It was determined by the Board of County Commissioners that your request was not a material deviation from the plans or Development Standards approved for Special Use Permit 454:80:44. The Board has requested that Mr. Duckworth: 1 . Limit the water intake at the facility until the repair and reconstruction of ponds C and D is completed and the facility is in compliance with the approved Special Use Permit plans and Development Standards; 2. Obtain a grading permit before construction of the berming on pond D begins; and 3. Install aeration facilities on pond C to facilitate evaporation as soon as possible. While we are opposed to any significant change in the pond size and depth, it has been noted that the proposed change will not increase the total area of the pond. The depth of the liquid in Pond C is approximately 10 feet and the total depth of the liquid in Pond D will be the same if the berms are raised by four feet. Tom indicated that this increase in capacity will improve their ability to work on the berms on Pond C, because they intend to drain some of the liquid from Pond C to Pond D after the berms are completed to facilitate repair work on the Pond C liners. With the above considerations in mind, we recommend for approval of the request to raise the berms on Pond D by four feet. The work must be supervised by a registered professional engineer and the final construction certified by the same engineer. We request that you evaluate the proposal to determine whether it would be considered a substantial change to their special use permit and whether your staff would approve of the proposal. Pond D was probed to determine the maximum pool depth. You requested this information to allow your staff to determine the effects of the proposed raising of the berm by four feet. Pond D was found to contain a maximum pool depth of six feet (6') when a three foot (3') freeboard is maintained. The raising of the berm as proposed will increase the maximum pool depth to ten feet (10'). This depth is considered adequate for an evaporation lagoon. The additional depth will still allow proper thermal conductivity for efficient evaporation. The sprayers will assist in any odor control during the seasonal turning of the lakes. We would like to request your timely review on this matter. The owners intent is to make the necessary repairs and expansion this fall prior to the weather change and the Show Cause Hearing on November 14, 1988. On October 11, 1900 I surveyed the water surface of Ponds C 8c D to determine the actual water surface area that exists on these ponds. The following information was determined from that survey: Allowed Area Determined Area Pond A 1.9 Acres 0.0 Acres Pond 6 1.9 Acres 0 0 Acres Pond C 8.2 Acres 5.8 Acres Pond D 5.4 Acres 6.0 Acres TOTAL 1 7.4 Acres 11.8 Acres Ponds A & 6 are no longer used for disposal of liquid brine water, since Weld County Health Department suspected the integrity of the liners. That surface area for evaporation purposes has been lost, although the Standard Development did allow nearly four acres of evaporation surface area in the original Special Use Permit. An additional 1.8 acres of evaporation surface area is also being lost in Ponds C & D from the Development Standards as set forth in the SUP. S. The operator of the facility would like to repair and reconstruct the upper portion of the berms in Pond C to meet a three to one slope, therefore minimizing the potential for erosion. The operator would also like to level the elevation of the berm on Pond C while the earthrnoving equipment is on site. The operator does not intend to significantly raise the berm to Pond C, since the existing water depth is sufficiently deep enough while still allowing proper thermal conductivity for efficient evaporation. The operator would like to raise the berm on Pond D by four feet. The increase of the berm elevation on a three to one slope would increase the surface area of Pond D. However, the total surface area of the ponds would still be considerable less than the total allowed surface area as shown in the Development Standards. The increase of the berm is needed to allow the proper needed repair to both ponds and is not anticipated to be a detriment to the effectiveness of the thermal properties in pond D, since this pond is a very shallow pond The repair and reconstruction of the berms would be constructed in conformance to the Development Standards. To prevent seepage to the groundwater, the slope of the ponds will be lined with bentonite or other impervious material similar to the construction of the existing liners. See Exhibit 1, for the proposed typical cross section. The berms and liners will be required to meet ninety-five percent (952) Standard Proctor compaction. A geotechnical engineer or other professional engineer familiar with soils will be required on site during the placement of the liner to ensure the consistency of any liner material used. The operator would like to complete the repairs and reconstruction to Ponds C & D as soon as possible. Ideally, the proposed work should be completed by the November Show-Cause Hearing. The operator is proposing to commence work on approximately October 24, 1988.
