WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on March 23 , 1983 , approved Recorded Exemption No. 591 concerning property described as Part of the SW', Section 35 , Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Associated Natural Gas, Inc. is now requesting that Recorded Exemption No. 591 be amended to increase the parcel of land used for a natural gas processing facility, and WHEREAS, the Board of County Commissioners has studied said request to amend Recorded Exemption No. 591 and deems it advisable to approve the same. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the amendment to Recorded Exemption No. 591 be, and hereby is , approved. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The parcel of land on which the request is being made is described as part of the SW1, Section 35, T4N, R66W of the 6th P.M. , Weld County, Colorado. The applicants are amending RE-591 in order to increase the parcel of land used for a natural gas processing facility. This request is being completed in conjunction with amending USA-542. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The impact on surrounding agricultural land-uses does not appear to be significantly different than the original request approved on March 23, 1983; 2. The request complies with Section 9-2 E. of the Subdivision regulations. Additionally, the plant expansion will include facilities for loading trucks with compressed natural gas which will be trucked from the site for use in oil and gas production in the area. The proposed addition will necessitate the purchase of three additional acres of land. Associated Natural Gas is therefore requesting that recorded exemption No. 591 be amended to include the additional acreage. The proposed oil and gas processing plant addition will be operated as a business with no residential units at the plant site . It will basically be operated twenty-four (24) hours per day with one to two people at the plant during normal working hours. It will be maintained by a crew working in an around the plant site to operate and maintain the plant and the gas gathering system which brings raw natural gas to the plant. The existing plant and the proposed addition is located on property presently zoned Agricultural . The addition is consistent with the Weld County Comprehensive plan as similar plants have been constructed in Agricultural zones throughout the County. The domestic sewage system at the site is a septic system sized to accommodate the equivalent of a single-family residence. No additional sanitary facilities are required for the addition. The existing domestic water supply is from the present property owner' s well. No additional domestic water is required for the addition. The operator intends to construct the addition to the plant incrementally over the next 6-8 months as gas production in the area increases . No specific landscaping plan is proposed with this site. The reclamation procedure that would be implemented when the plant is no longer needed for use would be to sell all major equipment and move it from the site . Only a minor amount of piping and unsalvageable material would remain. 851043 The fire protection measures necessary for a processing plant of this type, consist primarily of continual attention to safety procedures by the employees . Fire extinguishers will be available at the facilities and in all vehicles; however , if a major fire occurred, even the local fire departments would not be able to control such a fire. It would be necessary to shut down the gas pipeline system and let the fire burn itself out . Automatic emergency shutdown valves are provided in this event. All facilities subject to burning have been set back at least sixty- five ( 65 ) feet from the County Road to provide extra protection to the roadway. Future development in the area is anticipated to be additional Agricultural uses with continued development of the oil and gas available in rural Weld County . This future development is compatible with the use intended and in fact is necessary in the case of oil and gas development. This application complies with the Weld County Zoning Ordinance , Section 50 , Overlay District Regulations , in that no overlay districts exist at the proposed gas processing plant site.
