HomeMy WebLinkAbout870145.tiff RESOLUTION RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER USE BY SPECIAL REVIEW FOR A RECREATIONAL TRAIN FACILITY - CHARLES HOBDAY WHEREAS , the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 4th day of March , 1987, at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Charles Hobday, 1443 South Harlem, Forest Park, Illinois 60130 , for a Use by Special Review for a recreational train facility on the following described real estate, to-wit: Part of the SEa of Section 30 and the Eh Ek of Section 31 , Township 2 North, and the Eh E_ NEa of Section 6 , Township 1 North , all in Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Don Drawer, and WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners , after hearing all the testimony and statements of those present and studying the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter , deemed it advisable that said hearing be continued to March 25 , 1987, to allow the applicant time to provide additional material as required by the recommendation of the Planning Commission and to provide time for the Planning staff to review the water situation on this property and submit a recommendation to the Board. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hearing to consider the request of Charles Hobday for a Use by Special Review for a recreational train facility be, and hereby is , continued to March 25 , 1987, at 2 : 00 p.m. BE IT FURTHER RESOLVED by the Board that the applicant be, and hereby is, directed to submit a complete list of items located on the property, as required by Condition #3 of the Planning Commission resolution , prior to said hearing. // U `, y � ., rr _ t 870145 Page 2 RE: USR - HOBDAY BE IT FURTHER RESOLVED BY THE Board that the Planning staff be, and hereby is , directed to review the water situation on said property and submit a recommendation to the Board. Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Gene Brantner Commissioner Jacqueline Johnson Commissioner Frank Yamaguchi - Excused Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated February 11, 1987, and duly published February 19, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the application of Charles Hobday for a Use by Special Review for a recreational train facility. Lee Morrison, Assistant County Attorney, made this matter of record. Keith Schuett, Planning Department representative, read the favorable recommendation of the Planning Commission, which is subject to seven Conditions and nineteen Development Standards, into the record. Mr. Schuett presented each Commissioner with a list of scrap items which are to be removed from the property. The Board determined that this list is not sufficient to satisfy Condition 113, which calls for a list of those items which will remain on the property, as well as the items which are to be removed. Don Drawer came forward to represent the applicant. The Board reviewed two sets of photographs which were presented by Mr. Drawer and Jimmie Miller at the Planning Commission hearing. Mr. Drawer questioned Condition ld, which requires a well permit, the word "structures" in Development Standard #4 and the year-around insurance requirement of Development Standard #13 of the Planning Commission's recommendation. Andrew Haller, an adjacent property owner, asked for assurances that Weld County would not give up its right-of-way along Weld County Road 39. He was advised that this application does not affect the right-of-way and there is no intent to vacate it. Mr. Haller stated that his neighbor, Jimmie Miller, was unable to attend today's hearing due to illness, and wanted his objections made known. Commissioner Johnson asked that the Planning staff review the water situation and make its recommendations to the Board. (Tape Change #87-22) Commissioner Kirby moved to delete the word "structures" from Development Standard #4. The motion was seconded by Commissioner Brantner and carried unanimously. With respect to Development Standard #13, the Board suggested that the applicant research the type and cost of insurance coverage which would be appropriate when this operation is not open to the public. Commissioner Kirby moved to continue this matter to March 25 at 2:00 p.m. , and Commissioner Brantner seconded the motion. It was determined that during this continuation period the applicant is to provide a complete list which will adequately satisfy Condition #3 and the Planning staff is to review the water situation.
