Z N z r zrn NOW, THEREFORE, BE IT RESOLVED by the Board of Countytil N Commissioners of Weld County, Colorado, that Chartwell Cable of q u+ Colorado, Inc. , a Colorado corporation, its successors and assigns, is hereby granted a nonexclusive, revocable franchise to N construct, maintain and operate such transmission and distribution facilities as may be reasonable required for or are, in any ztO manner, incidental to the transmission of signals , other than telephone company signals, by wire in and for the unincorporated r co areas of the County as hereinabove described. This franchise and all rights granted hereunder shall continue for a period of 7c• � fifteen years from the effective date hereof, unless sooner a, : terminated or revoked. A public hearing was conducted on December 19, 1988, at 9:30 A.M. , with the following present: Commissioner Gene Brantner, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Jacqueline Johnson Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Bruce T. Barker The following business was transacted: I hereby certify that pursuant to a notice dated December 5, 1988, and duly published December 7, 1988, in the Platteville Herald, a public hearing was conducted to consider the request of Chartwell Cable of Colorado, Inc. , for a Cable Television Franchise. Bruce Barker, Assistant County Attorney, made this matter of record. Robert Briney, Vice President of Operations, came forward to represent the applicant. He explained that his company has purchased a private cable system which they wish to extend beyond the current limits. Mr. Barker said that he has examined this application and everything appears to be in order. Mr. Barker reviewed the standards which are to he considered. No public comment was offered concerning this application. Commissioner Lacy moved to approve this request. Commissioner Yamaguchi seconded the motion and it carried unanimously. The applicant had requested two variances: because they expect to have less than 500 subscribers, they asked to waive Section C requiring equipment for local production and presentation of Cable cast programs; and they requested 180 days to complete the system, rather than 30 as normally required. Mr. Briney explained that, under normal weather conditions, it would be almost impossible to complete the system in 30 days and even more difficult under winter weather conditions. Commissioner Johnson moved to grant the two variances, with the waiver of Section C being in effect only so long as there are less than 500 subscribers. Commissioner Lacy seconded the motion. No public comment was received concerning the motion which carried unanimously. This Certification was approved on the 21st day of December, 1988. An application for a cable T.V. franchise has been submitted to you by Chartwell Cable of Colorado, Inc. Chartwell operates out of Fort Collins, Colorado. The system area for which they are requesting the franchise will include a relatively small area of the County. The origination point will be from the River Valley Village Mobile Home Park at Del Camino. Chartwell' s cables will extend east along State Highway 119 (which then becomes Weld County Road 24) . The cables will then run south along WCR 15 to the Enchanted Hills and Casa Grande Estates Subdivisions. I have checked Chartwell ' s application carefully and have found no missing elements. Chartwell has also submitted the application fee of $500 .00. Attached hereto you will find a sheet with various standards for your determination in the hearing. Pursuant to the "Waiver of Requirements" section which was added to our Cable T.V. Ordinance by Ordinance No. 94-A, Chartwell has requested the following: a. A waiver of the requirement under "Company Services" in Ordinance 94 , Section C - Equipment for local production and presentation of cablecast programs. Chartwell apparently feels that the company cannot install such equipment until and unless they have 500 subscribers on the system. b. A waiver of the requirement found in "Construction Timetables" in Ordinance 94-B, Section B - Completion of the system within thirty days. Chartwell believes that it will need at least 180 days in order to complete the system. I believe that the requests for waivers by Chartwell are reasonable. The requirement of local production facilities may be difficult to obtain for that small a system. The thirty-day completion requirement is probably too short for any system. A longer period of time seems more reasonable; however, 180 days may be a little too long. The Board will need to make the following decisions at the hearing on the franchise: 1 . ( 1 ) Applicant: Chartwell Cable Of Colorado, Inc . 125 West Crestridge Drive Suite 205 Fort Collins, CO 80525 Application Date: November 18, 1988 ( 2 ) Proposed System: Chartwell Cable Of Colorado is in the process of purchasing a Private Cable System (SMATV) in River Valley Village Mobile Home Park located in Del Camino at I-25 and HWY 119. We intend to use this location to upgrade the present cable services and extend the system into nearby areas. Business Hours: Office: 9am - 5pm Weekdays exc. holidays . Staff: Manager Technicain - Roy Watson Clerk - to be hired Maintenence Procedures: General : On-going planned System Maintenance Program that incorporates the highest of CATV technical standards . Customer repairs: completed within 24 hours . Outages: worked on and repaired immediately -- 24 hours a day 7 days a week. 881200 1 Management- The system will always have a full- Marketing time manager. Also, additional management and marketing support will be provided by the regional office in Fort Collins and the Corporate office in Denver. Most marketing procedures will be in the area of direct sales and direct mail. Direct sales will mainly involve contacting the potential subscriber at the time of installation. Public Access A channel will be set aside for use by the public and will conform to the County guidelines. However, a waiver is requested from providing any public access equipment until the system reaches a level of 1000 subscribers. Services Provided The system initially will consist of 22 channels of programming with a capacity of 36 . ( 9 ) Audited Financial Because the parent corporation, Statement Chartwell Cable Fund, Inc. has only been in business for a little over one year, its first audited financial statement is due in the first week of December of this year. The System will run 24 hours a day, and although no studio equipment will be available, the County, School District or members of the local community may use the alloted system facilities at any time with reasonable notice.
