RE- APPROVE USE BY SPECIAL REVIEW FOR AN AGRICULTURAL SERVICE
ESTABLISHMENT, FIREWOOD AND WOODCHIP PROCESSING - WES MOSER
AND SONS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and.
WHEREAS, the Board of County Commissioners held a public
hearing on the 16th day of September, 3987 , at the hour of 2 :00
p.m. in the Chambers of the Board for the purpose of hearing the
application of Wes Moser and Sons , 15208 Front Street,
Platteville, Colorado 80651 , for a Use by Special Review for an
agricultural service establishment, firewood and woodchip
processing, on the following described real estate, to-wit:
Part of the W} SEI , Section 30 , Township 4
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by John Moser, and
WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. This proposal is consistent with the Weld County
Comprehensive Plan' s Urban Growth Boundary Area
Goals. This proposal does not appear to have an
effect on the urban growth of the Town of Milliken
or the Town of Gilcrest.

b. The proposed use is consistent with the intent of
the Agricultural Zone District and is provided for
as a Use by Special Review.
c. The proposed uses are compatible with the existing
surrounding land uses and with the future
development of the surrounding area as permitted by
the Agricultural Zone District.
d. No overlay districts affect the site.
e . Use by Special Review Development Standards will
provide adequate protection of the health, safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an agricultural services establishment,
firewood and woodchip processing, on the hereinabove described
parcel of land be, and hereby is, granted subject to the following
conditions:
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2 . The Use by Special Review activity shall not occur nor
shall any building or electrical permits be issued on
the property until the Use by Special Review plat has
been delivered to the Department of Planning Services
Office and the plat is ready to be recorded in the
office of the Weld County Clerk and Recorder.
3 . Prior to continuing the use of the property for firewood
and woodchip processing, the structures shall be
inspected by the Weld County Building Inspection
Department and determined to be in compliance with the
Weld County Building Code Ordinance.
4 . A copy of a Soil Erosion Control Plan shall be submitted
to the Department of Planning Services within 30 days of
approval by the Weld County Board of County
Commissioners .

1 . The Special Review permit is for a home business , firewood
and woodchip processing, as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein.
2 . Wood shavings and waste materials shall be handled, stored,
and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
3 . All off-street loading and unloading and parking areas shall
be surfaced with either gravel, asphalt or concrete and shall
be maintained to alleviate dust and to prevent drainage
problems.
4 . The property shall be maintained in accordance with the Soil
Erosion Control Plan approved by the Platte Valley Soil
Conservation District.
5 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance .
6 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance .
7 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
-8 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
9 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services .

10 . The property owner or operator shall be _responsible for
complying with all of the foregoing Standards . Noncompliance
with any of the foregoing Standards may be reason for
revocation of the permit by the Board of County
Commissioners .

I -hereby certify that pursuant to a notice dated August 26, 1987, and
duly published September 3, 1987, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Wes Moser and -Sons for
a Use by Special Review for an agricultural service establishment,
firewood and woodchip processing. Bruce Barker, Assistant County
Attorney, made this matter of record. Rod Allison, Planning Department
-representative, incorporated the Planning Commission`s recommendation
for approval of this request into the record. John Moser came forward
to represent the applicant and answer questions of the Board. No
public comment was made concerning this request. Commissioner Kirby
moved to approve this request, based upon the recommendation of the
Planning Commission, which was subject to four Conditions and ten
Development Standards. Commissioner Yamaguchi seconded the motion and

A regular meeting of the Weld County Planning Commission was held on August
18, 1987, in the County Commissioners ' Hearing, First Floor (#101) , Weld
County Centennial Building, 915 Tenth Street, Greeley, Colorado . She
meeting -was called to order by the chairman, Ann Garrison at 1:40 p.m.

John Moser, partner and applicant, explained the nature of their request.
The Chairman called for discussion from the members of the audience. There
was none.
The Chairman asked Mr . Moser if he had reviewed the recommendations,
conditions , and Development Standards as outlined by the Department of
Planning Services ' staff. He stated he has reviewed these and is concerned
about being -able to meet Condition #4 because he is not sure what the
landscaping requirements could te. However, he will work with the _Platte
Valley Soil Conservation District and comply with their recommendations.

