HomeMy WebLinkAbout861373.tiff AK2iia2589 V ORDINANCE NO. 77-B IN THE MATTER OF THE REPEAL AND RE-ENACTMENT WITH AMENDMENTS OF ORDINANCE NO. 77 , AMBULANCE SERVICES RULES AND REGULATIONS ow co-W BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD a• COUNTY, COLORADO: 0 WHEREAS, the Board of County Commissioners of the County of Boa Weld, Colorado, pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested with the authority of administering r+ x the affairs of Weld County, Colorado, and WHEREAS, pursuant to the recently modified Colorado Emergency W• O Medical Services Act Rules and pursuant to the recommendation of oz the Department of Health , the Board of County Commissioners of Weld County, Colorado, deems it advisable to amend the Ambulance N � Services Rules and Regulations Ordinance to include the role of a the Emergency Medical Technician , Intermediate (EMT-I) , and to o • otherwise update the general wording to coincide with that of the awM current Emergency Medical Services Acts , C.R.S. , 1973 , 25-3. 5-101 , N et seq. , as amended, and co z oz N RC WHEREAS, said Act requires that the Board of County o >, Commissioners of each county adopt certain standards , requirements a and procedures for providing emergency medical services within each county, and o d ,,, WHEREAS, said Act authorizes the Board of County ri r-1 Commissioners of each county to license and regulate ambulances, CO w and ambulance services , and WHEREAS, the Board of County Commissioners of the County of Weld deems it in the best interest of the citizens of said County to adopt the following Ordinance. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld County, Colorado, that Ordinance No. 77 previously enacted be, and hereby is , repealed and re-enacted with amendments as follows: Section 1 - Purpose 1. 1 The purpose of these Rules and Regulations is to set forth the requirements for the planning and implementing of high quality emergency medical services to all citizens of Weld County. It is the intent of the Board of County Commissioners that the emergency medical 861373 1 F - f r. ...�I-' PAGE 2 RE: AMBULANCE SERVICES RULES AND REGULATIONS NO 0 0 O • NO service in Weld County will consist of at least a transportation, treatment, communications, training and o w documentation systems designed to prevent premature o mortality and to reduce the morbidity that may arise o w from critical injuries, exposure to poisonous substances, and illnesses. u° 1. 2 - Delegation The Board of Weld County Commissioners designates and delegates to the Weld County Health Department the ~ z authority to manage the Ambulance Services Rules and Regulations. Under the direction of the Board, cO w v inspections, licenses, permits , applications, and other o z functions necessary to implement these Rules and M H Regulations shall be the responsibility of the Health N F Department. -' w w co• W Section 2 - Definitions inw c 2 2. 1 The following definitions shall apply in the N interpretation and enforcement of these Rules and >4 Regulations: va 2. 1-1 "Ambulance" means any privately or publicly owned land e vehicle especially constructed or modified and equipped , intended to be used and maintained or operated by an ambulance service for the transportation upon the w streets and highways in this County, of individuals who are sick , injured , or otherwise incapacitated or helpless. 2 . 1-2 "Ambulance Driver" means any person authorized to drive an ambulance, which is a land vehicle, in this County as provided in these Rules and Regulations. 2. 1-3 "Ambulance Service" means the furnishing, operating, conducting, maintaining, advertising, or otherwise engaging in or professing to be engaged in the transportation of patients by ambulance. Taken in context, it also means the person so engaged or professing to be engaged. The person so engaged and the vehicles used for the emergency transportation of persons injured at a mine are excluded from this definition when the personnel utilized in the operation of said vehicles are subject to the mandatory safety PAGE 3 RE: AMBULANCE SERVICES RULES AND REGULATIONS NO .� U 0 c' 0 standards of the federal mine safety and health administration, or its successor agency. a o 2. 1-4 "Ambulance Service License" shall mean a nonexclusive o authorization issued by the Board of County w Commissioners to operate an ambulance service, publicly a or privately within Weld County; the license shall issue 0 only to Ambulance Services whose primary base of operation is located in Weld County. vx `.. X73 2. 