RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL
REVIEW PERMIT FOR A SALVAGE YARD LOCATED IN THE A
(AGRICULTURAL) ZONE DISTRICT - MANUEL BALDERAS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 8th day of February, 1989 , at the hour of 10 :00
a.m. in the Chambers of the Board for the purpose of hearing the
application of Manuel Balderas , 27867 Weld County Road 18 ,
Keenesburg, Colorado 80643 , for a Site Specific Development Plan
and Amended Special Review Permit for a salvage yard located in
the A (Agricultural) Zone District on the following described real
estate, to-wit:
Part of the SE* , Section 22 , Township 2 North,
Range 64 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant was present, and
WHEREAS , Section 24 . 4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed , finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 .2 of the Weld County Zoning Ordinance as follows:
a. The proposed Special Review Permit is located
within the Urban Growth Boundary Area of the Town
of Keenesburg. The location of the Special Review
area and the attached Conditions and Development
Standards make the proposed use consistent with the

Urban Growth Boundary Goals and policies of the
Weld County Comprehensive Plan .
b. The Town of Keenesburg, in a letter dated November
28 , 1988 , recommended conditional approval of the
Special Review Permit. These conditions are
addressed as Development Standards and additional
comments.
c. The Special Review Permit proposal is consistent
with the intent of the A (Agricultural) Zone
District. The salvage yard is allowed as a Special
Review Permit in the A (Agricultural) Zone
District.
d. The proposal is compatible with the -existing
surrounding land uses and with the future
development of the surrounding areas as permitted
by the Weld County and the Town of Keenesburg
Comprehensive Plans. Uses on surrounding properties
include Gingerich Hatchery Incorporated and dry
land farming. No objections -have been received by
the Department of Planning Services ' staff from
surrounding property owners .
e. No overlay districts affect the site.
f. -The Special Review Permit Development Standards
will provide adequate protection of the health,
safety, and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Amended Special Review permit
for a salvage yard located in the A (Agricultural) Zone District
on the hereinabove described parcel of land be, and hereby is ,
granted subject to the following conditions:
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.

2 . No additional building or electrical permits shall be
issued on the property until the Special Review plat is
ready to be recorded in the office of the Weld County
Clerk and Recorder.
3 . The septic system(s) for the proposed office and mobile
home are required to be designed by a Colorado
Registered Profe-ssional Engineer according to the Weld
County Individual _Sewage Disposal Regulations.
4 . Upon the Town ofKeenesburg or Weld County notifying the
property owner/applicant that a residential -subdivision
has been approved within five hundred feet of the
Special Review site, the boundaries of the Special
Review site shall -be screened. The screening plan shall
be reviewed and approved by the Department of Planning
Services ' staff. The screening plan shall be
constructed within 120 days of the approved residential
subdivision development.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 8th day of
February, A.D. , 1929 .

DEVELOPMENT STANDARDS
Manuel Balderas
Amended USR-713
1 . The Site Specific Development _Plan and Amended Special Review
Permit is for a salvage yard located in the A (Agricultural)
Zone District as submitted in the application materials on
file in the Department of Planning Services and subject to
the Development Standards stated herein.
2. Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . All waste oil , treatments , anti-freeze, and other associated
liquid and solid wastes shall be stored and removed for final
disposal in a manner that protects against surface and
groundwater contamination.
4 . No permanent disposal of wastes shall be permitted at this
site.
5 . An individual septic disposal system (ISDS) evaluation on all
existing septic systems shall lbe performed prior to issuing
the required septic permits on the existing systems.
6. Fugitive dust shall be confined to this site.
7 . When constructed, the screening on the site shall be
maintained at all times.
8 . Waste materials shall be handled and stored at the facility
in such a manner so that nuisance conditions are not created
by -odor, windblown debris, and fugitive dust.
9 . A six-foot high chain link fence or other screening approved
by the Department of Planning Services shall enclose the
Special Review Permit area at all times.
10 . The cars and salvage materials shall not exceed 6 feet in
height.
11 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.

12 . The property owner or operator shall be responsible for
complying with the design standards of Section 24 . 5 of the
Weld County Zoning Ordinance.
13 . The property owner or operator shall be responsible for
complying with the performance standards of Section 24 .6 of
he Weld County Zoning Ordinance.
14 . Personnel from the Weld County Health Department, Keenesburg
Fire -Protection District, and the Weld County Department of
Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities
carried out on the property comply with the Development
Standards stated herein and all applicable Weld County
Regulations .
15. The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
16 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards .
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners .

