HomeMy WebLinkAbout890722.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT PLAN - DEL CAMINO CENTER PARTNERSHIP WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public meeting on the 22nd day of March, 1989 , at the hour of 9 : 00 a.m. in the Chambers of the Board for the prupose of considering the Site Specific Development Plan and Planned Unit Development Plan, First Filing, submitted by Del Camino Center Partnership, c/o Ed Kanemoto, 203 South Main Street, Longmont, Colorado 80501 , and WHEREAS , said Site Specific Development Plan and Planned Unit Development Plan, First Filing, concerns the following described real estate , to-wit: A tract of land located in the W# of the NW$ of Section 14 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was represented by Mike Daley, of The Neenan Company, and WHEREAS, the Board heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in the matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 28 . 9 of the Weld County Zoning Ordinance. 2 . The Planned Unit Development (PUD) Plan application is in conformance with Section 28 . 14 of the Weld County Zoning Ordinance as follows : a. The proposed PUD Plan is located within the I-25 Mixed-Use Development Area. The uses proposed for the PUD Plan are consistent with the uses described in the I-25 Mixed-Use Development Area and Activity Centers Section of the Comprehensive Plan. The Utility Coordinating Advisory Committee reviewed and approved the utility plan map at its February 23rd meeting. c. The application materials demonstrate that the uses allowed under the proposed PUD Plan will be compatible with existing and future development of the surrounding area and also with future development as projected by the plans of affected municipalities . d. The PUD is not located in an overlay district area. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Del Camino Center Partnership for a Site Specific Development Plan and Planned Unit Development Plan, First Filing, on the above referenced parcel of land be, and hereby is , granted subject to the following conditions: 1 . Prior to recording the PUD Plan plat, the applicant shall : a. Submit a Weld County Subdivision Improvements Agreement to the Department of Planning Services . The Agreement shall be approved by the Board of County Commissioners . b. Submit an Off-site Road Improvements Agreement for Weld County Road 22 to the Department of Planning Services . The Agreement shall be approved by the Board of County Commissioners . A cul-de-sac street may be substituted for the street which accesses Weld County Road 22 . c. Amend the PUD Plan plat to show: a temporary cul-de-sac replacing the dead end street at the south end of the PUD Plan; and, if warranted, access to Weld County Road 22 ; and a cul-de-sac street South of the Godding Ditch to replace the dead end street. d. Submit a letter to the Department of Planning Services from Mr. Don Carroll , Engineering Department, updating Mr. Carroll ' s February 23rd memo and approve the drainage plan for the PUD Plan. 890722 Page 3 RE : PUD PLAN - DEL CAMINO CENTER PARTNERSHIP e. Amend the PUD Plan covenants to explain the requirements and provision of service of the Weld County Sheriff ' s Office as outlined in its memo dated October 14 , 1988 . The amended covenants shall be approved by the Sheriff' s Office. f. Amend the PUD Plan plat to show the Godding Ditch Company has adequate access on the south side of the ditch from the western boundary line of the PUD Plan to the two headgates (approximately 200 yards) for maintenance and repair. g. Amend the drainage plan to demonstrate that runoff retention pond water will be returned to the Godding Ditch through culverts or waterways that will not erode ditch banks. This plan shall be approved by representatives of the Godding Ditch Company. h. Amend the PUD Plan plat to show an additional 20 feet of dedicated right-of-way to the south side of the existing Weld County Road 22 right-of-way. i. Amend the PUD Plan plat to show an additional 10 feet of dedicated right-of-way to the east side of the existing East I-25 Frontage Road right-of-way. j . Amend the PUD Plan plat to show the potential 200 foot oil and gas production facility location in accordance with note 5 of the PUD district plat. k. Amend the PUD Plan plat to show that the new access with the I-25 Frontage Road is flared to allow room for signage and utilities as explained in the February 28th letter from Mr. Jacobson of the Colorado Division of Highways . 2 . The following notes shall be placed on the PUD Plan plat: a. The uses permitted in this PUD plan are C-1 (neighborhood commercial) , C-2 (general commer- cial) , C-3 (commercial) , I-1 (industrial) , I-2 (industrial) , and oil and gas production facilities as described in the application materials and set forth in the Weld County Zoning Ordinance on file with the Clerk to the Board of County Commissioners . 890722 -Page 4 -RE: PUD PLAN - DEL CAMINO CENTER PARTNERSHIP b. Prior to issuing building permits , approval of a site plan review on each lot is required in accordance with Section 33 . 