A WET, OPEN-CUT SAND AND GRAVEL OPERATION - REYNOLD HERBST WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 14th day of May, 1986 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Reynold Herbst, 12351 Weld County Road 62 , Greeley, Colorado 80631 , for a Use by Special Review for a wet, open-cut sand and gravel operation on the following described real estate, to-wit: Part of the NWa, Section 31 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 , 44. 1 , 44. 2 and 44 . 3 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. This request is in compliance with the Weld County Comprehensive Plan and the Weld County Extraction Plan, Mineral Resources, Volume II. The Weld County area in question is located in a resource conservation area. The Weld County Extraction Plan states that extraction shall be encouraged in resource conservation areas , as long as appropriate extraction standards are followed. The proposal is consistent with the Comprehensive Plan policies T,/ c7 ')-;"•" /tra n '4' 860469 Page 2 RE: USR, HERBST which allow uses of an industrial nature to occur where the resources are available (i.e. , sand and gravel operations as noted on pages 62-63 of the Comprehensive Plan. ) b. The proposal is consistent with the intent of the Agricultural Zone District in that the proposed use does not interfere with other agricultural -activities in the area or the County, and as a Use by Special Review the activity can take place in the District. c. The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood, as well as the projected development in the future. d. The Greeley Planning Commission has reviewed this proposal and has recommended no objections to the request. 2. The subject site is in a Flood Hazard Overlay District area. Development Standard #6 addresses this concern. f. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a wet , open-cut sand and gravel operation on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . The applicant and/or operator shall be required to obtain all applicable building or electrical permits for USR-731 : 86 : 13. 860469 Page 3 RE: USR, HERBST 4 . The following note shall be placed on the Use by Special Review plat: Note: The Mined Land Reclamation Board has the authority to issue permits for mining and reclamation activities. Activities related to mining and reclamation are, therefore, under the jurisdiction of the Mined Land Reclamation Board; however, Weld County has jurisdiction of those matters outlined in the Development Standards. 5 . The applicant shall submit evidence to the Department of Planning Services that the Use by Special Review activity is in compliance with Section 44 . 4. 10 , of the Weld County Zoning Ordinance. 6. Prior to recording the Use by Special Review plat, the applicant shall offer and agree to a program of road maintenance that is acceptable to the Board of County Commissioners. The agreement shall mitigate impacts generated on County roads by the gravel mining _operation' s truck traffic. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of May, A.D. , 1986 . The Tee by Special Review permit ie for the extraction of sand and gravel as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Vehicular traffic shall ingress and egress onto Weld County Road 62 as shown on the submitted ZJse by Special Review plat. The haul route shall be from the point of ingress and egress east to Weld County Road 27 and south to U.S. Highway 34 or north to -Weld County Road 64 . 3 . The operator shall complete a -Road Maintenance and Improvements Agreement with Weld County in accordance with the specifications outlined by the Eoard of County Commissioners prior to extraction of sand and -gravel from the Use by Special Review area. 4 . The property owner and/or operator shall apply for a well permit from the Division of Water Resources to comply with C.R. S. 37-90-137 . Prior to extraction of sand and gravel, a copy of the well permit application shall be forwarded to the Department of Planning Services. 5 . The applicant shall obtain a N.P.D.E.S. Permit from the Water Quality Control Division of the Colorado State Health Department prior to discharge of any water into the Cache la Poudre River. A copy of the N.P.D.E.S. Permit shall be forwarded to the Department of Planning Services . 6. All operations on said described parcel shall be in conformance with the Weld County Flood Hazard Regulations including: A. No permanent structures, fill, berms or stockpiles of sand and gravel shall be placed in the one hundred year flood plain of the Cache la Poudre River which would obstruct passage of flood flows. B. All fuel tanks, septic tanks, temporary buildings , and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood-proofed to avoid creation of a health hazard. Following completion of mining, all temporary buildings shall be removed. 7 . The owner/operator shall obtain the required emissions permit from the Air Pollution Control Division, State Health Department. 860469 Bage 2 RE: DEVELOPMENT STANDARDS - IJSR, HERBST 8 . Any on-site septic system shall be designed by a Colorado Registered Professional Engineer in accordance with Weld County Individual Sewage Disposal Regulations. 9 . The open-cut sand and gravel operation shall comply with Section 44 .4 , Operation Policies. 10 . All construction done on the property shall be accordance with the requirements of the Weld County Building Code Ordinance. 11 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24. 5 of the Weld County Zoning Ordinance. 12 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 13. