MESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A NURSING CARE FACILITY - HCC COUNTRY VIEW CARE CENTER, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Mule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of November, 1988 , at the hour of 10 :00 a.m. in the Chambers of the Board for the purpose o₹ hearing the application of HCC Country View Care Center, Inc. , 303 North Hurstbourne, Suite 250 , Louisville, Kentucky 40222 , for a Site Specific Development Plan and Special Review Permit for a nursing care facility on the following described real estate, to-wit: Part of the SW* , Section 13 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by John Houtchens, Attorney, and WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the -application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . Zt is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. The Special Review Permit is consistent with the Weld County Comprehensive Plan' s Urban Growth Boundary Area Goals and Policies, and is located within the urban growth boundary area of the Town of Mead . The Mead Planning Commission reviewed this request on October 7 , 1988 , and found no 881146 Page 2 RE: USR - HCC COUNTRY VIEW CARE CENTER, INC. conflicts with its interests. The Special Review site is in an area that will not interfere with urban development. b. The Special Review activity is consistent with the A (Agricultural) Zone District. The existing facility will not affect productive _farmland. c. The Special Review site is compatible with the existing and future land uses. Conditions of approval and Development Standards will ensure compatibility. d. No overlay districts affect the site. e. Special Review Development Standards mill -provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Beard of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review -Permit for a nursing care facility -on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall -be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the -Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners . 2 . No building or electrical permits shall be issued on the property until the Special Review plat is _ready -to be recorded in the office of the Weld County Clerk and Recorder. 3 . The Site Specific Development Plan and the Special Review Permit is for a nursing care facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . A 6-foot solid-wood fence shall be constructed and maintained on the south and west boundary of the aeration lagoon. 4 . Native grass vegetation approved by the Longmont Soil Conservation District shall be maintained at all times. 5 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 7. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 8 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 9 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. John Houtchens, Attorney, came forward to represent the applicant. He stated that this facility has been operating as a non—conforming use and decided to go through the Special Review Permit process. Mr. Houtchens said there are no plans for future expansion of the operation. No public comment was offered concerning this request. Commissioner Lacy moved to approve the request of HCC Country View Care Center Inc. , for a Site Specific Development Plan and Special Review Permit, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation. The motion was seconded by Commissioner Johnson, and it carried unanimously. This Certification was approved on the 5th day of December, 1988. This use has taken place on the property since 1970. Eighty-seven residents have been allowed at this facility, and there will be no change in this. The applicants are requesting this use by special review to legitimize the care center. Also, in the event a disaster should befall the operation, rebuilding would be allowed to take place without -delays in obtaining the necessary permits. The Chairman called for discussion from the members of the audience. Ray Edmuston, area property owner, stated he is concerned about the ponds and felt the 180 day requirement for reclamation should be strictly enforced. The Chairman asked the applicant if he had reviewed the recommendation, conditions, and Development Standards presented by the Department of Planning Services' staff. He has and is taking exception to Condition #/2. He asked that the first part of the sentence be dropped: "The Special Review activity shall not occur nor shall any. . ." The proposed use is the existing use. The property is presently used as a nursing care facility for developmentally disabled persons and is licensed by the Colorado Department of Health as an ICF/MR facility. B. Explain need for use. The facility has been licensed and caring for developmentally disabled persons since the 1970 ' s and has continuously provided active treatment and care for such persons. There continues to be a need for such a facility in the area, as evidenced by the fact that persons are continually admitted for services and care. C. Explain the type of existing uses on surrounding properties. The property is surrounded with primarily agricultural uses. The bulk of the area north of the facility is covered by reservoir properties. The surrounding properties, as shown on the vicinity map, are primarily agricultural related properties, although there are seven dwellings within one-half mile of the subject property. The dwellings are on properties that are primarily used for agricultural or agricultural related activities. D. The distance of the proposed use to residential structures in each direction. Residential uses to