RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT
DEVELOPMENT PLAN - DEL CAMINO CENTER PARTNERSHIP
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
meeting on the 22nd day of March, 1989 , at the hour of 9 : 00 a.m.
in the Chambers of the Board for the prupose of considering the
Site Specific Development Plan and Planned Unit Development Plan,
First Filing, submitted by Del Camino Center Partnership, c/o Ed
Kanemoto, 203 South Main Street, Longmont, Colorado 80501 , and
WHEREAS , said Site Specific Development Plan and Planned Unit
Development Plan, First Filing, concerns the following described
real estate , to-wit:
A tract of land located in the W# of the NW$
of Section 14 , Township 2 North, Range 68 West
of the 6th P.M. , Weld County, Colorado
WHEREAS , said applicant was represented by Mike Daley, of The
Neenan Company, and
WHEREAS, the Board heard all of the testimony and statements
of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of
the exhibits and evidence presented in the matter and, having been
fully informed, finds that this request shall be approved for the
following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 28 . 9 of the Weld
County Zoning Ordinance.
2 . The Planned Unit Development (PUD) Plan application is
in conformance with Section 28 . 14 of the Weld County
Zoning Ordinance as follows :
a. The proposed PUD Plan is located within the I-25
Mixed-Use Development Area. The uses proposed for
the PUD Plan are consistent with the uses described
in the I-25 Mixed-Use Development Area and Activity
Centers Section of the Comprehensive Plan.

b. The PUD Plan conforms to the PUD District. The
Utility Coordinating Advisory Committee reviewed
and approved the utility plan map at its February
23rd meeting.
c. The application materials demonstrate that the uses
allowed under the proposed PUD Plan will be
compatible with existing and future development of
the surrounding area and also with future
development as projected by the plans of affected
municipalities .
d. The PUD is not located in an overlay district area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application of
Del Camino Center Partnership for a Site Specific Development Plan
and Planned Unit Development Plan, First Filing, on the above
referenced parcel of land be, and hereby is , granted subject to
the following conditions:
1 . Prior to recording the PUD Plan plat, the applicant
shall :
a. Submit a Weld County Subdivision Improvements
Agreement to the Department of Planning Services .
The Agreement shall be approved by the Board of
County Commissioners .
b. Submit an Off-site Road Improvements Agreement for
Weld County Road 22 to the Department of Planning
Services . The Agreement shall be approved by the
Board of County Commissioners . A cul-de-sac street
may be substituted for the street which accesses
Weld County Road 22 .
c. Amend the PUD Plan plat to show: a temporary
cul-de-sac replacing the dead end street at the
south end of the PUD Plan; and, if warranted,
access to Weld County Road 22 ; and a cul-de-sac
street South of the Godding Ditch to replace the
dead end street.
d. Submit a letter to the Department of Planning
Services from Mr. Don Carroll , Engineering
Department, updating Mr. Carroll ' s February 23rd
memo and approve the drainage plan for the PUD
Plan.

e. Amend the PUD Plan covenants to explain the
requirements and provision of service of the Weld
County Sheriff ' s Office as outlined in its memo
dated October 14 , 1988 . The amended covenants
shall be approved by the Sheriff' s Office.
f. Amend the PUD Plan plat to show the Godding Ditch
Company has adequate access on the south side of
the ditch from the western boundary line of the PUD
Plan to the two headgates (approximately 200 yards)
for maintenance and repair.
g. Amend the drainage plan to demonstrate that runoff
retention pond water will be returned to the
Godding Ditch through culverts or waterways that
will not erode ditch banks. This plan shall be
approved by representatives of the Godding Ditch
Company.
h. Amend the PUD Plan plat to show an additional 20
feet of dedicated right-of-way to the south side of
the existing Weld County Road 22 right-of-way.
i. Amend the PUD Plan plat to show an additional 10
feet of dedicated right-of-way to the east side of
the existing East I-25 Frontage Road right-of-way.
j . Amend the PUD Plan plat to show the potential 200
foot oil and gas production facility location in
accordance with note 5 of the PUD district plat.
k. Amend the PUD Plan plat to show that the new access
with the I-25 Frontage Road is flared to allow room
for signage and utilities as explained in the
February 28th letter from Mr. Jacobson of the
Colorado Division of Highways .
2 . The following notes shall be placed on the PUD Plan plat:
a. The uses permitted in this PUD plan are C-1
(neighborhood commercial) , C-2 (general commer-
cial) , C-3 (commercial) , I-1 (industrial) , I-2
(industrial) , and oil and gas production facilities
as described in the application materials and set
forth in the Weld County Zoning Ordinance on file
with the Clerk to the Board of County
Commissioners .

