RE: DENY MOBILE HOME PERMIT NO. 1039 - BARBARA AND RUSSELL
MENDOZA
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 10th day of July, 1985 , considered the request of
Barbara and Russell Mendoza for one mobile home to be used as a
principal dwelling, and
WHEREAS, said request was to occupy the mobile home in an
A-Agricultural Zone District on a parcel of land being more
particularly described as follows:
Part of the Sigh NW', Section 30 , Township 5
North, Range 65 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the Board of County Commissioners , having heard the
testimony, finds that said request should be denied based upon the
recommendations of the Weld County Planning Department and the
City of Evans.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Barbara and Russell Mendoza for permission to place one mobile
home to be used as a principal dwelling on the above described
parcel of land be, and hereby is, denied because said mobile home
did not in compliance with Section 43 of the Weld County Zoning
Ordinance.

This request is for one mobile home to be used as a principal dwelling.
Legal Description of Parcel: Pt. SW4 NW of Section 30, T5N, R65W of the
6th P.M. , Weld County, Colorado
Location: South end of Larson Avenue, west and adjacent to the City of
Evans shop facility.
The Department of Planning Services staff has reviewed this request and
recommends that the request be denied for the following reasons:

Plan.
X Be compatible with the surrounding area.
X Be in harmony with the character of the
neighborhood.
X Adversely affect the immediate area.
X Be adequately served by water and sewage disposal
facilities.
X Adversely affect the general health, safety and
welfare of the inhabitants of the area and the
County.
COMMENTS:
The city of Evans recommended denial of this request in a letter dated June
12, 1985. The applicant has failed to demonstrate that the mobile home can
be adequately served by sewage disposal facilities. The surrounding area is
zoned agricultural and the uses are primarily residential. The mobile home
is not compatible with the surrounding area or in harmony with the
neighborhood because the lot is poorly maintained.
Scrap piles and deteriorating wood piles are openly stored on the lot. At
least one inoperative vehicle is located on the property. Junk is piled
around the mobile homes. The mobile home contributes to the poorly
maintained condition of the lot.
The Department of Planning Services has received one letter objecting to
this proposal.

Barbara and Russell Mendoza
On July 3, 1985, the Department of Planning Services staff recommended
denial of ZPMH-1039 and 1040 applications submitted by Barbara and Russell
Mendoza. The staff has met with the applicants since that time in order to
further clarify intended uses of the mobile homes and reasonable options
that exist.
The Board of County Commissioners should be aware that the Mendozas have
also applied for a zoning permit for the third mobile home on the property;
the designated use is temporary storage. The staff's determination
regarding the request is pending the outcome of this hearing.
An alternative that has been explored by the staff is a reclassification of
the mobile home to be used as a principal dwelling to an accessory
structure. An accessory structure would not be required to be served by
water and sewage disposal facilities. As the Mendozas are not living in the
mobile home at the present time, this option does exist so long as no one
occupies the structure.
Based upon the number of mobile homes on the property and the manner in
which the lot is maintained, the Department of Planning Services staff
recommends denial of ZPMH-1039 and 1040 as proposed. It is the staff's
opinion that this property, as i.t presently exists, adversely affects the
surrounding area and is not compatible with the intent of the Agricultural
Zone district or the future development plans of the City of Evans.

Dear Chuck:
The Evans Planning Commission reviewed the subject applications at
their Regular Meeting on June 11, 1985. Since both applications involved
the same persons and property, they were reviewed together and the
recommendation contained in this letter applies to both.
After reviewing the information submitted by your office, plus a letter
from Lindamarie K. Vaughan of 2209 40th Street, Evans, a resident of the
subject area, the Commission Members expressed concern that approval of the
applications would not help to upgrade the area and they felt a number of
questions were not answered by the information submitted. Neither the
applicant nor a representative attended the meeting.
Following discussion, the Evans Planning Commission passed a motion
to recommend to Weld County that both zoning permit applications by
Barbara and Russell Mendoza be denied as they would not be in the best
interests of the City of Evans growth plan for the following reasons:
1. The proposed land use would not conform to the Zoning Ordinance
nor Building Code of the City of Evans and therefore would
constitute a non-conforming use at such time as the property
is annexed.
2. A mobile home is designed and constructed to be used as a living
unit and not as an accessory structure as proposed by the
applicants.
3. The specific use of the mobile home which would be designated
as an accessory structure was not provided and the applicants
did not appear at the meeting to explain the intended use.

4. Adequate water for fire protection is not available in the area.

In reviewing the proposal I question that the .479 acre lot will
have sufficient room to accomodate the proposed dwelling, storage
building, accessory structure, and shed, and still have enough
room for a septic disposal system according to county regulations.
The applicant must provide more information regarding the size of
the dwelling and soil characteristics so that I can further
evaluate this proposal . It may be helpful to have the applicant
talk to me for some suggestions on the proposal .

Dear Mr. Kane:
This letter is in regards to a notice I received from
the Weld County Department of Planning Services. Enclosed
are copies.
I am truly concerned about this area West of Evans
and its future development. This has been conveyed to the
Weld County Planning Services on several occasions. This
year the County checked the area and found many infractions
to the zoning regulations, several being on the property
owned by the Mendoza's.
It is my feeling that the City of Evans will eventually
expand to the West. It is imperative that long range plans
and solutions to the existing problems be dealt with immedi-
ately. It is also my feeling that mobile homes do not make
suitable accessory structures if this area is to be upgraded..
I ask the City of Evans to please fight against anything
that will not enhance this area. I feel sure that your goals
are the same as mine. If I can be of any assistance please
call me.
