RE: APPROVAL OF AMENDMENT TO USE BY SPECIAL REVIEW BY EXPANSION
OF A NATURAL GAS PROCESSING PLANT - ASSOCIATED NATURAL GAS,
INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 26th day of June, 1985 , at or about 9 : 00 a.m. in
the Chambers of the Board for the purpose of hearing the
application of Associated Natural Gas , Inc. , 1401 17th Street,
Suite 600 , Denver, Colorado 80202 , to amend a Use by Special
Review Permit by expansion of a natural gas processing plant on
the following described real estate, to-wit:
Part of the SE', Section 35 , Township 4 North,
Range 66 West of the 6th P.M. , Weld County,
Colorado
WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the policies of the
Comprehensive Plan. Expanding the gas processing
plant will not adversely impact the agricultural
interest of the County. The subject site is
located on valent sand with a capability subclass
of Vie and is non-prime agricultural land. The
size and location of the expansion is as small as
possible and preserves the maximum amount of
agricultural land in the farm parcel. il7q 2

b. The proposal is consistent with the intent of the
Agricultural Zone District since it does not
adversely impact the agricultural interest of the
County. The proposal expands the capabilities of a
plant used for gathering raw natural gas from gas
wells in the area. These gas fields are fixed in
location.
c. The permitted use would be compatible with the
existing surrounding land uses. The surrounding
land uses are agricultural in nature.
d. The permitted use would be compatible with future
development of the surrounding area as permitted by
the existing zoning and with the future development
as projected by the Comprehensive Plan or Future
Development Plan of the Town of Gilcrest. The Weld
County Comprehensive Plan and Gilcrest Future
Development Plan indicate that the future
development of the area is intended to be
agricultural in nature.
e. No overlay districts affect the site.
f. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for
amendment of a Use by Special Review by expansion of a natural gas
processing plant on the hereinabove described parcel of land be,
and hereby is, granted subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . The prescribed Use by Special Review activity shall not
occur nor shall any additional building or electrical
permits be issued on the subject property until the Use
by Special Review plat has been delivered to the
Department of Planning Services office and the plat has
been recorded in the office of the Weld County Clerk and
Recorder.
3 . Prior to recording the amended Use by Special Review
plat, the plat shall be amended to show a fifteen foot

(15 ' ) high sound barrier fence on the west and north
side of the gas compressors and air compressors. The
electrically operated compressors are not required to
have a sound barrier fence.
4 . Prior to recording the amended Use by Special Review
plat, the owner/operator shall submit evidence to the
Department of Planning Services that the concerns of the
Division of Water Resources, as stated in its letter
dated May 8 , 1985 , have been satisfied.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of

OPERATION STANDARDS
Associated Natural Gas, Inc.
Amended USR-542 :85 : 16
1 . The uses permitted shall be a natural gas processing facility
as described in the application materials amending
USR-542 : 85 : 16 on file with the Department of Planning
Services and subject to the Operation Standards listed
hereon.
2 . A chain link fence, a minimum of six feet in height, shall
enclose the amended USR area.
3 . Upon cessation of the proposed use, the natural gas
processing facility shall be removed and the land reclaimed
to its prior use.
4 . All vehicular traffic shall ingress and egress onto Weld
County Road 35 . The truck traffic haul route shall be from
the point of ingress and egress, north to Weld County Road 40
and west on Weld County Road 40 to State Highway 85 .
5 . The operator shall complete a road maintenance and
improvements agreement with Weld County, for maintaining and
upgrading Weld County Road 35 and Weld County Road 40 to
specifications to be approved by the Board of County
Commissioners prior to beginning the proposed use. A copy of
the agreement shall be forwarded to the Department of
Planning Services.
6 . The subject site shall be limited to the four accesses as
shown on the amended USR plat. All accesses will have a
fifteen inch (15" ) x sixty foot (60 ' ) C.M.P. culvert for
drainage.
7 . Construction of a flare pit shall be prohibited in the Use by
Special Review area.
8 . Liquified petroleum gas (LPG) is considered a hazardous
substance per C.R.S. 29-22-107 (2) (a) . Prior to the issuance
of any additional building permits, the owner/operator shall
list the maximum quantity of LPG expected at the site with
the State Health Department, Division of Waste Management,
and with the Weld County Emergency Response Coordinator.
Evidence of this listing shall be provided to the Department
of Planning Services.
9 . The operator shall provide the Platteville Fire Protection
District a list of four names , phone numbers, and addresses
of responsible parties it can contact in case of an
emergency. The operator shall provide instructional training
on the gas processing plant to representatives of the
Platteville Fire Protection District.
10 . A fifteen foot high wooden sound barrier fence shall be
constructed and maintained on the west and north sides of the
gas and air compressors . Additionally the existing engine
mufflers shall be changed to "hospital grade" mufflers and
all future engine mufflers must be hospital grade. In the
event that noise measurements show any violation of the State
Noise Standards, the wooden sound barrier shall be improved
by increasing the size, dimension or composition of the
barrier.
11 . The applicant shall comply with the design standards for the
Use by Special Review, Section 24 . 5 et seq. , of the Weld
County Zoning Ordinance.
12 . The applicant shall comply with the Operation Standards for
Uses by Special Review, Section 24 . 6 et seq. , of the Weld
County Zoning Ordinance.
13 . Representatives or members of the Weld County Health
Department and Weld County Department of Planning Services
shall be granted access onto the site at any reasonable time
in order to insure the operations carried out on the site
comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
14 . The Use by Special Review area shall be limited to the plans
shown hereon and governed by the Standards as stated above
and all applicable Weld County Regulations. Any material
deviations from the plans and/or Standards as shown or stated
above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board
of County Commissioners before such changes from the plans
and/or Standards are permitted. Any other changes shall be
filed in the office of the Department of Planning Services.
15 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated
Standards . Noncompliance with any of the above stated
Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