b. Prior to issuing building permits , approval of a
site plan review on each lot is required in
accordance with Section 33 . 4 .5 , of the Weld County
Zoning Ordinance. The site plan review shall
comply with the PUD Plan application materials on
file with the Clerk to the Board of County
Commissioners .
c. All lots shall be created and approved as part of
the Site Plan Review application process . A mylar
plat shall be submitted with the site plan review
application. The plat shall be prepared by a land
surveyor registered in the State of Colorado. The
minimum dimensions of the plat shall be 8-1/2
inches wide by 14 inches high. A plot plan and
vicinity map shall be shown on the plat. The plot
plan shall show a certified boundary survey of the
lot under consideration with a complete legal
description, including lot and block number, all
bearings and distances of the lot boundary lines,
total number of acres , title, scale, north arrow,
date of drawing, and surveyor' s certificate . All
lots shall show a minimum side lot utility and
drainage easement of 10 feet and a minimum rear lot
utility and drainage easement of 20 feet. The
vicinity map shall identify all lots created within
the PUD district and the possible 150 foot radius
easement for oil and gas drill sites and production
facilities. All plats shall be recorded by the
Department of Planning Services in the office of
the Clerk and Recorder.
d. The streets located within the PUD Plan are private
and shall be maintained by the owners ' association
and property owners as described in Case #S-300 , on
file with the Clerk to the Board of County
Commissioners.
e. The requirements of the Longmont Fire Protection
District shall be met.
f. The requirements of the Weld County Sheriff' s
Department shall be met.
g. Outdoor storage shall be visibly screened from
1-25 , Weld County Road 22 , and adjacent properties.
This does not include parking areas for company
vehicles , visitors , and customers. This does not

include loading areas so long as they are not used
as storage areas.
h. Conflicts with existing easements shall be resolved
prior to construction of roads, utilities, and
other facilities.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
March, A.D. , 1989 .

A public hearing was conducted on March 22, 1989, at 10:00 A.M., with

The following business was transacted:
I hereby certify that pursuant to a notice dated February 13, 1989, and
duly published February 15, 1989, in the Platteville Herald, a public
hearing was conducted to consider a Site Specific Development Plan and
Planned Unit Development Plan, First Filing, submitted by Del Camino
Center Partnership. Lee Morrison, Assistant County Attorney, made this
matter of record. Rod Allison, representing the Planning Department,
entered the favorable recommendation of the Planning Commission into
the record of this hearing. Mr. Allison said the Planning staff
recommends a change to Condition 1. (c) , and read the proposed change
into the record. Mr. Allison also advised the Board that the Tri-Area
Planning Commission has recommended approval of this request. Mike
Daley, of The Neenan Company, came forward to represent the applicant
and answer questions of the Board. No public comment was offered
concerning this request. Commissioner Lacy moved to approve this
request, subject to the amended Conditions. The motion, seconded by
Commissioner Kennedy, carried unanimously.
This Certification was approved on the 27th day of March, 1989.

