RESOLUTION
RE: APPROVE ROAD IMPROVEMENTS AGREEMENT WITH C & M READY MIX
CONCRETE COMPANY OF BOULDER, INC. , AND AUTHORIZE CHAIRMAN TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and PI x

WHEREAS, the Board has been presented with a Road ul w
Improvements Agreement with C & M Ready Mix Concrete Company of rn
Boulder, Inc. , and x
WHEREAS, said Agreement involves increased truck traffic due K n
to a Special Review Permit granted to C & M Companies, and y N

WHEREAS, after study and review, the Board deems it advisable Z w
to approve said Agreement, a copy being attached hereto and o0
incorporated herein by reference . a
NOW, THEREFORE, BE IT RESOLVED by the Board of County ,?311-I.:
Commissioners of Weld County, Colorado, that the Road Improvements 2 --
Agreement with C & M Ready Mix Concrete Company of Boulder, Inc. , z o„
be, and hereby is, approved.

BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement. x o

COUNTY OF WELD, STATE OF COLORADO
ROAD IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into the 9th day of October
€ t , 1989, by and between the COUNTY OF WELD, STATE OF
COLORADO, hereinafter called "County" and C & M Ready Mix
Concrete Co. of Boulder . Inc . , hereafter called C & M.
WHEREAS. C & M is intending to operate an open-cut
gravel mine on the property known as the Distile Farm which
borders Road 20 1/2 to the North .
WHEREAS, Weld County bridge No. 20 .5-3A is immediately
East of the planned entrance to Road 20 1/2, and is not
designed for the anticipated truck traffic .
WHEREAS. C & M and the County plan a joint effort to
repair the Weld County bridge.
NOW, THEREFORE, in consideration of the mutual
covenants and conditions hereinafter set forth. C & M and
the County mutually agree as follows:
1 . C & M will agree to participate in the cost of
replacing Bridge No. 3A at 30% of the total
construction cost , not to exceed a maximum of $8,000 .
The Bridge would be replaced by Weld County and ready
for traffic prior to April 1 , 1990 .
2. The County Roads that serve the gravel mine are
Weld County Road 20 1/2 and Weld County Road 7.
Traffic is restricted to going south only from the
intersection of these (2) roads.
3. C & M agrees to work jointly with the County and
other operators to excavate and patch any damage on the
above mentioned roads that has been created by heavy
truck hauling from C & M's gravel mine .
4. At any time in the future, when road damage has
increased beyond the point that patching can reasonable
restore the road, C & M will cooperate with the County
and other operators in the reconstruction of those
parts of the County roads.
5. The details of construction and the amount of
aggregate base course required will be determined by
sampling and testing of the existing roads by the Weld
County Engineering Department .

6. When reconstruction is required C & M Companies
will supply their proportionate share of the hot
bituminous pavement . aggregate base course , equipment
and labor for reconstruction .
7. When reconstruction is required, the County will
reeimburse operators for the cost of AC-10 liquid
asphalt for the manufacture of hot bituminous pavement .
8. All construction and materials will be in
accordance with the State Department of Highways,
Division of Highways, State of Colorado, Standard
Specifications for Road and Bridge Construction , 1981 .
9. The term of this Agreement is from the date of
shown and shall run until C & M Companies ceases its
operation of said mine.
