RE: GRANT MOBILE HOME PERMIT NO. 1600 - BARBARA A. MILLER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 29th day of November, 1989, considered the
request of Barbara A. Miller for a mobile home to be used as a
principal dwelling, and
WHEREAS, said mobile home is to be occupied in an
A-Agricultural Zone District on a parcel of land being more
particularly described as follows :
Part of Section 21 , Township 1 North, Range 63
West of the 6th P.M. , Weld County, Colorado
WHEREAS, at the meeting of November 29 , 1989 , a motion was
made and seconded that the Board of County Commissioners, having
heard the testimony, find that said request should be granted
subject to the following conditions: 1) The applicant shall
obtain a building permit for the mobile home within thirty days
from the date of approval by the Board of County Commissioners; 2)
A septic permit shall be obtained prior to the issuance of a
building permit; 3) If the owner changes the domestic uses of the
existing well , a permit must be obtained to drill a new well; and
4) The mobile home shall not be occupied until such time that the
applicant has complied with the above mentioned conditions, and
WHEREAS, at said meeting of November 29 , Commissioners
Harbert and Lacy voted "aye" and Commissioners Brantner and Kirby
voted "nay" , resulting in a tie vote, and
WHEREAS, pursuant to the Policy concerning Land-use matters,
Commissioner Kennedy reviewed the record and listened to the tape
of said meeting, and, at the regular meeting of the Board on
December 6 , 1989, cast the deciding vote in favor of granting ZPMH
No. 1600 for Barbara A. Miller.

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Barbara A. Miller for permission to place a mobile home to be used
as a principal dwelling on the above described parcel of land,
which was found to be in compliance with Section 43 of the Weld
County Zoning Ordinance , be, and hereby is , granted subject to the
hereinabove listed conditions.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote.

This request is for one mobile home to be used as a principal dwelling.
Legal Description of Parcel: Part of Section 21, T1N, R63W of the 6th P.M. ,
Weld County, Colorado
Location: West of Weld County Road 67, south of Weld County Road 8
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the following reasons:
WILL WILL NOT
X Be compatible with the Weld County Comprehensive
Plan.
X Be compatible with the surrounding area.
X Be in harmony with the character of the
neighborhood.
X Adversely affect the immediate area.
X Be adequately served by water and sewage disposal
facilities.
X Adversely affect the general health, safety, and
welfare of the inhabitants of the area and the
County.
COMMENTS:
The Department of Planning Services' staff has concerns about the ability of
the existing wells to supply an adequate source of water. Existing on the
parcel are a livestock well and a well for household use only. The Division
of Water Resources has stated that the applicant could write a letter
abandoning one of the wells. The applicant could then apply for a new well
permit which would allow domestic uses including lawn and garden.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The applicant obtaining a building permit for the mobile home
within thirty (30) days from the date of approval by the Board of
County Commissioners.

2. A septic permit shall be obtained prior to the issuance of a
building permit.
3. Prior to the issuance of a building permit, the owner shall submit
evidence that a new well permit has been obtained for domestic
uses and that the well is supplying water in such a manner as to
be adequate in quality, quantity, and dependability for the
proposed use.
4. The mobile home shall not be occupied until such time that the
applicant has complied with Conditions 1, 2, and 3 above.

18. With respect to the growing crops Seller and Purchaser agree as follows: to be property of Purchaser at the time of
closing and delivery of deed.
17.Possession of the Property shall be delivered to Purchaser on date of closing and delivery of deed