RE: AMEND USE BY SPECIAL REVIEW - EXPANSION OF A NATURAL GAS

A public hearing was conducted on June 26, 1985, at 2:00 P.M. , with the
following present:

Commissioner Frank Yamaguchi

The following business was transacted:
I hereby certify that pursuant to a notice dated May 29, 1985, and duly
published June 6, 1985, in the Johnstown Breeze, a public hearing was
conducted to consider amending a Use by Special Review permit to expand
a natural gas processing plant for Associated Natural Gas, Inc. On
June 24, 1985, the motion was to continue this hearing to allow the
Planning staff to develop new Operation Standards concerning a possible
Road Maintenance Agreement and the noise level. Rod Allison, Planning
Department representative, presented the Board with a new set of
Operation Standards. Mr. Allison stated that changes were made to
Standard #4, which addresses the USR truck haul route; Standard #5,
which addresses the Agreement between Weld County and the Operators;
and Standard #10, which addresses the noise level. Joe DeGraeffenreid,
with Associated Natural Gas, Inc. , came forward and stated that there
are no problems with the new Standards. After discussion concerning
Standard #10, Commissioner Kirby moved to approve the Amendment to the
Use by Special Review Permit for Associated Natural Gas, Inc. with the
new Operation Standards as presented by Mr. Allison. Commissioner
Brantner seconded the motion and it carried unanimously. At this time,
Amended RE #591 was heard by the Board. Rod Allison, Planning
Department representative, read the favorable recommendation of the
Planning staff into the record. He stated that this request is to
increase the parcel of land which is used for the natural gas facility.
Commissioner Lacy moved to approve Amended RE #591 and Commissioner
Brantner seconded the motion. The motion carried unanimously.

Tear Mr . Allison :
Subsequent to the Weld County Planning Commission ' s denial of
a motion to recommend approval of the proposed amended special
use permit , we have collected additional data regarding the noise
impact of the plant on the surrounding area. This data will be
presented to the Board of County Commissioner on June 17 , 1985 ,
and will show that the plant meets all state and county
r-egulations relating to noise . However , in order to further
lessen the plant's impact on the community, we will implement ( if
the permit is approved ) additional measures as follows :
1 — Increase the height of the sound barrier fence to 15
Teet .
2 — Replace all existing engine mufflers with "hospital
grade" mufflers which will provide the maximum sound
-mitigation that can be provided by a muffler . This
level of sound mitigation is significantly greater
than provided by our present mufflers . All future
-mufflers will be of the same grade .
We propose that Operations Standard #9 be revised as follows :
A fifteen ( 15) foot high wooden sound barrier fence shall
be constructed and maintained on the west side of the gas and air
compressors as shown on the amended Use by Special Permit plat .
Additionally , the existing engine mufflers be changed to
"hospital grade" mufflers and all future engine mufflers be
"hospital grade" .
Also attached is a revised permit drawing showing the
location of the proposed fence .

Natural Gas, Inc. Kersey Gas Processing Plant

It has come to Amoco' s attention that Associated Natural as, Inc.
(ANGI ) is applying for modification of their current permit to
be able to expand their Kersey Gas Processing Plant. Amoco recently
contracted some gas production in North Wattenberg Field to ANGI
to be processed in this facility. Amoco is evaluating potential
additional drilling in the area. Future capacity availability in
the ANGI plant could provide either a potential market for the
resultant gas or a facility to process the gas to allow sales to
other markets.

Dear Ms. Johnson:
As you know all too well, oil and gas assessments have been declining.
At a time when county and municipal governments need more revenue to
handle less federalism, this current state of affairs facing the com-
missoners must be frustrating.
The oil and gas industry in the basin is facing some rather frustrating
problems of its own. The restrictive influences on oil and gas develop-
ment have never been greater. International price competition for oil
puts the domestic producer at a distinct disadvantage. Deregulated
gas prices have left many producers without a gas contract from the
large pipeline companies.
The tax proposals in Washington have put many prospects on hold. It
is a time when many in the oil business are deciding if a future really
exists for them to continuing operating. Others have simply decided
that no future exists and are pursuing other interests.
On Monday, June 17th, the Weld County Commissioners have an opportunity
to, in no small way, help maintain the viability of Weld County as the
largest producer of oil and gas in the Denver-Julesburg Basin.