The Chairman asked Mr. Moser if he had any objections to not reading the
recommendations, conditions, and Development Standards into the record? He
had no objections. The Chairman asked that these be filed with the summary
to serve as a permanent record of the hearing.
MOTION:
Louis Rademacher moved Case Number USR-806:87:32 for Wes Moser and Sons,
Incorporated, for a Use by Special Review permit for a Home Business to
process firewood and wood chips be forwarded to the Board of County
Commissioners with the Planning Commission's recommendation for approval
based upon the recommendation, conditions, and Development Standards as
outlined by the Department of Planning Services' staff and the testimony
heard by the members of the Planning Commission. Motion seconded by Ernie
Ross.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the Secretary to poll the members of the Planning
Commission for their decision. Ivan Gosnell - yes; Bud Halldorson - yes;
Ernie Ross - yes; Louis Rademacher - yes; -Paulette Weaver - yes; Ann
Garrison - yes . Motion carried unanimously.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity shall not occur nor shall any
building or electrical permits be issued on the property until the

1 . The submitted -materials- are in compliance with application
-requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff
that the applicant has -shown -compliance with Section 24.3 of the
Weld County zoning Ordinance as follows:
- This proposal is consistent with the Weld County
Comprehensive Plan's Urban Growth Boundary Area Goals.
This proposal does not appear to have an effect on the
urban growth of the Town of Milliken or the Town of
Gilcrest.
- The proposed use is consistent with the intent of the
Agricultural Zone District and is Provided for as a Use
by Special Review.
- The proposed uses are compatible with the -existing
surrounding land uses and with the future development of
the surrounding area as permitted by the Agricultural
Zone District.
- No overlay districts -affect the site.
- Use by Special Review Development Standards will provide
adequate -protection -of the health, safety and welfare of
the neighborhood and County.
This _recommendation is based, in -part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.

The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special -Review activity -shall not occur nor shall any
building or electrical permits be issued an the property until the
Use by Special Review plat has been delivered to the Department of
Planning Services' office and the plat is ready to be recorded in
the office of the -Weld County Clerk and Recorder.
3. Prior to continuing the use -of the property for firewood and wood
chip processing, the structures shall he inspected by Weld County
Building Inspection Department and determined to the in compliance
with the Weld County puilding Code Ordinance.

provisions of the Weld County Building Code be met.
I notice from his letter that he will not be installing sanitary facilities.

RE: Proposed Use
The property will be used to bag wood bark (2 & 3 cu. ft. bags) , and
bundle firewood. (1 cu. ft. bundles)
The property is now a farm yard, approximately two acres, with
four structures on it. There is a house (600 sq. ft. ) , a garage (400
sq. ft. ) , a storage shed (500 sq. ft. ) , and the bark bagging building
(2800 sq. ft. ) .
We will not need to put up any other structures for our operation.
,This property is rented from Mrs. Elizabeth Deroo till December 31 , 1987 .
At this time our lease will run out, or we may renew. If we do not
renew the lease, our operations will cease at this location.
There are two part-time employees engaged at the bark bagging
and firewood operation, beside myself, and other family members. One of
the employees lives in the house to be close to the premesis. The bark
bagging and firewood operations are very simple and take a minimum of
man power.
The material is hauled in from Kremmling, Colorado and stored on
site until it is processed. There are usually four to ten semi loads
stored outside at any one time, depending upon the time of year and the
demand for the product. There is about a 3, 000 sq. ft. area used for
outdoor storage.
There are from two to six truckloads of material moving in and out
of the yard per week. The route is going north of Platteville on
Highway 85 to Highway 60 , then north to Road 40, then west on 40 to
Road 25 1/2 to our location .

FIRE PROTECTION
Fire extinguishers have been in stalled in the buildings. Most of
the wood product is kept outside.
STOCKPILE
Outdoor storage of wood will vary greatly depending upon the time
of year. However, approximately 3 , 000 sq. ft. have been set aside,
1 , 000 sq. ft. for bark and 2 , 000 sq. ft. for firewood. The stockpile
will not exceed ten feet in height.
STORM WATER RETENTION FACILITIES
None provided.
REMOVAL OF WASTE
All products are utilized, and there is no waste that needs to be
disposed of. The bark is bagged and shipped out, the firewood is
sold, and bark contaminated with soil and sawdust is sold as animal
bedding. Boxes that are used to ship the bags in are broken down and
used on top of the pallets to protectthe bagged bark from coming
through the holes in the pallets
LANDSCAPING AND EROSION CONTROL
No landscaping or erosion control are planned at this time and no
problems have observed.
RECLAMATION PROCEDURES
All materials will be removed when business ceases. This should
require no more than three months, unless the lease is renewed.
STARTUP
The operation has been going for about three years.

No farmland will be taken out of production, and the operation will
. not interfere with any -existing farming operation.

The operation will comply with all fire district regulations . The
road and access to the property are safe.

The arm is expected to remain agricultural as it is now. It should
be noted that wood is an agricultural product.