If Seller fails to deliver possession on the date ligroin specified,Seller shall be subject to eviction and shall be liable for a daily rental of
S 50.00 until possession is delivered.
• 18.The risk of loss from any damage to the improvements by fire or other casualty prior to the date of closing shall be on Seller;provided,however,that
if Seller shall maintain insurance on said improvements which will compensate for the full replacement value thereof,and if Purchaser elects to carry
out this contract despite such damage,Purchaser shall be entitled to all such insurance proceeds.The risk of loss for any damage to growing crops,by fire
or other casualty,shall be borne by the party entitled to said crops as provided in paragraph 16,and such party shall be entitled to the insurance proceeds,
if any.
19.Time is of the essence hereof.If any note or check received as earnest money hereunder or any other payment due hereunder is not paid,honored or
tendered when due.or if any other obligation hereunder is not performed as herein provided,there shall be the following remedies:
(a)IF PURCHASER IS IN DEFAULT,then all payments and things of value received hereunder shall be forfeited by Purchaser and retained on be.
half of Seller and both parties shall thereafter be released from all obligations hereunder.It is agreed that such payments and things of value are LIQUI-
DATED DAMAGES and are(except as provided in subparagraph(c))the SELLER'S SOLE AND ONLY REMEDY for the Purchaser's failure to perform
the obligations of this contract.Seller expressly waives the remedies of specific performance and additional damages.
(b)IF SELLER IS IN DEFAULT,(I)Purchaser may elect to treat this contract as terminated.in which case all payments and things of value received
hereunder shall be returned to Purchaser and Purchaser may recover such damages as may be proper,or(2)Purchaser may elect to treat this contract as
being in full force and effect and Purchaser shall have the right to an action for specific performance or damages.or both.
(c)Anything to the contrary herein notwithstanding,in the event of any litigation arising out of this contract.the court may award to the prevailing
party all reasonable costs and expense, including attorneys'fees.
(d) J.L. Sears & Associates represents the Seller in this transaction but pledges to treat all parties hereto
in a fair and businesslike manner.
20.Purchaser and Seller agree that in the event of any controversy regarding the earnest money or things of value held by broker,unless satisfactory
mutual written instruction is received by broker,broker shall not be required to take any action but may await any proceeding,or at broker's option and
discretion,may interplead any moneys or things of value into the court and may recover court costs and reasonable attorneys' fees.
21. Additional provisions:
A.) Purchaser shall seek authorization from Weld County officials to place 2 mobile homes on this property.
Said authorization will be obtained at Purchaser's expense prior to date of closing. Should Purchaser be unable
to obtain this authorization, this contract shall beccme null and void, at Purchaser's option, and all earnest
monies refunded.
8.) All parties agree to extend this contract as may be necessary by mutual agreement to accomodate mobile
home permitting process.
22. If this proposal is accepted by Seller in writing and Purchaser receives notice of such acceptance on or before September 4
19 89 this instrument shall become a contract between Seller and Purchaser and shall inure to the benefit of the heirs,successors and assigns of

Dear Ms. Miller:
Your mobile home zoning permit application is complete and in order and will
be processed by our office on or before November 15, 1989. If it is
determined that the application meets the approval criteria of Section 43 of
the Weld County Zoning Ordinance and you have submitted a petition with the
signatures of at least 70% of the surrounding property owners who have no
objection to your request, you will be notified that the zoning permit is
approved. If the staff determines that the application does not meet the
approval criteria, you will be notified and asked to appear before the Board
of County Commissioners at a public hearing. You will be informed of the
hearing date at least a week prior to the hearing. The Board of County
Commissioners will then consider your application and make a final decision
on the zoning permit for the mobile home.

County , State of Colorado , state as follows :
1 . That we own one or more parcels of real property in Weld
County , Colorado ;
2 . That we are aware that Barbara A . Miller has requested a
zoning permit for a mobile home to be used as a principal
dwelling , to be located on part of SECTION TWENTY-ONE (21) ,
TOWNSHIP ONE (1 ) NORTH , RANGE SIXTY-THREE (63 ) WEST OF THE 6TH
P .M . , WELD COUNTY , COLORADO , which section is located west of
Weld County Road No . 67 and South of Weld County Road No . 8 ;
3 . That the Weld County Board of County Commissioners is to
hold a public hearing concerning this request of Barbara A .
Miller on Wednesday , November 29 , 1989 , at 9 :00 A .M . , in the
County Commissioners ' Hearing Room, first floor , Weld County
Centennial Center, 915 10th Street , Greeley, Colorado ; and
4 . That we object to the Weld County Board of County
Commissioners granting the request of Barbara A . Miller for a