Request for Associated Natural Gas, Inc.
To Expland Kersey Plant
Sirs:
HO-AD, Inc. is very concerned about the possibility of Associated Natural Gas,
Inc not being allowed to expand their Kersey Plant. We have been doing business
with Associated Natural Gas, Inc. since their inception. They are one of our largest
customers. Associated Natural Gas, Inc. pays their accounts on or before due dates
in every respect.
Due to the nature of our business, which is gas measurement facilities, pipeline
construction, plant installation and various types of equipment and labor that is
leased to Associated Natural Gas, Inc. almost on a daily basis, we are very concerned
of the fact that this will greatly effect our business and employees (32 total ) . The
Associated Natural Gas, Inc. account is approximately thirty-three percent (330) of
HO-AD, Inc. yearly earnings. If they are not allowed to expand, no more gas can be
accepted by Associated Natural Gas, Inc. , and as a result, no more well connects will
be made, ending or greatly affecting any growth for Associated Natural Gas, Inc. or
HO-AD, Inc.
We, as tax payers, contributors to Weld County, plead that you favorably consider
this expansion.

Gentlemen:
As an active producer of Natural Gas in Weld County, Golden Buckeye
Petroleum Corporation wishes to express its support for the proposed expansion
of the Associated Natural Gas Kersey Plant. It is our feeling that such
expansion is in the best interest of the citizens of Weld County as well as, of
course, the Oil and Gas industry in the area for the following reasons:
1) . Oil and Gas sales and the taxes generated therefrom represent a very
significant and increasing source of revenue to and for the benefit of
the citizens of Weld County.
2). Increasing the capacity of Associated' s Kersey Plant increases the
potential production of Natural Gas, thereby increasing the county's
tax base.
3) . Failing to approve tne expansion would result in exceeding the
capacity of the currently existing facilities, which in turn will
result in curtailment of production "takes" by Associated to the
producers in the area. The production in this area is very sensitive
to economics, and such curtailments would almost certainly result in a
significant decrease in the amount of drilling in the area, (including
that done by Golden Buckeye) and therefore a corresponding decline in
the tax base available from oil and gas production.
In addition to the above, as we are sure you are aware a large number of
support businesses have sprung up as a result of the oil and gas activity in the
area. These small businesses are very dependent on the continued drilling and
production in the area, and would undoubtedly be seriously and negatively
inpacted by a decision not to allow expansion of this or other gas processing
plants in the area.

consideration to Associated's application for expansion.

Gentlemen:
As an active producer of Natural Gas in Weld County, Golden Buckeye
Petroleum Corporation wishes to express its support for the proposed expansion
of the Associated Natural Gas Kersey Plant. It is our feeling that such
expansion is in the best interest of the citizens of Weld County as well as, of
course, the Oil and Gas industry in the area for the following reasons:
1). Oil and Gas sales and the taxes generated therefrom represent a very
significant and increasing source of revenue to and for the benefit of
the citizens of Weld County.
2). Increasing the capacity of Associated's Kersey Plant increases the
potential production of Natural Gas, thereby increasing the county's
tax base.
3). Failing to approve the expansion would result in exceeding the
capacity of the currently existing facilities, which in turn will
result in curtailment of production "takes" by Associated to the
producers in the area. The production in this area is very sensitive
to economics, and such curtailments would almost certainly result in a
significant decrease in the amount of drilling in the area, (including
that done by Golden Buckeye) and therefore a corresponding decline in
the tax base available from oil and gas production.
In addition to the above, as we are sure you are aware a large number of
support businesses have sprung up as a result of the oil and gas activity in the
area. These small businesses are very dependent on the continued drilling and
production in the area, and would undoubtedly be seriously and negatively
inpacted by a decision not to allow expansion of this or other gas processing
plants in the area.

Dear County Commissioners:
On behalf of Basin Exploration, Inc. I would like to express my support
of Associated Natural Gas and the proposed expansion of their
processing plant in the Kersey area. This proposed plant would open
new areas for drilling which are presently inadequately served by a gas
plant , due to large quantities of gas being produced in the area.
Associated Natural Gas Company has provided a viable market for small
-companies whose shut-in wells were either tied into Panhandle Eastern
Pipe Line Company' s system or had no viable market for their production
at all. We feel Associated Natural Gas Company has directly
contributed to the economic survival of numerous small oil and gas
producers in Weld County.
-In conclusion, Basin Exploration, Inc. is in support of an expanded
Associated Natural Gas plant in the Kersey area, feels it will be a
valuable asset and requests that the Weld County Board of County
Commissioners give it careful consideration.

It has been brought to my attention that Associated Natural Gas
has proposed expanding its natural gas processing capability at
its Kersey plant.
Frizzell Oil Company is a small, independent exploration and
production company. The market for our produced gas that
Associated has provided has been crucial to our being able to
drill the wells we have in Weld County. The expansion of the
Kersey plant will make continued operations in Weld County
feasible.
Working with Associated has been an experience marked by
professionalism, integrity, and exemplary performance. From my
experience, I can highly recommend them as an organization
willing to do their part.
Please add my expression of support for the request of Associated
Natural Gas to expand the Kersey gas plant.

