RE: APPROVE DOCUMENTS CONCERNING PURCHASE OF WATER SERVICES FROM
THE CENTRAL WELD COUNTY WATER DISTRICT AND AUTHORIZE CHAIRMAN
TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with certain documents
between Weld County and the Central Weld County Water District
concerning the purchase of water services for the Peckham Grader
Shed located in the NW, of Section 23 , Township 4 North , Range 66
West of the 6th P.M. , Weld County, Colorado, and
WHEREAS , the terms and conditions are as stated in said
Documents , copies of which are attached hereto and incorporated
herein by reference , and
WHEREAS , after study and review, the Board deems it advisable
to approve said Documents .
NOW, THEREFORE, BF IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the documents between
Weld County and the Central Weld County Water District concerning
the purchase of water services be , and hereby are , approved .
BE IT FURTHER RESOLVED by the Board that the Chairman he, and
hereby is , authorized to sign said documents .
The above and foregoing Resolution was , on motion duly made
and seconded , adopted by the following vote on the 12th day of
July, A.D. , 1989 .

ACTIVE TAPS
TAP FEE AGREEMENT
THIS AGREEMENT, made and entered into this` 12th day of July , 19 89_
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter called the
District, andX WELD COUNTY BOARD OF COMMISSIONERS and
hereinafter called Customer, WITNESSETH:
WHEREAS, District has been organized as a legal body and is known as the
Central Weld County Water District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring
to join said District, or U/A and,

WHEREAS, Customers are desirous of acquiring otilE water tap of ib't
inches in diameter from the said District,
NOW, THEREFORE , in consideration of the premises and the terms of this agreement,
it is mutually agreed as follows:
1 . Customer agrees tp pay the tap fee of $ caccooe0

2. In the event it is not economically feasible to extend the water to the
property line of Customer, which matter is in the entire discretion of District,
then all sums paid hereunder shall be returned to Customer and the agreement shall
be null and void.
3. The description of the premises for which these taps are being purchased
is as follows:
Lot 'A' of Recorded Exemption Number 1057-23-2-RE-600 as recorded June 9,
1983 in Book 0999 as Reception Number 01928764 of the records of Weld
County Clerk and Recorders and being part of the NWT of Section 23,
Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado
4. This agreement, when approved by the Board of Directors, shall become a
legal and binding contract upon all parties hereto.
5. Customer further agrees to execute any and all easements needed by District
at no expense to District, across Customer' s property for the purpose of installing
any pipelines constructed by District. District shall be responsible for restoring
surface area back to reasonable condition at District cost.
6. It is further mutually agreed that this agreement shall extend to and be
binding upon the heirs, executors, administrators and assigns of the parties hereto.
7. Customer further agrees to the following special provisions:

and regulations of the District.

TO: THE BOARD OF DIRECTORS OF THE CENTRAL WELD COUNTY WATER DISTRICT
I/we, being all of the owners of the below described real property, which
property is capable of being served with the facilities of the aforesaid District,
hereby petition the Board of Directors of said Central Weld County Hater District
to include the below described real property within the boundaries of said District.
Assent to the inclusion of such property is hereby given by the below signers ,
which signers constitute all of the fee owners of said below described property.
Lot 'A' of Recorded Exemption Number 1057-23-2-RE-600 as recorded
June 9, 1983 in Book 0999 as Reception Number 01928764 of the records
Of Weld County Clerk and Recorders and being part of the Nler. of Section
23, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado
Owner (s) further agree to give the District any and all easements, for
pipelines, they deem necessary, at no expense to the District.

SUPPLEMENTAL NR WATER SERVICE POLICY TO DISTRICT RULES AND REGULATIONS :
A. ENE1. Tentative fees : Meters larger than 1 inch must be accepted
individually by Board action .
2 . Standby Taps : Standby Taps are taps purchased but not activated .
Standby Taps are subject to the extension policy in effect when
activated and are subject to renewal at the option of the District
Board after five years from date of purchase . All Standby Tap
purchases are subject to approval of the Board .
3 . A separate meter is required for each individually-owned property ,
except by separate written agreement with the District .
4 . For mainline extensions , services , and appurtenances required to
serve individual taps , subdivisions or other developments ; the
customer and/or developer shall be responsible for all costs .
Where required by District for future expansion , customer and/or
developer may be required to front necessary monies for oversizing
of the District mains . A separate written agreement is required .
5 . Where land is subdivided into lots , the Developer and/or Owner
shall meet the requirements of the District for the water system.
The Owner and/or Developer shall be responsible for all costs and
the installation of all water mains and appurtenances within the
Subdivision . Prior to construction , completed plans and specifi-
cations must be submitted to the District and approved in writing .
All materials and installations shall be subject to the approval
of the District . Advance written notice shall be given to the
District prior to any construction. After final written acceptance
by the District , Owner shall deed the water system to the District .
Complete and acceptable reproducible maps of record drawing of
system must be provided to the District .
6 . The District shall not be committed to future taps beyond that
amount paid in tap fees , except by separate written agreement .
The District will not reserve service in water mains for Future
taps , unless by separate written agreement .
B. ADMINISTRATIVE AND STUDY FEES:
1 . For consideration for a new water service , the potential customer
shall pay an Administrative Study Fee . Where a District line
extension is required to serve customer , said fee amount shall be
doubled .
2 . Where more than one tap is being considered , $5 . 00 is required for
each equivalent dwelling unit in addition to the designated fee .
3 . Letters indicating service availability will be provided only if
property owner has paid an Administration and Study Fee .
C. CAPITAL IMPROVEMENT FEE:
The Capital Improvement Fee may be reduced by $200. 00 where meter
and service installations are not installed by the District .
( Applies primarily to subdivisions or towns and requires separate
written agreement . )
D . MINIMUM RAW WATER REQUIREMENT$:
1 . Raw Water Fee subject to review and change by Board at any time .
2 . District may require raw water in lieu of Raw Water Fee .
3 . All raw water transfer costs shall be the obligation of owner
and/or customer .
4 . Raw water supplied shall be Colorado Big Thompson Project water or
Windy Gap water , unless otherwise accepted in writing by District .
5 . A surcharge shall be paid for all water used over the annual
allotment shown or established for the applicable water year .
Said surcharge shall be 40% of the lowest base rate per 1 , 000
gallons .
6 . Subject to approval by the Board of Directors , customer may trans-
fer raw water in ownership to the District and said customer ' s
annual allotment shall be increased in the amount of 300 , 000 for
each C .B . T . and W. G. unit transferred .