Environmental Prot-ection Services has reviewed this proposal and -recommends
for approval, subject to the fallowing conditions:
1. Waste oil, waste paints, stains, treatments, spent drug containers,
anti-freeze, -and other associated liquid and solid wastes, shall be
stored and removed for final disposal in a manner that protects
tgainst surf-ace and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, _disposed, in a manner
that controls fugitive dust, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust must be confined on this site.
5. Maximum permissible noise level shall not exceed the industrial
limit of 80 db(A) , as measured according to 25-12-102, Colorado
Revised Statues.
6. The Division requires that this facility utilize the existing
municipal sewer treatment system. Adequate water supply must be
provided to the development by the Central Weld County Water
District.

Commission's recommendation for approval based upon the recommendation and
conditions presented by the Department of Planning Services' staff and the
testimony heard by the Planning Commission. Motion seconded by Ann
Garrison.

LOCATION: North of and adjacent to Weld County Road 62-1/4 and east of and

APPEARANCE:
Gary Tuttle, P.E. , Tuttle, Applegate, and Rindahl, Inc. , represented the
applicant. Hall-Irwin purchased this gravel pit about a year ago with the
intention of enlarging it to serve their needs. Two and one—half to six
acres will be mined per year. He also discussed the reclamation plans for
the pit area.
Rod Allison reported the applicant is working with the U.S. Army Corps of
Engineers. A standard requiring the operator to obtain the necessary
permits from the U.S. Army Corps of Engineers has been incorporated into the
staff's recommendation.

update Mr. Carroll' s February 23rd memo and approve the
drainage plan for the PUD plan;
- Amend the PUD plan covenants to explain the requirements and
provision of service of the Weld County Sheriff's Office as
outlined in its memo dated October 14, 1988. The amended
covenants shall be approved by the Sheriff's office;
- Amend the PUD plan plat to show the Godding Ditch Company has
adequate access on the south side of the ditch from the
western boundary line of the PUD plan to the two headgates
(approximately 200 yards) for maintenance and repair;
- Amend the drainage plan to demonstrate that runoff retention
pond water will be returned to the Godding Ditch through
culverts or waterways that will not erode ditch banks. This
plan shall be approved by representatives of the Godding
Ditch Company;
- Amend the PUD plan plat to show an additional 20 feet of
dedicated right-of-way to the south side of the existing Weld
-County Road 22 right-of-way;
- Amend the PUD plan plat to show an additional 10 feet of
dedicated right-of-way to the east side of the existing East
I-25 Frontage Road right-of-way; and

Amend the PUD plan plat to show the potential 200 foot oil
and gas production facility location in accordance with note
5 of the PUD district plat.
- Amend the PUD plan plat to show the new access with the I-25
_Frontage Road is flared to allow room for signage and
utilities as explained in the February 28th letter from Mr.
Jacobson of the Colorado Division of Highways.
2. The following notes shall be placed on the PUD plan plat:
- The uses permitted in this PUD plan are C-1 (neighborhood
commercial) , C-2 (general commercial) , C-3 (commercial) , I-1
(industrial) , I-2 (industrial) , and oil and gas production
facilities as described in the application materials and set
forth in the Weld County Zoning Ordinance on file with the
Clerk to the Board of County Commissioners;
- Prior to issuing building permits, approval of a site plan
review on each lot is required in accordance with Section
33.4.5, of the Weld County Zoning Ordinance. The site plan
review shall comply with the PUD plan application materials
on file with the Clerk to the Board of County Commissioners;
- All lots shall be created and approved as part of the Site
Plan Review application process. A mylar plat shall be
submitted with the site plan review application. The plat
shall be prepared by a land surveyor registered in the State
of Colorado. The minimum dimensions of the plat shall be
8-1/2 inches wide by 14 inches high. A plot plan and
vicinity map shall be shown on the plat. The plot plan shall
show a certified boundary survey of the lot under
consideration with a complete legal description, including
lot and block number, all bearings and distances of the lot
boundary lines, total number of acres, title, scale, north
arrow, date of drawing, and surveyor's certificate. All lots
shall show a minimum side lot utility and drainage easement
of 10 feet and a minimum rear lot utility and drainage
easement of 20 feet. The vicinity map shall identify all
lots created within the PUD district and the possible 150
foot radius easement for oil and gas drill sites and
production facilities. All plats shall be recorded by the
Department of Planning Services in the office of the Clerk
and Recorder;

shall be maintained by the owner's association and property
owners as described in Case #S-300, on file with the Clerk to
the Board of County Commissioners;

