RE: APPROVAL OF RECORDED EXEMPTION NO. 765 - STEVEN M. AND
BELINDA J. HARLESS AND JERRY W. AND KATHLEEN J. SOUKUP
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 765 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 765 was
submitted by Steven M. and Belinda J. Harless and Jerry W. and
Kathleen J. Soukup for property which is located in the NE4,
Section 17 , Township 4 North, Range 64 West of the 6th P.M. , Weld
County, Colorado, being more particularly described in the plat
which shall be provided by the applicant and known as Exhibit "A" ,
said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 20 acres and 132 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) The applicant shall submit a
mylar plat to the Department of Planning Services to be recorded
in the office of the Weld County Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty days from the date of approval by
the Board of County Commissioners; and 2) In accordance with a
letter dated June 3 , 1985 , from the Farmer' s Reservoir and
Irrigation Company, the recorded plat shall reflect a total 45
foot right-of-way for the Gilmore Canal.

Dear Commissioners:
This request for a recorded exemption is submitted by Steven M. & Belinda J.
Harless/Jerry W. & Kathleen J. Soukup. The parcel of land on which this
request is being made is described as NEB of Section 17, T4N, R64W of the
6th P.M. , Weld County, Colorado. The property is located 43 miles south of
Kersey on Weld County Road 53. The parcel of land under consideration is
the total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 20 acres and 132
acres, more or less. The applicants are requesting to split this land in
order to sell the 20 acres to their tenant. The remaining, larger parcel
will continue to be leased and farmed.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the
requirements of Section 9-2 C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty (60) days from
the date of approval by the Board of County Commissioners.
2. In accordance with a letter dated June 3, 1985 from the Farmer's
Reservoir and Irrigation Company, the recorded plat shall reflect a
total 45 foot right-of-way for the Gilmore Canal.

The following information is submitted in accordance with the
application requirements .
1 . The completed application form is attached hereto .
2 . The certificate of conveyances is attached hereto .
3 . A copy of the deed shows fee simple title in the name of
the applicants herein.
4 . The purpose of dividing this property is to be able to
convey to the party nor in possession of the house and
improvements under a lease with an option to purchase .
The property has been leased for some time, in .fact _since
purchased by the present owners, and the improvements
would be better cared for by owner/occupants than by the
normal month to month tenants of the past .
5 . The proposal is consistent with the policies of the Weld
County Comprehensive plan, consistent with the zoning of
the district in which it is located, both the parcel to
be exempted and the balance of the property will remain
in agricultural useage, all compatible with land uses
surrounding the property. There is no anticipated use
other than agriculture for the surrounding area. The
use and care given by the owner/occupant should certainly
improve the overall maintenance and upkeep of the improve-
ments now existing, and more concern can be expected with
regard to proper grazing of the grass pasture . Creating
the parcel of approximately 20 acres will improve the overall
agricultural use of the total property. The 20 acre 'unit -
is now all in irrigated grass and includes the improvements,
making an excellent small family unit . The balance is all
irrigated and cultivated land which is leased, will remain
intact as an operating farm unit . In the past the tenant
on the irrigated land did not find the use of the pasture
feasible due to the small acreage . The division of this
property will contribute to better agricultural use of the
improvements and land .
6 . Water for domestic use is from a well on the property, the
sewage is handled by a septic system.
7 . No flood plain, geologic hazard, airport overlay area or
other known condition exists that would affect this property.
8 . A sketch plan of the proposed division of the property has
been attached or included . A survey by a registered land
surveyor will be completed upon notice of the approval of
this application and will be submitted for recordation.