4 .5 , of the Weld County Zoning Ordinance. The site plan review shall comply with the PUD Plan application materials on file with the Clerk to the Board of County Commissioners . c. All lots shall be created and approved as part of the Site Plan Review application process . A mylar plat shall be submitted with the site plan review application. The plat shall be prepared by a land surveyor registered in the State of Colorado. The minimum dimensions of the plat shall be 8-1/2 inches wide by 14 inches high. A plot plan and vicinity map shall be shown on the plat. The plot plan shall show a certified boundary survey of the lot under consideration with a complete legal description, including lot and block number, all bearings and distances of the lot boundary lines, total number of acres , title, scale, north arrow, date of drawing, and surveyor' s certificate . All lots shall show a minimum side lot utility and drainage easement of 10 feet and a minimum rear lot utility and drainage easement of 20 feet. The vicinity map shall identify all lots created within the PUD district and the possible 150 foot radius easement for oil and gas drill sites and production facilities. All plats shall be recorded by the Department of Planning Services in the office of the Clerk and Recorder. d. The streets located within the PUD Plan are private and shall be maintained by the owners ' association and property owners as described in Case #S-300 , on file with the Clerk to the Board of County Commissioners. e. The requirements of the Longmont Fire Protection District shall be met. f. The requirements of the Weld County Sheriff' s Department shall be met. g. Outdoor storage shall be visibly screened from 1-25 , Weld County Road 22 , and adjacent properties. This does not include parking areas for company vehicles , visitors , and customers. Conflicts with existing easements shall be resolved prior to construction of roads, utilities, and other facilities. Mr. Allison also advised the Board that the Tri-Area Planning Commission has recommended approval of this request. Mike Daley, of The Neenan Company, came forward to represent the applicant and answer questions of the Board. No public comment was offered concerning this request. Commissioner Lacy moved to approve this request, subject to the amended Conditions. The motion, seconded by Commissioner Kennedy, carried unanimously. Filing No. 1 indicates a 60' access to the north through the cul-de-sac to Weld County Road 22. Will there be an access there? If so, paving of Weld County Road 22 will be needed from the east property line to the Frontage Road. A Paving Agreement will be worked out prior to approval . This was not shown on the Sketch Plan P.U.D. dated January, 1988. The Drainage Plan indicates that starting at the south end next to the Frontage Road, the flow is to the north, and Point "G" is 24" R.C.P. It then shows a reduction to two (2) 18" R.C.P. Next, it shows an increase to 30" R.C.P. , and finally shows it coming back down to the existing 18" C.M.P. Are you restricting the flow at the 18" R.C.P. area? A proposed use shall comply with uses permitted by Weld County for C-1, C-2, C-3 , I-1 and I-2 zoning districts. 2 . Each building footprint shall occupy less than 40% of the lot area. The total building square footage shall not exceed 40% of the lot area. There is no minimum square footage, as it is possible that a lot may be used solely for receiving, storing and dispatching material or merchandise. 3 . Once constructed, the roads and their maintenance shall be the responsibility of the Property Owners Association and roads must be maintained to a level acceptable to the majority of this body. They will have the right to place liens, if necessary, against all properties to guarantee these standards. The Property Owners Association will retain a private contractor who will remove -snow and at least twice yearly inspect and when necessary, repair all roads and appurtenant features. 16 . Minimum lighting on each lot and building shall be the responsibility of the lot owners. This. minimum shall be sufficient to insure public safety and convenience, but of a type (or shielded) so as not to create glare on highways or the adjacent road. Each such owner, tenant or occupant shall remove, at its own expense, any rubbish or trash of any character which may accumulate on its building site, and shall keep un-landscaped areas maintained and free from weeds and other unsightly plant -growth, rubbish and debris. Rubbish, trash, garbage andother waste shall be kept only in sanitary containers. All equipment for the storage or disposal of such materials shall be kept in a clean and sanitary condition. Rubbish and trash shall not be disposed of on the Premises by burning in open fires. In the event any owner, tenant, or occupant of any building site fails to keep landscaped or un-landscaped areas maintained as provided for herein, then in such event Declarant, or this designee, may within fifteen (15) days after written notice of such failure to owner, tenant or occupant, cause such area to be maintained in accordance herewith for the account and at the expense of such owner, tenant or occupant of said building site. 14 .