the -West of the subject property are located from 50 feet to 1, 300 feet. To the 'east of the subject property there is a residence approximately 700 feet away. E. The maximum number of users, patrons, members, and buyers. The facility is licensed for 87 residents. In addition to the residents, there are occasionally visitors and counselors , but they are few in number and frequency of visit. • S81146 F. The number of employees, number of shifts, and hours of operation. The facility operates three shifts per day on a 24-hour per day basis. The maximum number of employees on the premises during any shift would be approximately 35. -The total number of employees at the facility for all shifts would be approximately 95. G. The type of water source for the proposed use. -The water for use at the facility is supplied by Little Thompson Water District through a water tap. H. Explain the access routes to be utilized for the proposed use. The access routes currently being utilized for access to the facility are State Highway 66 to Weld County Road 13 or I-25 Frontage Road to Veld County Road 32. I . Explain type, size, weight, and frequency of vehicular traffic associated with the proposed use. Vehicular traffic to the site is primarily single passenger vehicles, van for transportation of the residents, small service delivery trucks, and periodically a rubbish disposal truck. Each employee makes a round trip to the facility- each day, they work, The facility vans make a total of approximately eight round trips per day transporting residents to and from activities. J. The type of sewage facilities for the proposed use. The facility was formerly using a septic system with leach fields adjacent to the property. That use is being abandoned and an engineer-designed aeration and chlorination treated discharge facility has been permitted by the State of Colorado and is in the final stages of construction. It will entail a discharge of treated affluent into Lake Thomas , pursuant to a license granted by the owner of Lake Thomas, Public Service Company of Colorado. K. A description of the proposed fire protection measures associated with the proposed use. The facility is fully protected by an interior fire sprinkler system, and employees of the facility frequently are trained in fire protection and •emergency procedures. The fire protection service outside of the facility is provided by Longmont Rural Fire Department. 881146 L. The types and maximum number of animals to be concentrated on the Use by Special Review area at any one time. There are no agricultural animals at the site. At the present time there is currently one dog that is a pet of the facility residents. M. The type and size of any waste, stockpile or storage areas associated with the proposed use. The only waste generated by the facility is normal residential waste, which is placed in four (3 cubic yards) exterior dumpsters and haulzti off by iri-Area Rubbish Co. on -a semi- weekly basis. -N. Type of storm water retention facilities associated with the proposed use. No water retention facilities are in place nr proposed. Natural drainage occurs generally to the north of the facility to Lake Thomas, a lame storage reservoir. O. The time schedule and method of removal and disposal of debris , junk, and other wastes associated with the proposed use. See answer to Paragraph M above. P. Explain proposed landscaping plans and erosion control measures associated with the proposed use. The facility is presently landscaped and has not experienced any erosion control problems. No change is anticipated. Q. Reclamation procedures to be employed upon cessation of the Use by Special Review activity. No cessation of use currently employed is anticipated. R. A timetable showing the periods of time required for construction and start-up of the proposed use. The applicant feels the proposed use is consistant with the Weld County Comprehensive Plan for the following reasons : ( 1 ) The site is presently improved for the proposed use and does not remove prime agricultural land from use . ( 2 ) The site is well separated from the residential units in the agricultural zone . ( 3 ) No new facilities or utility services are required . Public water is being furnished to the site as well as electricity and gas . A new private sanitary sewage system is being permitted and put into operation . ( 5 ) With the proposed use and facilities : water , surface and air pollution will be minimal . Intent of zoning district : The proposed use is consist-ant with the intent of the agri - cultural district in that alternate uses may be allowed with adequate controls such as through a "Use By Special Review" permit and it does not remove agricultural land or water from use . C . Conservation of Productive Agricultural Land : The land is presently improved with buildings , drives , sewage facilities , etc . and does not remove prime agricultural land from use . Potential production ranges front 2,200 pounds per acre in favora- ble years to 1,800 pounds in unfavorable years. As range condition deteriorates, the sand bluestem, sand reedgrass, and switchgrass decrease and blue grama, sand dropseed, and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. Management Of vegetation on this soil should be based on taking half and leaving half of the total annual produc- tion. Seeding is desirable if the range is in poor condition. Sand bluestem, sand reedgrass, -switchgrass, sideoats grama, blue grama, pubescent wheatgrass, and crested wheatgrass are suitable for seeding. -The grass -selected should meet the seasonal requirements of livestock.
