Kirby, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner George Kennedy Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Brian Bingle Certified Shorthand Reporter, Jolene R. Gaffey The following business was transacted: I hereby certify that pursuant to a notice dated February 27, 1989, and duly published March 8, 1989, in the Platteville Herald, a public hearing was conducted to consider the application of DBP, Inc., dba Peter Angelo's Restaurant, for a Hotel/Restaurant Liquor License. Lee Morrison, Assistant County Attorney, made this matter of record. Mr. Morrison noted that there is a copy of a letter in the file concerning the on—site inspection which Commissioner Lacy made, finding everything in order concerning this application. Phillip Bryson, Attorney, came forward to represent the applicant. He asked questions of David Pietrangelo, principal owner of DBP, Inc., concerning the proposed operation. Mr. Bryson also requested permission for this establishment to stay open until 9:00 p.m., three hours later than the hours contained in the Standards for the Conditional Use Permit granted to this location. Brian Bingle, representing the Planning Department, explained that a Conditional Use Permit was approved on this property, and several Development Standards are currently out of compliance. Be said the CUP could be vacated, and the present operation would be acceptable to the current C-3 zoning; or the Board could determine that the change in hours would not be a substantial change to the Development Standards. Fred Sekich, owner of the building, stated that he would be agreeable to vacation of the CUP. Mr. Sekich also spoke favorably concerning the granting of this license. Commissioner Lacy moved to approve the application of DBP, Inc., dba Peter Angelo's Restaurant, for a Hotel/Restaurant Liquor License and reviewed the findings to be made for granting such license; to find that the request to allow the restaurant to be open until 9:00 p.m. be granted; and to find that said request is not a substantial variation to the existing CUP. The motion was seconded by Commissioner Kennedy. and it carried unanimously. 891529 i_Coo3.a ., Page 2 RE: ROTEL/RESTAURANT LIQUOR LICENSE — PETER ANGELO'S This Certification vas approved on the 17th day of April, 1989. c._{ APPROVED: 1 Q,t,u/,d2l,L Gr3 BOARD OF COUNTY COMMISSIONERS ATTEST: WELD COUNTY,,/COLORADO Weld County Clerk and Recorder da and Clerk to the Bo C.W.