- Outdoor storage shall be visibly screened from I-25, Weld

construction of roads, utilities, and other facilities.

I have reviewed the information you submitted regarding the development and
site plan and have the following concerns:
The Master Utility Plan dated January, 1989, shows a cul-de-sac at the
north end of the road. Filing No. 1 indicates a 60' access to the north
through the cul-de-sac to Weld County Road 22. Will there be an access
there? If so, paving of Weld County Road 22 will be needed from the east
property line to the Frontage Road. A Paving Agreement will be worked out
prior to approval . This was not shown on the Sketch Plan P.U.D. dated
January, 1988.
The Drainage Plan indicates that starting at the south end next to the
Frontage Road, the flow is to the north, and Point "G" is 24" R.C.P. It
then shows a reduction to two (2) 18" R.C.P. Next, it shows an increase to
30" R.C.P. , and finally shows it coming back down to the existing 18"
C.M.P. Are you restricting the flow at the 18" R.C.P. area?
The 900 corner at the south end does not meet the regulations of the
Horizontal Curves Data, Subdivision Regulations 8-2 Streets. C. Curvature
and Alignment (1) Horizontal Curves.

Gentlemen:
We have a major concern with this development plan, and that is
with the irrigation ditch that crosses the area. Whenever urbani-
zation occurs around irrigation ditches, there is a problem of
agricultural producers having problems with water.
We would recommend that the Planning Department contact the
owners of the ditch to discuss and eliminate problems that might
occur along the ditch during and after construction.

Dear Mr. Allison:
Thank you for sending for our review the application for a site specific
development plan and planned unit development plan, 1st filing, for Del Camino
Center.
This 72 acre site is located east of I-25 and south of Weld County Road 22 and
is within the I-25 mixed use development area. Previously the City of Longmont
has commented upon both the sketch plan and the change of zone applications.
This latest application addresses the City's previous concerns. The PUD
provides perimeter landscaping along the I-25 frontage, along internal roads ,
and as a buffer bordering residential properties. According to the PUD narra-
tive, any outside storage will be screened with a solid fence and located
to the rear of a building. Individual lots also will not be allowed to access
the frontage road directly, and an access easement will be provided for the
outlot in the event of its redevelopment.

1. A proposed use shall comply with uses permitted by Weld
County for C-1, C-2, C-3 , I-1 and I-2 zoning districts.
2 . Each building footprint shall occupy less than 40% of the
lot area. The total building square footage shall not
exceed 40% of the lot area. There is no minimum square
footage, as it is possible that a lot may be used solely for
receiving, storing and dispatching material or merchandise.
3 . The building height and total size shall not exceed height
and square footage allowed by the Uniform Building Code.
4 . All parking shall be provided on the lot. There shall be
one parking space for each anticipated employee on the
maximum shift, plus 5% minimum for visitor cars. Parking
spaces shall be 9 ' x 19 ' for standard size cars and 8 . 5 ' x
15 ' for compact cars. Compact car ratio shall not exceed
30% of the total required spaces. There shall be no on-
street parking or backing of trucks permitted. Parking and
truck areas shall be paved. Paving sections shall be as
recommended by a geotechnical engineer. Customer parking
shall be convenient to the building' s entry and the site
access.
5 . Outside storage area shall not exceed 25% of the total lot
area, except where total building area is less than 40%. In
these instances, the outside storage area may replace that
portion of the building area not used in addition to the
25% . All outside storage shall be screened by using solid
durable fencing to a height of 8 ' . The maximum storage
height for general stackable material shall be 8 ' (i. e. ,
pipe, block, palletized storage, etc. ) , working trucks and
equipment shall not be included in this provision. All
outdoor storage shall be limited to that portion of the lot
that is to the rear of the front of the building.
6 . Each lot shall have a maximum of one driveway access for
each 250 ' or less of frontage on interior roads. The
driveway access centerline shall be a minimum of 30 ' from
interior property lines and a minimum 200 ' from property
line at the Frontage Road. No access is allowed from
individual lots into the Frontage Road. A maximum of two
driveway accesses are allowed on any lot. Minimum driveway
access width is 25 ' , with a maximum width to be 35 ' . There
shall be a minimum 18" drainage pipe under each driveway at
the borrow ditch locations.

