RESOLUTION RE: APPROVE AMENDED SPECIAL REVIEW PERMIT TO EXPAND AN EXISTING DOG KENNEL FROM 30 DOGS TO 200 DOGS - L.E.A.D. , INC. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 9th day of December, 1987 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of L.E.A.D. , Inc. , c/o John Birleffi , 2056 26th Avenue, Greeley, Colorado 80631 , for an amended Special Review permit to expand an existing dog kennel from -30 dogs to 200 dogs on the following described real estate, to-wit: Part of the W} NWI , Section 13 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Bob Ray, Attorney, and John Birleffi; and Zane Pic and Kenneth Lind , Attorneys , represented certain opponents, and WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a . The proposed use is located within an Agricultural area and is consistent with the Weld County Comprehensive Plan ' s Agricultural Goals and Policies . The proposed use will not infringe on the continued agricultural use in the vicinity or county. The proposed use does not appear to have 871517 Page 2 RE: AMEND USR - L.E.A.D. , INC. any adverse impacts on the agricultural interests of the county or the environment. b. The proposed use is consistent with the intent of the Agricultural Zone District and is provided for as a U-se by Special Review. c. The proposed use will be compatible with existing agricultural uses as well as with the future development in the immediate area. The future uses are proposed to remain agricultural in nature. The proposal will not have any significant traffic impacts . d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for an amended Special Review permit to -expand an existing dog kennel from 30 dogs to 200 dogs on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to _recording the plat. 2 . Within 30 days of approval by the County Commissioners, the applicant shall submit an amended mylar plat which shall include: a. The 300 foot by 400 foot by 300 foot fence located on the south, west, and north property lines respectfully as being E feet in height and constructed with a solid wooden face . A slatted design type fence shall not be used. Twenty-one training runs shall be within the wooden fence area. The plat shall also show a fence which shall be attached to the wooden fence or constructed for purposes of containment of all dogs on the facility. 871517 Page 3 RE: AMEND USR - _L.E.A.D. , INC. 3 . The Amended Special Review activity shall not occur nor shall any building or electrical permits be isaued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Special Review permit is for a kennel facility for a maximum of 200 dogs -which includes dogs under b months in age as submitted -in the application materials on file -in the Department of Planning Services and subject to the Development Standards stated herein. At any given time, the total number of dogs shall not exceed 42 in the training runs, 32 in the puppy runs, -88 in the indoor runs, and 13 bitches and 48 puppies in the brood house. 2 . The water supply for the facility shall be limited to the North Weld County -Water District. -At no time shall the existing wells on the site be used for the Special Review site unless authorized by permit from the State Engineer, Division of Water Resources . 3 . The greyhound kennel facility shall comply -with the Colorado Racing Commission' s Rules and Regulations pertaining to greyhound kennels. 4 . Buildings and grounds shall be kept clean, in good repair, and free of trash. Animal waste shall be removed daily from the kennel area and stored in an enclosed container. The waste shall be removed from the property on a weekly basis . 5 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . Dogs housed inside the -kennel building shall not be turned out between the hours of 10 :00 p.m. and 6 :00 a.m. 7 . The Use by Special Review shall not be leased, conveyed, transferred, or sold without prior approval by the Board of County Commissioners. 8 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 9 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 871517 Page 2 OPERATION STANDARDS - L.E.A.D. , INC. 10 . Per-sonnel from the Weld County Health Department, Colorado Racing Commission, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 11 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans -or Standards are permitted. Any other changes shall. be filed in the office of the Department of Planning Services . 12 . The property owner or operator shall be responsible for complying with all of the foregoing Standards . Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners. 871517 HEARING CERTIFICATION DOCKET NO. 87-70 RE: AMEND SPECIAL REVI-EW PERMIT TO EXPAND AN EXISTING DOG KENNEL FROM 30 DOGS TO 200 DOGS - L.E.A.D. , INC. A public hearing was conducted on December 9, 1987, at 2:60 P.M. , with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Gene Brantner Commissioner Jacqueline Johnson Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, The following business was transacted: I hereby certify that pursuant to a notice dated October 14, 1987, and duly published October 22, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the request of L.E.A.D. , Inc. for an amended Special Review permit to expand an existing dog kennel from 30 dogs to 200 dogs. Lee Morrison, Assistant County Attorney, made this matter of record, stating that this hearing was continued from November 4, 1987, to allow the applicant to provide more evidence, and he reviewed the items which were to be submitted. Brian Bingle, representing the Planning Department, said the required -information -was submitted to the Planning staff and forwarded to the -Board. Mr. Bingle also presented the -Board with a Proposed Development Standard regarding transfer of the Special Review. Bob Ray, Attorney representing the applicant, said this proposed Development -Standard was agreeable to the applicant. John -Birleffi came forward to explain the proposed wooden fence. Mr. Birleffi also said the number of dogs could be reduced to 150 if pups under six months of age are not to be counted. The Board had considerable discussion regarding the method to be used when counting the dogs on the property and the number to be allowed. When the hearing was opened to public comment Ken Lind, Attorney representing the neighbors, and Zane Pic, Attorney for Doris Anderson, made comments concerning the number of dogs to be allowed and the proposed fencing. After further discussion concerning these matters, a recess -was called to allow certain details to be resolved. Upon reconvening, Mr. Bingle read into the record -a proposed Development Standard regarding the number of dogs to be allowed in various areas of the property. This Development Standard provides that the site shall never exceed a total of 200 dogs, including puppies. (Tape Change #87-118) Chuck Cunliffe, Director of Planning Services, suggested that a Condition be added requiring that the Special Review plat be amended to show the desired fencing. It was recommended that a new Development Standard providing that the dogs inside the kennel building shall not be turned out between 10:00 P.M. and 6:00 A.M. be added, along with the Development Standard introduced earlier concerning transfer of the Special Review permit. Commissioner Johnson stated that "and runs" should be added after "kennel areas" in Development Standard #4. Commissioner Johnson moved to approve this request for an amended Special Review permit, subject to the Conditions and Development Standards as amended. The motion -was seconded by Commissioner Yamaguchi. Commissioner Kirby commented that he -felt the problem areas have been mitigated and he will vote for the motion. GEC a 1997 _ Dear Mr. Birleffi , coo. As requested, on November 20, 1987, I made a site inspection of the above kennel for the purpose of evaluating the surface drainage. The pen runs have been sur- faced with sand. At the time of inspection, there was snow melting and some storm water was present on the surface. Under the low flow conditions present and from visual evidence, there were no collection or major flow channels indicating that the storm water was percolating into the ground. The general fall of the ground is Easterlyfrom County Road 47 at about 2%. All flows leaving the housing and kennel area will flow Easterly on the subject property into the exercising area, sprint run and expansion areas. These areas presently have a range or pasture grass and could absorb considerable amounts of storm runoff on site. The Soil Survey indicates a Nelson Fine Sandy Loam, 0 to 3% slopes with a moder- ately rapid permeability and slow to medium surface runoff. The pens were clean of dog feces. Contamination from urine would appear minimum in the arid climate and with the open soil . The area just West of the Brood House has general drainage Easterly towards the Brood House, however, the normal storm water flows do not seem to have breeched the 10 - 15 foot of flat area adjoining the Brood House. Adequate fall is available to create a drainage swale parallel to the West side of the Brood House to intercept any storm flows and divert them Southerly and Easterly around the Brood House. It is my judgement that from a physical standpoint, there is no major drainage concerns on the site and that normal storm flows in this area will not create any significant health concerns. Attached you will find a short scenario of each application, a map showing proximity to surrounding residences, and the adopted development standards for each case. Along with these material's, staff has included a copy of both adopted zoning ordinances of Kennels, and Household