Dear Board Members:
Bellwether Exploration has been notified of the above Cause and would
like to take this opportunity to explain briefly our position.
Associated Natural Gas has proved invaluable to producers of oil and
gas, such as ourselves, because they have offered a market for our
products in areas that have not traditionally been attractive to
larger purchasers, such as Panhandle Eastern Pipe Line Company.
Shey have benefited landowners because cash flow streams that would
not have been available under Panhandle contracts, and are now released
-to Associated, are now helping to stabilize the farm community through
royalty payments at a time when farmers need to generate all the
revenue they can from any source.
Associated Natural Gas aggressively purchases gas and is in need of
additional thoughput capacity. More equipment at the Kersey Plant
site in Gilcrest is necessary to achieve this end.
Royalty owners and exploration companies benefit directly, and the
county benefits indirectly, from oil and gas extracted from the ground.
Bellwether alone, expects to pay over $400,000 per year in advalorem
taxes. Zf you multiply the number of companies that have approximately
the same number of wells in Weld County, the revenues to the county
become staggering. And this is from oil and gas operators alone!

Dear Sirs:
Irt has come to our attention that Associated Natural Gas
(Associated) is seeking permission of your Board to expand its
Kersey Plant in Weld County. This firm does not represent
Associated, but we do represent a number of small producers which
sell their natural gas to Associated.
As you know, there is a surplus of natural gas in the market-
place today. The largest purchaser of natural gas in the area
has substantially reduced its price for natural gas and at—the
same time has reduced its takes. While the major purchaser will
still take 100% of casinghead gas, it has also reduced the price
it pays for such gas below the market price. In addition, the
major purchaser has refused to hook up any more wells for at
least the next two years.
The result of this policy has been to force producers to seek
alternative purchasers. As for new wells in the area, an
alternative purchaser is absolutely necessary. For old wells,
such a purchaser may spell the difference between economic
disaster and solvency.
Associated represents one of the most important alternative
purchasers in the area because it has the ability to take gas at
capacity levels. However, as Associated reaches the capacity of
its processing plants, that ability may be impaired. This could
have a detrimental effect on the oil industry in the area,

especially on the Codell/Niobrara play, if there is not a place
to market casinghead gas. Such a slowdown would also be
economically detrimental to Weld County.
On behalf of our clients, we would like to recommend that the
Board of Commissioners favorably consider Associated 's request
bor an expansion of its Kersey Plant to keep that alternative
option alive and well in Weld County.

Gentlemen:
This letter is in support of Associated Natural Gas ' request for
-a special use permit in order to increase the size of their Kersey
_plant.
Over the past two years , Shepler & Thomas , Inc . has drilled 37
wells in the general area of Johnstown. A significant factor in being
able to attract investment dollars for these wells was the fact that
Associated provided a market for all the gas that could be produced.
Investors in Shepler & Thomas , wells currently plan to drill approximately
thirty new wells in Weld County in 19-85 . In our opinion, if there were
a significant risk of not having a continuing market for all gas produced,
this number would be greatly reduced. The economics of Codell-Niobrara
completions is such that a well needs to be produced pretty much con-
tinuously in order for the return on investment to be acceptable . Even
increased line pressure in a gas gathering system can restrict production
to the point were the economics are adversely affected .
We estimate that the property taxes to be generated over the
next four years by the thirty wells to be drilled this year will be approxi-
mately $720 ,000 . Additionally, 30 wells will generate $9 million in
drilling and completion expenditures , much of which will accrue to Weld
County businesses .
We strongly urge that Associated ' s request be approved .

attention that a proposed expansion of one of Associated Natural Gas Company's
processing plants is meeting with considerable opposition.
On bahalf of Calvin Petroleum Corporation and the landowners which we represent,
may I ask that you give very serious consideration to approving Associated
Natural Gas Company's request for facilities expansion and urge your associates
to do the same. I have reviewed with Gene Brantner the chain of events which
has recently had tremendous adverse impact on the natural gas market. Your tax
base will reflect the results of that impact.
Associated Natural Gas Company has provided a viable market for small companies
whose shut—in wellswere either tied into the system of Panhandle Eastern Pipe
Line Company or did not have any market for their product, at all. I believe
it would be a fair statement to say that Associated Natural Gas Company has directly
influenced and contributed to the economic survival of many small oil and gas
producers in Weld County. Without this market, many companies may well have been
forced into bankruptcy.
To deny Associated Natural Gas Company a much needed expansion of their facility
may prevent many of these small companies from reaching a natural gas market.
This, in turn, will certainly slow, if not stop, the development of new leases
and drilling programs. The result of that would be lost revenues for already
beleagured farmers and the Weld County Treasury.