1-5 "Ambulance Vehicle Permit" shall mean the authorization issued by the Department with respect to an ambulance used or to be used to provide ambulance service in Weld co a County. co c.) o z 2. 1-6 "Applicant" shall mean that person who is an initial rn w applicant or an applicant for renewal for an ambulance H cn service license, or ambulance vehicle permit. rn o 2. 1-7 "Board" shall mean the Board of County Commissioners of co in w Weld County. NZ 2. 1-8 "County" shall mean Weld County, Colorado. z 2. 1-9 "Current E.M.S. Act" shall mean the Emergency Medical Services Act, C.R.S. 1973, 25-3. 5-101 et seq. , as amended. coo ei en 2. 1-10 "Department" shall mean the Weld County Health Department. co 44 2. 1-11 "Director" shall mean the Medical Director of Weld County Health Department. 2. 1-12 "Emergency" means any actual or self-perceived event which threatens life, limb, or well-being of an individual in such a manner that a need for immediate medical care is created. 2. 1-13 "Emergency Medical Technician (EMT) " means an individual who holds a valid Emergency Medical Technician certificate issued by the Colorado Department of Health. 2. 1-13a "Emergency Medical Technician-Basic (EMT-B) " means an individual who has been duly certified by the Emergency Medical Services Division of the Colorado Department of Health, and who is authorized to provide basic emergency medical care in accordance with the acts allowed by the PAGE 4 RE: AMBULANCE SERVICES RULES AND REGULATIONS NO -4U 0 Colorado State Board of Medical Examiners and the rules u of the Colorado Board of Health. W 2. 1-13b "Emergency Medical Technician-Intermediate (EMT-I) " 0 3 means an individual who has been duly certified by the o a Emergency Medical Services Division of the Colorado Department of Health , and who is authorized to provide a emergency medical care in accordance with the acts u allowed by the Colorado State Board of Medical Examiners and the Colorado Board of Health. ,n 2. 1-13c "Paramedic" means an individual who has been duly certified by the Emergency Medical Services Division of a the Colorado Department of Health and who is authorized 0 u to provide advanced emergency medical care in accordance with the acts allowed by the Colorado State Board of o w Medical Examiners and the rules of the Colorado Board of N Ei Health. 2 . 1-13d "Emergency Medical Technician Certificate (EMT-B, EMT-I, C71 W Paramedic) " shall mean the certificate issued by the w Colorado Department of Health as provided in the C.R. S. o z Emergency Medical Services Act. c44 0 2 . 1-13e "First Responder" shall mean an individual who has u a successfully completed a course recognized by affidavit filed with the Emergency Medical. Service Division of the o Colorado Department of Health. ko en 2. 1-14 "Patient" means any individual who is sick, injured, or otherwise incapacitated or helpless. 2. 1-15 "Physician Advisor" means a physician (M.D. or D.O. ) licensed by the State of Colorado who establishes protocol for medical acts performed by emergency medical services personnel and who is specifically designated and responsible to assure the competency of the performance of those acts by such personnel within Weld County, in accordance with the applicable rules of the Colorado State Board of Medical Examiners. 2. 1-16 "Rescue Unit" means any organized group chartered by this State as a corporation not for profit or otherwise existing as a non-profit organization whose purpose is the search for and the rescue of lost or injured persons and includes, but is not limited to, such groups as search and rescue , mountain rescue , ski patrols (either volunteer or professional) , law enforcement posses, PAGE 5 RE: AMBULANCE SERVICES RULES AND REGULATIONS civil defense units, or other organizations of governmental designation responsible for search and NO ,1 v rescue. 0 Lno o Section 3 - Requirements for Licensure of Ambulance Services and Ambulance Vehicle Permits a ow or 3. 1 After January 1, 1978 , no person shall provide ambulance o t:4 service publicly or privately in Weld County unless that o person holds a valid license to do so issued by the Department, except as provided in subsection 3. 5 of this section . The fee for said license shall be set by VD C4 separate Ordinance. ccca x 3. 2 In addition to the license required by Section 3. 