RE: APPROVE CONTINUANCE OF SHOW CAUSE HEARING - HIGH COUNTRY TURF
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 12th day of July, 1989 , a public hearing was
held to consider the revocation of Use by Special Review 4498 ,
granted to High Country Turf, and
WHEREAS, the Board deemed it advisable to continue said
hearing to November 8 , 1989 , at 10 : 00 A.M. , with the condition
that High Country Turf submit an application for annexation to the
City of Frederick within 30 days , and
WHEREAS, the Board deemed it advisable that if said
application is not submitted within 30 days , a Show Cause Hearing
shall be scheduled before November 8 , 1989 , and the Applicant
shall be notified of such hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Show Cause
Hearing for High Country Turf be, and hereby is , continued to
November 8 , 1989 , at 10 : 00 A.M. , subject to the hereinabove stated
condition.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 12th day of
July, A.D. , 1989 .

RE: RE: HEARING TO SHOW CAUSE FOR REVOCATION OF USE BY SPECIAL REVIEW
#498 - HIGH COUNTRY TURF
A public hearing was conducted on July 12, 1989, at 10:00 A.M. , with
the following present:
Commissioner C.W. Kirby, Chairman
Commissioner Jacqueline Johnson, Pro-Tem
Commissioner Gene Brantner
Commissioner George Kennedy
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Lanell Curry
The following business was transacted:
I hereby certify that pursuant to a notice dated May 31, 1989, and duly
published June 15, 1989, in The New News, a public hearing was
conducted to consider revocation of Use by Special Review #498 issued
to High Country Turf. Lee Morrison, Assistant County Attorney, made
this matter of record and said this matter was continued from June 28,
1989. Lanell Curry, representing the Department of Planning Services,
said the permit holder is not in compliance with Development Standards
#1 and #5; therefore, the Planning staff recommends revocation of Use
by Special Review #498. Harold Taggert, representing High Country
Turf, said this property may be annexed into the City of Frederick. He
said the the City of Frederick is agreeable to an annexation, but the
formal application for annexation has not been submitted. Mr. Taggert
requested an extension to work on the annexation. Following
discussion, Commissioner Lacy moved to continue this hearing to
November 8, at 10:00 A.M. , subject to the condition that the formal
application be submitted to the City of Frederick within 30 days, and
if not submitted during this period the Board will hear this matter
prior to the November 8 date, with the applicant being notified of the
date of the Show Cause Hearing. Seconded by Commissioner Kennedy, the
motion carried unanimously.
This Certification was approved on the 17th day of July, 1989.

LEGAL DESCRIPTION: SWi and part of the SEi of Section 26, T2N, R68W of the
6th P.M. , Weld County, Colorado.
It is the opinion of the Department of Planning Services' staff that the
-following standards as approved for Case Number USR-498 are not in
compliance:
Development Standard #1
"The uses permitted on this site shall include the nursery and
landscaping business as described in the application materials on
file in the Weld County Department of Planning Services."
Uses currently being conducted on the Special Review permit site include a
pallet business (which was permitted under USR-498) , a consulting business,
and a recreational facility for model airplanes. The site does not appear
to be used for a nursery or landscaping business.
Development Standard #5
"The Use by Special Review shall be limited to the plans shown
hereon and governed by the Standards stated above and all
applicable Weld County Regulations. Any material deviations from
the plans and/or Standards, as shown or stated above, shall
require the approval of an amendment to the Permit by the Weld
County Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Standards are permitted.
Any other changes shall be filed in the office of the Department
of Planning Services."
The additional uses being conducted on the property are material deviations
from the plans approved and require an amendment to the Special Review
permit. In addition, parts of the property have been sold and the site is
now in three separate ownerships.

A Use by Special Review application which, if approved, would permit the
pallet business, has been submitted. The application fee has not been
submitted. The application cannot be processed until the appropriate fee
has been submitted.
-Based upon the information, the Department of Planning Services' staff
recommends that the Board of County Commissioners consider revocation of
USR-498.
