HomeMy WebLinkAbout871225.tiff RESOLUTION RE- APPROVE USE BY SPECIAL REVIEW FOR AN AGRICULTURAL SERVICE ESTABLISHMENT, FIREWOOD AND WOODCHIP PROCESSING - WES MOSER AND SONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and. WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of September, 3987 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Wes Moser and Sons , 15208 Front Street, Platteville, Colorado 80651 , for a Use by Special Review for an agricultural service establishment, firewood and woodchip processing, on the following described real estate, to-wit: Part of the W} SEI , Section 30 , Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by John Moser, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan' s Urban Growth Boundary Area Goals. This proposal does not appear to have an effect on the urban growth of the Town of Milliken or the Town of Gilcrest. 871225 Page 2 RE: USR - WES MOSER AND SONS b. The proposed use is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposed uses are compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Agricultural Zone District. d. No overlay districts affect the site. e . Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an agricultural services establishment, firewood and woodchip processing, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to continuing the use of the property for firewood and woodchip processing, the structures shall be inspected by the Weld County Building Inspection Department and determined to be in compliance with the Weld County Building Code Ordinance. 4 . The Special Review permit is for a home business , firewood and woodchip processing, as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Wood shavings and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 3 . All off-street loading and unloading and parking areas shall be surfaced with either gravel, asphalt or concrete and shall be maintained to alleviate dust and to prevent drainage problems. 4 . The property shall be maintained in accordance with the Soil Erosion Control Plan approved by the Platte Valley Soil Conservation District. 5 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance . 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance . 7 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. -8 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 9 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. The property owner or operator shall be _responsible for complying with all of the foregoing Standards . The Town of Milliken will, however, review this request prior to the Board of County Commissioners' hearing. STOCKPILE Outdoor storage of wood will vary greatly depending upon the time of year. However, approximately 3 , 000 sq. ft. have been set aside, 1 , 000 sq. ft. for bark and 2 , 000 sq. ft. for firewood. The stockpile will not exceed ten feet in height.