I am writing this letter to express my support of Associated
Natural Gas and their proposal to expand their gas processing
plant in the Kersey area . As an oil and gas producer in this
area, I know that one of the major problems we face in this
area is the large quantity of gas being produced without having
the facilities to process this gas . The availability of the
market and transport of gas is a prime consideration to an
operator before a well is drilled. This proposed processing
plant would open up new areas for drilling that are not now
adequately served by a gas plant .
We are presently selling gas to Associated from several of our
wells and they are professionals in every sense of the word.
They are the only company in this area that I am aware of that
is buying gas full time without extended shut-in periods . An
expanded gas plant in the Kersey area will open up drilling
into areas that have excellent production potential .
In conclusion I feel an expanded Associated Natural Gas plant
in the Kersey area will be a valuable asset , not only for the
local oil and gas industry but also for the county taxpayers .

A regular meeting of the Weld County Planning Commission was held on June 4,
1985, in the County Commissioners' Rearing Room, Weld County Centennial

order by the chairman, Bob Ehrlich, at 1:30 p.m.

LEGAL DESCRIPTION: Part of the SE' Section 35, T4N, R66W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Approximately 2.5 miles southeast of Gilcrest; south of Weld
County Road 40 and west of Weld County Road 35.
APPEARANCE:
Joe Degraffenried, President, Associated Natural Gas, Inc. , reported they
want to expand their gas facility southeast of Gilcrest. They are currently
capable of processing fifteen million cubic feet of gas per day and they
would like to be able to process thirty million cubic feet per day. They
are currently receiving gas from three hundred and eighty wells, but they
have enough room to at this site to process gas from one thousand wells.
They sell the gas processed at this site to Western Gas Supply. The safety
factors of this plant comply with all federal, national, state, and local
regulations. They have taken pains to be rated one of the safest and
quietest plants around. There is an average of five trucks per day entering

the area at this time. Expansion of the plant would increase traffic to
approximately ten trucks per day.
Richard Powell, Associated Natural Gas, Inc. , reported on the safety
features of the plant and of their meeting with the Gilcrest Planning
Commission.
The Chairman asked Rod Allison to read the recommendations, Conditions, and
Operation Standards, as outlined by the Department of Planning Services
staff into the record.
The Chairman called for discussion from the audience.
Richard Miller, area resident, spoke against this proposal because of the
noise, traffic, and loss of wildlife to the area.

Phil Behrig, adjacent property owner, spoke against this request because of
the noise and increased traffic.
John Hopkins, surrounding property owners, spoke against this request
because of the noise, increased traffic, and lack of safety precautions
taken by truck drivers and maintenance workers entering the plant site area.
Max Ulrich, area resident, spoke against this request because of the noise,
excessive speed of the vehicles, and road deterioration caused by the gas
plant traffic.
Bill Brunner, surrounding property owner, spoke against this proposal
because of the noise, traffic, deterioration of the roads, and lack of
safety and courtesy shown by those who drive vehicles into and out of the
gas plant area.

Sharon Linhart moved Operation Standard #9 be amended to read as follows:
9. A ten (10) foot high wooden sound barrier fence shall be
constructed and maintained on the west side of the gas
and air compressors as shown on the amended Use by
Special Review Permit plat. If periodic regular noise
measurements show any violation of state noise
standards, the wooden sound barrier shall be improved by
increasing the size or composition of the barrier.

MOTION:
Sharon Linhart moved Case Number Amended USR-542:85: 16 for Associated
Natural Gas, Inc. , to amend a Use by Special Review permit for the expansion
of a natural gas processing plant be forwarded to the Board of County
Commissioners with the Planning Commission's recommendation for approval
based upon the recommendations and conditions, as outlined by the Department
of Planning Services staff and the Operation Standards as outlined by the
Department of Planning Services staff and amended by the Planning
Commission. Motion seconded by Jack Holman.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Sharon - yes; because she does understand
the concerns of the citizens and she is certainly sympathetic to them. But
this actually opens up a window of opportunity for us to require Associated
Natural Gas to install noise abatement that we didn't have before. It is
hoped that what we are doing will allow the company to offer an opportunity
for economic expansion as well as benefit the citizens who live in the area.
Jack Holman - yes; Louis Rademacher - No, because until they get this plant
quieted down they should not enlarge their operation. Paulette Weaver - No,
because as proposed she does not feel this is in the best interests of the
health, safety, and welfare of the residents of the County. Bob
Ehrlich - No. Motion is denied with two voting for the motion and three
voting against the motion.

applicant has shown compliance with Section 24.3. 1 et seq. of the
Weld County Zoning Ordinance as follows:
The proposal is consistent with the policies of the
Comprehensive Plan. Expanding the gas processing plant
will not adversely impact the agricultural interest of
the County. The subject site is located on valent sand
with a capability subclass of VIe and is non-prime
agricultural land. The size and location of the
expansion is as small as possible and preserves the
maximum amount of agricultural land in the farm parcel;
- The proposal is consistent with the intent of the
agricultural zone district since it does not adversely

fence on the west side of the gas compressors and air compressors.
The electrically operated compressors are not required to have a
sound barrier fence.

