HomeMy WebLinkAbout880143.tiff RESOLUTION RE: APPROVE RATIFICATION OF DECLARATION OF POOLING AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County is the holder of an Oil and Gas Lease with Cache Exploration, Inc. concerning certain mineral acres located in the EINWI , Section 25 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board has been presented with a Ratification of a Declaration of Pooling concerning said mineral acres , and WHEREAS, after review, the Board deems it advisable to approve said Ratification, retroactive to October 27 , 1983 , a copy of said Ratification being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Ratification of the Declaration of Pooling concerning the above mentioned mineral acres be , and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Ratification. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of February, A.D. , 1988 , nunc pro tunc October 27 , 1983 . M. , Weld County, Colorado, do hereby ratify the declaration of Pooling to be filed covering the above property. Said Declaration of Pooling shall be dated and made effective as of the date of the Affidavit of Production which covers the subject property. The undersigned parties recognize that production from the Gerry #1 and #2 wells is and has been based upon the pooled production from the above noted wells. In addition the undersigned parties recognize and agree that their interest within the the producing unit is as set out on previously signed Division Orders. The undersigned by their signatures do ratify their original oil and gas lease and all terms included within and added to said lease, the recording information for such leases is set out on the Declaration of Pooling, to be filed, and the Affidavit of Production, previously filed. • Effective the 27th day of October, 1983. I would like to have you examine this with respect to whether or not it is one of the older leases which did not have a pooling clause and if that be the case the Clerk to the Board wants to know whether the $50 . 00 fee which was instituted by the Board a week or so ago, would apply in this case. In other words , the question is whether or not the original lease has to be amended to allow pooling which triggers the $50 .00 fee followed by a ratification of pooling.
