RE: APPROVE LETTER FROM WELD COUNTY DEPARTMENT OF PLANNING
SERVICES TO NICK AND FRED SEKICH CONCERNING RELOCATION OF
ACCESS BARRIER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Planning Services received a
request from Nick and Fred Sekich concerning the removal of an
access barrier at Sekich Business Park, said barrier being located
between Lots 2 and 3 in Block 4 , and
WHEREAS, the recommendation of the Department of Planning
Services is to allow the relocation of the access barrier from its
present location to the lot line common to Lots 3 and 4 in Block
4 , as stated in the letter to Nick and Fred Sekich, a copy of said
letter being attached hereto and incorporated herein by reference,
and
WHEREAS, after review, the Board of County Commissioners
deems it advisable to approve the recommendation of the Department
of Planning Services that said access barrier be relocated and not
removed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the letter to Nick
and Fred Sekich, from the Department of Planning Services,
advising them that the access barrier between Lots 2 and 3 in
Block 4 may be relocated to the lot line common to Lots 3 and 4 ,
Block 4 , Sekich Business Park be, and hereby is , approved.

The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 8th day of May,

Re: Request to remove access barrier from between Lots 2 & 3 to between
Lots 3 & 4 in Block 4, Sekich Business Park.
Dear Nick and Fred:
I have enclosed a copy of the Division of Highway Department's review of
your request to remove the access barrier between Lots 2 and 3, Block 4,
Sekich Business Park.
The Division of Highways and the Department of Planning Services do not
object to the relocation of the barrier to the lot line common to Lots 3 and
4. This would still prevent use of the access easement for through traffic,
but would allow Lot 3 to access to Mead Street.
If you choose to remove the access barrier location as discussed, please
submit an amended Final Plat of Sekich Business Park to this Department.

Based upon the referral information from the Division of Highways, the
removal of the barrier and traffic count restrictions is considered a major
change from the approved Final Planned Unit Development. Any request to
make a major change to an approved Planned Unit Development Plan shall be
processed as a new application for a Planned Unit Development Plan under
Section 28.5.2 of the Weld County Zoning Ordinance.

Dear Mr. Allison:
In response to your August 21, 1984, letter to this office regarding
the proposal to remove the "barrier" restricting access between Lots 2 and
3, Sekich Business Park, we again recommend against the removal of this
condition. This is consistent with the position which we expressed to you
in our letter of May 8, 1984. It is based on the concern that removal of
this "barrier" could lead to turning conflicts where the access easement
intersects with County Road 9-1/2 and the proposed access to State
Highway 66 known as Mead Street. These turning conflicts could also
affect the flow of traffic at the access approaches to the highway.
The design of the left-turn lane for the Mead Street access and the
barrier condition were discussed with Nick and Fred Sekich at a July 31,
1984, meeting with Al Chotvacs, District Engineer. At that meeting it
was decided that we would not object to the relocation of the barrier to
the lot line common to Lots 3 and 4. This would still prevent use of the
access easement for through traffic, but would allow Lot 3 to obtain
access to Mead Street.