7 . Each lot, when created, shall provide a 10 ' drainage and
utility easement at interior property lines, and a 20 '
drainage and utilities easement at rear and side property
lines which abut property not included in Del Camino Center
P.U.D. easements along Frontage Road and County Road 22
shall be as dedicated on the overall plat.
8 . A 40 ' access easement shall be provided for the benefit of
the Outlot, which is an existing residential use located on
the Frontage Road, to provide access to the internal access
of this development, in the event the Outlot's use is
changed to an industrial park use. The easement shall
dedicated, as Del Camino Center lots are platted adjacent to
the Outlot. At such time that the Outlot's use does change
to an industrial park use, and that Outlot begins use of the
above access easement, the Outlot shall become a member of
the Property Owner's Association.
9 . Two 150 ' radius easements for oil and gas wells shall be
finalized as lots in the areas shown on the district plat
are platted.
10. Signage
A. There shall be a general identification sign at each
entrance to Del Camino Center. They shall be one or
two sided and their size shall not exceed 5 ' x 20 ' in
length per side. The sign shall be ground mounted with
the total size height including base, to not exceed 8 '
in height. Sign lighting shall be shielded to prevent
glare to vehicles on the highway, and of a type meeting
Weld County requirements.
B. Individual lot signs shall be located on the building
walls or ground mounted near driveway access onto a
lot. Sign area shall be limited to 100 ' square feet
maximum total . Signs shall be constructed of a
durable, weather resistant material, :. and no sign shall
have more than two faces. No sign shall be placed
above the top of the maximum wall height, and ground
mounted signs, including base shall not exceed 6 ' .
Sign lighting shall be shielded to prevent glare to
vehicles on the highway and internal roads, and of a -
type meeting Weld County requirements.
11. The design of each building shall be governed by notes shown
on the recorded final plan, covenants running with the lots
and the following standards:

in place, tilt-up or pre-east) , or synthetic stucco.
Other materials such as wood and metal siding may be
used only in combination with one of the above
-materials and upon approval of the Property Owner' s
Association.
B. Exterior colors shall be limited to neutral colors, and
accent colors approved by Property Owner's Association.
C. All buildings must be constructed with new materials.
No used buildings, sheds, fencing, etc. shall be used.
12 . All landscaping must conform generally to the Landscape
Plan.
A. County Road 22 and I-25 Frontage Road landscape areas
(20 ' wide, as shown on plan) :
Deciduous canopy trees shall be placed informally at an
average of 50 ' on center. Suggested trees to be Green
Ash, Cottonless Cottonwood, Honeylocust, and Linden.
B. Residential landscape buffer areas (20 ' wide, as shown
on plans) :
6 ' high solid fence in combination with upright
Evergreens at 20 ' maximum o.c. , like Robusta Green
Juniper, Keteleeri Juniper or Manhattan Blue Juniper
(generally 15-20 ' in height with good width) , Pinyon
Pine , Austrian Pine, or similar trees can be
substituted for variety at 40 ' o. c.
_C. Residential landscape buffer areas (50 ' wide, offsite,
as shown on plans) :
Deciduous buffer trees shall be staggered in
alternating rows at 50 ' o.c. in each row (see landscape
plan) , low maintenance semi-native trees like Russian
Alive shall be used. °
D. Individual lot landscaping (minimum 20% of lot area) :
1) One tree or eight bushes per 1, 000 sq. ft. of
required landscape area (maximum 50% of required
count are to be bushes) .
2) approximately 50% of trees and bushes are to be
deciduous, and 50% coniferous.
3) Use of flowering and seasonal color planting is
encouraged.
-4) 50% of required landscape area to be irrigated
turf grasses.
5) Trees in buffer areas (Items A and B) can be used

