HUEBNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, at a public meeting held in the Chambers of the Board, did consider the request of Fred B. Huebner for Recorded Exemption No. 1138 , and WHEREAS, the request for Recorded Exemption No. 1138 concerned property which is located in part of the TO NWI , Section 34 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request was to divide the property into parcels estimated to be approximately 30 acres and 10 acres, and WHEREAS, after reviewing the submitted materials and hearing the testimony presented, Commissioner Brantner made a motion to approve said request, and WHEREAS, on a roll call vote, said motion was defeated, with Commissioners Johnson, Kennedy, and Kirby voting nay. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Fred B. Huebner for Recorded Exemption #1138 be, and hereby is, denied. Huebner. The parcel of land on which this request is being made is described as part of the W} NW} of Section 34, TIN, R66W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1 .5 miles east of the City of Brighton, east of Weld County Road 31, and south of Weld County Road 4. The request is to divide a 40 acre parcel of land, which is the total contiguous land holdings of the applicant, into two lots of thirty acres and ten acres, more or less. The proposed smaller lot is currently served by a domestic well. The applicant proposes sharing the well between the two lots. A septic system exists on the proposed smaller lot and is proposed on the larger lot. The Town of Lochbuie and the City of Brighton have reviewed the application materials and have no objections to the request. The Weld County Health Department has reviewed the request and recommended that each lot have a separate source of water instead of sharing a well. The Division of Water Resources has also reviewed the application materials and recommended approval if the applicant complies with certain conditions. The staff has concerns whether adequate water will be available for the potential uses of this property if the Division of Water Resources' conditions of approval are met. If it is determined that the application meets the approval criteria of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations, you will be notified that the recorded exemption is approved. Huebner The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. A Weld County Septic Permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal Regulations. The following note shall be placed on the recorded exemption plat prior to recording the plat: At the request of the Division of Water Resources, in Its letter of January 5, 1989, the following conditions shall be complied with: 1. Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or mechanisms should establish a lot owners' association with authority to make decisions concerning management and operation of the well. A joint maintenance agreement is a required part of such an association. The applicant shall submit documents that indicate the applicant' s willingness to comply with the conditions of the Division of Water Resources identified in its letter of January 5, 1989. Well Permit No. 141089 has been previously issued as the only well on the 40 acres. The applicants propose to share this well between the two lots. The well permit has no restriction prohibiting the proposed use. No additional exempt wells will be permitted on this 40 acres. In order to assure that a permanent water supply will be available on an equitable basis to either lot, we recommend the following: 1 . The well should be located on an outlot owned in common by all property owners using the well . Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or other mechanisms should establish a lot owners association with authority to make decisions concerning management and operation of the well . NEVILLE and BEVERLY A. NEVILLE, Buyer, as follows: WHEREAS, the Seller is selling and the Buyer is buying Parcel B described on the sketch plan attached, Weld County, Colorado; and WHEREAS, a domestic well is located on Parcel A which is the property of the Seller, and the well belongs to the Seller; and WHEREAS, as a condition of said sale and purchase, the parties desire to agree upon the joint use, ownership and maintenance of said well . NOW THEREFORE, as for the consideration of the aforesaid sale and purchase, and as a part thereof, it is agreed: 1. From this date the parties shall jointly (1/2 to each) own and use the domestic well located on Parcel A. 2 . Each party shall be entitled to a substantially equal amount of water from said well and neither party shall substan- tially increase his use at any time without the prior consent and approval of the other party. 3 . A separate meter shall be maintained by each party. 4 . All costs of maintenance, replacement and repair shall be shared equally by the parties. In the event a party fails or refuses to pay his equal share of any maintenance, replacement or repair within thirty (30) days after billed by the vendor, then the other party may pay same and collect the amount paid plus twenty percent (20%) penalty. All decisions on the use and maintenance, etc. shall be made jointly except in an emergency, then the decision of one party shall be sufficient. 5. The Buyer shall have the right to ingress and egress to the well site as may be required for reasons of inspection, maintenance and matters related to the well and its joint use. 6. In the event that Parcel B becomes the property of the Seller by reason of foreclosure, then any and all rights of Buyer hereunder shall also terminate and cease and be null and void. 7 . Neither party shall have the right to permit another to use said well and the use of same shall be restricted to the respective homes and domestic use of each party. 390133 - 2 - 8.