Services that the concerns of the Division of Water Resources has
stated in it letter dated May 8, 1985 have been satisfied.

1. The uses permitted shall be a natural gas processing facility as
described in the application materials amending USR-542:85: 16 on file
with the Department of Planning Services and subjected to the Operation
Standards listed hereon.
2. A chain link fence, a minimum six (6) foot in height shall enclose the
amended USR area.
3. Upon cessation of the proposed use, the natural gas processing facility
shall be removed and the land reclaimed to its prior use.
4. All truck traffic associated with the permitted use weighing in excess
of seventy thousand (70,000) pounds shall not use bridge 35/38 B over
the Evans #2 Ditch on Weld County Road 35.
5. The subject site shall be limited to the four (4) accesses as shown on
the amended USR plat. All accesses will have a fifteen inch (15") x
sixty foot (60') C.M.P. culvert for drainage.
6. Construction of a flare pit shall be prohibited in the Use by Special
Review Area.
7. Liquified petroleum gas (LPG) in considered a hazardous substance per
C.R.S. 29-22-107 (2) (a) . Prior to the issuance of any additional
building permits, the owner/operator shall list the maximum quantity of
LPG expected at the site with the State Health Department, Division of
Waste Management and with the Weld County Emergency Response
Coordinator. Evidence of this listing shall be provided to the
Department of Planning Services.
8. The operator shall provide the Platteville Fire Protection District a
list of four (4) names, phone number, and addresses of responsible
parties it can contact in case of an emergency. The operator shall
provide instructional training on the gas processing plant to
representatives of the Platteville Fire Protection District.
9. A ten (10) foot high wooden sound barrier fence shall be constructed
and maintained on the west side of the gas and air compressors as shown
on the amended Use by Special Permit plat. If periodic regular noise
measurements show any violation of state noise standards, the wooden
sound barrier shall be improved by increasing the size or composition
of the barrier.
10. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.

Special Review, Section 24.6 et seq. , of the Weld County Zoning

carried out on the site comply with the Operation Standards stated
hereon and all applicable Weld County Regulations.
13. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the Standards as stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
14. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

1. The submitted materials are in compliance with application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff
that the applicant has shown compliance with Section 24.3.1 et
seq. of the Weld County Zoning Ordinance as follows:
- The proposal is consistent with the policies of the
Comprehensive Plan. Expanding the gas processing plant
will not adversely impact the agricultural interest of
the County. The subject site is located on valent sand
with a capability subclass of VIe and is non-prime
agricultural land. The size and location of the
expansion is as small as possible and preserves the
maximum amount of agricultural land in the farm parcel;
- The proposal is consistent with the intent of the
agricultural zone district since it does not adversely
impact the agricultural interest of the county. The
proposal expands the capabilities of a plant used for
gathering raw natural gas from gas wells in the area.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
Criteria for this proposal is listed in Section 24.3 of the Weld County
Zoning Ordinance. The applicants will need to register a change of use in
water from domestic and livestock to commercial with the Division of Water
Resources. A conditional statement will address this concern.
The Engineering Department expressed concern about the weight of vehicles on
the restricted bridge over the Evans #2 Ditch. Please refer to item #3 in a
letter dated April 25, 1985, from Don Carroll of the Engineering Department.
An Operation Standard will address this concern. In a letter dated May 17,
1985, the applicant amended the application to include a wooden fence as a
noise buffer (see letter) .
The Town Board of Gilcrest recommended denial in a letter dated May 16,
1985. (see enclosed letter) .
The Department of Planning Services staff has received phone calls and
Inquiries objecting to this proposal. The staff has received 7 letters from
companies associated with the oil and gas industry, supporting the proposal.

and a labor house located at the southeast corner of the intersection of
Weld County Road 40 and Weld County Road 35, approximately .6 of a mile
north of the site. There are two residences on Weld County Road 38
approximately .8 and .9 of a mile southeast of the site. There are 5
residences on Weld County Road 33 approximately 1 mile east of the site.

I have reviewed the application from Associated Natural Gas for the Amended
USR site.
1. Vicinity Map - Proposed Special Review Permit area dimensions read 380' x 373.89'
and should read 380' x 773.89' .
2. Both accesses will have a 15" x 60' CMP culvert for drainage.
3. On Road 35 are two bridges north of the access road. Bridge 35/38A over the
Platte Valley Canal is a legal bridge, but 35/38B over the Evans #2 Ditch
is a restricted bridge, posted at 23,35,37. A legal semi-trailer will
weigh 85,000 lbs . The bridge is posted for a semi-trailer at 70,000 lbs .
All legal loads or overweight vehicles must exist south on Road 35 from site.

Dear Mr. Mullen:
We have reviewed the above referenced special review permit application.
The application states that no additional domestic water is required for the
addition. The existing domestic water supply is from the present property
owner's well. We can find only one permitted well (no. 63933) on the owner's
property. If this is the source of water, a change of use from domestic and
livestock to exempt commercial should be applied for. A new permit would also
be required if an old unregistered domestic well is the water source.
It is unclear whether any water is needed for processing, washing, or
other industrial uses. A well permit definitely could not be issued for these
uses unless an augmentation plan to replace consumptive uses has been approved
by the Division 1 Water Court.
It does not appear a legal water supply is available for the natural gas
processing plant. We cannot recommend approval of expansion.