1 for an ambulance service , the Department shall issue a 1/40 ,1 permit for each ambulance used. The Ambulance vehicle permit fee ~ a shall be set by separate Ordinance.OD ra 3. 3 The Ambulance Service License and Ambulance Vehicle N w Permit shall be valid for twelve (12) months from the o z date of issue. N 3 . 4 Each ambulance service licensed in Weld County shall W IX have a physician advisor. rz o r 3. 5 The provisions of Section 3 shall not apply to the M following: ri r, w w 3. 5-1 The exceptional emergency use of a privately or publicly owned vehicle, including search and rescue unit vehicles , or aircraft not ordinarily used in the formal act of transporting patients. 3 . 5-2 A vehicle rendering services as an ambulance in case of a major catastrophe or emergency when ambulances with permits based in the localities of the catastrophe or emergency are insufficient to render the services required. 3. 5-3 Ambulances based outside the State of Colorado or Weld County which are transporting a patient in Colorado. PAGE 6 RE: AMBULANCE SERVICES RULES AND REGULATIONS NO 0 o O 1° v 3 . 5-4 Vehicles used or designated for the scheduled transportation of convalescent patients, handicapped ova individuals , or persons who would not be expected to 0 3 require skilled treatment or care while in the vehicle. voiw 3. 5-5 Vehicles used solely for the transportation of intoxicated persons or persons incapacitated by alcohol o as defined in current C.R.S. , 25-1-302 as amended, but awho are not otherwise disabled or seriously injured and who would not be expected to require skilled treatment .. go or care while in the vehicle. 3. 6 Every applicant for an Ambulance Service License or an go a Ambulance Vehicle Permit shall complete and submit to the Department an application and supporting documents o z M H for approval. Said application for approval shall ro F contain but not be limited to the following information : � trl 3. 6-1 The name, address and telephone number of the owner of c w the ambulance service. 1, w • Z 3. 6-2 The name and address and current telephone number of the N Z person who will be in charge of the operation of the o ambulance service. oa 3. 6-3 The description of the ambulance (s) , including the make, model, year of manufacture, current Colorado state o °° license number, motor vehicle chassis number, length of rim time the vehicle has been in service. rl r, ▪ w 3. 6-4 The location and description of the place or places from which the ambulance service will operate. 3. 6-5 The name, address and telephone number of the required advisory physician to the ambulance service. 3 . 6-6 The area to be served by the ambulance service. 3 . 6-7 A list of all emergency personnel who may be called upon to respond to an emergency with the ambulance service. This list shall include the following information on each person: a) complete name, address , and date of birth. b) the highest level of certification , licensure or training attained. PAGE 7 RE: AMBULANCE SERVICES RULES AND REGULATIONS N o c) a copy of a current Colorado Department of Health o v EMT-B, EMT-I or Paramedic certificate; or an Advanced First Aid card from the American Red U Cross; or a First Responder Course completion A certificate; or a Cardiopulmonary Resuscitation w card issued by the American Heart Association or o oz the American Red Cross. oa vi-P4 d) proof of a valid Colorado Driver' s License. e) a statement of criminal complaint or convictions aincluding Class I and II traffic violations within the previous twelve (12) months. .. w to r-+ 3. 6-8 Proof of vehicle insurance, such as self-insurance certificate or card issued by the insurance company ) which provides the insurance. co M H 3. 6-9 Such other information as the Department may require to N make a fair determination. 3 . 7 After receipt of an original application for an W Ambulance Service License or an Ambulance Vehicle • w Permit, or a renewal thereof, the Department shall w z review the application and the applicant' s record and N Z provide for an inspection of equipment and vehicle (s) to o determine compliance with this ordinance. If a vehicle x is replaced or an additional vehicle or vehicles are a added to a service' s fleet, an application for a vehicle permit shall be filed with the Department within 30 days a °; of receipt of the new vehicle or vehicles. The completed application shall include a description of the vehicle (s) that were replaced. Upon receipt of a new C" vehicle permit application the Department will inspect and issue the new vehicle permit. 