RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AGRICULTURAL SERVICE OPERATION - JOSE A. GONZALES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of October, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Jose A. Gonzales , P.O. Box 1015 , La Salle, Colorado 80645 , for a Use by Special Review for an agricultural service operation on the following described real estate, to-wit: Part of Lot 8 in NW' NWq of Section 30 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, according to the subdivision of lands made by the St. Louis Western Colony WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance. 3 . There appears to be very little movement of the equipment in and out of the property, and it appears this is essentially a storage yard. 4 . There is a large number of residents in the area who support this request . PL0901 _.. 850581 Page 2 RE: USR - GONZALES 5 . The operation is compatible with the existing character of the area. 6 . Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an agricultural service operation on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review Permit be adopted and placed on the Use by Special Review plat prior to recording. 2 . The Use by Special Review plat shall be delivered to the Department of Planning Services Office and shall be recorded in the office of the Weld County Clerk and Recorder. The use permitted shall be the storage of concrete ditch lining equipment as described in the application materials on file with the Department of Planning Services and subject to the Development Standards listed herein . 2 . The Use by Special Review permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property. 3 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 of the Weld County Zoning Ordinance. 4 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 .6 of the Weld County Zoning Ordinance. 5 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated herein and all applicable Weld County Regulations. 6 . The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changed shall be filed in the office of the Department of Planning Services. 7 . The terms of this Use by Special Review, upon the request of the applicant, shall be limited to a period of five years. 8 . No operation of heavy equipment shall be allowed between the hours of 7 :00 p.m. and 7 :00 a.m. , or on Sundays and legal holidays. Page 2 DEVELOPMENT STANDARDS - GONZALES USR 9 . The Use by Special Review shall be screened from the mobile home park by the erection of a six-foot fence which will provide visual screening on the west line. 10 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 85-77 RE: USE BY SPECIAL REVIEW, AGRICULTURAL SERVICE OPERATION - JOSE A. GONZALES A public hearing was conducted on October 16, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated September 25, 1985, and duly published October 3, 1985, in the Johnstown Breeze, a public hearing was conducted to consider a Use by Special Review for an agricultural service operation, requested by Jose A. Gonzales. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, and said there are seven recommended Development Standards. Keith McIntyre, attorney representing the applicant, came forward to make a presentation. Mr. McIntyre submitted photos of the site to the Board. Those in the audience who came forward to speak in favor of this request were: Ralph Rodman; George Jones; Orville Casteel; and John Ellis. Those who voiced opposition were: Loren Uhrig; Betty Shepherd; and Steve Westerdahl, representing the City of Evans. After completion of testimony from the audience, Mr. McIntyre gave his final presentation. Commissioner Brantner moved to deny the request of Jose A. Gonzales for a Use by Special Review. The motion was seconded by Commissioner Yamaguchi. (TAPE CHANGE #85-91) Following considerable discussion, a roll call vote was requested and the motion failed with Commissioners Brantner and Yamaguchi voting aye; and Chairman Johnson and Commissioners Lacy and Kirby voting nay. Commissioner Lacy moved to grant the Use by Special Review with three additional Development Standards as follows: 8) The term of this USR, upon the request of the applicant, shall be limited to a period of five years; 9) No movement of heavy equipment shall be allowed between the hours of 7:00 p.m. and 7:00 a.m. , or on Sundays and legal holidays; and 10) The USR shall be screened from the mobile home park by the erection of a six-foot fence which will provide visual screening on the west line. Commissioner Kirby seconded the motion. Commissioner Brantner requested that the word "movement" in the Operation Standard #9 be replaced with the word "operation". This amendment was acceptable to the motioner and the seconder. On a roll call vote, the motion carried with Chairman Johnson and Commissioners Lacy and Kirby voting aye, and Commissioners Brantner and Yamaguchi voting nay. Considering future land use in this area, I feel that I must oppose this request. This agricultural service operation involves larger noisy equipment. It is bordered to the West by a residential area. Although this area appears now to be a no-man's land, I feel it is too close to both Greeley and Evans to ignore future development. Lot 8 in NW1 NWZ of Section 30, T5N, R65W of the 6th P.M. , Weld County, Colorado. LOCATION: Less than 1/4 mile west of Evans, east of 23rd Avenue and south of 37th Street. APPEARANCE: Keith McIntyre, Attorney, McIntrye and Varallo, represented the applicant. This is a request for a Use by Special Review Permit for an agricultural service operation which is in the Agricultural Zone district and should he allowed as a use by special review in this area. He distributed photographs showing the proximity of this location to the city of Evans shops. The business Mr. Gonzales has located here is strictly agricultural. He moves ,E XNiAiT l.. Summary of the Weld County Planning Commission Meeting September 17, 1985 Page 2 his equipment cut to the fields from March through June and the equipment is not brought back in until he can no longer get into the fields because the crops have become too large. The equipment is then brought back