Further to our recent conversation regarding the subject
permit , this letter will confirm Associated Natural Gas '
intention to construct a ten foot high heavy wood fence (similar
to the noise abatement fences being constructed along the Denver
freeways) along the sides of our compression equipment . The
location is shown on the attached drawing . We feel that this
fence will abate the noise which the neighborhood residents find
objectionable . Work will begin on the fence as soon as the
permit to expand is approved.

Dear Sirs:
It has come to our attention that Associated Natural Gas
(Associated) is seeking permission of your Board to expand its
Kersey Plant in Weld County. This firm does not represent
Associated, but we do represent a number of small producers which
sell their natural gas to Associated.
As you know, there is a surplus of natural gas in the market-
place today. The largest purchaser of natural gas in the area
has substantially reduced its price for natural gas and a-t- -the
same time has reduced its takes. While the major purchaser will
still take 100% of casinghead gas, it has also reduced the price
it pays for such gas below the market price. In addition, the
major purchaser has refused to hook up any more wells for at
least the next two years.
The result of this policy has been to force producers to seek
alternative purchasers. As for new wells in the area, an
alternative purchaser is absolutely necessary. For old wells ,
such a purchaser may spell the difference between economic
disaster and solvency. •
Associated represents one of the most important alternative
purchasers in the area because it has the ability to take gas at
capacity levels. However, as Associated reaches the capacity of
its processing plants, that ability may be impaired. , This could
have a detrimental effect on the oil industry in the area,

especially on the Codell/Niobrara play, if there is not a place
to market casinghead gas. Such a slowdown would also be
economically detrimental to Weld County.
On behalf of our clients, we would like to recommend that the
Board of Commissioners favorably consider Associated ' s request
for an expansion of its Kersey Plant to keep that alternative
option alive and well in Weld County.

I am writing this letter to express my support of Associated
Natural Gas and their proposal to expand their gas processing
plant in the Kersey area . As an oil and gas producer in this
area , I know that one of the major problems we face in this
area is the large quantity of gas being produced without having
the facilities to process this gas . The availability of the
market and transport of gas is a prime consideration to an
operator before a well is drilled. This proposed processing
plant would open up new areas for drilling that are not now
adequately served by a gas plant .
We are presently selling gas to Associated from several of our
wells and they are professionals in every sense of the word .
They are the only company in this area that I am aware of that
is buying gas full time without extended shut-in periods . An
expanded gas plant in the Kersey area will open up drilling
into areas that have excellent production potential .
In conclusion I feel an expanded Associated Natural Gas plant
in the Kersey area will be a valuable asset , not only for the
local oil and gas industry but also for the county taxpayers .

Gentlemen:
This letter is in support of Associated Natural Gas ' request for
a special use permit in order to increase the size of their Kersey
plant.
Over the past two years , Shepler & Thomas , Inc. has drilled 37
wells in the general area of Johnstown. A significant factor in being
able to attract investment dollars for these wells .was the fact that
Associated provided a market for all the gas that could be produced.
Investors in Shepler & Thomas , wells currently plan to drill approximately
thirty new wells in Weld County in 1985 . In our opinion, if there were
a significant risk of not having a continuing market for all gas produced,
this number would be greatly reduced. The economics of Codell-Niobrara
completions is such that a well needs to be produced pretty much con-
tinuously in order for the return on investment to be acceptable . Even
increased line pressure in a gas gathering system can restrict production
to the point were the economics are adversely affected.
We estimate that the property taxes to be generated over the
next four years by the thirty wells to be drilled this year will be approxi-
mately $720 , 000. Additionally, 30 wells will generate $9 million in
drilling and completion expenditures , much of which will accrue to Weld
County businesses .
We strongly urge that Associated' s request be approved.

I wish to take a moment to elicit your support. It has been brought to our
attention that a proposed expansion of one of Associated Natural Gas Company's
processing plants is meeting with considerable opposition.
On bahalf of Calvin Petroleum Corporation and the landowners which we represent,
may I ask that you give very serious consideration to approving Associated
Natural Gas Company's request for facilities expansion and urge your associates
to do the same. I have reviewed with Gene Brantner the chain of events which
has recently had tremendous adverse impact on the natural gas market. Your tax
base will reflect the results of that impact.
Associated Natural Gas Company has provided a viable market for small companies
whose shut-in wells were either tied into the system of Panhandle Eastern Pipe
Line Company or did not have any market for their product, at all. I believe
it would be a fair statement to say that Associated Natural Gas Company has directly
influenced and contributed to the economic survival of many small oil and gas
producers in Weld County. Without this market, many companies may well have been
forced into bankruptcy.
To deny Associated Natural Gas Company a much needed expansion of their facility
may prevent many of these small companies from reaching a natural gas market.
This, in turn, will certainly slow, if not stop, the development of new leases
and drilling programs. The result of that would be lost revenues for already
beleagured farmers and the Weld County Treasury.