The following business was transacted:
I hereby certify that pursuant to a notice -dated January 11, 1989, and
duly Published January 25, 1989, in the _Platteville Herald, a _public
hearing was conducted to consider the request of Manuel Balderas for a
Site Specific Development Plan and amended Special Review Permit for a
salvage yard located in the A (Agricultural) Zone District. Lee
Morrison, Assistant _County Attorney, made this matter of -record. Brian
Bingle, -Planning Department representative, entered the favorable
recommendation of the :Planning Commission into the record. He
explained that this amends the screening required -at this site and
provides for the addition of a mobile home. Manual Salderas, the
applicant, was present. He said he has no objections to the Conditions
and Development Standards contained in the _Planning Commission
recommendation. No public comment was teeeived -concerning this
request. Commissioner Lacy moved to approve the request of Manuel
Balderas for a Site Specific Development Plan and amended -Special
Review Permit for a salvage yard located in the -A (Agricultural) Zone
District. She motion ass seconded by Commissioner Johnson, and it
carried unanimously. Mr. Single made it of record that It will not be
necessary for Mr. Balderas to be -present at the Show Cause hearing
scheduled for March 1 Concerning this property.
This Certification was approved on the 13th day of February, 1989.

MOTION:
LeAnn Reid moved Case Number USR-868 for Steve and Jeanie Benson for a Site
Specific Development Plan and a Special Review permit for an airstrip in the
Agricultural zone district be forwarded to the Board of County Commissioners
with the Planning Commission's recommendation for approval based upon the
recommendation, conditions, and Development Standards presented by the
Department of Planning Services' staff and the testimony heard by the
members of the Planning Commission. Motion seconded by Rick Iverson.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning

Town of Keenesburg or Weld County that there will be residential development
within 500 feet of their property and to allow them to place a mobile home
on the property for an employee. Their property is fenced with chain link
fence, but they would prefer not going to the expense of a privacy fence
unless residential development were imminent.
The Chairman called for discussion from the members of the audience. There

The Chairman asked the applicants if they had reviewed the recommendation,
conditions, and Development Standards outlined by the Department of Planning

be recommended favorably to the Board of County Commissioners for the
following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24 .7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 24.3 of the Weld
County Zoning Ordinance as follows:
- The proposed use by special review is located within the
urban growth boundary area of the Town of Keenesburg. The
location of the special review area and the attached
conditions and development standards make the proposed use
consistent with the Urban Growth Boundary Goals and Policies
of the Weld County Comprehensive Plan.
- The Town of Keenesburg, in a letter dated November 28, 1988,
recommended conditional approval of the special review
permit. These conditions are addressed as development

intent of the A (Agricultural) zone district. The salvage
yard is allowed as a use by special review in the A
(Agricultural) zone district.

- The proposal is compatible with the existing surrounding land
uses and with the future development of the surrounding areas
as permitted by the Weld County and the Town of Keenesburg
Comprehensive Plans. Uses on surrounding properties include
Cingerich Hatchery Incorporated and dry land farming. No
objections have been received by the Department of Planning
Services' staff from surrounding property owners.
- No overlay districts affect the site.
- The Use by Special Review Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed this
request.
The Planning Commission's recommendation for approval is conditional upon
the following:
- The attached Development Standards for the special review
permit shall be adopted and placed on the special review plat
prior to recording the plat. The plat shall be delivered to
the Department of Planning Services and be ready for
recording in the Weld County Clerk and recorder's office
within 15 days of approval by the Board of County
Commissioners.
- No additional building or electrical permits shall he issued
on the property until the special review plat is ready to be
recorded in the office of the Weld County Clerk and Recorder.
- The septic system(s) for the proposed office and mobile home
are required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
- Upon the Town of Keenesburg or Weld County notifying the
property owner/applicant that a residential subdivision has
been approved within five hundred feet of the Special Review
site, the boundaries of the Special Review site shall be
screened. The screening plan shall be reviewed and approved
by the Department of Planning Services' staff. The screening
plan shall be constructed within 120 days of the approved
residential subdivision development.

1. The Site Specific Development Plan and Special Review permit is for a
salvage yard located in the A (Agricultural) zone district as submitted
in the application materials on file in the Department of Planning
Services and subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. All waste oil, treatments, anti—freeze, and other associated liquid and
solid wastes, shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. An individual septic disposal system (ISDS) evaluation on all existing
septic systems shall be performed prior to issuing the required septic
permits on the existing systems.
6. Fugitive dust shall be confined to this site.
7. When constructed, the screening on the site shall be maintained at all
times.
8. Waste materials shall be handled and stored at the facility in such a
manner so that nuisance conditions are not created by odor, windblown
debris, and fugitive dust.
9. A 6 foot high chain link fence or other screening approved by the
Department of Planning Services shall enclose the Use by Special Review
area at all times.
10. The cars and salvage materials shall not exceed 6 feet in height.
11. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
12. The property owner or operator shall be responsible for complying with
the design standards of Section 24.5 of the Weld County Zoning
Ordinance.
13. The property owner or operator shall be responsible for complying with
the performance standards of Section 24.6 of he Weld County Zoning
Ordinance.

