.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the County shall take
no action concerning the dust blowing complaint against GP III ,
because it has been determined that the above described property
is within the jurisdiction of the City of Greeley, and the City
has exercised its control over said property, pursuant to its
Fugitive Dust Ordinance.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 4th day of
April, A.D. , 1988 .

RE: Dust Blowing Complaint for Property Located at the NW corner
of the intersection of 35th Avenue and the Highway 34 Bypass
in Greeley, CO (SE}SE} 14-•5-66)
Dear Sirs :
The Board of County Commissioners of Weld County, Colorado, has
been informed that dust is blowing from a parcel of land owned by
you, as hereinabove described. According to the information
received, the soil is moving from said parcel and is causing
damage to surrounding properties. Pursuant to Section
35-72-102 (b) , C.R.S. , it is the duty of the owner or occupier of
any land in the State of Colorado to prevent soil blowing from
such land.
The Board will hear the matter at its regularly scheduled meeting
on Monday, April 4 , 1988 , at 9 : 00 a.m. The meeting will take
place in the First Floor Meeting Room, Weld County Centennial
Center Complex , 915 Tenth Street, Greeley, Colorado . You may be
present at the meeting in order to give testimony relative to the
dust blowing problem.
The Board requested an inspection of the above-described property.
The inspector will be present at the meeting in order tc inform
the Board what his inspection revealed and recommend treatment of
the property. Pursuant to Section 35-72-103 (1) , C.R.S. , the Board
cf County Commissioners may order certain treatment of the parcel
so as to reduce or abate the dust blowing therefrom.

To Whom It May Concern:
This letter is to express my concern about the severe dust problem that
is being experienced around the property located at the NW Corner
of the Intersection of 35th Avenue and the Highway 34 Bypass in
Greeley.
Dust blowing has been a problem in this area since the beginning of the
Gateway Park development on this land about three years ago. The farmland
was plowed to make way for a development that is no longer something that
will happen in the near future. During periods of high wind, the homeowners
around this parcel of land experience severe problems. The intersection
at 35th Avenue and the Highway 34 Bypass is almost impassable during these
periods. I believe that a very serious traffic Lazard exists. I have
also received damage to my draperies and carpet in my home due to the
blowing dust. It is nearly impossible for my children to play outside
when the wind is blowing because of the health hazard that breathing dust
and dust blowing in their eyes would cause.
I respectfully request that the owners of the land be forced to comply
with soil erosion and dust blowing ordinances. The homeowners in this
area have been voicing their concern with this problem for three years and
we feel as if nothing has been done that has solved the problem.
I would appreciate being kept informed of any progress that is made
concerning this issue.

Thank you for calling in a dust blowinc complaint on March 24 ,
1955 . Your complaint concerns property located at NW Corner of
the Intersection of 35th Avenue and the Highway 34 Bypass in
Creeley, Colorado (SE.xr£Ea 14-5-66) . According to your complaint,
dust has been blowing from the parcel and has caused damage as a
result.
I respectfully request that you provide the Board of County
Ccrsiissioners with a note or letter describing the following:

Board of Coounty Commissioners has asked for an inspection of the
subject parcel. The inspection will determine the extent and
effect of the dust blowing.
The Board of County Commissioners will hear the matter cf the dust
complaint after it has received your note or letter . The hearing
will be on iCor;day, April 4 , 1986 , at the Board ' s regularly
scheduled meeting at 9 : 00 a .m . The hearing will take place in the
Board ' s First Floor Meeting Room, Centennial Center Complex, 915
Tenth Street, Greeley, Colorado . The Clerk to the Board ' s Office
will he sure to confirm with you of the date of that hearinc so
that you may be in attendance to testify as to the extent and

We are concerned about the dust blowing from the parcel of land at
the following location: the land at the northwest corner of
Bypass Highway 34 and 35th Avenue--extending to the South
boundaries of Greeley West High School .
Since this has been cleared for development, but has not been
developed, we get tremendous dust storms whenever the wind blows.
At times the wind had blown so much dust that at the intersection
of Bypass Highway 34 and 35th Avenue it is almost impossible to
see cars coming for a left turn. At other times we can hardly see
the houses across the street.
We are receiving extensive dust and dirt in and around the house
due to these dust storms. Since this has been plowed, we have
noticed an increase in alergies due to the excess amount of dust
in the air.
We are concerned about the continuance of this problem.