13 . Individual property owners are responsible for maintenance
of borrow _ditches and culverts on their property. Ditches
on interior property lines shall be jointly maintained by
adjacent property owners.
14 . ZJnoccupied lots will be maintained by the owner (or if
unsold, the developer) so that weeds and dust are controlled
and open area grass seeded to prevent erosion and unsightly
appearance. (In addition to the covenants guiding permitted
use of lots, each owner shall be required to become a member
of the Property Owners Association and this association will
be empowered, if other measures fail, to clean up and repair
buildings, lots, ditches, roads, etc. and bill all owners or
responsible parties, for this expense) .
15. Once constructed, the roads and their maintenance shall be
the responsibility of the Property Owners Association and
roads must be maintained to a level acceptable to the
majority of this body. They will have the right to place
liens, if necessary, against all properties to guarantee
these standards. The Property Owners Association will
retain a private contractor who will remove -snow and at
least twice yearly inspect and when necessary, repair all
roads and appurtenant features.
16 . Minimum lighting on each lot and building shall be the
responsibility of the lot owners. This. minimum shall be
sufficient to insure public safety and convenience, but of a
type (or shielded) so as not to create glare on highways or
the adjacent road. The type shall be high pressure sodium.
17 . Each lot will have a trash bin sufficient in size for trash
disposal for that particular business, screened from general
view and enclosed and constructed to prevent blowing of
trash. It will be required that trash shall not be allowed
to accumulate, but will be disposed of when it has reached
the capacity of the particular bin. All trash of noxious or
-objectionable odor must be disposed of immediately.
18 . Where necessary, all building foundations shall be raised
sufficiently to insure proper drainage away from buildings,
and appurtenant structures and into surrounding drainage
ditches and swales.

the Weld County Zoning Ordinance, is required prior to using
or developing any lot.
20. Other than the required 20% landscaping -on each lot, there
is no public open space within the P.U.D.
21. All requirements of the Longmont Fire Protection District
have been met. Notes of requirements are on the Final Plan
map and Utility Plan.
22 . access and pipeline easements for oil and gas are shown on

23 . Each lot shall provide on-site storm water detention in
accordance with drainage master plan and drainage report.

COVENANTS
THIS DECLARATION made this 1st day of February, 1989,
by DEL CAMINO CENTER PARTNERSHIP, A COLORADO PARTNERSHIP,
hereinafter called the "Declarant. "
WITNESSETH:
WHEREAS, ' the Declarant is the present equity owner of
property situated in the County of Weld, State of Colorado,
more particularly described as follows, hereinafter called
the "Premises" :
Del Camino Center - Part of the West Half,
Section 14-2-68 according to the recorded plat
thereof; and
WHEREAS, Declarant is desirous of subjecting said
Premises to the conditions, covenants, restrictions and
reservations hereinafter set forth to insure proper use and
appropriate improvements of said Premises as follows:
1. Wherever herein used, the term "building site" shall
mean any plot of land lying within any Lot and Block in Del
Camino Center, the size and dimensions of which shall be
established by the legal description in the original
conveyance from Declarant to the first fee owner of said plot
of land, other than Declarant. A building site -may also be
established by Declarant by an instrument in Writing,
executed, acknowledged and recorded by the Declarant and
filed with Weld County, which designates a plot of land as a
building site for purposes of these Covenants. If two or
more building sites, as defined hereinabove, are acquired by
the same owner in fee, its commonly owned building sites may,