Pets. This was done to show that it has been customary in the past to interpret animal units within kennels to be older than six months. In this particular instance, the applicant has requested that the 6 month and younger animal units be included in the total of the kennel operation. KENNEL: Any place other than a PET SHOP or veterinary clinic or hospital, where five (5) or more HOUSEHOLD PETS of one specifies, or a total of eight (8) or more HOUSEHOLD PETS of two (2) or more species are kept or maintained. Property that is zoned Agricultural and not part of a platted subdivision or unincorporated town and which is larger than ten (10) acres shall be permitted to keep or maintain eight (8) HOUSEHOLD PETS of one species or sixteen (16) HOUSEHOLD PETS of two (2) or more species without being considered a KENNEL. From what I have learned, they will be using 18 acres of irrigated farm ground to build dog kennels, etc. , taking the land out of production permanently. Is this protecting the agricultural interest of Weld County? A greyhound dog kennel has nothing beneficial to add or offer to the agricultural community, and -„you'd be using productive farm ground for non-productive purposes. We have lived here for nine years and chose to live here to get away from the mental torture of barking dogs in town. Being in an agricultural area where livelihoods are derived from food producing livestock, we expected noise from cattle, dairies, pigs, sheep etc, and occasional barking farm dogs. It is very seldom that a cow bellows all day or night, but we knew to expect this periodically. We knew, also of the kennel, but it was small enough to be reluctantly acceptable. 200 adult dogs are not acceptable, nor -are 100 dogs. The number can increase markedly when puppies can come twice a year. An average of 8 pups per litter, times 100 females, equals 800 pups. This, twice a year, equals 1600 pups, plus the 200 adult dogs, making a total of 1800 dogs. Pups are kept for approximately one year during which time another set of pups can come, making 2600 dogs. Hence, we are very concerned about the health of the community, due to the number of dead and culled dogs this would produce. I have also heard that under their 30 dog permit, L.E.A.D. Inc. has had up to 100 dogs already. With this evidence of operating in the past, outside of their set limits, what would keep them from abusing the limits of the permit in the future? I have also heard L.E.A.D. Inc. uses live rabbits in training the dogs, which is against the racing commission' s rules and is illegal. Obviously, their lack of respect for laws and requirements is a threat to the welfare of the community. This also would threaten the physical and mental health of the inhabitants of the surrounding area. Please consider the preservation of our valuable productive Weld County farm ground and the health and welfare of the people of the area who would be directly affected. Our first letter was sent to the Weld County Planning Commissioners who met on and to our grave disappointment approved the said proposal on October 6, 1987, The purpose of this letter is to inform you of our concerns with the existing kennels and to urge you to vote -against au expansion. Our home is located near the intersection of Weld County Roads 47 and 70 which is less than one-half mile from the present dog kennels and training track. Although we previously have been bothered by the dogs -barking and/or howling at all hours of the day and night and have also had concerns about the kennel' s apperance, we had not complained earlier because we did not wish to cause problems with the neighbors. However, this L.F,.11.::). proposal has pushed us too far and we reel we are forced to speak out as opponents. The idea of having to deal with mare than 30 dogs has be- come such a significant concern that we wish to be on recod of strongly opposing any, further expansion. It would be wonderful to not have -any of the boarding or training of the-se greyhounds, as was the case this past summer. However, it is our understanding that a "-grandfather" permit has been granted which reportedly allows the premises to maintain 30 dogs. Since it appears there will -always be $o many dogs near to us, we -encourage much closer monitoring of these kennels and training track, as well as requiring the owners and lessors to adhere to strict standards of operations. Some of our recommendations include: enforcing mandatory hours on a consistent and regular basis for the dogs to be allowed outside, and installing a privacy fence/noise barrier of no less than eight feet high. In addition, we would request more frequent cleaning and disposal of the dog runs. The pens have at times not only looked bad from all the dogs' feces, but the odor has been offensive when -either walking or driving