3 . 8 In addition to the inspection required at the time of application, the Department may also visit or contact all ambulance services at one other time during the year at which time an inspection may or may not be performed. The inspections of the ambulances and related equipment shall cover but not be limited to the following items: condition of the vehicle, safety and warning systems, Minimum Required Equipment for Colorado Ambulances (as per current E.M.S. Act, CRS , 25-3. 5-101 , et seq. ) ; Each service shall provide evidence of an adequate on going vehicle safety and maintenance program. This shall be a log which shows the dates of the service and list of PAGE 8 RE: AMBULANCE SERVICES RULES AND REGULATIONS service (s) performed. The Department may modify this CV v regulation or adopt additional requirements with the o consent of the board. co O o 3. 9 Each ambulance vehicle shall be equipped according to the current C.R.S. 42-4-212 as amended, and all other o w applicable State or County regulations. In addition ° Z each vehicle shall be equipped with seat belts , which o w shall he worn when the vehicle is in operation. 0 3 . 10 All licenses and permits shall be renewed annually, o shall expire on December 31 of the year issued, and L x shall not be renewed until the application has been approved by the Department. All applications for renewal of licenses and permits shall be made not later than sixty (60) days prior to the date of expiration. Each permit shall be CO 0 issued only for the vehicle described in the application o z and no license or permit shall be transferable or rn W assignable. Obtaining or attempting to obtain a license NE. or permit by fraudulent means or misrepresentation shall ~ a be grounds for denial , suspension or revocation of the ] license or permit. The Department shall notify, by o w certified mail, return receipt requested, each licensee • w of the renewal requirements of this section , within CO Z o z ninety (90) days prior to the date of expiration. N a a O Z Section 4 - Requirements for the Operation of Ambulances a 0 0 4 . 1 Ambulance Crew Members - Training. No patient shall be d N transported in an ambulance within the county unless r-I 01 there is available in the patient compartment, a w State-certified EMT-Basic or higher level trained co person. This requirement is subject to waiver by the Board. The ambulance driver shall meet the requirements of 25-3 . 50-202 , C.R.S. , as amended. In unusual emergency conditions when no driver meeting these requirements is available, this requirement may be waived by the Board . A current First Responder Card is considered to be equivalent to the requirements for the ambulance driver requirements. 4. 2 Ambulance Crew Members - Criminal Record. Unless waived by the Board, no person shall be employed by an ambulance service as an ambulance crew member who has been convicted of a felony, misdemeanor, Class I, or PAGE 9 RE: AMBULANCE SERVICES RULES AND REGULATIONS NO HI C.) O rn p Class II traffic offense within the previous twelve (12) v months from the date of application . A O w 4 . 3 Insurance - No ambulance shall operate in the County O z unless it is covered by a vehicular liability insurance O a policy as defined by section 10-4-703 (2) , C.R.S. , 1973 , tow as amended. In addition, the ambulance service shall a have professional and liability insurance with policy o limits at least $300 ,000 per individual and $500 ,000 per • a occurrence. Certificates of insurance shall be filed with the Department. Evidence of such insurance policy shall be submitted with the application for an Ambulance Service License. W O a 00 o z Section 5 - Qualifications of Emergency Medical Technicians H N F 5. 1 No person shall practice as an Emergency Medical ~ z Technician for any Weld County based Ambulance Service unless that person holds a valid Emergency Medical o O W Technician license from the State of Colorado. � w CO N o 5. 2 Each Emergency Medical Service shall provide the z sc Department with a list of its Emergency Medical Technicians as per section 3 . 6-7. ua 5 . 3 Within thirty (30) days after an Emergency Medical 0 Technician' s (EMT) license expires, the Ambulance N Service shall provide the Department with a written statement showing the EMT' s name, date the license was w issued and date it expired , and the certificate number of the new State license. Failure to comply means the EMT is not certified to practice in any Weld County Emergency Medical Service. Section 6 - Suspension or Revocation of License or Permit; Conditional Permits 6. 