14. Personnel from the Weld County Health Department, Keenesburg Fire
Pxctection District, and the Weld County Department of Planning
Services shall be granted access onto the property at any reasonable
time in order to ensure the activities carried out on the property

Weld County Regulations.
15. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall re quire the approval of an amendment of the
permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
16. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the

had been agreed on earlier by Balderas and the Town of Keenesburg, with the
stipulation if this adjacent property is ever developed into residential hous-
ing it would not prevent future Boards or developers from requesting this
privacy fence requirement. Stan Gingerich seconded the motion. All voted

Amendment and Change to the Use by Special Review #713
This amendment is to change the requirement #2 of the
regulation use of a privacy fence. We request an amendment
be approved that a privacy fence be postponed and to
stipulate that this requirement be met only at such time as
the surrounding property is developed into residential
construction. At that time M.B. Auto would immediately
fence the South and East boundaries of the property .
Submitted for approval by the planning and engineering
department of the County of Weld, the following types of
fences: 1 . Solid wood fence
2. Snow fence with 1/4" partitions
3. Berm with landscaping
All of the above mentioned would be good alternatives , after
a complete analysis of the most economic and best appealing
to the surrounding area.
CHANGE:
We are requesting a permit be approved for a proposal of a
Mobile Home on the property to house an employee or for
security. We require a person or persons stay in this
proposed Mobile Home to oversee the business when we leave
on a vacation or any length of time. This would be
accomplished in the future.
All the necessary connections are readily available on the
site — water, septic, electrical , etc.

We have undertaken a new advanture ; on that we thin4( is a perfect

small scale . Now that this property became available at a good prices
we have decided to , as we said , "Take the Bull by the Horns . " I Hope

Mr. Gray for years had a mechinc shop and sold path . This being the .

also , benefit the Town of Keenesburg , bring more business and interest

Waste would be carried off to disposal areas and junk medal to the Salvage
Processing Plan. Upon the availability of the permit the time period to
start up the proposed use of the land would be 2 months .

The land when we purchase it was use as a salvage area for about ten
year. The owner did not obtain permit for the operation. We bought
it with same intent but to make it a business and use it to maintain
a standard living off this property. This property is listed in the
phone directory as Gray ' s Garage #1 NW of Keenesburg .
The proposed site is pretty much isolated from the neighborhood and a
privacy fence will be construted around the property to keep trespasser
out , and provide for some safety .
The compatibility of the surrounding land use would be Commerical be-
cause the land is us for Dry Zand Wheat Farming on three side and a
Turkey Farm on the East side. I see this land being use as commerical
property in the near future , because of it -easy exit to I-76 .
The proposed site is not in a flood plain or gealogic hazard nor in an
Airport area .
Water is available the well as recorded on 09-25-73 , yield is 14 . 0 with
a dpth of 804 ft water level at 375 . see attached information sheet .

The proposed use for the land is a Salvage Yard . The area needs a local
salvage yard , if a person needs and parts they would have to go to_Ft . _Morgan
40 miles away , Greeley 45 miles , Brighton 22 miles or Hudson 8 miles of which
not very many parts are available . .
The properies surrounding the proposed site is Farm land on three side an
a turkey farm on one side, of which the place has closed down, and is for
sale .
Distance of residential property is pretty far except the resident on the
Turkey farm that for sale . their is a dwelling on the proposed site which
is about 604 ft from the Garage.
This would be a speculative number of patrons 5 to 8 person per day with
the hope of more person in time when the business location get to be known
and a few years .
Employees , this would be a family project with the hope of employing one or
two person to help in the future .
''Water is not a main source of importance but it is available for public
facilities with a rest room and septic sewage . Enclosed is a copy of the
date the well was drilled and depth and yield .
The access route to the proposed area are Interstate 76 to Keenesburg , North
on 571 about 1/3 mile and West on route 18 1/3 mile to proposed site .
Vehicular traffic would be cars , pick-up an a occasional tandem truck to
carry out a vehicle they may buy .
As a fire protection we have several fire extinguishers in the more possible
needed areas , but no combustible material will be kept or stored in the site .
Types of animals would be only pets and 4H projects like rabbits , goat , cats
chickens, dogs , etc small animal type .