Dear Sirs:
My name is Roy Johnson. I'm a farmer, and have been all my life. We
farm the adjoining property next to the site of the existing Associated
Natural Gas plant. My family and I have worked our whole life for the farm we
have with all its good points: on a hill side with a beautiful view, and peace
and quiet.
The existing gas plant of Associated Gas is 9/10 of a mile from our home.
Our sleep has been interrupted many nights with loud, annoying sounds. It has
released dangerous gas under extreme pressure numerous times. One of the
serious and longest occurrences happened on October 6, 1984. A safety valve
released and stayed open all night with no safety alarms going off, and no one
to correct the problem. An employee of the plant said $20,000 of natural gas
escaped. This plant is in operation 24 hours a day, but there is an employee
there 12 hours a day. Isn' t this a violation of zone?
On October 8, 1984, 2 nights later, the same situation happened as 1
described before. This time we called 911. A dispatcher called both Gilcrest
and Platteville fire departments, but when they arrived at the scene, they
were afraid to go into the plant to try and stop the problem. No one from
the plant could be found. The plant was locked so nothing could be done. The
existing Associated Gas Plant puts out 41 decibels at 9/10 of a mile which
wakes us when conditions are right. The expansion of this plant will be
double in size and possibly put out twice the noise level it does now.
Our livestock are uneasy. The hunters who belong to the sportsman's club
that leases our ponds have not been hunting here for months. All wildlife has
disappeared. Should this plant be approved, this income will be lost for
good.
If this plant is approved we will have 2 such plants in 11/2 miles. That
is too many for this area.
We want you to consider our issues and feelings, which are strongly
against this proposed expansion of this gas plant. Our lives could be in
jeopardy. Think of us and future generations to live in this area. I was
never notified officially of the first proposed building or hearing for a
natural gas plant to be built.

FOR: An Amendment to a use by Special Review Permit for expansion of a
natural gas processing plant
A petition was signed by 50 residents to stop proposed expansion.
Reasons: This permit would allow Associated Gas to increase the size of their
existing plant from a 15 MMCF to a 30 MMCF. _
We live in a rural residential and agricultural area. This area
houses many families with children.
Our problems with the present plant have been many. This plant is
the main reason that we were against South Greeley Gas or any other
firm to build in our area.
Problems:
Noise
The strange shrill noises from present 15 MMCF plant are so loud
that it awakens you at night. A constant noise that gets on your
nerves through the day, every day! It even disturbs livestock.
Air, Soil, and Water Pollution
Due to break downs at present 15 MMCF plant, which is manned only
part of the day, there have been leaks and spills that we could
smell one mile away . Are these spills leaching into our water?
Roads
During winter months, roads become almost impassible to small
vehicle traffic.
Traffic
Gas plant traffic tends to have no concern for speed or stop signs;
therefore causing a severe threat to school bussing and other traffic.
New Expansion of Present Plant
Concerns:
1 . Plant property would be within 500 feet to residents and %, mile to
many more.

2. Future Expansion: We feel they already have plans to buy up
the whole S. E. 14 section which would put them within 500 feet
of many land owners.
3. Truck Traffic: The traffic would double, creating many more
road and traffic problems.
4. Noise, Air, Soil and Water Pollution: The Gas Company say they
will build dikes around tanks, this does not stop spills from
leaching into ground water and nearby irrigation ditches.
5. Will safe travel be guaranteed for school children?
6. Lighting: Will it look like another Fort Saint Vrain?
7. Real Estate: Depreciation was checked into and it is definite
that property values will be affected.
8. Will the city of Gilcrest and the county of Weld need additional
police protection and fire protection?
9. The plant is unmanned at night! This is when it operates at full
rapacity.
10. Unsightly: It would burden many houses and farms that have a
high dollar investment.
11 . Fire and Explosion: Such as the one in Basile, LA, which was
also a 30 MMCF, caused residents to be evacuated within one mile
of plant--due to explosion and intense heat.
As concerned citizens, we are asking you not to approve this expansion. We do
not need an additional problem in our area, one that frightens wild life,
devaluates land, keeps local citizens awake with fear and anxieties, and could
cause water, air, and ground pollutions.

RE: Expansion of Associated Natural Gas Kersey Plant
Dear County Commissioners:
St has been brought to my attention that Associated Natural Gas
has proposed expanding its natural gas processing capability at
its Kersey plant.
Frizzell Oil Company is a small, independent exploration and
production company. The market for our produced gas that
Associated has provided has been crucial to our being able to
drill the wells we have in Weld County. 'The expansion of the
Kersey plant will make continued operations in Weld County
feasible.
Working with Associated has been an experience marked by
professionalism, integrity, and exemplary performance. From my
experience, I can highly recommend them as an organization
willing to do their part.
-Please add my expression of support for the request of Associated
Natural Gas to expand the Kersey gas plant.