to this site and stored on the property until about the first of September when some fields have been harvested and concrete ditch liner can again be laid. The equipment will not be brought in again until it has become too cold to put in concrete ditch liner. Then the equipment will be brought back onto this site for storage through the winter. There is no work done on the equipment at this site, other than routine maintenance work. Mr. Gonzales keeps the property very neat and tidy. Materials stored in the yard are piled neatly and covered from the elements. A traffic log was presented which determined whether or not traffic entering this access road was going to the Evans Shops, Mr. Gonzales Storage Yard, or a miscellaneous destination. The traffic into the Gonzales property was much less than the other two categories. The traffic log was retained for evidence. Letters from residents in the area who are in favor of having the storage yard in this area, and a petition with thirty—four signatures was presented to the Planning Commission. The letters and petition were retained as evidence. Pictures were presented of the buffer zone between Terrace Mobile Home Park and this property. The pictures were retained by the staff for evidence. The Chairman called for discussion from the members of the audience. Ralph Rodman, surrounding property owner, spoke in favor of granting this request. It was his feeling the request is compatible with the surrounding neighborhood, and the noise and traffic from the Evans Shops are much more distracting that Mr. Gonzales' storage yard. George Jones, surrounding property owner, felt the request made by Mr. Gonzales is an appropriate business to be located in this area, and is an asset to the neighborhood. Jose Gonzales, applicant and owner of the concrete ditch lining business, reported on the number of vehicles, trucks, and heavy equipment stored on the property. Loren Uhrig, owner, Terrace Mobile Home Park, spoke in opposition to this request. MOTION: Paulette Weaver moved Case Number U'SE-689:85:33 for Jose A. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE DENIED FOR THE FOLLOWING REASONS: It is the opinion of the Department of Planning Services staff that the proposed operation does not meet the criteria for review and approval as stated in Section 24.3 of the Weld County Zoning Ordinance. Section 24.3. 1.4 states that the uses which would be permitted will be compatible with the future development of the surrounding area as projected by the Comprehensive Plan of affected municipalities. The City of Evans has indicated to the Department of Planning Services that the subject property is within a proposed annexation area. The Evans Planning Commission recommended denial of the request because, under city zoning regulations, the use would require an industrial zoning classification. Galen Kane, Evans Planning Administrator, in a letter dated July 24, 1985, stated that a rezoning would not be compatible with the surrounding residential neighborhood. According to Section 24.3. 1.2, the proposal is to be consistent with the intent of the district in which the use is located. The Agricultural Zone cki District of the County, of which the property is currently a part, allows this type of operation with a Use by Special Review permit. As this neighborhood is surrounded on three sides by Evans, it is the staff's opinion that incorporation into the City Limits in the near future is inevitable. When the property is annexed into the City of Evans, the use will be incompatible with the proposed zoning. The Evans Preliminary Comprehensive Plan indicates this area should be developed for residential uses and zoning. The Department of Planning Services staff also feels that because of the residential density of the immediate area, noise created by early-morning activity at the site may be a nuisance to neighbors. This concern was brought to our attention by the owner of the mobile home park which is located directly west of the property. It is the staff's opinion that the applicant has not made adequate provisions for protection of the welfare of the inhabitants of the neighborhood. Gonzales at their Regular Meeting on July 23, 1985. No one appeared to represent the applicant at this meeting. Mr. Loren J. Uhrig, the owner of a mobile home park adjacent to the subject property, contacted the Evans Planning Department prior to the meeting to express his opposition to approval of the permit. His concerns were noise created by the business during the early morning hours and the accumulation of trash on the property. Following review of the information submitted, including the concerns of Mr. Uhrig, the Planning Commission passed a motion to recommend to Weld County that the Use by Special Review permit requested by Jose Gonzales be denied for the following reasons: 1. The City of Evans is presently in the process of annexing an area which includes the subject property and under City zoning regulations, the proposed use of this property would require an industrial zoning classification which is not compatible with the area. 2. The subject property is almost totally surrounded by existing residential uses and the proposed use in not compatible with residential uses. 3. The Evans Preliminary Comprehensive Plans indicates this area should be developed for residental uses. To the West is a trailer court. North of us are unoccupied properties and a house belonging to Ruben Gonzales. Fifty feet to the East is residential. - I will be the only user. My brother is the owner of the property. - We employ 8 to 10 people. They will only meet there in the morning to be dispatched to jobs. The rest of the day no employees will be on property, unless making preparations on equipment to take to jobs. - No need for use of water. - The access route will be on Larson Avenue. - Only during working months will there be vehicular traffic. This includes: A boom truck 19,700 pounds. A tractor trailer 19,900 pounds, that will haul a grader 23,000 paunds, trencher 10,000 pounds, a backhoe 10,000 pounds and a winch truck 10,300 pounds. And three pick-ups. - No sewage facilities will be needed.