by. My husband and Z have invested more than just money into our home and land. We have spent countless hours working to improve its WpearanO.eand use of our 1-and. We adhere to a belief of respecting the agricultural roots of this Area and in Weld County. It seems ironic that none of the L.E.A.D. owners live anywhere near the kennels or training track. The greyhounds are not livestock and are not commensurate with the existing agricultural area. The L.EA.D. owners won't be the ones who have -to deal -with their dogs' noise, debris, -and hassles created by their greyhounds. The reason for this letter is to voice my displeasure along with my neighbors that I am very much against this proposel going through. In 1977 I knew about the Kennel and I also knew about the limit of 30 dogs; We can live with that, however, I am very concerned-with the idea of allowing 200 or more dogs in that particular area. This memorandum serves to notify you of our regulatory objectives and jurisdiction regarding greyhound kennels. All greyhound kennels where racin-g greyhounds are kept are required to A register and comply with Commission rules and regulations regarding safety, sanitation and health of the kennel . I am enclosing a copy of current requirements which are used to insure that greyhounds are properly cared for and that the kennels are maintained in a safe and sanitary condition. As part of our regulatory activities, my field staff inspects each registered greyhound kennel for every greyhound meet at which the kennel is operating. If any problems or non—compliance with our rules are noted, we return to the kennel within ten days to insure that all requirements are met. In the event a substantial problem arises, we will take action to discipline the licensee and take further steps to insure that the health and safety of the animals are maintained. All kennels, -whether on or off the racetrack must te available for inspection at any time by -representatives of the Commission. Greyhounds housed at any kennel which does not meet minimum require- ments that may be set forth from time to time by the Commission will not be -eligible for entry to race in an official race. 17.01:2 - It is considered contrary to these Rules for any licensed owner, trainer or assistant trainer to utilize any training track or facilities used for training, unless the training track or facilities- have been approved by the Commission. The training track or facilities will be inspected periodically by Commission representatives for the purpose of observing the training and practices used. If it is determined that practices and methods used at training tracks are contrary to good training practices in conformity with requirements as set forth from time to time by the Commission, the Com- mission may disallow the use of the facilities by licensed owners, trainers, or assistant trainers. 17.01:3 - The Commission reserves the right to disapprove any persons or business firms who deal in raw greyhound food or greyhound food additives or supplements used by racing greyhounds if the Commis- sion finds that the source of greyhound food products, their handling thereof, method of delivery, and security in relation thereto are unsatisfactory. If greyhound food products are delivered to the kennels the Commission reserves similar rights with regard to the person(s) making the delivery. If the person or business firms should be disapproved by the Commission and any licensed greyhound owner or trainer uses the source of greyhound food they may have their greyhounds scratched. The type of lock used must be approved by the Commission. (g) All housing kennels must have at least two (2) fire extinguishers, which are in work • - ing order. (t) All openings must te screened with ordinary fly screen and covered -with mesh wire. (1) Housing kennel areas must be equipped -with sufficient lighting. (j) All housing kennels must te properly venti- lated. (k) All meat delivered and -water used will be subject to testing by the Commission chemist, or other competent Chemists as designated ty -the Commission. } (1 ) Kennels and immediate surrounding area shall be kept clean and reasonably unclut- tered at all times. All manure must be picked up and removed from the kennel area daily. Manure buckets must -have lids, and the lids kept over manure buckets except when it use. 17.02:2 — Public Housing Kennel facilities: (a) Public -housing kennel facilities construct- ed after -March 1, 1980 shall be subject to the following additional requirements. Further, any public housing kennel facility which changes ownership after March 1, 1980 will be subject to these same provisions. (d) _Each kennel building shall have run-out pen facilities which allows a minimum of thirty (30) square feet per greyhound. (e) -Run-out pens and open exercise areas shall be enclosed with fences which shall be a minimum of 6' in height. All run-out pens and open exercise area gates are to be fitted with ample lucking devices. 