FAGERBERG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of May, 1987 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of David A. Fagerberg, 3527 Cindy Place , Greeley, Colorado 80631 , for a Use by Special Review for an agricultural services establishment, onion storage and sorting facility, on the following described real estate, to-wit : Part of the SEa , Section 13 , Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by John Barry, Attorney, and WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendation of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a . The proposal is consistent with the intent of the Weld County Comprehensive Plan Urban Growth Boundary Goals and Policies . The proposed use is an agribusiness and is provided for as a Use by Special Review in the A (Agricultural) Zone District . c . The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive Plan and the Town of Ault ' s Comprehensive Plan. d. The proposed use is not located in the Airport Overlay District or a Geological Hazard District. A portion of this proposal is identified as being in the Flood Hazard Overlay District. e. Use by Special Review Development Standards will provide adequate protection of the health , safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an agricultural services establishment, onion storage and sorting facility, on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review permit is for an agricultural service establishment (onion sorting and storage facility) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. No on-site disposal of produce of any type shall be permitted at any time. 3 . Produce shall be handled and stored at the facility in such a manner so that no nuisance conditions are created by odor, blowing debris and fugitive dust, or spoiled produce on or around the facility. 4. All septic systems shall be reviewed and approved by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 5. A Flood Hazard Development permit shall be required for all new construction or substantial improvements of existing structures located in the Flood Hazard Overlay District on the property. 6 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 7 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 8 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 9. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11 . The property owner or operator shall be responsible for complying with all of the foregoing Standards . Rod Allison, Planning Department representative, read the favorable recommendation of the Planning Commission, which is subject to two Conditions and eleven Development Standards, into the record. John Barry, Attorney, came forward to represent the applicant. He said the applicant has had a similar facility at this site for fifteen years, and recent trading of property made this application necessary. He also stated that the applicant has no problem with the proposed Development Standards. No public testimony was offered concerning this request. Commissioner Kirby moved to approve the Use by Special Review, subject to the Conditions and Development Standards as recommended by the Planning Commission. Commissioner Yamaguchi seconded the motion which carried unanimously. There is not that much of a substantial change even though we are operating under the new Comprehensive Plan, and it appears that all of the conditions this case was previously denied for would probably still exist. S. Highway 85 on the north side of Weld County Road 80 APPEARANCE: John Berry, Attorney, Karowsky, Witwer, and Oldenberg, represented the applicant. The Fagerbergs sold their property but retained an acreage when they obtained a recorded exemption. Because the acreage changed the applicant now needs a Use by Special Review permit to continuing operating his business even though the business has been here for years. A small office addition will be added to the existing building. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked the applicant if they had reviewed the recommendations, conditions, and development standards as set forth by the Department of Planning Services staff. He stated they have and have no objections to them. The Chairman asked that reading of the staff's comments, recommendations, and development standards not be read into the record, but that they be filed with the summary as a permanent record of these proceedings. MOTION: Lydia Dunbar moved Case Number USR-786:87: 11 for David A. Fagerberg , submit the following as their statement explaining the aspects of their proposed use by special review permit and also as support therefore: Our application seeks permission to utilize a tract of approximately 3 . 6 acres which we own and which is located in the Southeast Quarter of Section 13 , Township 7 North, Range 66 West of the 6th P.M. in Weld County, Colorado, for onion sorting and storing purposes . Mr . Fagerberg has been engaged in the onion growing and marketing business for over 20 years , and plans to continue in such business , together with his son, Lynn Fagerberg, for many years in the future. Four buildings presently exist upon the site, which buildings are utilized presently for pur- poses of sorting -and bagging onions grown in the vicinity, and the storing of those onions until they have teen marketed. This property has been used in this fashion since 1971 or 1972. This facility is needed in order to properly sort and bag the dif- ferent onions which are grown and store the bagged onions in order to prevent them from rotting and decaying until such time as they can be sold. The surrounding properties consist of irrigated farm prop- erty, utilized in growing primarily corn and onions . The nearest residence to the north of the facility is approximately .8 miles , and the nearest residence in a westerly direction is also .8 miles away . The nearest residence to the south is approximately } mile . There is a labor house , occupied by