BOCK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority -of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado, on the 2nd day of December, 1987 , considered the request of Robert F. and Beverly A. Bock for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as follows: Lot 6 , Block 8 , Aristocrat Ranchettes , located in Part of the NE* NW} , Section 27 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions : 1) The applicant shall apply for a building permit for the mobile home within thirty days from the date of approval by the Board of County Commissioners; 2) A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; 3) Prior to occupying the mobile home , the owner shall submit evidence that a cistern is supplying water in such a manner as to be adequate in quality, quantity, and dependability for the proposed use; 4) The mobile home shall not be occupied until such time that the applicant has complied with the preceding conditions; 5) At the time a water tap becomes available to Lot 6 , Block 8 , Aristocrat Ranchettes Subdivision, from the Aristocrat Ranchettes Water Project, the use of the cistern shall cease and the applicant shall obtain the water tap and be served by Aristocrat Ranchettes Water Project; 6) No more than one acre of ground on Lot 5 and Lot 6 , Block 8 , Aristocrat Ranchettes Subdivision, together shall be irrigated using the domestic well; and 7) Water quality of the water in the cistern shall be analyzed monthly for total coliform bacteria. Legal Description of Parcel: Lot 6, Block 8, Aristocrat Ranchettes Subdivision, Weld County, Colorado Location: Approximately nne mile north of Fort Lupton The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the following reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan. X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. X Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. _ X Adversely affect the general health, safety and welfare of the inhabitants of the area and the County. COMMENTS: If this zoning permit is approved, the applicant -proposes using a 1,550 gallon cistern as the water source to the property. The applicant has submitted a proposed agreement wherein the owners of Lot 5, Block 8, will provide water to the cistern from their domestic well until the time a water tap can be obtained from the Aristocrat Ranchettes Water Project. The State Engineer's Office, Division of Water Resources has indicated no objections to the proposal with the condition that no more than one acre of ground total between the two lots is irrigated using the domestic well. The Weld -County Health Department has recommended that the water in the cistern be analyzed monthly for coliform bacteria. -Aristocrat Ranchettes Water Project has stated the proposal has no conflicts with their interests. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. It is our intention to occupy the Mobile Home as our permanent, full time residence. We have not yet contracted for the Mobile Home through the sales agency as our purchase of the property and Mobile Home is subject to obtaining the necessary permits through Weld County to properly install the Mobile Home as a permanent residence. It is however, our intention to purchase a new 16'x7ai two bedroom Mobile Home and pay cash for the unit, as we are paying cash for the land, septic system and other components to properly install and hook up. We will have access to the land we are purchasing from Dale Street, and the top- ography is flat. It does not appear that a culvert will be necessary under the driveway for unhindered drainage on Dale Street where our driveway will connect. It is our intention to spread gravel on the driveway area, and at a later date, with the proper permits, construct a garage for automobile storage. We have retained the services of an attorney to properly prepare a Water Agreement between ourselves and the Seller of the property, to insure provision of water in adequate quantity and quality for our domestic purposes until such time as a water tap becomes available to us through another source. In addition to this, we will be installing a cistern for storage with Health Department and Weld County permit requirements. Mr. LeRoy Scruffham will be installing the septic system and cistern with the proper permits when our petition for permits have been approved, and he returns from vacation early 'in November. The perk test will be performed on Tuesday, Nov. 10th. As we discussed in our conversation on Wednesday, Nov. 4th, the water agree- ment is just to provide a continuing source of good potable water for Mr. and Mrs. Bock, and that water necessary can just as well be provided from another source since the water cistern is also going to be installed. KINNE and MILDRED A. KINNE, here and after referred to as "Kinne" and ROBERT F. BOCK and BEVERLY A. BOCK, here and after referred to as "Bock" . WHEREAS, Kinne and Bock have entered into a contract dated October 15, 1987 for the sale of certain real property and WHEREAS, that contract calls for an agreement between these parties for Bock to receive potable water from the Kinne well and in consideration of that contract and the sale of the subject property it is therefore agreed by the parties, to-wit: 1. All pre-closing requirements of the Contract dated October 15, 1987 have been satisfied. 2 . On and after the date of this Agreement Kinne will provide to Bock potable water from the Kinne well located on Lot 5 , Block 8 , Aristocrat Ranchettes, Meld County and registered with the State of Colorado as permit No. 55088 to satisfy their reasonable domestic needs including drinking, washing, and irrigation of a garden area not to exceed twelve feet by twenty- five feet and other domestic use. A reasonable amount shall be defined as being up to 150, 000 gallons annually and not exceeding 2_0, 000 gallons in any given month. 3 . Such water will be provided by Kinne to Bock until such time as a water tap becomes available from the Aristocrat Water Board or other like provider. At such time as a water tap becomes available, Bock will use due diligence to obtain such water tap, and pay for the water tap, and this Agreement shall be at an end when Bock is receiving domestic water from that water tap. 4 . Bock shall pay icinne the sum of $20. 00 per month (representing pump electricity costs) for as long as water is provided by Kinne beginning the first of each and every month after the signing of this Agreement. Failure pay when due shall result in a late charge in the amount of Fifty cents per 13849 . 2 — day in addition to the regular monthly charge. If not paid within sixty days of the date due then Kinne shall have the right to discontinue water delivery until such time as all charges are brought up to date, plus a twenty-five dollar reinstatement charge. B. It shall be Kinne's responsibility and -expense to maintain the well and delivery system up to the Bock property line and it shall be Bock' s expense and responsibility to -maintain the delivery line after it crosses into the Bock property. In the event the water line which runs across Lot 6 to the Northeast corner of the Bock property needs repair, then, Kinne agrees to put a "T" in the line and run the water line around the outside perimeters of tot 6 if Kinne elects to continue service to the Northeast corner of that property so that damage can be avoided to the tree roots which are already established in the area of the existing water line. The respons- ibility for the expense of this re-routing shall be Kinne' s. Should the well, and/or delivery system on the property of the Kinnes malfunction it is the duty and responsibility of Kinne to promptly and diligently repair such malfunction within an expedient period of time and failure of Kinne to do so shall empower Bock to have substitute water delivered to them at Kinne' s expense and/or to contract for the labor of a repairman to restore proper functioning to the well and/or delivery system at the expense of Kinne. Kinne shall designate a repair agency to be used in the event Kinne is unavailable to authorize a repair. -6. Should the water from the Well become polluted, Kinne will provide or pay for providing a substitute source of water for Bock in the same or similar amounts as previously stated in this Agreement. 7 .