1 Upon a determination by the Department that any service has violated or failed to comply with any provision of this ordinance or section of the current E.M.S. Act, which the County Commissioners or the Department has responsibility for administrating; the Department may temporarily suspend, for a period not to exceed thirty (30) days , any license or permit issued pursuant to this ordinance. The licensee shall receive written notice of such temporary suspension, and a hearing shall be held No rIU o PAGE 10 00 RE: AMBULANCE SERVICES RULES AND REGULATIONS a a ow no later than ten (10) days after such temporary o suspension . After such hearing, the Department may L'q suspend any license or permit issued pursuant to this ordinance, or any portion of, or for the remainder of o its life. At the end of such period, the person whose • x license or permit was suspended may apply for a new license or permit as in the case of an original .. w application. rz 6 . 2 In any legal action filed against a person who has been 1/4O COL) issued a license in which it is alleged that the o z plaintiff' s injury, illness, or incapacity was M exacerbated or that he was otherwise injured by the N El negligence of the licensee , an act of negligence shall not be presumed based on the fact of the allegation. In the event a judgment is entered against any such crt cow licensee , he shall within thirty (30) days thereof file 41-4 a copy of the findings of fact, conclusions of law and o z order in such case with the clerk and recorder of the N F:CC county issuing the license. the Department shall take „ not of such judgment for purposes of investigation and w a appropriate action if a violation of these Rules and Regulations is present. Any and all complaints received N directly by said Department shall be subject to review. • N ti01 6. 3 Any person who violates any provision of these Rules and w Regulations commits a class 3 misdemeanor and shall be punished as provided in Section 18-1-106 , CRS , 1973 , as amended. Section 7 - Documentation 7. 1 Each ambulance service shall prepare and transmit copies of uniform and standardized records concerning the transportation and treatment of patients as required by the department. Such records shall include all information determined to be essential by the Colorado Department of Health for maintenance of adequate minimum records on the patient' s medical condition and medical care provided by the ambulance service and shall be preserved by the ambulance service for a period of at least three (3) years . Act. a OW O 3 Section 9 - Effective Date o cz • q Pursuant to Section 3-14 (6) of the Weld County Home Rule o Charter, the Board of County Commissioners finds and ✓ hereby declares this Ordinance to be an Emergency Ordinance and that its immediate passage is necessary to vo the preservation and protection of the public health, . 44 property and safety, and that time is of the essence for x the effective date of this Ordinance. This Ordinance ashall take effect upon passage by the Board of County t.oco C.) Commissioners. 0z NE, Section 10 - Safety Clause The Board of County Commissioners of Weld County hereby cn m m finds, determines and declares that this Ordinance is 4n w necessary for the health, safety and welfare of the ccooz citizens of Weld County, Colorado. Oz N a' C4Section 11 - Severability Clause o M If any section , subsection, paragraph, sentence, clause, N or phrase of this Ordinance is for any reason held or Him decided to be invalid or unconstitutional such decision shall not affect the validity of the remaining portion . Pe w The Board of County Commissioners hereby declares that it would have passed this Ordinance and each and every section , subsection, paragraph, sentence, clause , and phrase thereof, irrespective of the fact that any one or more sections, subsections , paragraphs , sentences, clauses or phrases might be declared to be unconstitutional and invalid. BE IT FURTHER ORDAINED by the Board of County Commissioners of Weld County, Colorado, that this Ordinance No. 77-B shall become effective January 6 , 1987 , after its final public notice, in accordance with Section 3-14 (2) of the Weld County Home Rule Charter.
