J \� \ . a m. a. 3 AMENDED SUP-20586139 • RESOLUTION RE: APPROVAL OF REQUEST TO AMEND SPECIAL USE PERMIT FOR A LIVESTOCK CONFINEMENT OPERATION FOR CATTLE AND SHEEP (5,000 HEAD) - NOFFSINGER MANUFACTURING COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 12th day of November, 1986, at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Noffsinger Manufacturing Company, P.O. Box 488 , Greeley, Colorado 80632, to amend a Special Use Permit for a livestock confinement operation for cattle and sheep (5 ,000 head) on the following described real estate, to-wit: Part of the SE4, Section 8 , Township 7 North, Range 6.8 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Special Use Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan. The Comprehensive Plan encourages the development of agribusiness and agriculturally oriented industry provided these enterprises do not adversely affect the local economy or environment. Ault' s Planning Commission has reviewed this request and has no objections. e. No overlay districts affect the site. f. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application to amend a Special Use Permit for a livestock confinement operation for cattle and sheep (5,000 head) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. • 3. Within 30 days of final approval by the Board of County Commissioners, the applicant/operator shall submit to the Colorado Department of Health, Water Quality Control Division , an engineering report demonstrating compliance with its Guidelines for Design of Feedlot Runoff Containment Facilities. The report shall conform to the requirements of Section 8.3. 4 of the Colorado Department of Health, Water Quality Control Commission' s Guidelines for Designs of Feedlot Runoff Containment Facilities. This Amended Special Use Permit is for a livestock confinement operation for cattle and sheep as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The maximum number of livestock shall be 5,000 head. 2. The applicant shall be responsible for implementing and maintaining the feedlot runoff containment system in accordance with the engineered report, as approved by the Colorado Department of Health, Water Quality Control Division. All waste retention facilities shall meet and be maintained in accordance with the State Health Department' s Guidelines for Designs of Feedlot Runoff Containment Facilities. The applicant shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control Division. The feedlot runoff containment facility shall be in operation within six months from the date of approval by the Board of County Commissioners. 3. All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 5. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24. 6 of the Weld County Zoning Ordinance. 6. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 861055 Page 2 DEVELOPMENT STANDARDS - NOFFSINGER 7. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Morrison The following business was transacted: I hereby certify that pursuant to a notice dated October 15, 1986, and duly published October 23, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Noffsinger Manufacturing Company to amend a Special Use Permit for a livestock confinement operation for cattle and sheep (5,000 head) . Lee Morrison, Assistant County Attorney, made this matter of record, commenting that the hearing was continued to this date from November 5, 1986. Debbie de Besche, • Planning Department representative, read the favorable recommendation of the Planning Commission into the record. She stated that this recommendation is subject to four Conditions and nine Development Standards. She commented that there has been discussion regarding Condition #4 and Development Standard #3, both of which were requested by the State Highway Department, stating that there shall be only one access onto Highway 14. The Highway Department now says, because this is an existing operation, they will not require that either of the accesses be closed. The Planning staff has no objection to the removal of Condition #4 and Development Standard #3. Pat McNear came forward to represent the applicant and explained the necessity of having two accesses onto Highway 14. No public testimony was received concerning this request. Commissioner Lacy moved to delete Condition #4 and Development Standard #3, stating that he had conducted an on-site inspection and it is his opinion that two accesses are much safer than one. Seconded by Commissioner Kirby, the' motion carried unanimously. Commissioner Lacy moved to approve the request to amend Special Use Permit #205, subject to the amended Conditions and Development Standards. Commissioner Brantner seconded the motion which carried unanimously. This Certification was approved on the 17th day of November, 1986. The applicant shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control Division. The feedlot runoff containment facility shall be in operation within (6) months from the date of approval by the Board of County Commissioners. 