17.02:3 - All persons upon the premises of a housing kennel facility -whether private tr public must have in their possession a current validated license or be accompanied by a current 1itensee who shall be responsible. 17.02:4 - Transportation of Greyhounds to Official Racing Events: Each individual kennel incorporated in trucks and trailers delivering rating greyhounds to the racetrack must be inspected before loading, and except for emergencies a truck will not stop between the dousing kennel -and the racetrack. Any stops to and frtm the racetrack shall be reported to the judges. 17.02:5 - Security: The Commission or the judges investigating for violations of the Law or these Rules shall have the power to permit persons authorized ty either of then to search the person, or enter and search the -day kennels, paddock, lock--out kennels, vehicles or other places about the racetrack or places where greyhounds eligible to race at the meet are kept, of all persons licensed by the Commis- sion, and of all employees and agents of any associa- tion licensed by the Ctmmission; and of all vendors who are permitted by the association to sell and dis- tribute their merchandise about the racetrack in order to inspect and examine the personal effects or property of the persons or kept in such day kennels, pacdock, lock-out kennels, vehicles, or other places. The proposed use for the subject area is the raising of up to 200 greyhound racing dogs . The amended special use permit is needed because the present permit allows only a maximum of 30 greyhound racing dogs on the subject premises . The surrounding land uses are strictly agricultural , and the property is bounded by a large ditch, a county road and a greyhound training track. The nearest residential structure is approximately 6B0 feet from the boundary lines of the subject property. The total maximum number of users, patrons, members, buyers and/or employees at any one time would not exceed ten (10 ) . The maximum number of employees would be four ( 4) . They would not work shifts , however , at least one (1 ) employee would be a permanent resident on the site. The water source for the subject area is North Weld Water District , and there are two existing wells on the property. However, there are no water rights attendant to the property. The access routes for the property are Weld County Road 47 and Colorado Highway 392 . The vehicular traffic would be automobiles and pickups. It is anticipated that there would be no more than seven (7 ) such vehicles per day. The existing sewer system (a 750-gal . septic tank, with absorption trenches and seepage bed, for the residence and mobile home located on the premises ) will not be utilized by this pro- posed greyhound raising/training operation. The subject area is located in the Eaton Fire Protection Di-strict. The maximum number of greyhound racing dogs on the subject area at any one time will be 200 . Large dumpsters will be used for storage of waste materials. Waste will be put into the dumpsters on a daily basis, and the dumpsters will be removed and replaced as needed . The amount of impervious surface on 17 .032 acres is such that Applicant feels that a storm water management/retention program is not needed at this time. Applicant has no proposed landscaping plans for the subject area at this time. The existing grass, trees, and shrubs are all that are needed for erosion control . Reclamation procedures do not apply to the subject area or the proposed use. The -existing structures on the subject property are two kennels , storage buildings, a residence, a mobile home and a large garage. These structures will adequately accommodate the number of greyhound racing dogs proposed, and therefore no further construction is needed, and Applicant is ready to start the proposed use as soon as the amended permit is granted. o'1J�a' STATEMENT IN SUPPORT OF APPLICATION FOR AMENDED USE BY SPECIAL REVIEW (L .E.A .D. , INC. ) PAGE TWO 3 . Applicant believes the proposal is consistent with the Weld County Comprehensive flan , since the property in question has been used primarily for the raising of greyhound race dogs. Applicant believes that the future development of the surround- ing area will remain agricultural , and therefore the proposed amended use is not inconsistent with the intent of the district. Applicant believes that all productive agricultural land in the area has been conserved . Given the remoteness of the area, Applicant believes that the health, safety and welfare of the inhabitants of neighborhood and County will not be affected , and Applicant intends to take every procedure available in order to assure the same.
