HomeMy WebLinkAbout860862.tiff RESOLUTION RE: DENY APPEAL OF HEALTH BOARD DECISION - DANIEL K. & JANET J. GIBBS WHEREAS , the Board of County Commissioners of Weld. County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on June 24 , 1986 , the Board of Health denied a request from Daniel K. and Janet J . Gibbs for variances from the Weld County Individual Sewage Disposal Regulations concerning: 1) the use of chemical toilets for permanently occupied buildings; and 2) allowing discharge from the shower building to be deposited upon the surface of the ground, and WHEREAS , the property on which, said variances are being requested is described as the W1, NE1 of Section 28 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Daniel K. and Janet J. Gibbs appealed said decision to the Board of County Commissioners, said appeal being heard by the Board on August 27 , 1986 , and WHEREAS , at said hearing, after reviewing the testimony and evidence, the Board determined that said appeal to the decision by the Board of Health be denied because the violation of said Regulations may he injurious to the public health. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the appeal of the decision of the Health Board submitted by Daniel K. and Janet J. Gibbs 20504 WCR #54 Greeley, CO 80631 • Dear Mr. & Mrs. Gibbs, The Weld County Health Department, in response to a zoning violation notice referral from the Weld County Planning Department, inspected your property at 20504 WCR #54 (W1/2, NE 4, Section 28, Township 5, Range 65) . On May' 21, 1986, accompanied by you , Tom Wodtke• of ,this depar'tzaent observed ,several out buildings and a mobile home. One out building was observed to contain running water and have two shower stalls which drained •into an irrigation ditch lateral. Chemical toilets were reportedly in use during •times' the buildings are occupied by field workers. According to the Weld County Individual Sewage Disposal Regulations : Section 3. 1 General Sanitaticn Requirements: "the owner of any structure where people live, work, or congregate shall insure that the structure contains an adequate, convenient, sanitary toilet and sewage disposal system. in good working order. Under no condition, shall sewage or effluent he permitted to be discharged upon the surface of the ,ground, or into Waters of the State, unless the sewage or effluent meets the minimum requirements of this regulation or the water quality standards of the Colorado Water Quality Control .Commission, whichever are applicable. Any person who is aware of a malfunctioning septic system is encouraged to report the location of the system to the Departments" Also, Section 7.3 Chemical Toilets: "Portable chemical toilets shall have a superstructure which meets the requirements of a vault privy and shall have a sewage receptacle of easily cleanable and impervious material which as accessible or removeable for thorough cleaning and disinfection. The use of portable chemical toilets in permanently occupied buildings shall be prohibited except during the construction or under emergency circumstances with the approval of the Health Officer. Non—portable chemical toilets shall be I Mr. & Mrs. Gibbs Page 2 provided for permanent installations and shall drain into a vault. Design and installation shall meet the requirements of a vault, as outlined in 7. 1 and shall meet the superstructure requirements of a vault privy, ns outlined in 7.2, and shall meet all applicable Colorado Safety Codes. " Therefore, the mobile home and out buildings occupied by field workers are in violation of the Weld County Health Department Individual Sewage Disposal Regulations by: 1 . Allowing sewage (grey water) from the shower building to be discharged upon the surface of the ground , and 2. Not providing an adequate, sanitary toilet and sewage disposal system for the occupied buildings and mobile home. . Because the buildings and mobile home are not expected by you to be occupied until approximately July, proper sewage disposal system installations prior to use is required by this Department. Should the buildings and/or mobile home be occupied without proper sewage disposal systems , legal action by this department will result . .
