Application for Subdivision Exemption
STATEMENT .DESCRIBING
THE REQUEST, THE PURPOSE, AND THE BENEFITS
Frederick Kieber, also known as Fred Kleber, and Philip
Kleber, Jr . , also known as Philip Kleber , request that the parcel
containing Philip Kleber ' s residence be separated from the rest
of their farm through the subdivision exemption process . A
companion Recorded Exemption will separate Fred Kleber ' s
residence from the farm.
The purpose of the Klebers ' request is to establish
distinguishable parcels of land upon which their respective
residences sit so that they may leave these parcels to their
widows upon their deaths .
Some background information will be helpful here . Prior to
1950 the Kleber brothers came into the possession of their farm.
In approximately 1950 they built a residence on the farm which
they both shared . Subsequently, they each married and in 1962
Fred Kelber built a new house to the west of the original house .
Currently Fred Kleber and his wife occupy that house and Philip
Kleber and his wife occupy the original house . By use of the
subdivision exemption and a corresponding recorded exemption , the
Klebers hope to divide the two residence properties from the rest
of the farm so that they will be easily distinguishable and able
to be passed on to their wives . The Kleber brothers plan to
leave the rest of their farm in their joint names to continue to
be farmed under their direction .
The request will be beneficial to the Kleber brothers and
their wives in that it will provide for the orderly transfer of
real property on the deaths of the Kieber brothers . For the same
reason , the request will be beneficial to Weld County as a whole
and avoid what might become a difficult., long, and drawnout
probate litigation in the District Court of Weld County . The
division of the property at this time will also assist in the
orderly transfer of the property to future generations .
Basically, this request is an estate planning vehicle of an
unusual nature . Granting it will not change the use of the land ,
nor will it create future problems , rather it will help to
resolve them.

subdivision exemption. The parcel of land is described as part of the SEt
of Section 9, T7N, R65W of the 6th P.M. , Weld County, Colorado. The
location of the parcel of land for which this application has been submitted
is approximately 3.5 miles east of the Town of Ault.
This application is submitted to your office for review and recommendations.
Any comments or recommendations you consider relevant to this request would

1. Weld County Septic Permit is required for the existing migrant
labor house septic system and shall be installed according to
the Weld County Individual Sewage Disposal Regulations.
2. An ISDS Evaluation on the existing septic system of the migrant
labor house will be necessary prior to issuing the required
septic permit on the existing system.
3. It is the policy of this Division not to recommend for approval
of any lot size less than one (1) acre, which will utilize an
Individual Sewage Disposal System.
The existing septic system on Philip's home will be on Frederick's property
after RE-1025 is approved. We recommend Philip change his property boundry to
include his septic system, or request a variance from the Weld County Board of
Health.
The migrant labor house is serviced by a privy and a privy is not adequate,
nor in compliance, with Weld County Regulations.

tract for Philip Kleber ' s property including in it the easement
across Fred ' s property for purposes of the individual sewage
disposal system.
It is my understanding that you will be re-recording the
Department of Planning Services Subdivision Exemption
Administrative Review in the case so that the easement is
properly documented . Should you have any questions about this ,
please let me know. I certainly appreciate all your help with
this . While I am writing, may I advise you that I am getting the
information to Gerry McRae for purposes of revising the mylar in
the Recorded Exemption today . Hopefully I will have it shortly