an employee of our onion operation , located approximately 25 ' east of this facility. In addition , our son , Lynn Fagerberg , resides in the house which is approximately .3 miles east of the site of this facility . There are approximately 12 onion growers in the vicinity who provide onions to our facility for purposes of sorting , bagging and storing . No patrons actually come to the facility, as all sales of the onions are done by virtue of telephone communi- cations . Trucks come to pick up the sold onions at our facility, and we and our laborors assist in loading the onions upon the trucks . At the height of our season we employ 15 employees in 8 to 10 hour shifts , with one shift per day. Our facility is open approximately 7 months out of each calendar year . The water provided to our facility comes from the North Weld County Water District in Lucerne, Colorado. Our facility is located along Weld County _toad 80 , at a point which is approxima- tely 4 mile east of U.S. Highway 85. From 11.5. Highway 85 we may proceed east on Weld County Road D0 and come upon the site. A driveway is north of Weld County Road 80 and leads directly into our facility . Traffic at the facility consists of approximately 6 to 7 vehicles for our employees and an average of 4 to 5 trucks per day during our 7 month season. The trucks weigh approxima- tely 30 ,00D pounds when empty and approximately 75 ,000 pounds when full of onions . A septic tank is utilized on our premises for purposes of sewage disposal . The f-acility is provided fire protection by the Ault Fire Protection District, which is approximately 3/4 of a -mile away. Additionally, the facility has fire extinguishers and plenty of tap water is available -should any small fire break out. No ani- mals -whatsoever are to be concentrated on the 3.6 acre parcel . No waste or stock piled trash will be accumulated on the prop- erty, as our own trucks haul away any such debris daily. The only items to be stored or stockpiled upon the premises will be onion bags and onions which are stored inside the onion sheds. 870376 P QQ The storm water retention facility for the site consists of a sump which is approximately I mile away- The storm water would run in an -open ditch to the sump, and this arrangement has worked fine in the past. Again, there would -be no debris , junk or other waste associated with the use of the facility, as our own trucks remove any such items on a daily basis . The facility -has paved parting , -whi-ch parking spaces were asphalted a number of years ago. All parki-ng _occurs on this asphalt, and, therefore, there would be no landscaping or erosion problems . The site has been used each year for approximately 15 years , and there have been no adverse landscaping or erosion problems . -We have no plans presently to discontinue temporarily or otherwise cease use of the facility, and, therefore, there are presently no -plans for reclamation of the property. -we have uti- lized this 3 .6 acre tract as an onion sorting and storing site for approximately 15 years . Our proposed use of the 3.6 acre tract is consistent with the Weld County Comprehensive Plan because we are in no way altering the present use of the subject property or any of the surrounding properties . The facility for which we request -per- mission is an agriculturally oriented facility, -which allows us to sort, bag and -store -onions for our own f-arming operations and for those of other farmers in the vicinity. 2 . Our propposal is also consistent with the intent of the district in which the site is located in that the facility pro- vides services to the farmers and land owners in the area, and the business operated upon the site is a farming related acti- vity . The area in which the site is located is almost exclu- sively irri-gated farmland together with residences, outbuildings and other storage sheds which service the farming community. Therefore, the onion processing facility for which we seek per- mission is consistent with those ether uses . 3 . The location of the facility conserves productive agri- cultural land in that the site which was chosen approximately 15 years -ago is the site of the yard and driveway which serviced the residence which still exists upon the property. The property upon which the onion facility is located was not used as farmground , and , therefore, no productive agricultural farmground was taken out of production . 4 . There is adequate provision for the protection of the health , safety and welfare of the inhabitants of the area near the facility , in that no waste or other obnoxious debris is allowed to be retained upon the facility, the facility has access to plenty of fresh water , the facility is serviced by fire and emergency medical personnel as the facility is at a site between the towns of Ault and Eaton and is approximately } mile east of U.S . Highway 85 . 5 . The use which is made of the onion sorting and storing facility is compatible with the existing surrounding 1-and uses in that the surrounding land is utilized almost exclusively for pur- poses of irrigated farming . Farmers and farm laborors reside in the several residences in the area, and none have ever complained about the operation of the onion _facility. 6 . The use of the onion facility will be compatible with the future development of the surrounding area as permitted by the existing zone and also compatible with future development as pro- jected by the comprehensive plan of -Weld County and the adopted master plans of the affected municipalities because the proposal does not attempt to alter in -any way the present use of the faci- lity or any of the surrounding properties . The proposal will not result in any additional traffic then presently exists upon the roadways near the facility nor does our application result in the development of any additional homesit- s or residenti-al tracts other than have existed for a number of years in the vicinity. 7 .