at the option of said owner, be combined and treated as a
single building site for purpose -of the Covenants contained
herein.
2 . No noxious or -offensive trades, services or
activities shall be conducted on any building site nor shall
anything be done thereof which may be or become an annoyance
or nuisance to the owner, tenant or occupant of other
building sites within the Del Camino tenter area by mason of
unsightliness or the excessive emission of fumes, odors,
glare, vibration, gases, radiation, dust, liquid waste, smoke
or noise.
3 . No buil-ding shall at any time be erected on any
building site within twenty-five (25) feet of any street
easements adjoining the same, or any perimeter property line
of Del Camino Center. No building shall be constructed
within ten (10) feet or one (1) foot for every two (2) feet
of building height, whichever is greater from internal
property lines.
4. All vehicles shall be parked within the building
site when loading or unloading at a building site. No
loading dock shall be erected on any building site fronting
on any street, unless the Front of such loading platform
shall be set back at least one hundred fifty (150) feet from
the property line abutting the street on which said loading
dock fronts.
5. Any owner, tenant or occupant of any building site
shall provide on the Premises off-street automobile parking
facilities for each employee employed on the premises by the
original occupants thereof and appropriate visitor parking.
All off-street parking and access drives and all loading
areas shall be hard surfaced and properly graded to assure
proper drainage. parking lot lighting, poles, and fixtures
shall not exceed thirty-five (35) feet in height.
6. Any owner, tenant or occupant of any building site
shall submit to the Declarant's Architectural Review

Committee plans and specifications for any building,
improvements, or landscaping to be placed on the Premises.
No building improvements or landscaping shall be erected or
placed on the Premises without the prior written approval of
plans and specifications therefore given by the Architectural
Review Committee. All buildings shall be constructed of
concrete masonry units, tilt-up construction (excluding twin-
tees) or brick. All other -materials shall be reviewed by and
-must be approved specifically by the Architectural Review
Committee. landscaping must meet minimum requirements of the
PUD plan recorded with Weld County.
7. No building site nor any part thereof shall at any
time be used for any of the following purposes: dump, riding
academy, public incinerator, rodeo, junk yard, trampoline
center, quarries, sewage disposal plants, or gravel pits.
Permitted uses shall be those as defined in the PUD plan
recorded and accepted by Weld County.
8. Any owner, tenant or occupant of any buil-ding site
agrees that the area between the building lines as herein
defined and the street property lines shall be used only for
either open landscaped and green areas or for service access
to the building or to a parking lot. Landscaped areas shall
be done attractively with lawn, trees, shrubs or similar
treatment and shall he properly maintained in a sightly and
well—kept condition. All landscaping required hereunder or
otherwise to be provided on any building site shall be
completed within sixty (-60) days after the completion of
construction of improvements constructed on any buil-ding
site; provided, ₹however, if weather conditions do not at such
time permit, then such landscaping shall be completed as soon
thereafter as weather conditions permit.
9. Water towers, water tanks, standpipes, penthouses,
elevators, or elevator equipment, stairways, ventilating fans
or similar equipment required to operate and maintain any
building, fire or parapet -wills, skylights, tanks, cooling or