3. This is a 320 acre dryland parcel. The applicant wishes to split the property into two 120 acre parcels and one 80 acre parcel. They are applying for Use by Special Review permits so residences may be built on the properties. There is currently a house and a well on the 80 acre parcel, and it has not been decided if the old house will be torn down or remodeled. There will; however, only be one residence per parcel. One 120 acre parcel has been farmed in dryland wheat by a neighboring farmer for about twelve years. The 80 acre parcel is in the center and about half is farmed in dryland wheat and half is native grasses. The third parcel is all native grasses. Debbie deBesche reviewed the recommendation from Ron Miller, Greeley Soil Conservation District, recommending the entire parcel be seeded to native grasses. The Chairman asked Jerry McRae if he had reviewed the recommendations, conditions, and development standards as outlined by the Department of Planning Services staff. He stated they have and disagree with the soil conservation's recommendation. Since this land has and is being farmed he felt this recommendation should be conditional upon the land no longer being farmed. Marvin Barstow, applicant, stated the owner intends to build his house on this. property (the 120 tilled acres) , and sell the other two parcels. He also intends to continue to lease his land to the farmer who has been farming it for the last twelve years. Of the 320 acre parcel, only 160 acres is tillable land. Lee Morrison explained he did not feel the dust blowing ordinance would be applicable in this instance because the land was broken out of native grasses prior to the resolution being made. Debbie deBesche suggested Condition #3 be amended to read as follows: "3. Prior to recording the plat, the applicant/operator shall work with the Greeley Soil Conservation District to develop a conservation plan best suited for the property. Ann Garrison - Yes, because this would be putting the land into its second best use, and she would agree to that with two constraints. The first constraint, that the quality of the land be protected by the County, and the second constraint, that the quality of life with the current and future neighbors be protected. Jack Holman - No, he has always been of the opinion that once we do start something like this in an area like this then there is no way to stop it. As you recall, some of the testimony from the adjacent landowner was that he would like to do the same thing. Once we do open land up for this type of residential area we run into a problem maintaining it down to that size. Motion carried with four voting for the motion and two voting against the motion. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services' office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The applicant shall be responsible for implementing and maintaining the feedlot runoff containment system in accordance with the engineered report, as approved by the Colorado Department of Health, Water Quality Control Division. All waste retention facilities shall meet and be maintained in accordance with the State Health Department's Guidelines for of Feedlot Runoff Containment Facilities. The applicant shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control Division. The feedlot runoff containment facility shall be in operation within (6) months from the date of approval by the Board of County Commissioners. 3. The Use by Special Review Site shall be limited to one access on to State Highway 14 as recommended by the State of Colorado Division of Highways. 4. All Construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 5. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 6. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 7. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 8. The subject property, currently known as SUP #205, allows for a 5,000 head cattle and sheep feeding operation. The surrounding properties are used for agricultural crop production. The nearest residential structure is approximately 400 feet away and was located there prior to our purchase of the feedlot. There are no patrons employing Noffsinger feedlot, and there are 5 full time employees. The access used for shipping and receiving cattle is from Hwy 14. Vehicular traffic associated with the operation are cattle trailers with diesel tractors, 75,000 lbs_ gross weight, 48,000 lbs. net weight. The frequency is approximately 6' 0 earls in during the mont of October and November, 120 loads out during the months rch through and approximately one load in and out per week the balance of the ar. In addition to the cattle trailers, we require what ever local farm and truck traffic to put up 15,000 to 20,000 tons of silage during September, and haul in 360,000 lbs. of grain per week and one 40,000 lbs. of liquid protein every 10 days. The drainage facility is approximately 800,000 cubic foot sump pit. The manure is stockpiled in pens and seasonally hauled onto farmland. The sewage facility is septic and the fire district is Ault. This proposal is consistant with the Weld County Comprehensive Plan and with the intent of its district as it is an agribusiness located within an unincorporated agriculturally zoned area which provides a local market for crops grown in the area, as well as employment and tax revenues for the district. The operation complies with all health and safety regulations and is in no way harmful to the neighborhood or county. However, to bring this property's access into conformance with the State Highway Access Code, we ask the applicant to consider closing one or both of these accesses since alternative access to Weld County Road 29 is available.