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 1-4. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all -applicable Weld County Regulations. Vehicular traffic shall ingress and egress onto Weld County Road 62 as shown on the submitted Use by Special Review plat. Prior to recording the Use -hy Special Review plat, the applicant shall _offer and agree to a program of road -maintenance that is acceptible to the Board of Commissioners. The Use by Special -Review permit is for the extraction of sand and gravel as submitted in the application materials on file in the Department of Planning Services and subject to the -Development Standards stated hereon. 2. Vehicular traffic shall ingress and egress onto Weld County -toad 62 as shown -on the submitted Use by Special Review -plat. The haul route shall lie -from the point of ingress and egress east to Weld County Road 27 and then south to U.S. Highway 34 or north to Weld County Road 64. 3. The operator shall complete a road maintenance and improvement agreement with Weld County in accordance with the specifications outlined by the Board of County Commissioners Prior to -extraction of sand and gravel from the Use by Special Review area. 4. The property owner(s) and/or operator shall apply for a well permit with the Division of Water Resources to comply with C.R.S. 37-90 1-37. Prior to ,extraction of sand -and gravel, a copy of the well permit application shall be forwarded to the Department of Pl-anning Services. 5. The applicant shall obtain a N.P.D..S. Permit from the Water Quality Control -Division of the Colorado State Health -Department prior to discharge of any water into the Cache la Poudre River. A copy of the N.P.D.-E.S. Permit shall be forwarded to the Department of Planning Services. 6. All operations on said described parcel shall -be in conformance -with the Weld County Flood Hazard Regulations including: A. No fill, _berms or -stockpiles ,of sand and gravel shall be placed in the one hundred (10-0) year flood plain of the Cache la Poudre River which would obstruct passage of flood flows; and B. She proposed tract lies within a 260 t Acre tract purchased in 1974 by Reynold and Wynona Herbst , and has been farmed for the past 11 years with corn , beets and alfalfa , with average yields . The proposed tract lies in the flood plain of the Cache la Poudre River and in the neck of a river oxbow. Flood in 1983 and 1984 washed out the upstream retaining bank and washed across the tract of land . The bank was rebuilt , however , the grading anti topsoil were destroyed and have not been replaced . The operator proposes to use a plant consisting of a 36" Cone Crusher, Screeneing Plant , 2 Radial 'Stackers and several conveyor units with a production rate of 300 Tons/hour , and a Stale and Office unit . In addition, a combination of Dr-agline-s , Backhoes , -czars and Load-era -and Truc-ks will be used . The ground water table may be lowered and con- trolled throug-h th-e use of pumps durin-g the mining phase. The mining plan is to start on the Westerly side of the area with re- inforcing of t-he river bank and placement of topsoil from the first areas stripped on the tank. The proposed pit is set back about 600 feet from Weld County Road No. 25 and is screened by existing vegetation and growth along the Poudre River. The gravel pit site is relatively flat. Most surface drainage will be retained on the site. With the Herbsts' home on the property, they will continually moni- tor the operation. There will be a small increase in truck and vehicular traffic to the site, however, the county roads already carry traffic from adjoining farm operations and oil field activity. Traffic loads will be divided by the opposite direction to the major highways. No major areas of vegetation or cover are being destroyed, therefore the impact on wildlife will be minimal . This nearly level map unit is on bottom lands and flood plains of all the major streams in the survey area. Aquolls, which have a dark colored surface layer, make up about 60 percent of the unit. Aquents, which have a lighter colored surface layer, make up about 35 percent. About 5 percent is Aquepts and Bankard sandy loam. These are deep, poorly drained soils that formed in recent alluvium. No one pedon is typical. Commonly the line soils have a orttclayeyiidly surfacea layer and underlying al- kaline loamy material and are underlain by sand or sand and gravel within 48 inches. In places they have a gleyed layer in the underlying material. Most of the acreage is subject to flooding. The water table is at or near the surface early in spring and recedes to as deep as 48 inches late in fall in some years. These soils are used for rangeland and wildlife habitat. Some small areas have been reclaimed by major drainage and leveling and are used for irrigated crops. The potential native vegetation is dominated by alkali sacaton, switchgrass, and western wheatgrass. Saltgrass, sedge, rush, and alkali bluegrass are also prominent. Potential production ranges from 3,000 pounds per acre in favorable years to 2,000 pounds in unfavorable years. As range condition deteriorates, the switchgrass, alkali sacaton, and western wheatgrass decrease and saltgrass; sedge, and rush increase. Management of vegetation should be based on taking half and leaving half of the total annual production. Seed- ing is difficult and costly because numerous tillage prac- tices are required to eliminate the saltgrass d. Switchgrass, western wheatgrass, alkali sacaton, tall wheatgrass, and tall fescue are suitable for seeding. They can be seeded into a clean, firm seedbed.