other towers, wireless radio or televisions masts, flagpoles,
chimneys, smoke stacks, gravity flow storage and mixing
towers or similar structures may exceed a height allowed by
the Uniform Building Code from the established building
gra-de, only with the prior written approval of the
Architectural Review Committee.
10. Any owner, tenant, or occupant of any building site
shall submit to the Architectural Review Committee or its
designee, all plans for signs to be erected, substituted,
changed or -modified on the Premises, including -details of
design, materials, location, size, heights, color and
lighting. No .sign shall be erected, substituted, changed or
modified on the _Premises without the prior written approval
of plans and specifications therefore given by the Declarant,
or its designee. Sign shall also meet Weld County
requirements.
11. She Property Owners Association hereby retains such
rights-of-way and easements as may be necessary or convenient
for the purpose of erecting, _construction, maintaining,
repairing and operating utility services over, across, under
and through each building site in the designated setback
areas between the building lines and the property lines,
including public utility wires, and conduits for lighting,
power and telephone, gas line, sanitary sewer, storm sewer
and water, -and the Declarant shall have the right to grant
rights-of way and/or easements to others to carry out this
purpose. Any contract for the laying of such lines, wires,
conduits, pipes or sewers shall also provide that the
Premises shall le reasonably restored to the same condition
they ware in prior to the 'doing of such work.
12 . Storage yards on any building site for equipment,
raw materials, semi-finished or finished products shall be
allowed only with the prior written approval of the
Declarant, or its designee. Declarant reserves the right to
require fencing, shrubs, hedges, or other foliage as to

effectively screen the view of such storage areas as -deemed
necessary in keeping the Premises in a neat and sightly
condition.
13 . Each owner, tenant, or occupant of any building
site shall keep said building site and the buildings,
improvements, landscaped areas and appurtenances thereon in a
safe, clean, maintained, neat, wholesome condition and shall
comply in all respects with all governmental statutes,
ordinances , regulations , health and police and fire
requirements. Each such owner, tenant or occupant shall
remove, at its own expense, any rubbish or trash of any
character which may accumulate on its building site, and
shall keep un-landscaped areas maintained and free from weeds
and other unsightly plant -growth, rubbish and debris.
Rubbish, trash, garbage andother waste shall be kept only in
sanitary containers. All equipment for the storage or
disposal of such materials shall be kept in a clean and
sanitary condition. Rubbish and trash shall not be disposed
of on the Premises by burning in open fires. In the event
any owner, tenant, or occupant of any building site fails to
keep landscaped or un-landscaped areas maintained as provided
for herein, then in such event Declarant, or this designee,
may within fifteen (15) days after written notice of such
failure to owner, tenant or occupant, cause such area to be
maintained in accordance herewith for the account and at the
expense of such owner, tenant or occupant of said building
site.
14 . No fence, wall, -hedge or shrub, plant or tree which
obstructs site lines at elevations between three and six feet
above the roadway shall be _placed or permitted to remain on
any corner of any building site within the triangular area
formed by street property lines and a line connecting them at
points twenty live (25) feet from the intersecti-on of the
street lines.

15. Each of the foregoing covenants, conditions and
restrictions shall run with the land, and a -breach of any one
of them and continuance thereof, may at the option of the
Declarant, its successors or assigns, be enjoined, abated or
remedied by appropriate -proceedings, in addition to any other
remedy at law or in equity. It is understood, however, that
the breach of any of the foregoing covenants, conditions and
restrictions shall not defeat or render invalid the lien of
any mortgage or deed of trust on the Premises made fa _good
faith and for value; provided however, (i) that any breach or
continuance thereof may be enjoined, abated or remedied by
the proper proceedings as aforesaid; and (ii) that each and
all of the foregoing covenants, conditions and restrictions
shall at all times remain in full force and effect against
said premises or any part thereo-f, not withstanding any
foreclosure of any such mortgage or need of trust. No
assent, expressed or implied, to any breach of any one or
more of the within covenants or agreement hereof shall be
deemed to ₹be taken to be waiver of -any succeeding or other
breach.
16. If any provisions of these covenants are held
invalid as a matter of law, such invalidity shall not affect
the other provisions of these covenants, all of which shall
remain in full -force and effect as herein set forth.
17 . These protective covenants and amendments thereto
shall remain in full force and effect until April 1, 2009,
provided, ₹however, by written recorded instrument, the
Declarant may amend these protective covenants.
