RE: APPROVE CONTINUANCE OF HEARING CONCERNING APPEAL OF HEALTH
BOARD DECISION - DANIEL K. AND JANET J. GIBBS
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on August 6 , 1986 , a hearing was scheduled to the
hear the appeal of a decision made by the Weld County Board of
Health , concerning a variance request , from Daniel K. and Janet J.
Gibbs , and
WHEREAS , only three Commissioners were present at said
hearing and Russell Anson, Attorney representing the Gibbs ,
requested that the hearing be continued to a date when the full
Board will be present , and
WHEREAS, the Board deems it advisable to grant the request of
Mr. Anson and continue the hearing to August 27 , 1986 , at 10 : 00
A.M. , when a full Board can be present.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing
concerning the appeal of a Weld County Health Board decision by
Daniel K. and Janet J. Gibbs be , and hereby is , continued to
August 27 , 1986 , at 10 : 00 A.M.
The above and foregoing Resolution was, on motion duly made
and seconded , adopted by the following vote on the 6th day of
August , A.D. , 1986 .

RE: APPEAL OF HEALTH BOARD DECISION - DANIEL K. & JANET J. GIBBS
A public hearing was conducted on August 6, 1986, at 10:00 A.M. , with
the following present:
Commissioner Jacqueline Johnson, Chairman - Excused
Commissioner Gordon E. Lacy, Pro-Tem
Commissioner Gene Brantner - Excused
Commissioner C.W. Kirby
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Health Department representative, Wes Potter
The following business was transacted:
I hereby certify that on August 6, 1986, a public hearing was conducted
to consider the appeal of a Health Board decision by Daniel K. and
Janet J. Gibbs. Lee Morrison, Assistant County Attorney, made this
matter of record. Russell Anson, Attorney representing the Gibbs,
requested that: this matter be continued to a later date when there is
full Board present. He said he will be available the last week in
August. Commissioner Kirby moved to continue this hearing to
Wednesday, August 27, at 10:00 a.m. Commissioner Yamaguchi seconded
the motion and it carried unanimously. Mr. Anson said there were
witnesses present today who may not be available for testimony' on
August 27. He requested that their testimony be heard today, so as to
be of record. Mr. Potter said he objected to this request, saying that
if part of the testimony is given today, then this matter should be
heard in its entirety at this time. The Board advised Mr. Anson that a
notarized statement from these witnesses can be submitted and
considered at the hearing of August 27. Mr. Anson said he has no
objection to submitting such documents.
This Certification was approved on the 11th day of August, 1986.
